01Local service landscape

Serving Papers in Erlanger and Central Kenton County

Erlanger had 19,611 residents at the 2020 census and sits in the middle of Kenton County, between the river cities and the newer subdivisions to the south. The city has no courthouse of its own, so the summons we carry was almost always issued at the Kenton County Justice Center on Madison Avenue in Covington. Neighborhoods run from older streets near the original town center to the industrial area around the Cincinnati airport. Papers that follow a defendant toward the county seat go to our Covington service team.

City lines here are close together. Elsmere borders Erlanger to the south and was once called South Erlanger, while Crescent Springs, Edgewood and Lakeside Park sit within a short drive, so the same street name can belong to two cities. Part of the Cherry Hill area reaches into Boone County. We check each address against the right county before dispatch, which matters most for defendants near the Boone County line. Defendants who live farther south along the county's rural roads are handled through our Independence servers.

02Attorneys and law firms

Erlanger Service for Northern Kentucky and Cincinnati Firms

Erlanger defendants appear in Kenton County suits and in cases filed across the river in Ohio. Cincinnati firms with a Kentucky defendant need the delivery to satisfy the issuing court's rule, while Northern Kentucky lawyers need it to satisfy Kentucky's. We ask counsel which rule governs before assigning a server and keep one point of contact through the return. Our law firm service desk for Kentucky explains what we need at intake.

Erlanger's employer base includes logistics operations, corporate offices and the companies in the airport-area industrial zone along Mineola Pike. Under CR 4.04(5) a corporation can be served through an officer, a managing agent, its chief agent in the county where the action is brought, or an agent authorized by appointment or law. KRS 14A.4-040 names the registered agent as the entity's agent for service. We pull the entity's filing before dispatch, and our Kentucky registered agent delivery page lists what to send.

03Evasive and hard-to-serve

Shift Workers, Shared Homes and Defendants Who Dodge the Door

Many Erlanger residents work warehouse, airport and distribution shifts that start before dawn or end late at night, so a weekday afternoon attempt often finds an empty house. We plan attempts around the hours a defendant is most likely home and log each visit with the time and what the server observed. Kentucky gives no household option for a summons: under CR 4.04(2) the papers go to the person, or are offered if the person refuses, or go to an authorized agent. Our page on Kentucky defendants who are hard to reach explains the approach.

When a defendant has concealed himself so a summons cannot be served, CR 4.05 allows the clerk to issue a warning order on an affidavit, and the clerk appoints a warning order attorney who tries to reach the defendant by mail and reports within 50 days. A dated attempt log is the record counsel weigh when deciding whether that route fits, and your attorney makes that call. Our warning order attorney guide and the explainer on avoided service in Kentucky go further.

04Family law, evictions and subpoenas

Dissolution, Rental Disputes, Small Claims and Subpoenas in Kenton County

Erlanger dissolution and custody cases are filed in Circuit Court, where Kenton County has a Family Court division. A cooperative spouse may file a waiver of service and entry of appearance; otherwise the petition is served personally, by clerk mail or, in limited situations, through a warning order. We deliver family papers discreetly and away from workplaces when possible. The Kentucky divorce papers guide walks through each route.

Forcible detainer notices in Kentucky are directed by KRS 383.210 to the sheriff or a constable, and the officer gives at least three days' notice of trial. We do not serve those notices or carry out warrants of restitution. We can deliver a landlord's written pre-suit notice where the lease allows and serve summonses in separate suits for rent or damages, as our Kentucky landlord papers page explains. Small claims up to $2,500 usually go out by the clerk's certified mail or the sheriff, and witnesses can be served under CR 45.03 by any person over 18.

05Documentation

Kenton County Returns That Hold Up When Challenged

CR 4.03 requires proof of service to be filed promptly, and in any event within the time the person served has to respond. When the clerk hands the summons to a person authorized to deliver it under CR 4.01(1)(b), that person's endorsed return is the proof. Our Erlanger returns name the person served, the address, the date and time, and how identity was confirmed, and every return is backed by an attempt log that counsel can request. Rush files run through our same-day Kentucky service with the same record.

If a defendant later says the papers never reached him, the return and log show who received them, where and when, and whether the papers were handed over or offered after a refusal. That detail matters because Kentucky permits no household delivery for a summons. Serves outside Tennessee may be carried out by vetted servers Delator contracts with, each held to Delator's written documentation standard. For witness papers, our Kentucky witness subpoena delivery page covers the CR 45.03 proof options.

06Kentucky rules

Kentucky Service Rules in Plain Terms for Erlanger Cases

Under CR 4.01, as of 2026, the clerk issues the summons and then, at the plaintiff's direction, mails it by certified mail, transfers it to a person other than a mail carrier who is authorized to deliver it, or returns it to the filing party to arrange service. The sheriff is the officer named in KRS 454.140, and KRS 454.145 gives a court power to pick a person for one specific paper when good cause exists. Nothing in Kentucky law sets up a license for private servers. Our guide to who may serve Kentucky papers sets out each path.

A defendant generally has 20 days after service to answer under CR 12.01, and the summons states that period under CR 4.02. Kentucky law also gives defendants no exemption from civil service on a Sunday or holiday (KRS 454.135). These are plain-language summaries, not legal advice, so your attorney can confirm how they apply. Our step-by-step Kentucky service guide goes further, and a separate page covers Kentucky small claims delivery.

07Erlanger angle

A Banker's Name, a Busy Interchange and Two Counties Next Door

Erlanger takes its name from the Paris banking house Emile Erlanger and Company, whose founder helped finance early development, and the city grew up along the rail line before the interstates arrived. Today I-71/I-75 and the I-275 beltway carry much of the traffic that shapes when a server can reach an address. A defendant who works near the airport may live in Florence, Hebron or Union, so our Florence process serving team often shares a file with Erlanger.

Federal suits filed in the Eastern District's Covington division can name Erlanger residents alongside defendants in Campbell, Boone and Grant counties. Federal Rule 4 governs those serves, and counsel picks the method. When a file also includes a defendant across the Licking River, our Newport, Kentucky servers take that leg under the same quote, and the statewide Kentucky process serving hub shows how other counties are covered.

FAQ

Frequently Asked Questions

How much does a process server in Erlanger cost?

Kenton County's published Routine starting rate is $125. Its Urgent tier is $188, Rush is $250 and Same Day is $375. The final price depends on the address, the deadline and the papers, and it is confirmed in writing before the first attempt. The Kenton County rate finder also shows neighboring counties.

Where are Erlanger court papers filed and returned?

Kenton County's Circuit and District Courts and the Circuit Court Clerk are at the Kenton County Justice Center, 230 Madison Ave., Covington. Kenton County has two county seats, Covington and Independence, but the courts and clerk listed for the county are in Covington, so Erlanger returns go there. Federal returns go to the Eastern District clerk on West 5th Street in Covington.

Can papers be left with someone else at an Erlanger home?

Not for a summons. CR 4.04(2) allows delivery to the defendant personally, offering the papers if the defendant refuses, or delivery to an agent authorized by appointment or law. There is no household-member option for a private server. Kentucky's eviction notice is different, but only an officer serves it. For a summons, we keep attempting and log each visit.

Who is allowed to serve papers in Kenton County?

Kentucky's civil rules let the clerk mail the summons, transfer it to a person authorized to deliver it, or return it to the filing party to arrange service. There is no statewide license for private servers. We confirm how the Kenton clerk handled your summons before the first attempt and follow any order or practice that calls for the sheriff.

How long does an Erlanger defendant have to answer?

Generally 20 days after service of the summons under CR 12.01, and the summons states that period. Proof of service should be filed within that window under CR 4.03. A defendant reached by warning order is deemed summoned on the 30th day after the order is entered (CR 4.08). Counsel should calculate the deadline from the date on our return.

Can you serve a company at an Erlanger warehouse or office?

Yes, through the right person. A corporation is served through an officer, a managing agent, its chief agent in the county where the action is brought, or an authorized agent such as the registered agent. A front-desk employee usually does not qualify. We read the entity's filing first, and our business entity service page explains what counsel should send.

Do you serve Ohio court papers on Erlanger residents?

Yes. Tell us the rule your Ohio court uses for service outside its state, and we match the Kenton County delivery and sworn proof to it. Kentucky has no statute regulating service of an out-of-state summons here, so the issuing court's rules govern. Our page on papers from courts outside Kentucky explains what to include.

Can an eviction notice be served by your server in Erlanger?

No. Kentucky directs the forcible detainer warrant and notice to the sheriff or a constable, and the current AOC-215 form is addressed to them. Set-outs under a warrant of restitution belong to officers too. We can deliver the landlord's pre-suit written notice where the lease allows, and the Kentucky eviction service guide explains the officer's role.

Can papers be served in Erlanger on a Sunday?

Yes. KRS 454.135 gives a defendant no privilege of exemption from civil service on a Sunday or holiday, with narrow exceptions such as attending court as a witness. For defendants who work long weekday shifts, a weekend attempt is often the most practical. We plan attempt days and hours with counsel, and rush and same-day Kentucky serves can include weekend attempts.

Does Delator Field Services have an Erlanger office?

No. Delator Field Services, the process serving division of Delator Group, a Tennessee firm headquartered in Nashville, runs Erlanger files from Nashville and has no Kentucky office. Kenton County serves are coordinated through servers suited to the court and county involved, the price is confirmed in writing first, and one contact stays with the file until the return is delivered.
