Quick answer
How do I hire a process server in Henry County?
Send us the filed papers, the defendant's addresses and the deadline that matters. We confirm which Henry court issued them and how it treats that paper, write down the tier and price, and log every visit. Henry's published Routine starting rate is $125; the statewide county rate map shows the faster tiers.
01Local service landscape
Four Cities, One Interstate and a Lot of New Rooftops
Henry County has roughly 265,000 residents (2025 estimate) and four incorporated cities: Stockbridge, McDonough, Hampton and Locust Grove. Much of the population lives in subdivisions built off the I-75 corridor and in unincorporated areas between those cities, so addresses can carry a city name that does not match the jurisdiction. We confirm the county before quoting. Our Clayton County process service handles addresses just across the northwest line.
Interstate 75 runs the length of the county, and I-675 joins it near Stockbridge as a cutoff from the south side of Atlanta. Large distribution and logistics buildings line parts of the corridor, while the southern end around Locust Grove and Hampton stays more rural. Our servers plan by section of the corridor so attempts are not wasted sitting in interstate traffic. The Georgia price map by county explains the metro tier.

02Attorneys and law firms
Support for Counsel Filing in McDonough
Henry matters come from local firms near the McDonough square and from Atlanta and out-of-state counsel whose defendants have moved to the south metro. They want the summons and complaint served together, an affidavit that answers every question about date, place and manner, and updates without chasing. We keep one point of contact per file. The attorney service page lists the intake details that save time in Henry.
Business defendants here are often warehouse operators, trucking firms, staffing companies and retailers along I-75. We serve an officer, a managing agent at the Georgia facility or the registered agent, and explain the Secretary of State option when those cannot be served. Our registered agent service page covers how that fallback works and the 30-day answer clock that follows it.
03Evasive and hard-to-serve
Shift Work, New Subdivisions and Repeat No-Answers
Distribution centers run around the clock, and a Henry defendant on an overnight shift may never be home during a normal attempt. We ask about work hours at intake and schedule accordingly. Newer subdivisions add their own problems: house numbers that are not yet posted, streets missing from older maps, and HOA gates. Georgia's gated-community rule in O.C.G.A. 9-11-4(f)(4) governs how a server enters secured neighborhoods, and Delator Group's field standards govern how that entry is recorded.
When a person clearly avoids service, we vary the days and times, try a workplace if counsel approves, and log each attempt with what was observed. Before any of that, you can talk with us about the file. That detail is what a court reviews if counsel later asks about publication or another method. Read our guide to people who avoid service, or see how we handle hard-to-serve defendants in Georgia.
- Overnight warehouse and logistics shifts
- New streets and unposted house numbers
- HOA-gated subdivisions

04Henry family, landlord and claim papers
Family Filings, Magistrate Claims and Dispossessories in Henry
Divorce, custody and support papers in Henry Superior Court follow the Civil Practice Act. Personal service, abode service or a signed acknowledgment of service are the usual paths, and we keep family deliveries low-key. Henry Magistrate Court hears claims of $15,000 or less with an answer generally due in 30 days, and our magistrate claim service page explains how defendants outside Henry are reached by second original.
Henry has many rental homes and apartment communities, so dispossessories come up often. Since July 1, 2025, O.C.G.A. 44-7-51 names an approved process server among those who may serve the summons, but it does not define the term. We ask Henry Magistrate Court about its practice before accepting a dispossessory, and we do not execute writs. See Georgia dispossessory service and our subpoena service.
05Documentation and challenges
A Return the Henry Clerk Can File Without Questions
Georgia proof of service must state the date, place and manner of service, and a private server proves it by affidavit filed where the action is pending. If proof is late, the answer period generally does not start until it is filed. We return the signed affidavit quickly so counsel can file within the five business days O.C.G.A. 9-11-4(h) describes. Our Georgia guide to serving papers explains each requirement.
When service is challenged in Henry, the dispute usually concerns whether an abode recipient lived at the house, whether the correct new-construction address was served, or how diligent the attempts were. Our contemporaneous notes give counsel the facts. If an affidavit needs correcting, Georgia law lets the court permit an amendment unless it would materially prejudice the defendant. Faster Georgia tiers are available if a re-serve must happen before a hearing.
06Georgia service rules
Georgia's Rules on Who Serves Henry County Papers
O.C.G.A. 9-11-4(c) generally permits service by a sheriff or deputy, a marshal, a citizen specially appointed by the court, a non-party adult appointed by the court or as a permanent process server, or a certified process server under 9-11-4.1. Certified servers may serve only in counties whose sheriff accepts their notice of intent, which lasts one year. The Georgia server eligibility guide compares the categories.
DFS does not hold itself out as certified or appointed in Henry or any other Georgia county. Each Henry file gets a server who satisfies the issuing court's requirements for that paper, which we confirm in writing before accepting the serve. Where private service is not accepted for a document, we say so and the papers go to the Sheriff. Our Georgia service overview has the statewide picture.

Neighboring Counties on Every Side
Henry touches Clayton, DeKalb, Rockdale, Newton, Butts and Spalding, and many residents cross at least one of those lines each day. A Stockbridge resident may work in Clayton near the airport, and a Locust Grove family may shop or work toward Griffin. When a defendant has a second address in another county, we coordinate under one written quote. Rockdale County service covers Conyers to the northeast.
Hampton is home to Atlanta Motor Speedway, and large events can affect traffic on the roads around it, so we take event calendars into account when planning attempts nearby. Farther south, longer drives between rural addresses call for tighter sequencing. Defendants who have moved toward Covington are handled through Newton County coverage, and Fayette service covers Fayetteville and Peachtree City beyond Clayton.

FAQ
Frequently Asked Questions
Who can legally serve papers in Henry County?
Georgia generally allows a sheriff or deputy, a marshal, a court-appointed or permanent process server, or a certified server whose notice of intent the Henry Sheriff accepts. Which a court takes can depend on the type of paper. We assign a server who meets the court's requirements for your document and confirm it in writing before accepting the work.
What does a process server in Henry County cost?
Henry's published Routine starting rate is $125. Urgent is one and a half times Routine, Rush is double and Same Day Rush is triple. Your price depends on the address, the deadline and the documents, and it is confirmed in writing before the first attempt. The Henry rate on our county map sits beside its neighbors for comparison.
Can you serve someone who works nights at a warehouse?
Usually, with planning. Tell us the shift if you know it, and we will try the home when the person is most likely there, or the workplace if counsel approves and site rules allow it. Many distribution sites restrict entry, so workplace attempts are arranged with that in mind and recorded in the log.
What if the house number is not posted on a new street?
We confirm the address against county and mapping sources before the visit and note in the affidavit how the residence was identified. If the address is uncertain, we tell counsel before serving, because serving the wrong house invites a challenge. Photos, lot numbers and closing documents from the client help, and the log records which ones were used.
Will you serve a dispossessory filed in Henry?
Only once the Magistrate Court's current practice is confirmed. Georgia's 2025 amendment to O.C.G.A. 44-7-51 lists an approved process server without defining it, so courts differ and we check before quoting. Writs, set-outs and lockouts stay with law enforcement, never with our servers. Our Georgia eviction service guide explains the 7-day answer and the posting-and-mailing fallback.
Can papers be left with someone else at a Henry home?
Usually, if that person resides there and is of suitable age and discretion, under O.C.G.A. 9-11-4(e)(7). A visitor, a contractor or a neighbor watching the house does not qualify. The affidavit describes the recipient and how residence was confirmed, and counsel decides whether abode service fits the case or personal delivery is worth the extra attempts.
How long does a Henry defendant have to answer?
Generally 30 days after service of a superior or state court summons, and 30 days in magistrate civil claims, where answers may be oral or written. A dispossessory answer is due within seven days of service, moving to the next business day if the seventh falls on a weekend or holiday. Your attorney should verify the controlling date for the specific case.
What if a Henry defendant cannot be served at all?
We vary attempts and document each one. If the documented attempts still fall short, counsel may ask the court about publication under O.C.G.A. 9-11-4(f)(1), supported by an affidavit that the defendant cannot be found after due diligence or is concealing himself. Our service by publication guide explains the four newspaper notices, the 60-day answer period and the clerk's mailing step.
Do you serve divorce papers in McDonough and Stockbridge?
Yes. We serve divorce, custody and support papers personally or at the residence, quietly and with identity confirmed. A spouse who is cooperating may simply sign an acknowledgment of service, so no visit is needed. Our Georgia divorce service guide explains each option and the waiting period counsel should confirm.
Can you serve papers from another state on a Henry resident?
Yes. Tell us which rule the issuing court applies to service outside its state, and we match the Henry delivery and affidavit to it. Foreign subpoenas generally must first be submitted to the Henry Superior Court clerk under Georgia's UIDDA. The out-of-state papers page explains what to send so the Henry return fits your court.
