01Local service landscape

Serving Papers in a High-Country County of Small Towns

Summit County had an estimated 31,500 year-round residents in 2025, a number that swells with visitors and seasonal workers each winter and summer. Its seven incorporated towns are Breckenridge, the county seat, plus Frisco, Silverthorne, Dillon, Blue River, Montezuma and Keystone, which incorporated in February 2024. Copper Mountain, Dillon Valley, Summit Cove and Wildernest add many unincorporated addresses. We confirm each address and whether it is a residence or a rental before quoting.

Much of the housing is condominiums, townhomes and lodges with shared entries, key-code doors and front desks, and many units are second homes or short-term rentals. A server may find a different guest behind the same door each week. Servers plan attempts around access and record every refusal. When a defendant may live elsewhere, our Denver investigators and Colorado skip tracing confirm where the person actually resides.

02Attorneys and law firms

Service for Mountain Practitioners and Front Range Counsel

Summit County cases are filed at the Justice Center on North Park Avenue in Breckenridge. Local and Front Range firms send us construction and real estate disputes, HOA and condominium association claims, ski and recreation injury cases, short-term rental conflicts and domestic matters. Delator's Colorado attorney services give each firm one coordinator for the written quote, the logged attempts and the signed return.

Counsel outside Colorado often have only the address of a Summit County vacation property for a defendant who actually lives in Denver, Texas or elsewhere. We check that before sending a server over the Divide, because abode service at a part-time home may not hold up. When the real residence is unclear, lost contact searches in Colorado and witness research can run first.

03Evasive and hard-to-serve

Lift Crews, Lodge Staff and Defendants Who Leave at Season's End

Resort and hospitality jobs drive much of Summit County's economy, and many workers share housing, change addresses between seasons and leave once the lifts close. Some live outside the county and commute in. Servers try varied hours and days, log each attempt with what roommates or front desks said, and report when the person appears to have left, so counsel can decide whether to locate them elsewhere instead of repeating visits.

When a defendant avoids service on purpose, a Delator investigator can take over through evasive person locates, working from public records and lawful observation. Counsel who move under C.R.C.P. 4(f) can attach a server affidavit built from those Summit County entries. The record stays useful even if the search takes weeks. Owners dealing with damage or theft at rental units can ask about stolen asset investigations, and lodging businesses about employee theft.

04Family law, evictions and subpoenas

Family Law, Evictions, Small Claims and Subpoenas in Summit County

Summit County dissolution and parenting-time cases are generally heard in district court in Breckenridge. Under C.R.S. 14-10-107, a respondent generally must be personally served unless they join the petition or waive service, and the automatic temporary injunction on property, insurance and the children's travel applies from service. Counsel can read our hidden assets in divorce guide and parenting-time investigation guide.

Long-term and employer-provided housing produce FED cases in Summit County Court. Under C.R.S. 13-40-104, the notice period is generally 10 days for most residential tenancies and 3 days for employer-provided housing, which counsel should confirm. The FED summons itself must be served or posted seven or more days before the appearance. Only the sheriff executes a writ of restitution, and Delator never performs removals. Tenant screening helps owners renting long term.

  • Dissolution and parenting-time petitions
  • FED summonses including employer housing
  • Small claims notices 15 days before trial
  • Witness subpoenas for Breckenridge hearings

Summit County Returns Built for a Challenge

Each Summit County return states that the server is 18 or older and not a party, lists the documents, and gives the date, time, place and manner of service on the pattern of the JDF 98 Affidavit of Service. The supporting log records every attempt, front-desk refusal, closure and weather delay. Serves may be carried out by vetted servers Delator contracts with, all working to one written standard and a price confirmed in writing before work starts.

If a defendant disputes service, counsel can show whether delivery was personal, on a family member 18 or older at the usual abode, on a listed workplace contact, or after a refusal under C.R.C.P. 4(k). The log also shows whether the address was a residence or a rental, which often decides an abode question. For larger disputes, investigative consulting for counsel and general risk management reviews are available.

06Colorado rules

Colorado Service Rules for Summit County Papers

A process server needs no Colorado license. Under C.R.C.P. 4(d), the server generally need only be 18 or older and not a party to the action. C.R.C.P. 4(e)(1) allows personal delivery, abode service on a member of the person's family 18 or older at the usual place of abode, workplace service on a supervisor, secretary, administrative assistant, bookkeeper, human resources representative or managing agent, and service on an authorized agent. The Colorado service of process hub covers the details.

C.R.C.P. 4(m) generally requires service within 63 days after filing, and winter travel can eat into that window. The response deadline is generally 21 days, stretching to 35 if service happened outside Colorado or by publication. Publication, by court order, is reserved for property and status cases. These are summaries, not legal advice, and the Colorado guide to serving papers and what investigators may lawfully do explain more.

07Summit County angle

The Eisenhower-Johnson Tunnel, Loveland Pass and Highway 9

Most trips into Summit County from the Front Range pass through the Eisenhower-Edwin C. Johnson Memorial Tunnel, which carries I-70 under the Continental Divide at 11,158 feet at its west portal, the highest point on the Interstate Highway System. Hazardous-materials carriers must use Loveland Pass, at 11,992 feet, instead. Tunnel and pass closures, and the I-70 traction and chain laws in force from September through May, can delay any mountain serve.

Inside the county, Colorado Highway 9 between Frisco and Fairplay is on the state's commercial chain-law list, and Hoosier Pass separates Breckenridge from Park County. We build all of that into scheduling, tell you when weather affects an attempt, and never promise winter turnaround times. Papers continuing west over Vail Pass go through Eagle County process serving, and east-side papers through Lakewood process service.

FAQ

Frequently Asked Questions

Does a process server in Summit County need a license?

No. No Colorado license applies to process servers, and C.R.C.P. 4(d) generally permits any adult non-party, 18 or older, to serve a summons. Since no agency screens servers, ask how attempts, front-desk refusals and weather delays are documented. Our Colorado provider vetting guide lists useful questions to ask. Mountain serves make those records especially important.

How much does it cost to serve papers in Summit County?

Routine service in Summit County has a published starting rate of $170. In Summit County, Urgent begins at $255, Rush at $340 and Same Day Rush at $510. Clear Creek starts at $150 and Park at $160. Road conditions, the address, the deadline and the number of people all shape the final price, which we confirm in writing first.

Where is the Summit County courthouse?

Summit County District and County Court cases are filed at the Summit County Justice Center, 501 N. Park Avenue in Breckenridge, phone (970) 453-2272. Eagle, Lake and Clear Creek counties share the 5th Judicial District but have their own courts. Our affidavit names the court that issued the papers so it reaches the right clerk.

Can papers be left at a Breckenridge vacation condo?

Abode service under C.R.C.P. 4(e)(1) requires the person's usual place of abode and a family member 18 or older living there. A vacation condo used a few weeks a year may not qualify, and a guest or rental manager generally cannot accept papers. We confirm where the defendant actually lives before relying on a vacation address.

Is Keystone a town now?

Yes. Keystone incorporated as a town in February 2024, joining Breckenridge, Frisco, Silverthorne, Dillon, Blue River and Montezuma as Summit County's municipalities. For service purposes it is still in Summit County, so Routine service starts at $170. Service on the town itself generally goes to its mayor, manager or clerk.

Will the Eisenhower Tunnel or weather delay my serve?

It can. Tunnel and pass closures, and the I-70 traction and chain laws in force from September through May, can stop or slow travel. Highway 9 toward Fairplay is also on the commercial chain-law list. Scheduling follows the conditions, we report any weather delay, and we make no winter turnaround promises.

What if the defendant left after ski season?

Then a current address is needed before more attempts. A Delator investigator can locate the person, and Colorado papers can generally be served outside the state by a qualified adult non-party, with a 35-day answer period under C.R.C.P. 12(a). Colorado missing person guidance explains the lawful methods for finding someone who has moved.

Can you serve someone at work at a ski area or lodge?

We can attempt service where the employer allows a visitor to reach the person, but we do not interrupt operations or enter restricted areas. C.R.C.P. 4(e)(1) also generally permits leaving papers with a supervisor or human resources representative at the usual workplace. Every attempt and any refusal is logged. Workplace investigations are separate.

How do you serve a condo association or property manager?

Usually through the registered agent listed with the Colorado Secretary of State, or an officer or manager. If the agent cannot be served with reasonable diligence, C.R.S. 7-90-704 generally allows registered or certified mail to the principal address; the Secretary of State is not a substitute agent. Fraud risk audits are a separate service for associations.

Is Delator Group based in Summit County?

No. As a licensed Tennessee private investigation firm, Delator Group works from Nashville and has no office in Summit County. It coordinates service across Summit County through vetted servers held to one documentation standard, and it works to Tennessee's licensing standard in every state. The Colorado investigation services overview explains the investigative side.
