01Local service landscape

How Service Works in a One-City River County

Warren County stretches along the Mississippi River, which forms its western border with Madison and Tensas parishes in Louisiana. It covers about 619 square miles and had an estimated 41,800 residents in 2025, down about 6.6 percent from 2020. Vicksburg is the county seat and the only municipality; everything else is unincorporated, including Warrenton, Yokena, Rose Hill, Waltersville, Flowers and LeTourneau. Each request is priced in writing by our Mississippi process serving desk before a server sets out.

The county has an unusual shape. Its northern portion connects to the rest only through a narrow strip of former river channel near Eagle Bend, now an oxbow lake and marsh with no road across it, so an address there can mean a long detour. Rural river roads can also make door-to-door work slower than the map suggests. When an address is uncertain, a residence confirmation search usually pays for itself, and the statewide price table shows Warren's tier.

02Attorneys and law firms

For Vicksburg Counsel and Jackson-Area Firms

Vicksburg sits on I-20 at the Louisiana line, west of Jackson, so many Warren County cases are handled by Jackson firms as well as local practitioners. As of 2026 the circuit district pairs Warren with Issaquena and Sharkey, and the chancery district reaches into the Delta, which means witnesses may be spread well beyond Vicksburg. Our support for Mississippi law firms keeps the quote, log and affidavit for every address with one coordinator.

Federal cases from Warren County belong to the Southern District's Northern Division in Jackson, at the Thad Cochran U.S. Courthouse, rather than the Western Division in Natchez. We note the division on each return. When the case needs more than delivery, Delator's Warren County investigators and Hinds County investigators can handle witness or records work under separate written scopes, quoted before any work starts.

03Evasive and hard-to-serve

Warren County Defendants Who Are Hard to Reach

In Warren County the hardest serves usually involve mobility. Some defendants work shifts or travel for work and are home only at odd hours. Others move between Vicksburg and Louisiana, or between town and a rural property along the river roads. Our servers rotate attempt times across mornings, evenings and weekends, record vehicles and activity, and write down what neighbors volunteer, so the log reads as genuine diligence.

When the log points to avoidance or a move, we suggest a better tool than another visit. An evasive person search can identify a new address or employer, and a short surveillance assignment in Mississippi can show when someone is reliably home. For collection matters, a debtor locate may be the faster path. Each option is quoted separately and starts only on written approval.

04Family law, evictions, small claims, subpoenas

Chancery, Rental and Subpoena Papers in Warren County

The Warren County Chancery Court hears divorce, custody, support and estate matters. Since July 1, 2026, the special summons for custody, support and contempt has been part of M.R.C.P. 4(i), and it orders the defendant to appear on a date the court sets. A divorce on irreconcilable differences under Miss. Code Ann. § 93-5-2 generally requires either a joint complaint or a defendant who was personally served or signed a waiver. Our Mississippi custody investigations guide explains what can be gathered lawfully.

Residential landlords generally give a three-day written notice for unpaid rent or a 14-day notice for other breaches under Miss. Code Ann. § 89-8-13. In justice court, eviction and small claims summonses go to the constable first, and only a sheriff or constable removes a tenant after judgment. Subpoenas under M.R.C.P. 45 must be delivered personally with a day's attendance fee and mileage tendered. Our plain-language Mississippi service guide walks through each document.

  • Divorce complaints and written waivers
  • Rule 4(i) summonses for custody and support
  • Three-day and 14-day landlord notices
  • Trial, deposition and foreign-case subpoenas

05Documentation and challenges

Records That Stand Up in a Service Dispute

Proof of service by a private server takes the form of an affidavit under M.R.C.P. 4(f). We draft ours from notes taken during each attempt, covering the documents, the person served, the address, the date, the time, the method and how identity was confirmed. If papers are left at the home, the affidavit names the spouse or family member above sixteen who accepted them, their stated relationship, and the date of the first-class mailing that completes service ten days later. This is the field documentation standard Delator uses.

When a defendant says the house was not their usual abode or that the papers never arrived, counsel needs the underlying record quickly. We keep the attempt log, observations, any photographs and the mailing receipt in a single file, and the server can give sworn testimony at a hearing. Questions about a difficult address or the scope of a job can go through the Delator contact form before the first attempt is made.

06Mississippi service rules

Mississippi's Service Rules, Summarized

M.R.C.P. 4(c)(1) generally lets a non-party who is at least 18 serve a summons, and Mississippi issues no state process server license. A party may also request sheriff service in writing. First-class mail with a sworn acknowledgment is available under Rule 4(c)(3), but if it is not returned within 20 days another method is needed, and the court may order the defendant to pay for personal service. Our guide to choosing field help without a Mississippi license explains how to vet a server.

Rule 4(h) generally allows 120 days from filing to complete service, and Rule 12(a) gives the defendant 30 days to answer. A person outside Mississippi may be served by certified mail with restricted delivery under Rule 4(c)(5). Mississippi has not adopted the Uniform Interstate Depositions and Discovery Act; instead, M.R.C.P. 45(a)(3) lets an out-of-state subpoena be presented to the clerk where discovery is taken. These are summaries as of 2026, not advice; the Mississippi service and investigations hub has more.

07A Warren County angle

The Vicksburg Bridge and Cases That Cross the River

I-20 enters Mississippi from Louisiana on the Vicksburg Bridge, which makes Warren County a crossing point between the two states. A defendant in a Vicksburg case may live in Madison Parish just across the river, and a Louisiana case may need a Warren County witness. Visitors to the Vicksburg National Military Park add another layer: a witness or party may be in town only briefly.

For Louisiana defendants in Mississippi cases, our out-of-state field coordination and Rule 4(c)(5) certified mail are both options, and personal delivery across the river may be possible; counsel chooses. For out-of-state subpoenas, the Warren County clerk can issue a Mississippi subpoena under Rule 45(a)(3), which we then serve. Jackson-area files go to Hinds County process serving, and Louisiana or other states use the multistate service price map.

The court looks at the method and the proof, which is why every Warren County serve follows the written standard on our Mississippi process serving page.

What does it cost to serve papers in Warren County?

The defendant lives across the river in Louisiana. What can be done?

M.R.C.P. 4(c)(5) generally allows certified mail with return receipt and restricted delivery to a person outside Mississippi, and personal delivery in Louisiana may also be possible. Counsel decides which route fits the case. Include the Louisiana address with your request, and we will tell you in writing whether we can coordinate personal service there.

Can you serve a subpoena from an out-of-state case in Vicksburg?

Yes, once it has been domesticated. Mississippi has not adopted the uniform interstate discovery act, so M.R.C.P. 45(a)(3) generally requires presenting the out-of-state subpoena to the clerk of the county where discovery will be taken, who issues a Mississippi subpoena. We then serve that subpoena personally with the fee and mileage tendered.

Who serves Warren County justice court papers?

Justice court summonses, including evictions and small claims, are served by the constable in the first instance. A plaintiff may request a private server in writing once the constable has failed to return process, under Miss. R. Just. Ct. 14(g). Send us the case number and what has been tried, and we will reply in writing.

Do you remove tenants in Vicksburg?

No. Under Miss. Code Ann. § 89-8-39, the warrant for removal is directed to the sheriff or a constable, and the tenant generally has seven days after judgment to leave unless the court sets a different period.
