Quick answer

How do I arrange process serving in Hinds County?

Send the filed papers, the court and judicial district, and each address you have for the defendant. We confirm the Hinds County rate and total in writing, assign a server who is at least 18 and not a party, log every attempt and return a signed affidavit. Routine service starts at $125, and the Mississippi county rate map lists the other 81 counties.

01Local service landscape

Two Judicial Districts, Three Interstates and a Shrinking Address Base

Hinds County covers about 877 square miles between the Big Black River on the northwest and the Pearl River on the east, and it is split into two judicial districts with courthouses in Jackson and Raymond. The county had an estimated 211,888 residents in 2025, down about seven percent from the 2020 Census. That decline leaves more vacant houses and stale addresses than most metro counties, so we test the address before a server drives to it, and investigations in Hinds County can confirm a current residence when the record is thin.

Movement in and out of Jackson runs on I-20, I-55 and I-220, which links I-20 in Jackson with I-55 in Ridgeland. Many defendants live in one county and work in another, so a Hinds file often turns into a stop across the river in Rankin County around Pearl and Flowood or north in Madison County near Ridgeland. We plan those multi-county files under one written quote.

02Attorneys and law firms

Serving Papers for the Capital's Legal Community

Jackson holds the state's appellate courts, a federal courthouse and a dense concentration of law firms, so Hinds County generates a steady mix of commercial suits, insurance defense matters, medical claims and government litigation. Firms tell us the court and district on intake, and we route the papers accordingly. Our Mississippi attorney support program keeps the quote, assignment, log and affidavit with one coordinator, including for out-of-state counsel who rarely file in Mississippi.

We read every packet before scheduling. A First District chancery summons, a county court complaint and a federal summons from the Thad Cochran courthouse each have their own requirements, and we flag gaps such as a dissolved company, a missing suite number or a defendant who has relocated to Louisiana. When trial is approaching and a key witness has gone quiet, a locate on a hard-to-find witness can run beside the serve.

03Evasive and hard-to-serve

Apartments, Gated Complexes and Defendants Who Keep Moving

A large share of Hinds County service lands at apartment complexes, duplexes and rental houses where tenants turn over quickly and front offices will not confirm who lives where. Servers attempt at varied hours across weekdays, evenings and Saturdays, note gate codes and building layouts, and record each visit with date and time. When a defendant has clearly left, we stop and ask counsel before spending another trip, and a records-based skip trace is often the cheaper next step.

Some defendants simply refuse to answer. When a pattern of avoidance appears, a Delator Group investigator can take the file through evasive person skip tracing, and judgment creditors can add Hinds County debtor locates. If the person cannot be found on diligent inquiry, the attempt log supports the sworn showing counsel needs before asking to proceed by publication under M.R.C.P. 4(c)(4), with notice printed weekly for three weeks in a row.

04Family law, evictions and subpoenas

Chancery Summonses, Justice Court Evictions and Jackson Subpoenas

Hinds County forms its own chancery district as of 2026, with clerk offices in Jackson and Raymond. Divorce complaints, custody petitions, hidden asset disputes and contempt motions come to us with the district already chosen, and the special summons now found in M.R.C.P. 4(i) is returnable on a hearing date the court sets, so timing matters. We confirm identity before handing anything over and keep family serves out of public view. Parents can start with our guide to custody investigations in Mississippi.

Residential evictions in Hinds County often begin in justice court, where the constable serves the summons first and a private server is used only after the constable fails to return process and the landlord asks in writing. County court also hears unlawful entry and detainer. We confirm the court's practice before accepting any eviction file, and only a sheriff or constable carries out a removal. Witness subpoenas round out the docket, with fee and mileage tendered at service. Tenant screening helps landlords avoid repeat filings.

  • Divorce and custody papers for both districts
  • Rule 4(i) special summonses with hearing dates
  • Eviction papers where a private server is allowed
  • Trial and deposition subpoenas under Rule 45

05Documentation

Getting the District, the Method and the Affidavit Right

Filing the return in the wrong district clerk's office is a common and avoidable delay in Hinds County. Each affidavit we return names the court, the district and the case number from the papers, along with who was served, where, when and by what method. Under M.R.C.P. 4(f), a server who is not a sheriff proves service by affidavit, as our statewide Mississippi service page explains, and the field log behind it lists every attempt, including the ones that failed.

When a defendant later claims the papers never arrived, counsel needs more than a signature. Our log records the address, the hour, who answered, a description and, for abode service, the relationship and apparent age of the person who accepted the papers. Serves outside Tennessee may be carried out by vetted servers Delator contracts with, under the same written standard. If service becomes a factual dispute, our Mississippi investigative consulting team can review the record and prepare testimony.

06Mississippi rules

How M.R.C.P. 4 Applies to a Hinds County Serve

Mississippi does not license process servers at the state level, a point covered in hiring help where no state license exists, and M.R.C.P. 4(c)(1) generally allows any non-party at least 18 to serve. On a party's written request, the sheriff of the county where the defendant lives or is found serves the papers and returns them to the clerk within 30 days. Rule 4(c)(3) also permits first-class mail with an acknowledgment form, but if no sworn acknowledgment comes back within 20 days, another method is needed and the court generally shifts the cost of personal service to the defendant.

Personal delivery is the default. If it cannot be made with reasonable diligence, papers may be left with the defendant's spouse or a family member above the age of sixteen at the usual place of abode, followed by first-class mail, and service is complete on the tenth day after mailing. Service must generally be made within 120 days of filing, and the answer is generally due 30 days after service. Our explainer on Mississippi service of process covers each method in more depth.

07The capital

Serving State Agencies, Officials and Nonresident Drivers in Jackson

Jackson is the seat of state government, and suits against public bodies follow their own service rules. Under M.R.C.P. 4(d), the State is generally served through the Attorney General, a county through the president or clerk of its board of supervisors, and a municipality through the mayor or municipal clerk. We confirm the correct official from the complaint and counsel's instructions before any attempt, and we record the office, the person and the time. Agencies such as the Mississippi Gaming Commission, headquartered on North Street, also receive subpoenas, and compliance audit work often starts there.

Hinds County also plays a role in cases filed elsewhere. Under Miss. Code Ann. § 13-3-63, a nonresident driver involved in a Mississippi wreck is deemed to appoint the Secretary of State to receive process, and the Hinds County sheriff serves two copies on the Secretary of State with a $15 fee per defendant, after which notice goes out by certified or registered mail. Counsel handling hit-and-run driver locates often pair that route with a personal serve once the driver is found.

FAQ

Frequently Asked Questions

Which Hinds County judicial district handles my case?

Hinds County has a First Judicial District based in Jackson and a Second Judicial District based in Raymond, each with its own chancery and circuit clerk offices. The district is chosen when the case is filed, and it appears on the papers. We read it from the summons and make sure the affidavit is returned to the correct clerk, which avoids a common filing delay.

What does process serving in Hinds County cost?

Routine service in Hinds County has a published starting rate of $125. Urgent is $188, Rush is $250 and Same Day Rush is $375. A second address, a locate or a special access arrangement can change the figure, and every change goes into the written quote before the first attempt. Nothing is billed beyond what you approved in writing.

Can you serve a Mississippi state agency or official?

Yes, following the governmental entity rules in M.R.C.P. 4(d). The State is generally served through the Attorney General, counties through the president or clerk of the board of supervisors, and municipalities through the mayor or municipal clerk. Counsel tells us which official the complaint names, and we record the office and person served. Our Mississippi litigation support services cover related records work.

How are nonresident drivers served after a Mississippi crash?

Under Miss. Code Ann. § 13-3-63, a nonresident driver is deemed to appoint the Secretary of State to receive process. The Hinds County sheriff serves two copies on the Secretary of State with a $15 fee per defendant, and notice is then mailed by certified or registered mail with restricted delivery. Proof must be filed before judgment. Your attorney can confirm whether this route fits the case.

Jackson spans three counties. Does that change anything?

Jackson extends into Madison and Rankin counties, but a summons can generally be served on the defendant wherever the defendant is found in Mississippi. What matters for the return is the issuing court. We note the actual service address and county in the affidavit, and Brandon and Rankin County investigators can confirm a residence on the east side of the Pearl River.

Who serves justice court papers in Hinds County?

In Hinds County justice court, a constable gets the papers first under Miss. R. Just. Ct. 14. Only when that constable has failed to return process can the clerk route it to the sheriff or the plaintiff make a written request for a private server, who must be 18 or older and not a party. We accept those files only after the request is on record.

When can papers be left with a relative in Jackson or Clinton?

Only once personal attempts have failed despite reasonable diligence. At that point, M.R.C.P. 4(d)(1)(B) lets the server leave the papers at the defendant's usual home with a spouse, or with a family member older than sixteen who agrees to take them, and a copy follows by first-class mail. Service is complete ten days after that mailing, and our affidavit identifies the recipient.

Do you serve federal papers from the Jackson courthouse?

Yes. Federal civil cases from Hinds County are filed at the Thad Cochran U.S. Courthouse on East Court Street, home of the Southern District's Northern Division. Those summonses are served under Federal Rule 4, with the return prepared for that clerk. The Northern Division also covers Madison, Rankin, Warren, Lauderdale and other central counties, so one coordinator can handle related defendants. Felony defense investigations support federal criminal matters.

What happens if the defendant cannot be found?

We tell counsel exactly what was tried and pause before running up more trips. Counsel may then authorize a locate, and Mississippi skip tracing frequently produces a current address through records and field work. If diligent inquiry still comes up empty, a sworn complaint or affidavit can support publication under M.R.C.P. 4(c)(4), which runs in three successive weekly notices.
