Quick answer

How do I hire a process server in Aiken?

Upload the filed papers and the defendant's address in Aiken, North Augusta or elsewhere in the county. We confirm the court, check that a private adult may serve the paper and send a written price. Routine service in Aiken County has a published starting rate of $130, and the Aiken County service page lists every town.

01Local service landscape

Aiken County From the State Line to the Sandhills

Aiken had 32,025 residents in the 2020 census, and Aiken County about 181,500 in the 2025 estimate, spread across ten municipalities from North Augusta on the Savannah River to Wagener and Salley in the county's eastern reaches. Interstate 20 enters South Carolina from Augusta, Georgia, at North Augusta and passes the Aiken area on its way toward Lexington and Columbia. Rural roads fill the space between the towns. The countywide Aiken service page covers each community.

Aiken County's Routine starting rate is $130, while neighbors along the river and to the south run higher: Edgefield $185, Barnwell $190, Bamberg $195 and Allendale $230. We confirm the county from the address before quoting, because rural Aiken addresses near those lines are easy to misplace. Defendants who have moved up I-20 can be reached through Lexington process service, and the South Carolina county pricing map shows the rest of the state.

02Attorneys and law firms

For Aiken Practices and Firms on Both Sides of the River

Aiken and North Augusta practices handle collection suits, contract and real estate disputes, injury claims and family cases, and counsel across the river in Augusta may have Aiken County matters as well. Counsel elsewhere may need a local defendant served without traveling. We start with the papers, checking the Aiken County caption, the attached complaint and the defendant's name against the address. Our South Carolina law firm service program explains how quotes, attempts and affidavits are reported.

The summons cannot be served by counsel of record, since SCRCP 4(c) excludes attorneys in the action as well as parties, but any independent adult may serve it. Federal cases add a wrinkle: the Aiken division covers Aiken, Allendale and Barnwell counties, yet its cases are heard at the Perry Courthouse in Columbia. We note the division and the response period on any federal summons. The statewide South Carolina service hub describes how DFS coordinates work, and the multistate process serving rate map helps with cases in both states.

03Evasive and hard-to-serve

Long Driveways, Rural Routes and Defendants Who Cross the River

Outside the city, Aiken County addresses can mean long private drives, gated farm entrances and homes set far back from the road. Inside town and in North Augusta, apartment turnover and two-job households make timing the main problem. A defendant who works in Augusta may leave South Carolina every morning and return late. We plan visits around that pattern, record each one with what was observed, and never deliver until identity is confirmed. Our hard-to-serve South Carolina defendant page outlines the approach.

Sunday visits are an option too: S.C. Code 15-9-17 allows them, minus anyone traveling to, sitting in or leaving a worship service. When attempts keep failing, the dated log becomes part of counsel's diligence showing if they ask for publication under S.C. Code 15-9-710, which our guide to publication service covers. A defendant who now lives in Georgia raises a different question, discussed below, and Rush and Same Day service can help when a deadline is close.

04Family law, landlords and subpoenas

Family Court, Magistrate Matters and Aiken Subpoenas

Aiken County family cases are filed with the Clerk of Court, and the family court sits at 109 Park Avenue. The summons and complaint in a divorce or custody case are served under SCRCP 4, and a cooperative spouse may sign an Acceptance of Service instead. When counsel wants personal delivery, our server confirms identity first and keeps the handoff private. Contempt rules to show cause go through the sheriff or a court-designated person. The family law papers page for South Carolina explains each route.

Aiken landlords should know that a magistrate's rule to vacate is generally served through the sheriff's office, and we serve it only where the magistrate court confirms private service is accepted. Our servers do not post or enforce writs of ejectment. We do serve summonses in landlord suits for unpaid rent or damage, and magistrate claims up to $7,500 under SCRMC 6(c), described on the magistrate court service page. Hearing witnesses are covered by our subpoena service in South Carolina.

  • Family Court summonses and complaints
  • Landlord suits for rent or damage
  • Magistrate summonses up to $7,500
  • Subpoenas for hearings and depositions

05Documentation

What the Aiken County Clerk Receives

A private server proves South Carolina service by affidavit. SCRCP 4(g) requires the proof to state the date, time and place of service and the name and address of the person served, or a description if the name is unknown. Our Aiken affidavits follow that order. For abode service, we also state who received the papers and why they qualified as a resident of suitable age and discretion. The how-to guide for South Carolina service shows where the affidavit fits.

Each affidavit is supported by a log of every visit, including failed attempts, with times, observations and any conversation at the door. That record lets counsel respond if a defendant later denies service. Failure to file proof does not by itself invalidate service under SCRCP 4(g), and proof may be amended under 4(i). Outside Tennessee, Delator may assign a vetted server it contracts with under the same written standard, as the about Delator Group page explains.

06South Carolina rules

South Carolina Service Rules in Plain Terms

In Aiken County, as everywhere in South Carolina, SCRCP 4(c) lets the sheriff, a deputy or any non-party adult who is not counsel in the case serve the summons. The state has no licensing scheme for private servers, so those limits are the qualification each of our servers meets. Court orders, rules and writs usually require an officer or a court-designated person, and we check before accepting one. Our guide to who can serve papers in South Carolina goes further.

Individuals may be served personally, at their dwelling with a resident of suitable age and discretion, or through an authorized agent under SCRCP 4(d)(1). A summons may also go by restricted-delivery certified mail or a qualifying commercial delivery service, but a default generally requires a receipt the defendant signed. Where the limitations period has run, SCRCP 3(a) generally requires actual service within 120 days of filing. Your attorney can confirm these points, and our corporate and registered agent service handles entities.

07Aiken angle

Serving Across the Savannah River

Aiken County shares a metropolitan area with Augusta, Georgia, so many cases name someone who lives on one side of the river and works on the other. For South Carolina papers headed into Georgia, SCRCP 4(f) allows service outside the state only when a statute provides, and S.C. Code 15-9-750 makes personal delivery of the summons outside South Carolina the equivalent of publication, finished on the day it happens. Proof may be made by affidavit before a notary under SCRCP 4(h). A process server in Aiken should raise those points with counsel early.

Papers moving the other way follow the issuing state's rules. A Georgia summons for an Aiken County resident is served under Georgia's own requirements, and we ask counsel which rule their court uses for service outside its state before matching our delivery and affidavit to it. Georgia work inside Georgia is covered on our Georgia process servers page, and the out-of-state papers page for South Carolina explains how cross-border jobs are coordinated.

Process Servers Near Aiken

Aiken County cases often reach into the Midlands. Defendants who moved up I-20 toward the capital are handled through Lexington County service, Columbia process service or the Richland County process servers. Addresses farther east go to the Sumter process server page. Each of those jobs follows the same method as an Aiken serve: a written price before the first attempt, varied and logged visits, and a signed affidavit that meets SCRCP 4(g). Papers bound for Georgia are coordinated with counsel under the out-of-state rules.

FAQ

Frequently Asked Questions

How much does a process server in Aiken cost?

Aiken County's published Routine starting rate is $130. Urgent is $195, Rush $260 and Same Day Rush $390 at the published multiples. We price each Aiken job by address, document and deadline, and the figure is in writing before any server is booked. Neighboring counties, several of them higher, appear on the South Carolina county rate finder.

Who can serve a summons in Aiken County?

The sheriff, a deputy, or an adult 18 or older with no role as a party or attorney in the case may serve it, under SCRCP 4(c). Private servers in South Carolina need no state license. Orders, rules to show cause and writs follow a separate sentence of the rule and generally go through the sheriff or a person the court designates.

Can papers be left with a relative at the house?

SCRCP 4(d)(1) permits leaving copies at the defendant's home if the person who takes them lives there and is of suitable age and discretion. A relative who lives at the address can qualify; one who is only visiting cannot. Our affidavit describes the recipient and how we confirmed that person lives there.

Can you serve someone who moved to Augusta?

Counsel decides the route. SCRCP 4(f) allows service of South Carolina process outside the state only when a statute provides, and personal service across the state line counts as publication under S.C. Code 15-9-750 and is complete that same day. Proof outside South Carolina may be by affidavit before a notary under SCRCP 4(h). Our Georgia-line service coordination page has details.

Will you serve an eviction in Aiken?

Not the rule to vacate itself, unless the magistrate court confirms that private service is accepted, because the magistrate courts checked in South Carolina route it through the sheriff's office. Ejectment writs are executed by a constable or a deputy sheriff. Landlords' civil summonses are something we do serve, and the eviction service guide for South Carolina walks through the process.

Is certified mail good enough for an Aiken case?

Two mail routes exist: restricted-delivery certified or registered mail with a return receipt under SCRCP 4(d)(8), and a qualifying commercial carrier under 4(d)(9). Service is effective on delivery, but a default generally requires a receipt showing the defendant's own acceptance, and it can be set aside if an unauthorized person signed. Many attorneys therefore prefer hand delivery.

When are subpoena witness fees paid?

SCRCP 45 provides $25 a day plus mileage from the witness's residence to the place named in the subpoena, tendered when the witness arrives rather than at service. A non-party deposition subpoena must be issued and served in the county where the witness lives, works or regularly does business in person, which matters for witnesses who work in Georgia.

Can you serve papers on a Sunday?

Generally yes. Sunday service is lawful under S.C. Code 15-9-17, but a person on the way to church or another religious service, at it, or on the way home may not be served. We schedule Sunday attempts with that limit in mind and record the time, as the guide for defendants who avoid service suggests.

Where are Aiken federal cases heard?

The Aiken division of the District of South Carolina covers Aiken, Allendale and Barnwell counties, but its cases are heard at the Matthew J. Perry, Jr. U.S. Courthouse in Columbia. Federal Rule 4 allows a non-party adult to serve the summons and permits state-law methods. We note the division and the response period on the summons.

Do you handle Georgia papers for Aiken residents?

Yes, where counsel confirms the method. Tell us the rule your Georgia court uses for service outside Georgia, and we match the Aiken County delivery and the affidavit to it. Subpoenas from another state are different: S.C. Code 15-47-120 requires them to be submitted to the clerk in the county where discovery is sought. See the Delator Group home page for firm details.
