01Local service landscape

A Small River County Where Three States Meet

Boyd County sits at Kentucky's northeastern edge, near the Ohio River and the Big Sandy River, with Wayne County, West Virginia to the east and Lawrence County, Ohio to the northeast. It had an estimated 47,751 residents in 2025 and is part of the Huntington-Ashland metropolitan area. Ashland is the largest city, but the county seat and the courts are in Catlettsburg. Our Kentucky process serving network applies one written standard on both sides of that split.

Only two cities are incorporated, Ashland and Catlettsburg, while Summit and the hills toward Carter and Lawrence counties are unincorporated. Interstate 64 reaches the West Virginia line near Catlettsburg, and US 60 carries local traffic through Summit. Some homes sit on steep lots with narrow access. We review every address before the first attempt, papers addressed in town go to our Ashland process servers, and the Kentucky statewide rate list shows each county's published figure.

Tri-State Counsel Filing in the 32nd Circuit

Boyd County files come from Ashland and Catlettsburg practitioners, from Lexington firms, and often from Huntington, West Virginia and southern Ohio offices whose clients live or work across the river. Common matters include industrial injury and premises claims, contract and collection suits, real estate and family cases. Our service program for Kentucky lawyers gives counsel one contact for the written quote, the attempt log and the completed return.

Before an attempt we check the details that trip up tri-state cases: an Ashland-area mailing address that falls in a neighboring county, a defendant who lives in West Virginia but works in Kentucky, or a company whose registered agent sits in Louisville. A defendant served in Kentucky generally has 20 days to answer under CR 12.01, and proof must be filed within that window under CR 4.03. Firms serving in several states can see figures on our multistate service rate map, and Ohio or West Virginia counsel can review our Kentucky delivery for foreign courts.

03Evasive and hard-to-serve

Steep Lots, Shift Work and Defendants Who Cross the River

Avoidance in Boyd County is often geographic. A defendant can sleep in Kentucky, work in West Virginia and spend weekends in Ohio, and each state has its own rules. Industrial and hospital employers add rotating shifts. We plan attempts around what counsel knows of the person's schedule, including evenings and weekends where approved, and KRS 454.135 gives defendants no Sunday or holiday exemption from Kentucky civil process. Our Kentucky evasive defendant service page explains the method, and Kentucky rush and same day tiers cover a close hearing.

Because a Kentucky summons cannot be left with a household member, the log has to show genuine efforts at the defendant. If counsel concludes the person has left the county to avoid service, is concealing themselves or is a nonresident absent from the state, CR 4.05 allows the clerk to issue a warning order on an affidavit. The clerk appoints the warning order attorney, as our Kentucky constructive service overview explains.

04Family law, evictions, small claims, subpoenas

Divorce, Landlord Matters, Small Claims and Subpoenas in Catlettsburg

Dissolution cases in Boyd County are filed in Circuit Court at the Judicial Center in Catlettsburg. Service on the respondent can be by hand or by the clerk's certified mail, or the respondent can file a waiver of service and entry of appearance. When one spouse has moved across the river, we coordinate with counsel on whether Kentucky's out-of-state service rule fits. The general steps appear in our Kentucky divorce service walkthrough.

For rental property, KRS 383.210 directs the forcible detainer warrant to the sheriff or any constable, who gives at least three days' notice of trial, so we do not serve that notice or carry out warrants of restitution. We can deliver a landlord's pre-suit written notice where the lease allows and serve a separate suit for rent or damage. Small claims up to $2,500 usually go out by the clerk's certified mail or the sheriff. Any person over 18 may serve a subpoena under CR 45.03, and out-of-county witnesses get mileage under KRS 421.015; see our Kentucky witness subpoena page.

05Documentation and challenges

Proof of Service Ready for a Courtroom Dispute

A summons the clerk transfers for delivery under CR 4.01(1)(b) is proved by the endorsed return of the person who delivered it. CR 4.03 asks that proof be filed promptly and before the defendant's response time runs out. We send the completed return quickly so your office can file it at 2805 Louisa Street, and we flag right away if a federal or out-of-state court needs a different format.

Each return is drawn from notes taken at the attempt: arrival time, the address and approach, who answered, and whether the papers were handed over or offered on refusal under CR 4.04(2). For delivery in West Virginia or Ohio under CR 4.04(8), the affidavit must say the server personally knew the person served, and the record explains how. Questions about a specific serve can start through Delator's contact page, and who we are at Delator Group explains the organization behind the record.

06Kentucky service rules

Kentucky's Rules for Serving a Summons in Boyd County

CR 4.01 has the clerk issue the summons when the complaint is filed and, at the plaintiff's direction, send it by certified mail, transfer it to a person other than a mail carrier who is authorized to deliver it, or return it to the filing party to arrange service. Process is addressed to the Boyd County sheriff by default under KRS 454.140, and KRS 454.145 permits a court to appoint someone for a particular paper when good cause exists. Our Kentucky authorized server guide explains each path.

Kentucky has no license or certification for private process servers, and DFS does not claim any server holds one. Before accepting a Boyd County serve, we confirm how the clerk issued the summons and whether private delivery or a court appointment is needed, and where only an officer may act, the papers go to the sheriff. Nonresidents with Kentucky contacts may be served through the Secretary of State under KRS 454.210. This summary is not legal advice; our how-to for serving papers in Kentucky adds detail.

07A Boyd County angle

Refinery Town, Federal Courthouse and Papers From Other States

Catlettsburg's original oil refinery is still operating and is now owned by Marathon Petroleum, and the railroad helped make Ashland the county's largest city. Industrial employers draw contract, injury and employment cases, and businesses are generally served through a registered agent under KRS 14A.4-040 or through an officer, managing agent or chief agent in the county under CR 4.04(5). Our Kentucky company and agent service page covers the details, and the Pike County servers handle papers that move up the Big Sandy.

Papers also arrive from other states. When a West Virginia or Ohio court needs a Kentucky resident served, no Kentucky statute regulates that delivery, so the issuing state's rules govern and we match the affidavit to them. The Eastern District's Ashland courthouse handles federal matters for Boyd and ten other northeastern counties, and a federal prison sits in Summit, where facility procedures control any service on a person in custody. Our guide for papers from other states explains how we coordinate.

FAQ

Frequently Asked Questions

Can a private process server deliver a summons in Boyd County?

CR 4.01 allows the clerk to hand a summons to an authorized person or return it to the plaintiff to arrange delivery, and there is no Kentucky license for private servers. Courts can still differ, so we confirm how the Boyd County clerk issued the summons before the first attempt. Our Kentucky process serving hub has the statewide picture.

How much does a process server in Boyd County cost?

Routine service in Boyd County starts at a published $195. Urgent costs one and a half times that, Rush twice and Same Day Rush three times. Hillside or out-of-state addresses may need more planning, which we raise before any work starts. The final price is always confirmed in writing; Kentucky's published county rates show the comparison.

Are Boyd County papers filed in Ashland or Catlettsburg?

State court papers are filed and returned in Catlettsburg, at the Boyd County Judicial Center, 2805 Louisa Street, even though Ashland is the larger city. Federal matters for the county belong to the Eastern District's Ashland courthouse at 1405 Greenup Avenue. We prepare each return for whichever court issued the papers, including West Virginia and Ohio courts.

Can you serve a Kentucky defendant who lives in West Virginia or Ohio?

Generally yes. Under CR 4.04(8), an individual living outside Kentucky can be reached by the clerk's certified mail or handed the summons by any person over 18. Proof is an affidavit stating the time and place and that the server personally knew the person served. Without an appearance, such service generally does not support a personal judgment, which your attorney should consider.

Can papers be left with a family member?

Not for a Kentucky summons. The Kentucky rule, CR 4.04(2), generally requires the papers to reach the defendant personally, be offered on refusal, or go to an authorized agent. There is no household substitute for a private server. When hand delivery stalls, the log gives counsel what is needed to weigh certified mail through the clerk or a warning order.

Do you serve eviction papers in Boyd County?

Not the forcible detainer notice. Under KRS 383.210 that warrant goes to the sheriff or a constable, which is why the AOC-215 form names them; those officers also execute any warrant of restitution. An Ashland landlord's notice before filing, where the lease allows, and a separate civil suit are both papers we can deliver. Our Kentucky forcible detainer explainer has more.

What happens if the defendant cannot be found?

Each Ashland or Catlettsburg attempt is written into the log with the date, the time and what the server saw. Where a defendant has left the county to avoid service, is concealing themselves, is a nonresident or has an unknown residence, CR 4.05 allows a warning order on an affidavit. The clerk appoints a warning order attorney, who reports within 50 days. See what Kentucky allows when service is avoided.

How fast can papers be served in Ashland?

A Routine Boyd County job generally sees its first attempt within several days. Urgent, Rush and Same Day Rush move faster at 1.5, 2 and 3 times the Routine rate, and Same Day depends on the address, the state and the day. Tell us the hearing or filing date and we will confirm in writing what is realistic before you choose.

Does Delator Field Services have an Ashland office?

No. Delator Field Services belongs to Delator Group, a firm headquartered in Nashville, Tennessee, and it has no office in Kentucky. Boyd County serves are coordinated through servers suited to the issuing court and state, and each comes with a dated attempt log, a written price confirmed before work starts and a signed return when it is finished.

What should I include with a Boyd County request?

Send the issued summons and complaint, the defendant's full name, every known address in Kentucky, West Virginia or Ohio, the employer if known, a description or photo, vehicle details and the deadline. Tell us which court issued the papers. Self-represented filers can start with Kentucky small claims paper delivery so nothing is missing.
