Quick answer
What should tenant screening in Idaho include?
It should confirm the applicant's identity, search magistrate court records for prior evictions, small claims and judgments, review criminal history under consistent written criteria, and verify income and prior landlords directly. Reports used to approve or deny a rental generally fall under the federal FCRA. Our Idaho service price list shows the $102 basic and $300 deep-dive levels.
01The rental market
Why Idaho Landlords Screen More Carefully Now
Idaho added about 190,000 residents between the 2020 Census and the 2025 estimate, and Canyon County alone grew by roughly 19 percent. Many applicants arrive from out of state with rental histories that Idaho records will never show, and competition for units pushes some to overstate income or leave out a past eviction. A careful screen protects the property and the other tenants. Our Caldwell investigators see that pattern constantly in Canyon County, where new subdivisions and older rentals sit side by side.
Rental pressure reaches well beyond Boise. Bonner County grew more than 15 percent from 2020 to 2025 and Kootenai County 12 percent, and resort areas like the Wood River Valley carry home values well above the state average. In those markets a single bad tenancy can mean months of lost rent and costly repairs. Landlords outside Boise often manage properties from a distance, which makes independent verification more valuable, and our Sandpoint team supports north Idaho owners directly.
02Federal consent rules
FCRA Rules for Rental Applicant Reports
When a landlord uses a report from an outside firm to decide on a rental application, that report is generally a consumer report under the federal Fair Credit Reporting Act. In practice, the applicant should authorize the screening in writing, and if the landlord denies the application, requires a larger deposit or adds a co-signer because of the report, an adverse action notice generally must follow. We confirm the applicant's signed consent before any research begins, and our Idaho compliance reviews can check your application forms.
The FCRA also limits how far back some non-conviction information can be reported and gives applicants a right to dispute what a report says. When a dispute comes in, we pull the source record again and correct the report if needed. Applicants sometimes try to explain a record with a story that can be verified, and we check it rather than dismiss it. The same identity-matching discipline governs our employee screening work in Idaho, where mistakes carry similar consequences.
- Signed applicant authorization before research
- Adverse action notice when the report affects a decision
- Applicant right to dispute and reinvestigation
- Limits on reporting older non-conviction items
03Consistent criteria
Fair Housing Rules and Written Screening Criteria
The Idaho Human Rights Act, at Idaho Code § 67-5909, prohibits discrimination in real estate transactions based on race, color, national origin, religion, disability and sex, according to the Idaho Human Rights Commission. The federal Fair Housing Act adds protections, including familial status. Screening rules that look neutral can still create risk if they are applied unevenly, so we recommend written criteria for income, rental history and criminal records that every applicant meets on the same terms. Our Idaho attorney network services can connect landlords with counsel who draft those policies, including owners working with our Meridian investigators.
Criminal history needs particular care. Federal housing guidance has discouraged blanket bans on applicants with any record, and many property managers now look at the nature and age of an offense and whether it bears on safety. We report convictions accurately, distinguish them from arrests and dismissed charges, and leave the decision with you, a practice our Nampa landlord clients rely on. When a record involves a protection order or a threat against neighbors, the stalking and harassment team can help a landlord understand what the order covers.
04Prior evictions
Searching Idaho Eviction and Small Claims Records
Evictions in Idaho are unlawful detainer cases handled by the magistrate division, and they appear in the public court indexes for all 44 counties, generally from 1995 forward. Under Idaho Code § 6-310, many eviction cases move fast, with trial within 12 days of filing for nonpayment and service required at least five days before trial. A filing that ended in dismissal is different from a judgment for possession, so we pull the case summary and report the outcome. Our Twin Falls investigators handle many Magic Valley file pulls.
Small claims matter too. The small claims department, whose limit was raised to $15,000 as amended in 2026, is where many deposit disputes and unpaid-rent claims end up. A pattern of landlord suits against an applicant says more than a single case, and a judgment the applicant still owes is worth knowing. Because public Idaho entries omit addresses and identifiers, we tie each case to the applicant with at least two identifiers. For applicants with history in Utah or Washington, our skip tracing specialists confirm prior addresses first.
- Unlawful detainer cases in magistrate court
- Outcome reported, not just the filing
- Small claims judgments up to $15,000
- Two identifiers before any case is reported
05Verification
Verifying Income, Employment and Prior Landlords
Fabricated pay stubs and friendly references are common. In the $300 deep-dive check, we verify employment directly with the employer using contact information we confirm independently, never a number the applicant supplies. We also confirm that a claimed prior landlord actually owned or managed the property by checking county assessor and business records. A reference who turns out to be the applicant's cousin, with no ownership interest in the address, is a finding that matters. Our Idaho fraud risk audits apply similar tests for property managers facing repeated application fraud.
Self-employed applicants and newcomers need a different approach. We can confirm a business is registered through the Idaho Secretary of State's SOSbiz records, check whether it appears active and review public information about its operations. For applicants relocating for jobs at large employers, such as the Micron expansion in Boise or Idaho National Laboratory in Idaho Falls, we verify the offer with the employer when the applicant consents. Our Idaho Falls team handles many eastern Idaho verifications.
06After the lease
Deposits, Notices and Eviction Service Under Idaho Law
Good screening reduces disputes, but it does not end them. Under Idaho Code § 6-321, a landlord generally must return the deposit within 21 days after the tenant surrenders the premises if the lease sets no other period, and in no case later than 30 days, with a signed itemized statement for any amount kept. For nonpayment of rent, § 6-303 generally requires a written three-day notice before an eviction is filed, and a residential tenant has 72 hours after judgment to remove belongings. Our Idaho guide to serving legal papers covers notice delivery.
When a case is filed, the summons and complaint must be served as in other civil actions. Delator Field Services serves eviction papers with logged, time-stamped attempts and a signed affidavit, and Ada County service carries a published starting rate of $125 for routine delivery, with the final price confirmed in writing. Faster timelines cost more under the standard urgency multipliers. Landlords in the Boise area can request service through our Boise process server page, and tenants who leave owing money can be found by our debtor locate team.
07Special cases
Student Rentals, Military Tenants and Commercial Leases
Idaho's university towns create a distinct market. Brigham Young University–Idaho reported 20,173 on-campus students in its Winter 2026 semester, and Boise State, the University of Idaho in Moscow and Idaho State in Pocatello each enroll many thousands more. Student applicants often have no rental history, so screening focuses on identity and on the co-signer, whose income and court history carry the lease. Our Rexburg investigators and Pocatello staff verify parents and guarantors who may live in other states.
Mountain Home Air Force Base brings service members who rent off base, and federal law gives them certain lease protections, so landlords should ask counsel before applying standard terms. Commercial tenants need a different review entirely. For a retail or warehouse lease, we research the business entity, its owners, prior lawsuits and liens, and whether earlier landlords sued it. Tenant screening in Idaho at that level overlaps with our commercial real estate risk work, and our Mountain Home team supports Elmore County landlords.
- Co-signer income and court history checks
- Guarantors verified in other states
- Counsel review for military tenant terms
- Entity and owner research for commercial leases

How it works
How Idaho tenant screening works
- 01
Set your criteria
We agree in writing on the check level, the records to review and the criteria you will apply, so every applicant for the unit is measured the same way.
- 02
Collect consent
The applicant signs an authorization for the screening. We confirm it is on file before any research begins and keep a copy with the report for your records.
- 03
Search and verify
We search court indexes, confirm identity with two identifiers, verify income and prior landlords at the deep-dive level and pull case outcomes from the clerk where needed.
- 04
Report and follow up
You receive a written report. If you deny or condition the application, we provide what the adverse action notice needs and recheck any disputed record.

Where we screen tenants in Idaho
We screen applicants for rentals in every Idaho county. Most requests come from the Treasure Valley, including Boise, Meridian, Nampa and Kuna, followed by university markets in Rexburg, Moscow and Pocatello. North Idaho landlords in Coeur d'Alene, Hayden and Sandpoint often see applicants from Spokane, so we search Washington records too, and eastern Idaho owners near Blackfoot and Idaho Falls screen applicants from Utah. Remote checks reach every county. For process serving rates by county, see our Idaho rate map.
FAQ
Frequently asked questions
Do I need the applicant's permission to screen them?
Yes, in practice. When an outside firm prepares a report used to approve or deny a rental, federal FCRA rules generally apply, and written authorization from the applicant is the standard first step. We confirm the signed consent is on file before research begins. If you deny the application because of the report, an adverse action notice generally must follow.
How far back do Idaho eviction records go?
Idaho's electronic court records generally reach back to 1995 for all 44 counties, and older files may be available from the county clerk. Most landlords focus on the last five to seven years, but the written criteria you set should say so. We report the case outcome, not just the filing, because a dismissed eviction means something different from a judgment for possession.
Can I deny an applicant for a criminal record in Idaho?
Criminal history can be part of screening, but blanket bans can create fair housing risk under federal guidance, and criteria should be applied consistently. Many landlords consider the nature of the offense, how long ago it happened and whether it relates to safety. Counsel can help you write a defensible policy. Our guide to what Idaho investigators can lawfully do explains our role.
How quickly must I return a security deposit in Idaho?
Under Idaho Code § 6-321, generally within 21 days after the tenant surrenders the premises if the lease sets no other period, and never later than 30 days. If you keep any portion, you must provide a signed statement itemizing the amounts and reasons. Good move-in documentation makes those statements far easier to defend in small claims.
Can you screen applicants who are moving from another state?
Yes. Many Idaho applicants come from Washington, Oregon, Utah, California or Nevada. We confirm prior addresses first, then search courts in each state where the applicant lived, all within the same written scope. Applicants with South Dakota history are covered through our South Dakota investigations coverage, and Mississippi through our Mississippi coverage page.
What is Delator's licensing status for Idaho work?
No statewide license exists in Idaho, so no investigator holds one. Certain cities, including Chubbuck and Coeur d'Alene, have their own rules for investigators or detective agents, and we confirm them before field work there. Delator Group is a licensed Tennessee private investigation firm, insured, and follows Tennessee's licensing standard in Idaho. Our guide to vetting investigators explains why that matters.
What does tenant screening cost?
The basic remote check costs $102 per adult applicant, and the deep-dive check with income and landlord verification costs $300. Commercial tenant reviews may add hourly research at $100 per hour under a written cap. Property managers screening at volume can discuss consistent criteria and scheduling, but the per-check prices stay the same and are confirmed in writing.
Can you serve an eviction summons for me?
Yes. Delator Field Services serves unlawful detainer papers with logged, time-stamped attempts and a signed affidavit. Idaho eviction trials can be set quickly, with service required at least five days before trial in many cases, so tell us the trial date at intake. Pricing starts from the county's published routine rate and is confirmed in writing. See our Nampa process server page for Canyon County.
What if an applicant disputes something in the report?
The FCRA generally gives applicants the right to dispute information and have it reinvestigated. We pull the source record again, contact the county clerk if needed and send a corrected report if an error is confirmed. Hold the unit decision until the process finishes if you can. Disputes are often about identity mix-ups, which our two-identifier rule is designed to prevent.
Do you screen commercial tenants differently?
Yes. A commercial screen looks at the business entity's filings through the Idaho Secretary of State, its owners and guarantors, prior lawsuits and liens, and whether earlier landlords sued it. Consumer-report rules may not apply the same way to a business, but personal guarantors are still individuals. We scope the work to the lease term and the amount at risk.
