Quick answer

How do I hire a process server in Florence?

Send us the filed summons and complaint, the defendant's Florence County address and any deadline. We check the issuing court, confirm the tier and send a written price before anyone goes out. Routine service in Florence County has a published starting rate of $130, and the Florence County service page covers Lake City, Timmonsville and the other towns.

01Local service landscape

Where I-20 Meets I-95 in the Pee Dee

Florence is where Interstate 20 ends at Interstate 95, which makes the city the crossroads of the Pee Dee and the seat of a county of about 138,500 people. The city itself counted 39,899 residents in the 2020 census, so a large share of Florence County addresses sit outside city limits in places like Lake City, Pamplico and Johnsonville. Our Florence County countywide page lists every town we reach, and the South Carolina county rate map shows how neighboring Pee Dee counties are priced.

Distance is the main planning variable here. A residential address off Irby Street and a farmhouse near Olanta can both appear in the same file, and the server needs a route that fits both into a sensible day. Because Florence County service starts at $130 Routine while Marlboro County sits at $190, we always confirm which county an address falls in before quoting. Papers for addresses toward Sumter go through our Sumter process service page, and each job is quoted separately in writing.

02Attorneys and law firms

Supporting Florence Counsel and Firms Filing From Elsewhere

Local firms near the Judicial Center send us collection suits, contract disputes, injury complaints and deposition subpoenas, and firms in Columbia, Charleston or other states may need a Florence County defendant served without sending their own staff. Every engagement starts with the papers. We check that the summons was issued by the Florence County Clerk of Court, that the complaint is attached, and that the defendant's name matches the caption. Our law firm service program for South Carolina keeps the quote, attempts and affidavit in one record.

Counsel of record cannot serve their own summons in South Carolina, since SCRCP 4(c) excludes attorneys in the action along with the parties. That rule matters for small firms that used to send a paralegal across town, because a staff member is fine but the lawyer is not. If your firm is outside the state, the statewide South Carolina process server overview explains how Delator Field Services coordinates service through servers suited to each county and court.

03Evasive and hard-to-serve

Rural Routes, Shift Workers and Defendants Who Avoid the Door

Many Florence County defendants are not hiding at all. They work early shifts, long shifts or shifts on the road, and the house is empty whenever a server knocks at the usual hours. Others watch from a window and wait. We change the pattern with early mornings, evenings and weekend visits, and we record what each attempt showed, such as a vehicle in the drive or a neighbor's comment. The page on hard-to-serve South Carolina defendants describes how we sequence those attempts.

Sunday is a lawful service day in South Carolina under S.C. Code 15-9-17, with a carve-out for anyone on the way to, at, or coming home from worship, and our Sunday attempts in Florence County respect that carve-out. When repeated visits fail, the attempt log becomes part of the record counsel uses if they ask the court for publication. The guide to service by publication in South Carolina explains the due-diligence affidavit that S.C. Code 15-9-710 requires, and rush process service is available when a hearing date is close.

04Family law, landlords and subpoenas

Family Court, Magistrate Cases and Witness Subpoenas

Divorce, custody and support cases in Florence are filed with the Clerk of Court for Family Court in Suite 2700 of the Judicial Center. The summons and complaint are served under SCRCP 4 like any civil action, and many spouses instead sign an Acceptance of Service. When counsel wants personal delivery, we confirm identity first and keep the handoff quiet. Rules to show cause are a different matter: they generally go through the sheriff or a person the court designates. Our divorce papers service page for South Carolina compares the routes.

For landlords, the magistrate issues a rule to vacate, and the magistrate courts checked across the state send it through the sheriff's office, so we serve it only if the court confirms private service is accepted and we never post or carry out a writ of ejectment. We do serve magistrate summonses in claims up to $7,500, which SCRMC 6(c) lets any qualifying adult deliver, as described on our small claims service page. Witnesses are covered on the South Carolina subpoena service page.

  • Family Court summonses and complaints
  • Magistrate summonses up to $7,500
  • Landlord suits for rent or damages
  • Rule 45 subpoenas for any court

05Documentation

What a Florence Affidavit of Service Contains

Under SCRCP 4(g), a sheriff proves service by certificate and anyone else proves it by affidavit. The proof must state the date, time and place of service and the name and address of the person actually served, or a description when the name is not known. Our Florence affidavits follow that list item by item, and a server who leaves papers at a home also records why the recipient qualified as a resident of suitable age and discretion. The how-to guide for serving South Carolina papers shows where the affidavit fits.

Behind each affidavit sits a field log of every visit, including the failed ones. If a defendant later claims they were never served, counsel has the times, the address, what was observed and who answered. The rule also says that a failure to file proof does not by itself undo valid service, and the court may allow proof to be amended under SCRCP 4(i). Outside Tennessee, Delator may assign a vetted server it contracts with, and that server works under the same documentation standard, as explained about Delator Group.

06South Carolina rules

South Carolina Service Rules in Plain English

SCRCP 4(c) gives three options for a Florence summons: the sheriff, a deputy, or an adult of at least 18 who is neither a party nor counsel in the action. South Carolina has no statewide license for private process servers, and every server we assign meets those age and independence requirements. Orders, rules and writs sit under the rule's second sentence, which points to officers or a court-designated person, so we ask the issuing court before taking any of them. The guide to who can serve process in South Carolina goes further.

An individual may be served in person, at the dwelling with a resident of suitable age and discretion, or through an authorized agent under SCRCP 4(d)(1). A summons may also go by restricted-delivery certified mail or a qualifying commercial delivery service, but a default generally needs a receipt the defendant signed. If the limitations period has run by filing, actual service generally must happen within 120 days under SCRCP 3(a), and the answer is generally due 30 days after service. Your attorney can confirm the details, and our business and registered agent service covers entities.

Federal Cases From Eight Pee Dee and Coastal Counties

Florence is the seat of a federal division that reaches from the North Carolina line to the coast. Cases from Chesterfield, Darlington, Dillon, Florence, Horry, Marion, Marlboro and Williamsburg counties are heard at the McMillan Federal Building on West Evans Street, which means a Florence federal summons may name a defendant on the Grand Strand or in a small Pee Dee town. Federal Rule 4 allows service by a non-party adult and permits state-law methods, so the planning looks much like a state case. Coastal defendants are handled through our Myrtle Beach process service.

We read the federal summons, check the response period stated on it and match the proof to what the clerk will accept. If the defendant lives near the Horry County seat, the Conway process server page explains local conditions there. Firms filing in another state that need a Florence County resident served should tell us the rule their court uses for service outside its borders, and our out-of-state papers service page explains how we match the South Carolina delivery and affidavit to that rule.

FAQ

Frequently Asked Questions

How much does a process server in Florence cost?

Florence County's published Routine starting rate is $130. At the multipliers, Urgent is $195, Rush is $260 and Same Day Rush is $390 for a standard Florence County serve. The final figure depends on the address, the type of paper and your deadline, and we confirm it in writing before a server is assigned. The South Carolina pricing map shows every county's starting rate if the defendant lives elsewhere.

Who is allowed to serve a summons in Florence County?

SCRCP 4(c) allows the sheriff, a deputy, or any person at least 18 years old who is not a party to the case and not an attorney in it. The state does not run a licensing or registration program for private servers. Orders, rules to show cause and writs follow a different sentence of the rule and generally go through the sheriff or a person the court designates.

May a Florence server leave papers with a household member?

Yes, for an individual defendant. SCRCP 4(d)(1) allows copies to be left at the defendant's dwelling house or usual place of abode with a person of suitable age and discretion who lives there. A visitor or a contractor does not qualify. Our affidavit describes the recipient and how residence was confirmed, which helps if the defendant later disputes the service.

Will you serve an eviction in Florence?

Not the rule to vacate itself unless the magistrate court confirms that private service is accepted, because the courts checked across South Carolina route it through the sheriff's office. Removing a tenant under a writ of ejectment is officer work, done by a constable or deputy sheriff. We do serve a landlord's other papers, such as a summons for unpaid rent. The South Carolina eviction service guide explains each step.

Is certified mail enough in South Carolina?

It is a permitted method under SCRCP 4(d)(8) when the mail is restricted to the addressee with a return receipt, and service is effective on the delivery date. A default judgment generally needs a receipt showing the defendant's own acceptance, and a default can be set aside if someone else signed. That is why many Florence attorneys still choose hand delivery and a detailed affidavit.

Can you serve a business in Florence?

Yes. We deliver to the registered agent or to an officer, managing agent or general agent named in counsel's papers, and the affidavit records the person's name and title. If a South Carolina corporation has no registered agent who can be served, the court or clerk can order certified mail to the corporate secretary under S.C. Code 15-9-210(c), and counsel chooses that route. Our entity service page for South Carolina has more detail.

When are subpoena witness fees paid?

Under SCRCP 45, a witness receives $25 a day plus mileage from home to the place named in the subpoena, and that money is tendered when the witness arrives, not when the subpoena is served. For a non-party deposition, the subpoena has to come from and be served in the witness's home, work or regular business county, and we check that before a Florence server goes out.

Can you serve someone on Sunday in Florence?

Generally yes. S.C. Code 15-9-17 allows a process server to serve a summons, complaint or other judicial documents on Sunday, but not on someone who is going to, attending or returning from a church or other religious service. We plan Sunday visits around that limit and note the timing in the attempt log, as the guide on defendants who avoid service discusses.

How long does the defendant have to answer?

In the Court of Common Pleas, SCRCP 12(a) generally gives a defendant 30 days after service of the complaint. Florence County magistrate defendants answer within 30 days counted from the day after service, per SCRMC 7(b). On the self-help divorce summons, mail service with restricted delivery stretches the period to 35 days. Your attorney should confirm the deadline for your specific paper.

Do you handle papers for out-of-state courts?

Yes. Tell us the rule your court uses for service outside its own state, and we match the Florence delivery and the affidavit to it. Foreign subpoenas are different: under S.C. Code 15-47-120 they are first submitted to the clerk of court in the county where discovery is sought, who issues a South Carolina subpoena that we can then serve.
