Quick answer

How do I arrange a process server in Beaufort County, South Carolina?

Send the filed summons and complaint, every address you have, any gate or community name and your deadline. We confirm the court and paper type, put the tier and price in writing, assign a server who is 18 or older and has no role in the case, and return a signed affidavit. Routine work starts at $130; the SC county price map lists neighbors.

01Local service landscape

Islands, Bridges and Tidal Marsh Shape Every Beaufort County Serve

Beaufort County had about 204,433 residents in 2025, spread between the historic city of Beaufort, the town of Port Royal, fast-growing Bluffton and Hilton Head Island. Marsh, rivers and sounds separate many of these places, so the route between two addresses can be longer than a map suggests. Our statewide South Carolina service program treats island, mainland and gated addresses under one written standard, and Mount Pleasant process service picks up defendants who relocate up the coast.

US 278 carries most traffic between I-95, Bluffton and the bridge onto Hilton Head Island, and the island's summer population reportedly swells to about 150,000 as roughly 2.5 million visitors pass through each year. Bluffton grew more than 120 percent between 2010 and 2020. Papers addressed in town are often assigned to our Bluffton process servers, and the South Carolina rate lookup by county lists every starting figure.

02Attorneys and law firms

Serving the Firms That File in the 14th Judicial Circuit

Beaufort County matters come from local firms on the islands and in Beaufort, from Charleston and Savannah offices, and from out-of-state counsel whose clients own vacation property here. Common files include contract and collection suits, construction and homeowner association disputes, resort and hospitality claims, real estate matters and family cases. Our South Carolina law firm service program gives counsel one contact for the quote, the attempt history and the affidavit.

We read every file for local complications before an attempt: an owner who lives in another state most of the year, a timeshare or rental unit with no full-time occupant, or a company whose registered agent sits in Columbia. Under SCRCP 12(a), the defendant generally has 30 days after service to answer, so the affidavit goes out quickly. Counsel balancing several states can review the eight-state service pricing map before assigning work.

03Evasive and hard-to-serve

Gated Plantations, Seasonal Owners and Unanswered Doors

About 70 percent of Hilton Head Island reportedly lies inside gated communities such as Sea Pines, Hilton Head Plantation, Palmetto Dunes, Shipyard and Port Royal Plantation. A server cannot simply drive to the door, so we plan gate access in advance with counsel and log any visit where entry is refused. Seasonal owners add another layer, since a beach house may stand empty for months. Our service for evasive defendants explains how attempts are planned.

When the defendant is rarely in the county, the attempt log becomes the case file. Every visit records the date, time, location and what the server saw, including notes from the gatehouse. If counsel concludes the defendant cannot be found in South Carolina after due diligence, S.C. Code 15-9-710 allows publication by court or clerk order on an affidavit. Our Lowcountry guide to service by publication covers the process, and expedited service tiers help with near deadlines.

04Family law, evictions, small claims, subpoenas

Family Court, Rentals, Magistrate Claims and Witness Subpoenas

Domestic cases are heard by the Beaufort County Family Court, reported on the first floor of the Ribaut Road courthouse. The summons and complaint are served under SCRCP 4 like any civil case, and a spouse who agrees can sign an Acceptance of Service. Family court rules to show cause and protective orders go through the sheriff, law enforcement or a court-designated person, so we do not treat them as routine. Our overview of serving divorce papers in South Carolina sets out the steps.

Short-term and long-term rentals generate many landlord disputes here. The county's Bluffton magistrate page says eviction papers are processed and served by a sheriff's deputy, and only a constable or deputy sheriff carries out a writ of ejectment. We therefore do not serve the rule to vacate unless a court confirms private service is accepted, and we never post or execute a writ. We do serve summonses for unpaid rent or damage, magistrate claims up to $7,500 and Rule 45 subpoenas. See our landlord and tenant papers page.

05Documentation and challenges

Proof of Service That Stands Up in Beaufort County Courts

South Carolina distinguishes between a sheriff's certificate and a private server's affidavit. SCRCP 4(g) asks the proof to give the date, time and place of service and the name and address of the person served, or a description if the name is unknown. We write each Beaufort County affidavit against that list and send it promptly, so counsel has it well before the answer period closes. Under Rule 4(g), a failure to file proof does not by itself undo valid service.

Island serves raise their own record questions, so our notes cover the gate used, any security officer's response, the unit or villa number and who answered the door. If papers are left with a resident at the defendant's dwelling, the affidavit explains how residence and suitable age and discretion were confirmed. A disputed serve can be raised through Delator's contact desk, and the Delator Group company profile explains who reviews the record.

06South Carolina service rules

Plain-English Service Rules for a Beaufort County Case

Under SCRCP 4(c), the sheriff, a deputy, or anyone at least 18 who is not a party and not an attorney in the case may serve a summons. All other process, including orders, rules and writs, is generally reserved for the sheriff, another officer or a person the court designates, and we check with the issuing court before accepting any of it. No South Carolina statute creates a statewide license for private servers, so none is claimed here. Our rundown of who may serve South Carolina papers has the rule text.

An individual may be served personally, through a resident of suitable age and discretion at the home, or through an authorized agent. A summons may also travel by restricted-delivery certified mail or a qualifying commercial carrier, but those routes support a default only when the defendant signed. Sunday service is permitted except on someone going to, attending or leaving a religious service, under S.C. Code 15-9-17. This is general information, not legal advice; our guide to serving legal papers in South Carolina has more.

07A Beaufort County angle

Serving Papers Around Parris Island and MCAS Beaufort

Two Marine Corps installations sit in Beaufort County. Marine Corps Recruit Depot Parris Island lies within Port Royal, about five miles south of Beaufort, and trains roughly 17,000 recruits a year. Marine Corps Air Station Beaufort, home to F-35B squadrons, is about three miles northwest of downtown. Service on either base depends on that installation's access rules, so we coordinate with counsel and often look first at an off-base home or other location. Defendants with civilian jobs nearby may also be reached through our Hilton Head Island process servers.

Military cases carry federal rules as well. Before a default judgment, the Servicemembers Civil Relief Act generally requires an affidavit about the defendant's military status, and a court may need to appoint an attorney and grant a stay of at least 90 days. A servicemember who has transferred out of state may need papers delivered elsewhere, which our service of papers in other states coordinates. Mainland cases near the Colleton line can continue through Dorchester County service.

FAQ

Frequently Asked Questions

Can a private process server deliver papers in Beaufort County?

Yes, for a summons. SCRCP 4(c) allows the sheriff, a deputy, or any person at least 18 who is not a party or an attorney in the case to serve it. Orders, rules to show cause and writs generally go through the sheriff or a court-designated person. Our South Carolina process serving overview explains the background.

How much does a process server in Beaufort County charge?

The published Routine starting rate for Beaufort County is $130. Urgent service is 1.5 times that, Rush is two times and Same Day Rush is three times. Gated communities, seasonal homes or tight deadlines can change the plan, and we raise those issues before any work starts. The final price is always confirmed in writing; see the rate table for all 46 counties.

Can you serve someone inside a gated community on Hilton Head Island?

Often, with planning. Each community sets its own gate rules, so we discuss access with counsel before the first visit and log any attempt where entry is refused. Many defendants can also be reached at work or another location outside the gate. If repeated gate refusals stall the case, the attempt log gives your attorney a record for the next step.

Do you serve eviction papers in Beaufort County?

Not the rule to vacate as a standard service. The county's Bluffton magistrate page says eviction papers are processed and served by a sheriff's deputy, and only a constable or deputy sheriff carries out a writ of ejectment. We serve landlords' other papers, such as summonses in suits for unpaid rent or damages. Our South Carolina ejectment guide has the steps.

Can you serve a Marine stationed at Parris Island or MCAS Beaufort?

Service on a military installation depends on that base's access rules, so we never assume entry and we coordinate with counsel first. An off-base residence or other location is often the practical route. If a default judgment may follow, the Servicemembers Civil Relief Act generally requires an affidavit on military status, and counsel should review those requirements before filing.

What if the defendant only lives in Beaufort County part of the year?

We ask for every address the defendant uses, including any out-of-state home, and plan attempts around known travel. Personal service outside South Carolina is treated as equivalent to publication under S.C. Code 15-9-750 and is complete the day it happens. See how we handle defendants who avoid being served when the person cannot be pinned down.

Where are Beaufort County affidavits filed?

Common Pleas affidavits go to the Clerk of Court at the Beaufort County Courthouse, 102 Ribaut Rd., whose listed phone is (843) 255-5050. Family court is reported in the same building. Federal cases from the Beaufort division are heard in Charleston. We prepare the affidavit for whichever court issued the papers, including courts in other states.

How quickly can papers be served on Hilton Head or in Bluffton?

A Routine job normally sees its first attempt within several days of intake. The faster tiers cost 1.5, 2 and 3 times the Routine figure, though gate access and island traffic can affect Same Day availability. Give us the hearing date and we will say in writing what is realistic. Our South Carolina same day service page has details.

Is Delator Field Services based in Beaufort County?

No. Delator Field Services is part of Delator Group, a Tennessee firm headquartered in Nashville, and it has no office in South Carolina. In Beaufort County we coordinate service through vetted servers suited to the court and the address, with a written price, a logged attempt history and a signed affidavit on every assignment.

What should I send with a Beaufort County request?

Send the filed summons and complaint, the defendant's full name, all known addresses including any out-of-state home, the community or gate name, a description or photo, vehicle details and the deadline. For witness subpoenas, include the courtroom and hearing date. Self-represented filers can begin with serving a magistrate court claim.
