01Local service landscape
Serving Papers in Peachtree City and Fayette County
Peachtree City began as a planned community in the 1950s, when developers bought more than 12,000 acres in Fayette County, and it was chartered on March 9, 1959. Its residents live in five villages, Aberdeen, Braelinn, Glenloch, Kedron and Wilksmoor, with curving streets, cul-de-sacs and homes that back onto lakes or wooded path corridors. The city had 38,244 residents at the 2020 census. Georgia State Routes 54 and 74 carry most traffic, with SR 74, the Joel Cowan Parkway, on the west side. Our Fayette County process service covers the rest of the county.
Line Creek forms the city's western boundary and the county line, so a home a short walk from a Peachtree City shopping center may actually sit in Coweta County. That changes the court, the sheriff and sometimes the server. We confirm the parcel's county before quoting, and Coweta addresses move to our Newnan and Coweta servers. Fayetteville, the county seat, holds the courthouse where most Fayette papers are filed and returned.
- Five villages with curving streets and cul-de-sacs
- Lakeside homes near Lake Peachtree and Lake Kedron

02Attorneys and law firms
Peachtree City Service for Fayette Lawyers and Corporate Counsel
Fayette County practitioners handle family, estate, real estate and business cases, and Atlanta firms frequently need a south-metro executive or employee served before a deadline. Peachtree City's industrial park adds corporate defendants: Panasonic Automotive Systems Company of America is described as the city's largest employer, and companies such as Hoshizaki, Rinnai, TDK and Sany America also operate there. Counsel send the filed papers and we read them before scheduling. The attorney service program for Georgia explains how volume work is handled.
A corporation is generally served through its president or another officer, a managing agent at a Georgia facility, or its registered agent, under O.C.G.A. 9-11-4(e)(1)(A). A reception desk employee is not automatically a managing agent, so the server asks for the right person and records the answer. If none can be served, the statute allows service on the Secretary of State after the required mailing. Our Georgia corporate service page lists what to send.
03Evasive and hard-to-serve
Gated Neighborhoods, Commuters and Defendants Who Avoid the Door
Some Fayette County neighborhoods have gatehouses or controlled entry. Under O.C.G.A. 9-11-4(f)(4), a person authorized to serve may enter a gated community for a reasonable time after naming the person to be served and showing a government photo ID and evidence of an appointment as a process server, and must leave promptly afterward. We plan that step in advance rather than arguing at the gate. Our page on Georgia defendants who are hard to serve has more.
Many residents commute toward the airport or downtown Atlanta and keep irregular hours. Our servers vary the day and time of each attempt, note vehicles and lights, and never follow a defendant along the paths or into a business. When a person keeps avoiding service, the log supports counsel's request for another method. The guide for defendants who avoid service explains what courts usually expect. If the court later orders it, our Georgia publication service guide covers the newspaper notice.
04Family law, evictions and subpoenas
Divorce, Dispossessories, Magistrate Claims and Subpoenas in Fayette County
Fayette divorce and custody cases are filed in the Superior Court in Fayetteville. A cooperating spouse can sign an acknowledgment of service, and otherwise the papers are delivered personally or at the home under the Civil Practice Act. We avoid school pickup lines, youth sports fields and other public scenes, and we confirm identity before handing anything over. The Georgia guide to serving divorce papers covers the acknowledgment form. Our divorce and custody papers service page lists what to send.
For rentals, O.C.G.A. 44-7-51(a) has allowed an approved process server to serve a dispossessory summons since July 1, 2025, alongside the sheriff and constables, though the statute does not define approval. We ask the Fayette Magistrate Court how it handles the summons before accepting a dispossessory, and we never carry out writs. Witness subpoenas and magistrate claims are more common requests, and our Georgia magistrate court service page explains the 30-day answer rule.
- Divorce and custody papers for Fayette Superior Court
- Fayette dispossessories pending the court's answer
- Statements of claim up to $15,000
- Hearing and deposition subpoenas

A Fayette County Return That Stands Up to Scrutiny
Georgia requires a private server to prove service by affidavit stating the date, place and manner of service, filed within five business days of the serve in the court where the case is pending. Because the defendant's answer period generally does not begin until proof is filed, a prompt return keeps the case moving in Fayetteville. Every Peachtree City affidavit we prepare is signed and paired with a log of every attempt. Witness serves follow the same record, explained on our subpoena service for Georgia courts page.
If a defendant later claims the papers were left with the wrong person, the affidavit and log show who accepted them and why the server believed that person lived at the home. In Peachtree City, as elsewhere outside Tennessee, the serve may be made by a vetted Georgia server under contract with Delator, working to Delator's written documentation standard. When a hearing date is close, our Georgia same-day service tier keeps that standard.
06Georgia rules
How Georgia's Service Rules Work in Peachtree City
O.C.G.A. 9-11-4(c) generally permits service by the sheriff or a deputy, a court marshal, a citizen specially appointed by the court, a non-party adult the court appoints as a process server or permanent process server, and a certified process server under 9-11-4.1. A certified server may serve only in counties whose sheriff accepts a yearly notice of intent, so we confirm Fayette County's position for your case. We never claim a Georgia certification or appointment we have not confirmed. Our explainer on authorized process servers in Georgia lists each category, and the statewide rate table by county prices them.
An individual is generally served in person, at the dwelling with a resident of suitable age and discretion, or through an authorized agent. A minor is served together with a parent or guardian under 9-11-4(e)(3). The server is expected to act within five days of receiving the papers, though a later serve is not invalid for that reason alone. These are summaries, not legal advice, and our walkthrough of serving papers in Georgia adds detail.
07Peachtree City angle
Serving Papers in a City Built Around Golf Cart Paths
Peachtree City has more than 100 miles of golf cart paths, a network often described as the most extensive of its kind in the world. Many residents run errands, visit friends and reach school or work by cart, and some homes are easier to approach from the path side than from the street. Our servers still approach from the public front entrance, never through a backyard or private path spur, and they do not stop a defendant who is driving a cart. Our Fayette and Coweta county service pages note how this differs next door.
The cart culture also changes timing. A defendant who never seems to drive a car may be home more often than a commuter, and weekends around the lakes or the Falcon Field general aviation airport can be busy. We record what the server observes on each visit, and we pick attempt windows with counsel when a case is sensitive. Defendants who have moved toward Jonesboro or McDonough are served through our Clayton County servers or our Henry County process service.

FAQ
Frequently Asked Questions
How much does a process server in Peachtree City cost?
Routine service in Fayette County has a published starting rate of $125. For Fayette County, Urgent runs $188, Rush $250 and Same Day $375. Your Peachtree City price turns on the address, the deadline and the papers, and we confirm it in writing before anyone knocks. The Fayette County page covers the rest of the county.
Which court handles a Peachtree City case?
Most civil and family cases go to the Fayette County Superior Court or the State Court of Fayette County, both at One Center Drive in Fayetteville. Smaller civil claims up to $15,000 and dispossessories go to the Fayette Magistrate Court. Federal cases belong to the Northern District's Newnan Division. A home west of Line Creek may be in Coweta County instead.
Can a server enter a gated Fayette County neighborhood?
Under O.C.G.A. 9-11-4(f)(4), a person authorized to serve may enter a gated community for a reasonable time during reasonable hours after naming the person to be served and showing a government photo ID and evidence of a current appointment. The server must leave promptly afterward. A single Peachtree City home with its own gate falls outside the rule. Guards may ask for the unit number.
Will you serve someone on the golf cart paths?
We do not stop a defendant who is driving a cart, and we do not approach homes through backyards or private path spurs. Attempts are made at the front entrance of the home or at another lawful location counsel approves. Every visit is logged so counsel can see exactly what was tried, and the hard-to-serve defendants page explains the approach.
How do I serve a company in the Peachtree City industrial park?
Georgia generally requires service on an officer, a managing agent at a Georgia facility or the registered agent. We check the corporate filing first so the server asks for the right person, and the affidavit records who accepted and their role. Our registered agent service in Georgia explains the Secretary of State fallback.
Can you serve a dispossessory in Peachtree City?
Only after we confirm the Fayette Magistrate Court's practice. Since July 1, 2025, Georgia law allows an approved process server to serve the summons alongside the sheriff and constables, but it does not say who approves one. Writs of possession in Fayette County are never ours to carry out. The Georgia eviction guide explains the three-business-day notice and other steps.
How long does a Fayette County defendant have to answer?
In Fayette County superior and state court, the answer is generally due 30 days after service, and the count generally waits until proof of service is filed. Magistrate claims also allow 30 days. A dispossessory answer is due seven days after actual service. A defendant who waived service answers 60 days after the waiver request was sent. Counsel should calculate the exact date.
What does a Peachtree City affidavit of service include?
A Peachtree City affidavit states the date, place and manner of service, names or describes the person served and carries the server's signature, as O.C.G.A. 9-11-4(h) requires for private service. We prepare the Peachtree City return so it can be filed within five business days. A log of every attempt supports it, and counsel can ask for the log at any time.
What if the defendant moved out of Georgia?
For a Peachtree City case, Georgia allows personal service outside the state in some situations, including in place of publication, and the defendant then has 30 days to answer. Out-of-state serves for Peachtree City cases run under the same written quote and documentation standard. Our service for papers crossing state lines page describes the process for counsel.
Is Delator Field Services located in Peachtree City?
No. Delator Field Services, the process serving division of Delator Group, runs Peachtree City files from its Nashville, Tennessee headquarters and keeps no Georgia office. We coordinate Fayette County service through servers who meet the issuing court's requirements, confirmed in writing before the first attempt, and each file has a single point of contact by phone or email.
