Quick answer

What investigative support does Delator offer South Dakota attorneys?

Delator provides witness locates and interviews, recorded statements, surveillance, background and asset research, scene work, juror research within ethical limits and coordinated process service. Work is directed by counsel, scoped and priced in writing and reported for court use. Investigative time is $100 per hour and civil litigation support carries a $1,000 minimum, listed on our rate sheet for South Dakota work.

01How we work with firms

An Investigative Partner Structured Around the Attorney

Lawyers need investigators who take direction, protect privilege and write reports a judge can read. Delator Group is corporately structured with one chain of command, and leadership brings military and federal law-enforcement backgrounds to case management. Every assignment begins with a written scope and price, so a client's budget is not quietly consumed by open-ended hours. We work at counsel's direction, which helps preserve work-product protection, and you can learn more about our structure on the about Delator Group page.

Delator has no office in South Dakota. We assign investigators to each matter and coordinate process service in the county where it is needed, with reporting and quality control handled centrally. That arrangement lets a Sioux Falls firm send work to Spearfish, or a Rapid City firm send it to Yankton, under one point of contact. That is what investigative support for South Dakota attorneys should mean in practice. When a case is still taking shape, a few hours of case planning with an investigator often saves far more in field costs later.

02Courts

Investigations Planned Around South Dakota's Court Structure

South Dakota's Unified Judicial System groups all 66 counties into seven judicial circuits. The Second Circuit covers only Minnehaha and Lincoln counties, with the Minnehaha County Courthouse at 425 N. Dakota Avenue in Sioux Falls and the Lincoln County court in Canton, while the First, Third and Sixth Circuits each span fourteen counties. Magistrate courts hear civil claims of $12,000 or less, small claims, misdemeanors and many protection orders. Our Sioux Falls litigation investigators work Second Circuit matters most often.

Federal matters go to the U.S. District Court for the District of South Dakota, which sits in Sioux Falls, Rapid City, Pierre and Aberdeen, with appeals to the Eighth Circuit. The state Supreme Court sits at the Capitol in Pierre. We plan witness work around the venue: a Rapid City federal trial may need service on West River witnesses, and a matter in the Aberdeen division may call on an Aberdeen-based investigator for Brown County records and interviews.

03Civil litigation

Civil Litigation Support for South Dakota Law Firms

Limitations periods shape when the factual work must start. Under SDCL chapter 15-2, many contract and fraud claims generally carry six years, personal injury three years, and libel, slander, assault and battery two years, while medical malpractice generally runs two years from the act or omission. We locate fact witnesses, take statements, identify cameras and records and build timelines. Before a witness is relied on, a witness background review checks for prior statements, relationships and credibility issues.

Our civil work spans personal injury, commercial disputes, employment cases and estate litigation. For wrongful death matters, which generally must be commenced within three years of death under SDCL 21-5-3, our wrongful death investigation team reconstructs timelines with care for the family. Business disputes, from partner conflicts to vendor fraud, often move into our corporate investigation services. Civil litigation support carries a $1,000 minimum, billed at $100 per hour against a written scope.

04Criminal defense

Defense Investigation in South Dakota State and Federal Cases

Defense investigators test the prosecution's theory. We interview witnesses the State did not, revisit scenes, request records, examine timelines and identify alternative explanations. South Dakota is a non-Public Law 280 state, and the U.S. Attorney's Office reports that between 50 and 60 percent of its criminal caseload involves Indian country offenses, so federal defense work here often involves reservation communities and tribal records. Our criminal defense investigators in South Dakota approach those cases with patience and respect.

Defense pricing follows case-based minimums: misdemeanor defense from $750, a single felony from $1,000 and multiple charges from $1,500, all at $100 per hour beyond the minimum. Our felony case investigations page explains typical scopes. Trial-level indigent defense is funded and run by each county, and the Office of Indigent Legal Services, created in 2024, handles felony and abuse-and-neglect appeals. We help appointed lawyers frame funding requests through the court and county, as described on our appointed counsel support page.

05Family law

Investigations for South Dakota Family Law Practitioners

South Dakota still lists fault grounds for divorce under SDCL 25-4-2, including adultery and extreme cruelty, alongside irreconcilable differences. Whether infidelity evidence matters to grounds, alimony or custody is counsel's decision, and our infidelity investigations for married clients are scoped to answer the question counsel actually needs answered. Property may generally be divided regardless of title under SDCL 25-4-44, which is why an accurate inventory matters, a topic our guide on hidden marital assets covers.

Custody work requires discipline. Courts apply the child's best interests under SDCL 25-4-45 and may consider the Fuerstenberg factors, while SDCL 25-4-45.5 creates a rebuttable presumption against custody with a parent who has a history of domestic abuse. Lawful documentation of stability, caretaking and specifically harmful conduct is what tends to help. Domestic abuse protection orders under chapter 25-10 can last up to five years. Our custody investigation guide for South Dakota explains the evidence we gather and the lines we will not cross.

06Service of process

Process Service Coordinated for South Dakota Law Firms

Delator Field Services coordinates service of summons, subpoenas and other papers statewide. Under SDCL 15-6-4(c), service is generally made by a sheriff or constable or by any non-party who is an elector of any state. Businesses are generally served through an officer, director or registered agent under 15-6-4(d)(1), and individuals who cannot conveniently be found may be served at their dwelling with a resident over 14 under 15-6-4(e). Our statewide process serving service documents each attempt and returns a signed affidavit.

Cost and timing questions come up often. Under SDCL 15-6-4(i), a defendant who does not return a mailed admission of service within 20 days without good cause may be ordered to pay the costs of personal service. The answer period is generally 30 days after service under 15-6-12(a). Subpoenas under 15-6-45(c) generally require tendering one day's attendance fee and mileage. Routine service starts at a published $125 in Minnehaha and Pennington counties, with every county shown on our South Dakota service rate map and confirmed in writing.

07Trial preparation

Juror Research and Trial Preparation in South Dakota

Under SDCL 16-13-10, South Dakota jurors must generally be state citizens, residents of the county or jury district, at least 18 by January 1 of the year of service, of sound mind and able to read, write and understand English, and a felony conviction disqualifies unless civil rights have been restored. Juror research is limited to public information and never involves contact with jurors or their families. Our jury pool research follows counsel's instructions and the court's rules on what may be reviewed.

Trial preparation also means logistics. Witnesses on the West River side live on Mountain Time, roughly 349 miles from Sioux Falls by I-90, and winter closures can disrupt travel to a hearing. We confirm witness availability, serve trial subpoenas and keep counsel informed of conflicts. A Rapid City trial support investigator can be on call during a West River trial. For the ethical limits that govern all of this, see our plain-English guide to PI legal limits in South Dakota.

Statewide coverage

Attorney Support Across South Dakota

We support firms in every judicial circuit. Along I-29, our Brookings investigators for counsel and Watertown investigative support serve Third Circuit practices in Brookings and Codington counties. In the Sixth Circuit, Pierre-based litigation support reaches Hughes County, the state agencies and the federal courthouse in the capital. In the Fourth Circuit, a Spearfish investigator for law firms handles Lawrence County matters from Deadwood to the Wyoming line. Every assignment follows the same reporting standard and leadership review, so investigative support for South Dakota attorneys looks the same in Canton as it does in Deadwood.

FAQ

Frequently asked questions

Does South Dakota require investigators who work for attorneys to be licensed?

South Dakota has no statewide private investigator license, so firms should evaluate investigators on supervision, insurance, report quality and testimony experience. Delator Group is a licensed Tennessee private investigation firm and applies that standard to South Dakota work. Our guide to evaluating an investigator in South Dakota lists the questions worth asking.

Will your work be protected as attorney work product?

When an investigator is retained by counsel and works at counsel's direction in anticipation of litigation, the work is generally treated as part of the attorney's work product. Whether protection applies in a particular case is a legal question for you. We structure engagements through the firm, label reports appropriately and communicate through counsel to support that protection.

Can you find a witness who has moved out of state?

Yes. We trace witnesses across state lines, including into Minnesota, Iowa, Nebraska, North Dakota, Montana and Wyoming, and confirm addresses in the field when needed. Our South Dakota skip tracing service produces a dated report, and we can coordinate interviews or subpoena service wherever the witness now lives, with fees tendered as the rules require.

How do you handle surveillance in a case we are litigating?

We observe only from public places or places the investigator has a right to be, avoid repeated conduct that could look like harassment and never install devices in private places. Every session is logged with times and vantage points. Our surveillance investigations page explains the method and the documentation counsel receives.

Do you support insurance defense firms?

Yes. Defense counsel use us for claimant activity checks, recorded statements, scene work and witness development in injury, liability and workers' compensation cases. Our insurance claim investigation services describe the work in more detail, including how South Dakota's insurance fraud statute grades conduct by the amount involved and what that means for referral decisions.

How quickly can you serve papers for our firm?

It depends on the county, the defendant and the service level. Urgent, Rush and Same Day Rush service are available at 1.5, 2 and 3 times the Routine rate, and every attempt is logged and time-stamped. Our guide to serving legal papers in South Dakota explains the rules, and the price is confirmed in writing first.

Can you help with cases involving tribal land?

We can, with care. Service and investigation on reservation land can be governed by tribal law, and in Bradley v. Deloria the state Supreme Court held that service that did not comply with SDCL 15-6-4(c) failed to give the court jurisdiction. We confirm the method with counsel before any attempt and never give jurisdictional advice ourselves.

Do you take misdemeanor defense assignments?

Yes. Many misdemeanors are heard in magistrate court on short timelines, so focused work matters. Misdemeanor defense investigations start at $750, billed at $100 per hour beyond the minimum. Our misdemeanor defense investigation page explains common scopes, such as locating a key witness or documenting a scene before it changes.

Can your investigator testify at trial?

Yes. The investigator who did the work can testify about what was observed, how evidence was gathered and how it was preserved. Reports are written with cross-examination in mind, separating observations from statements and noting gaps. Testimony and preparation time are billed at the standard rate under the written scope.

How does billing work for law firms?

Each assignment has a written scope and price before work begins. Investigative time is $100 per hour, civil litigation support carries a $1,000 minimum and criminal defense work follows case-based minimums. Travel and mileage are stated up front. We do not bill beyond the approved scope without counsel's written permission, and invoices itemize the work performed.
