Quick answer

How do process servers in Idaho work with Delator?

Send the filed papers and the best address you have. Delator Field Services confirms the county, service level and price in writing, assigns a vetted server and logs every attempt. Routine rates start at $125 in Ada, Canyon, Bonneville, Bannock and Kootenai counties, and the county rate map lists the rest.

01Local service landscape

Serving Papers Across 44 Counties, Two Time Zones and One Long Highway

Idaho had an estimated 2,029,733 residents in 2025, up more than ten percent since the 2020 Census, and roughly four in ten of them live in Ada and Canyon counties. The rest are spread from the Canadian border to the Utah and Nevada lines. Most of our work lands in the Treasure Valley, where Boise process service near the Ada County Courthouse and Nampa and Canyon County serves make up the steady core.

Distance shapes everything else. Boise to Coeur d'Alene runs roughly 380 to 390 miles, most of it on US 95, the only road connecting the Panhandle with the rest of the state, and the nine northern counties keep Pacific Time while the south runs on Mountain Time. We treat North Idaho and southern Idaho as separate operations, quote appointments with the time zone attached, and plan eastern Idaho service from Idaho Falls on its own I-15 schedule.

  • Treasure Valley metro addresses
  • Panhandle files quoted in Pacific Time
  • US 95, I-84, I-86, I-15 and I-90 corridors
  • Winter timing for White Bird, Lookout and Fourth of July summits

02Attorneys and law firms

One Contact for Idaho Firms and Counsel Filing From Out of State

Idaho firms send us collection suits, injury claims, commercial disputes and family files, and firms in Salt Lake City, Spokane, Portland and farther away regularly need an Idaho resident served. Our Idaho attorney support page explains how one coordinator handles the quote, the assignment, the attempt log and the affidavit for every county, so counsel never has to find a new server for each corner of the state.

We read every packet before scheduling. A district court summons, a magistrate division eviction, a federal summons and a deposition subpoena each follow their own rule, and we flag gaps such as an expired address, a dissolved LLC or a defendant who has crossed into Washington or Utah. If a key witness has drifted, locating a lost contact can run beside the serve, and checking a witness's background is available before trial.

03Evasive and hard-to-serve

Shift Workers, Seasonal Moves and Defendants Who Stop Answering the Door

Idaho's economy produces irregular hours. Dairy and potato operations, the Idaho National Laboratory, Micron's Boise campus, Mountain Home Air Force Base, ski resorts and lake towns all keep people away from home at odd times, and summer and winter work moves some defendants across the state. Servers vary their attempt times, record every visit with date and hour, and stop where a gate, a posted field or a secured site says they should.

A defendant who is deliberately avoiding service usually leaves a trail. When routine attempts stall, a Delator Group investigator can take over the search through evasive person skip tracing, and debtor locates help collection counsel find a judgment debtor who has moved. If the person still cannot be found, our attempt log supports the affidavit counsel may file when asking a court to authorize publication.

04Family law, evictions and subpoenas

Divorce Papers, Eviction Summonses, Small Claims and Subpoenas in Idaho

Divorce and custody cases run through the magistrate division, and I.R.F.L.P. 204 generally allows personal delivery, abode service on a resident at least 18 or delivery to an authorized agent, with the same 182-day deadline as civil cases. We serve these papers quietly, confirm identity first and avoid public scenes, and when safety is a concern, stalking investigations can be coordinated alongside the serve. Parents preparing for a custody dispute can start with our Idaho custody investigation guide.

Idaho evictions move quickly. Under Idaho Code 6-310, a nonpayment case is generally set for trial within 12 days of filing, and the summons and complaint must be served at least five days before trial, so landlords should send papers the day they file. Small claims up to $15,000 and witness subpoenas round out most residential work, and screening an applicant before the lease can prevent the next filing.

05Documentation

The Same Record From Bonners Ferry to Franklin County

Under I.R.C.P. 4(g)(1), a server who is not a sheriff or peace officer proves service by affidavit stating that they are over 18 and how service was made, along with the documents served and the manner, date and place. Our affidavits meet that standard and sit on top of a field log of every attempt, including the failed ones. Serves outside Tennessee may be carried out by vetted servers Delator contracts with, all working to the same written documentation standard.

When a defendant later says they were never served, the log is what counsel reaches for. It shows the address, the hour, who answered, what they looked like and whether a resident at least 18 took the papers. I.R.C.P. 4(g)(2) lets the court allow proof of service to be amended, and good notes make that possible. When the dispute grows into a factual fight, our investigative consulting team or criminal defense investigators in Idaho can step in.

06Idaho rules

Who May Serve Under I.R.C.P. 4 and Why Idaho Has No Server License

Idaho does not license process servers. I.R.C.P. 4(c)(2) generally allows an officer authorized by law or any person over 18 who is not a party to serve a summons. Individuals are served by personal delivery, by leaving copies at the dwelling with someone at least 18 who lives there, or through an authorized agent. Businesses are served through an officer, managing or general agent, or registered agent, and the guide to serving legal papers in Idaho walks through each method.

Timing rules matter as much as method. A defendant not served within 182 days after the complaint is filed faces dismissal under I.R.C.P. 4(b)(2) unless good cause supports more time, and a served defendant generally has 21 days to answer. Service by publication rests on Idaho Code 5-508 and runs once a week for four consecutive weeks under 5-509. These are summaries, not legal advice, and what an investigator may lawfully do in Idaho covers the limits on field work.

07Statewide coordination

Tribal Land, Military Bases and the North-South Divide

Five federally recognized tribes have governments in Idaho: the Coeur d'Alene Tribe at Plummer, the Kootenai Tribe at Bonners Ferry, the Nez Perce Tribe at Lapwai, the Shoshone-Bannock Tribes at Fort Hall and the Shoshone-Paiute Tribes of Duck Valley. Service on reservation land may be governed by tribal law and tribal court rules, and whether state process is effective depends on the parties, the land status and the claim. Before a server goes anywhere near reservation land, we settle the approach with counsel and, when it helps, with the tribal court itself.

Military installations need the same care. The Idaho courts' interjurisdictional service guidance lists Mountain Home Air Force Base as a separate jurisdiction to contact, so we coordinate before sending a server to Elmore County addresses near the base. North Idaho files also tie to Washington, and Bonner County service around Sandpoint and Latah County serves on the Palouse are planned with that border in mind.

FAQ

Frequently Asked Questions

Do process servers in Idaho need a license?

No. Idaho has never adopted a licensing scheme for people who serve papers. I.R.C.P. 4(c)(2) generally leaves the job to an officer authorized by law or to any non-party older than 18. Delator Field Services adds a written documentation standard on top of that rule, and our Rexburg process serving page shows how it works in one Seventh District county.

What does an Idaho serve usually cost?

Each county has a published Routine starting rate. Ada, Canyon, Bonneville, Bannock, Kootenai, Nez Perce and Twin Falls counties start at $125, and Custer and Lemhi counties start at $235. Urgent is 1.5 times Routine, Rush is twice and Same Day Rush is three times. The final price is confirmed in writing before the first attempt.

Can papers be left with someone else at the home?

Often, yes. I.R.C.P. 4(d)(1)(B) generally allows copies to be left at the defendant's dwelling or usual place of abode with someone at least 18 years old who lives there. A teenage child or a visiting friend does not qualify. The affidavit describes who accepted the papers, and Lewiston process service uses the same approach in the Pacific Time counties.

How long does a plaintiff have to serve in Idaho?

Under I.R.C.P. 4(b)(2), if a defendant is not served within 182 days after the complaint is filed, the court must dismiss the case against that defendant without prejudice, on motion or after 14 days' notice, unless good cause supports an extension. Starting service early leaves room for locates and for the occasional winter delay on mountain roads.

What if the defendant cannot be found anywhere?

Idaho Code 5-508 allows service by publication on grounds such as a defendant who cannot be found after due diligence or who is concealing themselves. Publication generally runs once a week for four consecutive weeks under 5-509, with mailing when an address is known. Before that step, a missing person skip trace often turns up a current address.

Do you serve papers in North Idaho and the Panhandle?

Yes. We coordinate service in Kootenai, Bonner, Boundary, Benewah and Shoshone counties and schedule those appointments in Pacific Time. US 95 is the only road linking the Panhandle with southern Idaho, so we run North Idaho files as their own operation. Sandpoint and Bonner County service covers the lake country north of Coeur d'Alene.

Can you serve someone at a business or a large employer?

Yes. We serve individuals at work when the employer's rules allow it, and we serve the business itself through an officer, managing agent or registered agent under I.R.C.P. 4(d)(3). If the registered agent cannot be found, the rule sets out a certified mail alternative that counsel can use. Corporate investigations in Idaho can confirm who actually runs a company.

Do you serve papers on tribal reservations in Idaho?

Yes, once counsel and we agree on the method. Service on reservation land may be governed by tribal law and tribal court rules, and the Idaho courts advise contacting the individual tribal jurisdiction for service details. We work through counsel, and the tribal court where needed, before any attempt, and we do not give jurisdiction advice ourselves.

Can I file my own small claims case and have you serve it?

Yes. Under Idaho Code 1-2304, small claims papers are generally served personally, or the plaintiff can ask the court to mail them by certified or registered mail. Personal service costs are added to any judgment you win. We serve the summons, claim and answer form together and return an affidavit, and Blaine County service in the Wood River Valley handles resort-town defendants.

Is Delator Group based in Idaho?

It holds itself to Tennessee's licensing standard everywhere it works and coordinates process service in all 44 Idaho counties through vetted servers working to one documentation standard.
