01Local service landscape
Serving Papers in Independence and Across Kenton County
Independence has grown quickly. Its population rose from 14,982 in 2000 to 28,676 in the 2020 census, and much of that growth came as new subdivisions on former farmland. The city sits in central Kenton County, bordered by Elsmere, Erlanger, Covington and Ryland Heights, with Florence across the Boone County line to the northwest. Our Northern Kentucky rate map shows how Kenton and its neighbors are priced.
Kentucky Route 17, a four-lane divided highway, passes just east of the original city center and runs north to downtown Covington. Old Independence grew up along Madison Pike, while many newer streets branch off KY 17 into neighborhoods that mapping apps may not show accurately yet. We ask clients for subdivision names, lot or unit numbers and landmarks. Addresses north toward the river are handled through Covington process service.
Kenton County is on Eastern Time. We schedule every attempt and log every entry in local time, so the return matches the work schedules or other records counsel may compare it against later. Southern Kenton County still has rural stretches toward Walton and the Grant County line, and attempts there are grouped by route. Defendants just over the line in Boone County are covered by Florence process serving at the same Routine starting rate.

Process Service for Kenton County Litigators
Northern Kentucky firms, Cincinnati firms with Kentucky defendants and out-of-state counsel all use one intake. Send the filed summons and complaint, any return showing non-service, a description of the defendant and your calendar, and we reply with a written quote naming the court, tier and price. Nothing is attempted until you approve. Kentucky service for attorneys lists the details that help a first attempt succeed.
Under CR 12.01, a defendant generally has 20 days after service of the summons to serve an answer, and CR 4.02 requires the summons to say so. CR 4.03 asks the person serving to file proof promptly and within that window. When a hearing date is close, Kentucky same-day process serving can tighten the schedule, and Erlanger process service handles related defendants just to the north. Counsel can confirm how each rule applies.

When an Independence Defendant Works Odd Hours
Many Independence residents commute to jobs across Northern Kentucky and Cincinnati, including the large logistics operations at the Cincinnati/Northern Kentucky International Airport in Boone County, where Amazon Air and DHL run hubs. Rotating and overnight shifts make a single weekday visit unlikely to succeed. We spread attempts across early mornings, evenings and weekends, and KRS 454.135 gives defendants no exemption from civil service on Sundays or holidays. Serving a Kentucky defendant who avoids service explains how each visit is recorded.
If a defendant moves out of the county to avoid service, conceals themselves or leaves Kentucky, CR 4.05 lets the clerk issue a warning order on an affidavit from the plaintiff or counsel. The clerk appoints a warning order attorney, who writes to the defendant and reports to the court within 50 days. The defendant is deemed summoned on the 30th day after the warning order is entered. A careful attempt log helps counsel decide, and the warning order attorney guide for Kentucky explains the process.
04Family law, evictions, small claims, subpoenas
Family, Eviction, Small Claims and Subpoena Papers in Independence
Kenton County dissolution and custody cases are filed in Circuit Court at the Covington Justice Center, where the family court hears them. If a respondent will not sign a waiver of service and entry of appearance, the petition must be delivered to them personally or offered on refusal. We try to avoid serving in front of children and record the delivery precisely. Delivering Kentucky divorce papers explains each step.
Forcible detainer warrants go to the sheriff or a constable under KRS 383.210, and the AOC-215 eviction notice is addressed to them. We never serve the eviction notice or carry out a warrant of restitution. Some Northern Kentucky cities, including Covington, have adopted the Uniform Residential Landlord and Tenant Act according to a 2015 list, and notice periods differ where it applies. We can deliver a landlord's written pre-suit notice where allowed, as our Kentucky eviction service guide explains.
Small claims of $2,500 or less usually go by the clerk's certified mail or through the sheriff, and we help only where the court permits. Any person over 18 may serve a subpoena under CR 45.03, and witness subpoenas in Kentucky come back with an endorsed affidavit. A witness who lives in another county is allowed mileage under KRS 421.015, and Kenton County small claims papers explains when a private person may assist.
05Documentation
Returns Built for the Kenton County Clerk
When the clerk transfers a summons to a person authorized to deliver it under CR 4.01(1)(b), the endorsed return is the proof. A court appointee under KRS 454.145 must verify the return by affidavit. We record the date, time, place and manner of delivery and describe the person served, including any refusal and offer. Because Kenton County has two seats, the return names the Covington Justice Center as the filing location. Kentucky's service-of-process guide shows a complete file.
A defendant who disputes service usually challenges the return first. Specific times, a physical description, the vehicle in the drive and the words exchanged give counsel concrete facts. Unsuccessful attempts are documented in the same way, because they may support a warning order affidavit. Papers from Ohio or other states are matched to the issuing court's proof rule, which Kentucky service for out-of-state cases covers.
06Kentucky service rules
Kentucky Law on Who May Serve in Independence
CR 4.01 has the clerk issue the summons and, following the plaintiff's direction, mail it certified, transfer it to a person other than a mail carrier who is authorized to deliver it, or hand it back to the filing party to arrange service. KRS 454.140 directs process to the sheriff, and KRS 454.145 permits a court with good cause to appoint a person to serve one particular paper. Kentucky does not license private process servers, which who is allowed to serve in Kentucky explains.
Delator Field Services holds no Kentucky license, certification or appointment, because no such program exists. For each Independence job, we confirm with the Kenton County clerk or court how the summons will issue and whether private delivery or a special appointment is needed before accepting the papers. If only an officer may serve a document, we tell you and it goes to the sheriff.
CR 4.04(2) generally requires delivery to the individual, offering the papers if they refuse, or delivery to an agent authorized by appointment or law. The rule has no household substitute, so a summons is not left with a spouse or teenager. Companies are served through an officer, a managing agent or the chief agent in the county, and registered agent delivery in Kentucky covers entities with an agent on file.

A County Seat Without the Courthouse
Kenton County was formed in 1840, and Independence was named that year after a local farmer donated land for the county seat. Covington was also recognized because most residents lived there, and Kenton County's own history page says the two-seat arrangement continues today. In practice, the courts and the circuit clerk are at 230 Madison Avenue in Covington. A process server in Independence who knows that saves clients a wasted trip, and Kenton County service coverage applies the same routing countywide.
The old Independence courthouse on Madison Pike was reported in 2022 to house a county property valuation office, but filings and returns do not go there. Federal cases from Kenton County go to the Eastern District's Covington office on West 5th Street. Cincinnati is a short drive north, so some defendants work or live in Ohio. When a Kentucky summons must reach someone outside the state, CR 4.04(8) allows delivery by any person over 18, with an affidavit stating that the server personally knew the person served. Newport and Campbell County service covers addresses east of the Licking River.

FAQ
Frequently Asked Questions
Where do I file a return for an Independence serve?
With the Kenton County Circuit Court Clerk at the Kenton County Justice Center, 230 Madison Avenue in Covington. Independence is a co-county seat, but no clerk office is listed there, and the old Independence courthouse is not a filing location. CR 4.03 asks for proof to be filed promptly and within the time the defendant has to respond.
How much does it cost to serve papers in Independence?
Routine service in Kenton County has a published starting rate of $125. Urgent starts at $188, Rush at $250 and Same Day Rush at $375. What you pay depends on the address, the papers and how fast you need service, and the figure is written down before we start. The multi-state rate map shows neighboring counties and states.
Who can serve process in Independence?
Under CR 4.01, the Kenton County clerk can mail the summons by certified mail, transfer it to a person authorized to deliver it, or return it to the filing party to arrange service. Process is directed to the sheriff by KRS 454.140, and a court can appoint an individual for a given paper. Kentucky has no private process server license, so we confirm the clerk's practice first.
Can papers be left with someone at an Independence home?
Not for a summons. CR 4.04(2) generally calls for personal delivery to the individual, an offer of the papers on refusal, or delivery to an agent authorized by appointment or law. There is no household substitute in the rule. The family-member option in KRS 454.030 applies only to officers serving eviction notices, which we do not serve.
Can you serve an eviction notice in Independence?
No. The forcible detainer warrant goes to the sheriff or a constable under KRS 383.210, and the current AOC-215 notice names them as its addressees. That notice and any later warrant of restitution are left to officers. We can document a landlord's written pre-suit notice where allowed, and serve separate suits, as the Kentucky eviction papers page explains.
Do you serve small claims papers in Kenton County?
Kenton District Court small claims papers generally go out by the clerk's certified mail or through the sheriff, and the state handbook does not mention private servers. If the mailing comes back unserved, check with the clerk on acceptable delivery options before sending us the papers. Small claims service across Kentucky explains our limited role.
Can you serve a Kentucky summons on someone in Cincinnati?
Generally yes. CR 4.04(8) allows personal delivery outside Kentucky by any person over 18, excluding minors, people of unsound mind and prisoners. The affidavit must give the time and place of delivery and state that the server personally knew the person served. Service of that kind without an appearance does not support a personal judgment, which counsel should consider first.
How many attempts will you make in Independence?
It depends on the tier you pick and on the defendant's schedule. Attempts are spread across different days and hours, including early mornings, evenings and weekends for shift workers, so the log shows a real effort. If service still fails, counsel may consider a warning order under CR 4.05, explained in our guide to avoided service.
Do you serve subpoenas for Kenton County depositions?
Yes. CR 45.03 lets anyone over 18 serve a Kentucky subpoena statewide by delivering a copy to the witness or offering it. Witnesses from other counties are allowed mileage at the rate KRS 421.015 ties to state employees. Notice generally goes to the other parties before a non-trial subpoena is served, so counsel should confirm that step.
What if the defendant is a company near Independence?
Corporations are generally served through an officer or managing agent, the chief agent in the county where the action is brought, or an agent authorized by appointment or law. If the registered agent cannot be served with reasonable diligence, KRS 14A.4-040 allows certified mail to the principal office. Kentucky process servers can handle company defendants in any county.
