Quick answer
Where are papers filed and returned for a Montgomery County serve?
Montgomery County's circuit and general district courts are both at 55 E. Main St. in Christiansburg, the county seat, not in Blacksburg. We serve the papers anywhere in the county and return the private-server affidavit to the issuing clerk within 72 hours. The published Routine starting rate is $165; our Blacksburg process servers cover the town itself.
01Local service landscape
Two Towns, a University and the Valley and Ridge
Montgomery County covers about 389 square miles of the Valley and Ridge region, with an estimated 98,434 residents in 2025 (secondary). Two incorporated towns hold most of them: Blacksburg, the largest, and Christiansburg, the county seat. Around them are census-designated places such as Riner, Shawsville, Elliston, Lafayette, Merrimac, Prices Fork and Belview, and stretches of the Jefferson National Forest. Our Virginia statewide service program applies the same written standard to all of them, and our Blacksburg service of process page covers the town in more depth.
Interstate 81 runs through the Christiansburg area on its long path up the western side of the state, and the western part of the county drains toward the New River. The City of Radford sits on the county's western edge but is an independent city with its own courts. When a defendant's address reads Radford, we check the locality before quoting, because a Radford city serve is priced and returned differently, as the New River Valley rates on the Virginia map show.
- Blacksburg: campus, student rentals and research offices
- Christiansburg: courts, retail corridors and I-81
- Riner and Floyd-side farm roads
- Shawsville and Elliston toward Roanoke County
02Attorneys and law firms
Local Practitioners and Roanoke Firms on One Docket
Lawyers in Christiansburg and Blacksburg handle much of the county's work, and firms in Roanoke file here regularly when the defendant or property is in the New River Valley. Both groups need the same things: a server who knows the circuit and district courts share the East Main Street building in Christiansburg, a return in the form Va. Code § 8.01-325 requires, and a clear report when service has not yet happened. Our attorney process serving in Virginia page describes how firms send work, and company defendants are covered by our registered agent service for Virginia companies.
Federal matters from the county go to the Western District's Roanoke Division, so a single client may have papers for the Christiansburg courts and the Roanoke federal courthouse at the same time. When a defendant has moved east along I-81, our Roanoke County service of process team takes over, all under one written quote with a separate return for each serve.
03Evasive and hard-to-serve
Semesters, Lab Schedules and Shared Apartments
Virginia Tech is the county's largest employer, and its students, graduate researchers and staff make up a large share of Blacksburg's population. That creates particular service problems: roommates who will not say who lives where, buildings with controlled entrances, leases that end in May, and people who keep long lab hours. We vary attempt times, note every visit and confirm current addresses with counsel before each round. Our hard-to-serve defendants in Virginia page outlines the process.
Under Va. Code § 8.01-296, the person who takes papers for an absent defendant must be a relative aged 16 or over who lives in the home; a roommate or temporary guest does not count. In shared student housing, that often means personal service or, failing that, posting at the main entrance of the defendant's own unit. We record which door was used. The Virginia posted service guide explains why that detail matters, and the guide to avoided service covers the steps after posting.
04Family law, evictions, small claims, subpoenas
Leases, Deposits, Family Cases and Subpoenas
A large rental market produces a steady flow of landlord and tenant cases in Montgomery General District Court. A private server may deliver the unlawful detainer summons, which must be served at least 10 days before the return day, and we do. Executing a writ of eviction is reserved to the sheriff. Security deposit and property damage disputes often run through small claims, capped at $5,000. See our Virginia unlawful detainer service for landlord intake.
Divorces are filed in Montgomery Circuit Court, while custody and support matters are heard by the Juvenile and Domestic Relations District Court. Protective orders are served by law enforcement. Witness subpoenas for trials and depositions are served under the general statute; if counsel issues the subpoena, sending it out at least five business days ahead is the safer course. Our Virginia small claims service and subpoena pages explain more.
- Unlawful detainer: summons 10+ days before the return day
- Small claims: up to $5,000 in general district court
- Divorce: Montgomery Circuit Court in Christiansburg
- Protective orders: law enforcement only
05Documentation and challenges
What We Hand Counsel When Service Is Questioned
A contested serve in the New River Valley often turns on one question: was this the defendant's usual place of abode on that date? Our attempt log answers what the server can know, including the unit, the time, who answered and what was said, so counsel can match it against leases or other records. The return itself carries the § 8.01-325 items: qualifications affidavit, date and manner, the person served, the private-server notation and the server's contact details.
Returns go to the issuing Christiansburg clerk within 72 hours of service unless the court directs otherwise, and we send counsel a copy the same day. Witnesses served through our Virginia subpoena service receive the same documentation, so a contested subpoena can be answered from the record. If the defendant is outside Virginia, Va. Code § 8.01-320 allows an adult non-party to make the serve there, and our service of out-of-state papers uses the same return format.
06Virginia service rules
Virginia's Service Rules, Applied in Christiansburg
Va. Code § 8.01-293 generally lets a sheriff or any person 18 or older who is not a party and has no interest in the subject matter serve process. A private process server is such a person who charges a fee, and Virginia has no statewide license for the role. Officers keep a few acts, including writs of possession, levies and capiases. We assign servers who meet the statutory description and say so in each return. The who can serve process guide has the details.
No civil process may be served on Sunday under Va. Code § 8.01-289. Service within 12 months of filing is generally timely, and a circuit court defendant usually has 21 days to respond after service under Rule 3:8. Your attorney can confirm how those deadlines apply to a given case, especially one that started months ago and has had several failed attempts, and the guide to serving papers in Virginia collects them in one place.
07A Montgomery County angle
The Radford Line and the Pull of Roanoke
The county's western neighbor, the City of Radford, is in the same 27th Judicial Circuit but is its own locality, with its own courts and its own published rate. Many people who work in Christiansburg live across that line, and the reverse is just as common. We confirm the locality of each address from the record before quoting, because a Radford address is not a Montgomery County address no matter how close it sits. Tight hearing dates on either side of the line can use same-day service in Virginia.
To the east, Shawsville and Elliston lie along the route toward Salem and Roanoke County, and many residents commute that way. A defendant who works in the Roanoke Valley may be easier to reach at the workplace than at home. When that happens, our Roanoke process service and county teams coordinate under one quote, and the return still goes to the court that issued the papers. Those who commute farther, toward Lynchburg, are reached through Bedford County papers delivery.

FAQ
Frequently Asked Questions
Are the Montgomery County courts in Blacksburg?
No. The circuit court and general district court are in Christiansburg, the county seat, at 55 E. Main St. Blacksburg is the county's largest town but does not host those courts. Returns for papers issued by the Montgomery courts go to the Christiansburg clerks, and federal returns go to the Western District's Roanoke Division instead.
What does process serving cost in Montgomery County?
The published Routine starting rate for Montgomery County is $165, so Urgent comes to about $248, Rush $330 and Same Day Rush $495. The City of Radford has a different rate, and several addresses or a remote farm road can change the quote. Every final price is confirmed in writing before any attempt, and our Virginia rate map lists nearby localities.
Can a roommate accept papers for a Blacksburg tenant?
Generally no. The substituted service rule in Va. Code § 8.01-296 reaches only a family member, 16 or older, living at the defendant's usual abode, and it excludes temporary sojourners and guests. Sharing a lease does not make a roommate family. If personal delivery fails, the next step is posting at the main entrance, followed by the filing side's mailing.
Do you serve papers on Virginia Tech's campus?
Where a defendant can lawfully be reached on public or open areas, a server may attempt service there, but campus buildings can have their own access rules. We plan around those rules and often find a home address or off-campus work location more practical. Counsel decides the strategy, and we log what we try.
Is Radford part of Montgomery County?
No. Radford is an independent city with its own courts, even though it borders the county and shares the 27th Judicial Circuit. We confirm the locality before quoting because Radford addresses are priced and returned separately from Montgomery County addresses; the Montgomery and Radford rates are both listed on our map, with Radford's Routine rate at $225.
Can a private server serve an unlawful detainer summons here?
Yes. Va. Code § 8.01-126 allows the summons to be served under the general service statutes, which include private servers, and it must be served at least 10 days before the return day. Posting can be part of that if the earlier steps fail. Only the sheriff executes a writ of eviction afterward. Our eviction papers service page has more.
How soon is the return filed after service?
Va. Code § 8.01-325 generally requires a private server to return the process to the clerk within 72 hours of service, with deadlines falling on a weekend or holiday moving to the next business day. We send counsel a copy of the return and the attempt log at the same time.
Can you serve a defendant who has moved out of Virginia?
Va. Code § 8.01-320 allows a nonresident to be personally served outside Virginia by any adult who is not a party or interested, and the effect depends on whether long-arm jurisdiction applies. Your attorney can advise on that question. We coordinate the out-of-state serve and return the same documentation. See out-of-state papers service.
Will you attempt service on a Sunday?
No. Virginia does not permit civil process to be served on Sunday except in narrow situations, so the Sunday that a student or researcher spends at home is off limits. We schedule weekday evenings and Saturdays instead, which in a college town are often the likeliest times to find someone at home.
Does Delator have an office in the New River Valley?
No. Delator Group, a Tennessee firm headquartered in Nashville, runs Delator Field Services as its process serving division, and New River Valley serves are coordinated through servers suited to the Christiansburg courts and the address. The written standard is the same on every serve: time-stamped attempts and a signed return. Dial (629) 310-8667 or write through our contact page.
