Quick answer
What investigative support do Idaho attorneys use most?
Idaho firms most often ask for witness locates and interviews, defendant locates before service, lawful surveillance, asset searches, records research and process service, coordinated so findings and returns arrive together. Delator bills investigative work at $100 per hour with case minimums, and routine service starts at a published $125 in Ada County, as listed on our Idaho service pricing page.
01How we work
An Investigative Partner Structured Around the Attorney
Delator Group is a licensed Tennessee private investigation firm headquartered in Nashville, with leadership drawn from military and federal law enforcement backgrounds and one chain of command on every file. We have no office in Idaho; we assign investigators to Idaho counties and coordinate process service there under the same documentation standard. Investigative support for Idaho attorneys starts with counsel's theory of the case, and the investigator works to that theory without contacting the client's opponents or witnesses until you approve. Firms new to us often begin with our Idaho investigations overview.
Every engagement starts with a written scope and price, so a retainer is not quietly consumed by hours nobody approved. Reports are dated, cite sources and separate observation from inference, because opposing counsel will read them. When a matter is not yet ready for field work, a short investigative consulting review can define what is worth doing. Idaho does not license investigators at the state level, so our guide to vetting an Idaho investigator lists what to ask any vendor.
- Work directed by counsel from intake to report
- Written scope and price before hours are spent
- Dated, source-cited reports written for court
- Investigations and process service under one file
02Court structure
Investigations Planned Around Idaho's State and Federal Courts
Idaho's trial courts sit in seven judicial districts. The First District covers the five Panhandle counties from Boundary to Shoshone, the Fourth covers Ada, Boise, Elmore and Valley, and the Seventh spans ten eastern counties from Bingham to Teton. District courts hear felonies and civil actions over $10,000, while the magistrate division hears smaller civil claims, misdemeanors, family law and evictions. Our staffing follows that map, with Coeur d'Alene litigation investigators assigned to First District matters.
Federal practice adds its own divisions. The U.S. District Court for the District of Idaho has clerk's offices in Boise, Coeur d'Alene and Pocatello, with Coeur d'Alene intake on Pacific Time and the others on Mountain Time. Twin Falls, Blaine, Jerome, Gooding, Lincoln and Camas counties fall in the Southern Division for district court but the Eastern Division for bankruptcy, a split that matters for creditor work. We staff eastern federal matters through Pocatello investigators and Magic Valley files through our Twin Falls litigation support.
03Civil litigation
Civil Litigation Support for Idaho Law Firms
Civil work is largely about finding people and preserving facts before they fade. Under Idaho Code § 5-219(4), personal injury and wrongful death claims generally must be filed within 2 years, while written contract claims generally have 5 years under § 5-216. Early investigation captures scene conditions, video and witness memory while they still exist. Plaintiff and defense firms use our wrongful death investigations and our witness locate and background service to build that record.
Employment cases have their own clock. The Idaho Human Rights Act generally requires a complaint within one year of the alleged discrimination and covers employers with 5 or more employees, and at-will exceptions based on handbooks or public policy turn on specific facts. We interview former coworkers, document timelines and locate witnesses who have left the company, as described on our wrongful termination investigations page. When a defendant has gone quiet, a statewide skip trace for litigation usually comes first.
04Criminal defense
Defense Investigation in Idaho State and Federal Cases
Since October 1, 2024, trial-level public defense in Idaho has been run by the State Public Defender. Whether a lawyer is appointed or retained, early investigation can shape a preliminary hearing in the magistrate division, a suppression motion or a plea decision. We canvass scenes, interview witnesses, obtain public records and test the timeline in the police report. Retained and appointed counsel use our Idaho criminal defense investigations for felony files and our misdemeanor defense work for faster magistrate matters.
Some witnesses are in custody. The Idaho Department of Correction operates six facilities on South Pleasant Valley Road near Kuna, along with institutions in Cottonwood, Orofino and Pocatello, and some Idaho inmates are housed in Arizona. Facility rules govern visits and calls, so we plan contact through counsel and the institution. Kuna-area investigators handle most Pleasant Valley Road interviews, and our methods follow Idaho Code § 18-6702 on recording.
05Family law
Investigations for Idaho Family Law Practitioners
Family cases in Idaho turn on a small number of statutes. Section 32-906 makes property acquired during marriage, and income from separate property, generally community property, and § 32-712 starts from a presumption of substantially equal division. On custody, § 32-717 lists best-interest factors including stability and domestic violence, and § 32-717B presumes joint custody unless a parent is a habitual perpetrator of domestic violence. We tailor evidence to those factors, as our Idaho guide to divorce asset tracing explains for property issues.
Service in family cases follows I.R.F.L.P. 204, which generally allows personal delivery or abode service by a non-party adult and applies the same 182-day dismissal rule as civil cases. Protection orders are generally sent to law enforcement for service unless the petitioner chooses a private server. When one spouse has moved away, an out-of-state infidelity investigation can document conduct in another state, and custody-focused files can draw on our Idaho child custody investigation guide.
06Service of process
Process Service Coordinated for Idaho Law Firms
Delator Field Services, our process serving division, coordinates service in every Idaho county. Under I.R.C.P. 4(c)(2), any person over 18 who is not a party may generally serve, and Rule 4(g)(1) generally requires a non-officer to file an affidavit stating age and how service was made. Serves are documented with logged, time-stamped attempts and a signed affidavit, and they may be carried out by vetted servers Delator contracts with under our documentation standard. Routine service starts at a published $125 in Ada County, with the price confirmed in writing; see the Idaho process server rate map.
Subpoenas follow I.R.C.P. 45. Any non-party adult may generally serve by delivering a copy, hearing and trial subpoenas may be served anywhere in Idaho, and one day's attendance fee and mileage must be tendered if requested. When personal service fails after diligent effort, Idaho Code § 5-509 generally provides for publication once a week for four consecutive weeks. Firms can order service through our Idaho process serving division, including Coeur d'Alene process servers for Kootenai County.
07Trial
Juror Research and Trial Preparation in Idaho
Under Idaho Code § 2-209, a juror must generally be a U.S. citizen, at least 18, a resident of the county and able to read, speak and understand English, and a felony conviction disqualifies a person unless civil rights have been restored. Juror research uses only public sources, never contacts a prospective juror and follows the court's orders on what may be reviewed. Our jury pool background research is delivered in a format counsel can use quickly during selection.
Trial preparation pulls the threads together. We confirm that subpoenaed witnesses can be found the week before trial, update addresses, organize video and observation logs with chain of custody, and prepare the investigator to testify plainly about methods. Where conduct must be shown at trial, our Idaho surveillance team documents it within Idaho's trespass, voyeurism and stalking limits, as summarized in our overview of what Idaho investigators may do.

FAQ
Frequently asked questions
Does Delator have an office in Idaho?
No. Delator Group is headquartered in Nashville, Tennessee, and does not maintain an Idaho office. We assign investigators to Idaho counties and coordinate process service there under one chain of command and one documentation standard. For attorneys, that means a single point of contact, written scopes and consistent reports, whether the case is in Boise, Coeur d'Alene or Idaho Falls.
Do your investigators hold an Idaho license?
Idaho does not issue a statewide private investigator license, so no investigator holds one. Some cities, such as Chubbuck and Coeur d'Alene, regulate investigators locally, and we confirm current local requirements before work inside those city limits. Delator Group is a licensed Tennessee private investigation firm and applies that licensing standard, along with insurance and written scopes, to its Idaho work.
How do you bill Idaho attorneys?
Investigative work is billed at $100 per hour, with case-based minimums such as $1,000 for civil litigation support and $1,000 for asset investigations. Process service is priced by county from published starting rates, confirmed in writing. We put the scope and price in writing before work begins, so investigative support for Idaho attorneys never draws down a retainer without approval.
Can you serve subpoenas anywhere in Idaho?
Yes. Under I.R.C.P. 45, hearing and trial subpoenas may generally be served anywhere in Idaho by any non-party adult, and the attendance fee and mileage must be tendered if requested. Deposition subpoenas have residence limits, so counsel should confirm the location. We coordinate service statewide and return a signed affidavit, and Twin Falls process servers cover Magic Valley subpoenas.
What happens if service is challenged?
Our returns record the date, time, place, manner of service and a description of the person served, supported by logged attempts. If service is challenged, the server can provide a declaration or testify about what happened. Under I.R.C.P. 4(g)(2), the court may allow amendment of proof of service, and counsel decides how to respond to any motion.
Do you work on both plaintiff and defense matters?
Yes. We work for plaintiffs and defendants in civil cases and for defense counsel in criminal cases, subject to a conflict check on every file. We do not work both sides of the same matter. Our reports are written to the same factual standard regardless of who retains us, because a report that reads as advocacy is less useful to the attorney relying on it. Defense files often pair this with insurance claim investigations.
Can you interview witnesses who are incarcerated?
Often, yes, through counsel and the facility. The Idaho Department of Correction operates several institutions, including six near Kuna, and each sets its own rules for legal visits and calls. We coordinate through the attorney of record, follow facility procedures and document the interview. Where a client's own treatment in custody is at issue, our correctional facility abuse investigations can help.
How do you handle cases involving tribal land?
Idaho is a partial Public Law 280 state, and service and investigation on reservation land may be governed by tribal law and tribal court rules. Whether state process is effective depends on the parties, the land status and the claim. We confirm the method with counsel, and with the tribal court where needed, before any attempt. We do not decide jurisdiction ourselves.
Can you support cases that cross into other states?
Yes. Idaho cases frequently involve Washington, Montana, Utah, Oregon, Nevada and Wyoming. Delator also works in South Dakota, Alaska and Mississippi and coordinates process service in additional states. Our multistate process serving rate map shows published starting rates, and investigative work outside Idaho follows the same written scope and reporting standard.
How do we start a matter?
Call (629) 310-8667 or email contact@delatorgroup.com with the case caption, deadline and the tasks you have in mind. We run a conflict check, propose a written scope and price and begin once you approve. Rush service and short-deadline investigations are quoted at the outset. You can also send details through our contact page and a case manager will follow up.
