Quick answer
What should I know before hiring a process server in Bedford County?
Bedford County's courts are at 123 E. Main St. in the town of Bedford, and the former City of Bedford has been part of the county since July 1, 2013, so there is no separate city court. We serve papers anywhere in the county and return the affidavit to the issuing clerk. Routine service starts at $180; Lynchburg process service covers the city next door.
01Local service landscape
Lake Shoreline, Lynchburg Suburbs and Mountain Country
Bedford County covers about 769 square miles of the Piedmont between Lynchburg and Roanoke, with the Blue Ridge Parkway forming part of its western boundary. Its estimated 2025 population of 83,059 (secondary) includes the town of Bedford, the only incorporated town, and fast-growing areas such as Forest, about 11,709 people in 2020, on the Lynchburg side. Southern Bedford County reaches Smith Mountain Lake, while the north and west include parts of the Jefferson National Forest. Our Virginia process serving program plans each area on its own terms, and Bedford County rates on the map cover the town and the lake alike.
That spread means service can involve a subdivision near Lynchburg in the morning, a downtown Bedford storefront at noon and a lakeside home near Moneta in the evening. We build a route before the first attempt and log every stop. When a defendant works in the city rather than the county, our Lynchburg service of process team can attempt at the workplace under the same quote.
- Forest and New London toward Lynchburg
- Town of Bedford and the county courthouse
- Moneta, Stewartsville and Smith Mountain Lake
- Montvale, Big Island and the mountain west
02Attorneys and law firms
Lynchburg and Roanoke Firms Filing in Bedford
Bedford County is part of the Lynchburg metropolitan area, and many cases filed in Bedford come from Lynchburg offices, while lake and land disputes often bring in Roanoke firms. Both need a server who knows that the circuit and district courts sit side by side at 123 E. Main St., that the 24th Circuit's other courts are in Lynchburg and nearby counties, and that the return goes back to the clerk who issued the papers. Our attorney process serving across Virginia page describes intake.
Federal matters from the county go to the Western District's Lynchburg Division on Court Street, and marinas, builders and other companies are served through our Virginia registered agent service. When a defendant has moved west toward Salem or Vinton, our Roanoke County process servers take over, and one written quote covers every address in the assignment, with a separate return for each court.
03Evasive and hard-to-serve
Seasonal Lake Homes and Long Mountain Driveways
Smith Mountain Lake is about 20,000 acres with roughly 500 miles of shoreline, and many homes around it are second homes used part of the year. A defendant may list a lake address while spending most months somewhere else, which raises a question about whether it is the usual place of abode at all. In the mountain west, driveways can be long, steep and gated. We spread attempts across days and hours, never on Sunday, and log each one. The Virginia hard-to-serve service page explains how.
Va. Code § 8.01-296 allows substituted delivery to a family member 16 or older at the usual place of abode and then posting at the main entrance, but only at a usual abode. Posting on a vacation home the defendant rarely uses may not hold up. We report what the server observes so counsel can decide, and the posting rules in Virginia explain why the abode question matters. Our guide to avoided service in Virginia discusses the alternatives.
04Family law, evictions, small claims, subpoenas
Family Matters, Rental Disputes, Small Claims and Witnesses
Divorces for county residents are filed in Bedford County Circuit Court, while custody and support cases are heard in the Juvenile and Domestic Relations District Court. A spouse may accept service in a signed writing, and when that does not happen we serve the complaint. Any protective order is a matter for law enforcement to serve. Our divorce papers service in Virginia covers family filings.
Lake rentals and county housing bring landlord cases to Bedford General District Court. A private server may serve the unlawful detainer summons, at least 10 days before the return day, while only the sheriff executes the writ of eviction; see our unlawful detainer summons delivery. Small claims reach $5,000 and the district court's civil docket $50,000. Witness subpoenas are served under the general statute; see Virginia witness subpoena service for timing.
- Divorce: Bedford County Circuit Court
- Custody and support: Bedford J&DR District Court
- Unlawful detainer: summons 10+ days before return
- Small claims: up to $5,000
05Documentation and challenges
What a Bedford Return Contains and Why
Va. Code § 8.01-325 spells out what a private server's return must include, and every Bedford return we prepare has each item: the server's affidavit of qualifications, the date and manner of service, the name of the party served, a notation that service was by a private server, and the server's name, address and phone number. The return generally goes to the clerk within 72 hours of service, with weekend and holiday deadlines rolling to the next business day.
The attempt log behind it matters even more at the lake, where usual-abode questions are common. It shows each date and time, whether the home looked occupied, who answered and what they said. Counsel can use that record in a motion or hearing, and lower-dollar disputes served through our small claims papers in Virginia carry the same detail. For out-of-state owners, our out-of-state service coordination keeps the same format.
06Virginia service rules
Virginia Service Law for Bedford County Cases
Va. Code § 8.01-293 generally allows a sheriff or any adult 18 or older who is not a party or otherwise interested in the case to serve process. Virginia has no statewide license for private servers, which is why each return carries a qualifications affidavit. Executing writs of possession, levying on property and serving capiases or show cause orders stay with officers. The Virginia guide on who serves process lists those exceptions.
Va. Code § 8.01-275.1 treats a serve within 12 months of filing as on time, and a circuit court defendant generally has 21 days after service to respond under Rule 3:8. Civil process cannot be served on Sunday under Va. Code § 8.01-289. Your attorney can confirm how each rule applies to an older case or one with several failed attempts, and our Virginia service of papers guide puts them together.
07A Bedford County angle
A Former City, a National Memorial and the Peaks of Otter
Bedford was an independent city from 1968 until July 1, 2013, when it reverted to a town and rejoined Bedford County. Old records, outdated directories and some online lists still treat it as a separate city, which can lead to papers addressed to a court that no longer exists. Today every Bedford address is in Bedford County for court purposes, and returns go to the county clerks on East Main Street. We check the caption against that before filing.
The town is also home to the National D-Day Memorial, built there because Bedford suffered heavy losses on D-Day, and the Peaks of Otter rise along the Blue Ridge Parkway near milepost 85.6. Those landmarks bring visitors and seasonal businesses to the county, and our Roanoke city service handles owners who live across the mountain. When a holiday weekend squeezes a deadline, same-day process serving in Virginia is quoted in writing. When defendants live south toward the Pittsylvania line, our Danville process servers coordinate service across the Southside.

FAQ
Frequently Asked Questions
Is Bedford still an independent city?
No. Bedford reverted from an independent city to a town on July 1, 2013, and is now part of Bedford County. There is no separate Bedford city court or rate. Papers for Bedford addresses go to the Bedford County courts at 123 E. Main St., and we serve them at the county rate.
How much does it cost to serve papers in Bedford County?
The published Routine starting rate for Bedford County is $180, with Urgent at $270, Rush at $360 and Same Day Rush at $540. Lake and mountain addresses can affect the quote, and the final price is always confirmed in writing. The City of Lynchburg next door also starts at $180. See our Virginia process serving rates.
Can a private server serve papers in Bedford County?
Generally yes. Virginia lets the sheriff or any adult 18 or older who is not a party or otherwise interested serve process. Writs of eviction, levies, capiases and protective orders remain with officers. No Virginia statute licenses private servers, and each return carries a qualifications affidavit that counsel can review before filing.
Can papers be posted on a Smith Mountain Lake second home?
Posting under Va. Code § 8.01-296 works only at the defendant's usual place of abode and only after personal and family-member delivery have failed. A second home the defendant rarely uses may not qualify. We record occupancy signs at each attempt so counsel can judge whether posting there is sound.
Where is the federal court for Bedford County cases?
Bedford County federal cases are assigned to the Western District of Virginia's Lynchburg Division, whose clerk's office is at 1101 Court St., Suite A66, in Lynchburg. We serve federal summonses and subpoenas in the county under the applicable federal rules, and firms can send them through our Virginia attorney process serving intake.
Do you serve in Forest and other Lynchburg suburbs?
Yes. Forest, New London, Big Island and the other communities on the Lynchburg side of the county are in Bedford County, so their cases go to the Bedford courts unless the papers say otherwise. Many of those residents work in Lynchburg, where our Lynchburg process servers can attempt at a workplace.
Will you serve papers on a Sunday?
No. Under Va. Code § 8.01-289, a Bedford County defendant cannot be served with civil process on a Sunday, apart from rare exceptions such as an escape from custody. We plan Saturday and weekday evening attempts instead, which also suit residents who come to the lake for the weekend and leave Sunday afternoon.
What does the return of service include?
The server's affidavit of qualifications, the date and manner of service, the name of the party served, a notation that service was by a private server, and the server's name, address and phone number, as Va. Code § 8.01-325 requires. It is generally filed with the clerk within 72 hours of service.
Can you serve an owner who lives in another state?
Va. Code § 8.01-320 allows a nonresident to be personally served outside Virginia by an adult who is not a party or interested. Whether that counts as personal service in Virginia depends on long-arm jurisdiction, which your attorney can assess before we schedule the out-of-state attempt. Our out-of-state service page describes coordination.
Does Delator have an office in Bedford County?
No. The firm behind Delator Field Services is Delator Group, a Tennessee firm headquartered in Nashville, and DFS is its process serving division. For Bedford County we coordinate a server suited to the East Main Street courts and the address, and every serve follows one written standard of time-stamped attempts and a signed return.
