01Local service landscape

What Serving Papers in Lamar County Looks Like

Lamar County was carved out of Marion County in 1904 and covers about 500 square miles. It is growing: the 2025 estimate of roughly 67,400 residents is about 5 percent above the 2020 count. Most of that growth is in the northeast quarter next to Hattiesburg, while the rest of the county stays largely rural. Purvis is the county seat, and Sumrall, Lumberton and part of Hattiesburg are the other municipalities. Each request is priced in writing through our Mississippi service of process team.

The fastest-changing addresses are in the subdivisions west of Hattiesburg, where new streets appear before every map catches up and gated entrances are common. We confirm the street exists, note any gate or guard procedure, and plan the first attempt for a time residents are likely home. If a defendant may have moved, a pre-attempt address check saves a wasted trip, and our price map for every Mississippi county shows Lamar's tier.

02Attorneys and law firms

For Purvis and Hattiesburg Counsel

Many lawyers who practice in Lamar County keep offices in Hattiesburg, a short drive from both the Purvis courthouse and the federal courthouse on North Main Street. Out-of-area firms working a Pine Belt case may need one Lamar County defendant served without traveling. Our support for Mississippi litigators gives a single contact for the quote, the attempt log and the affidavit, which keeps a busy docket organized.

As of 2026, Lamar shares its circuit district with Jefferson Davis, Lawrence, Marion and Pearl River counties, so a circuit case can involve witnesses scattered across five counties. We quote each address separately and coordinate attempts so subpoenas arrive in a sensible order. If the case also needs background research on a witness or party, our Lamar County investigators can work under a separate written scope, with trial consulting available too.

03Evasive and hard-to-serve

Hard-to-Serve Defendants in a Commuter County

Lamar County's newer neighborhoods are full of commuters who leave early and come home late, which makes weekday daytime visits unproductive. Rural properties in the southern and western county bring the opposite problem: long driveways, closed gates and no one answering. Our servers schedule evening and weekend attempts, note vehicles and activity at the house, and keep each entry specific enough to support a diligence argument if the court later asks.

When the log shows a defendant is deliberately avoiding contact, we suggest a focused alternative instead of repeating the same visit. That may be an evasive defendant locate to identify a workplace, or a brief surveillance assignment in Mississippi to learn when the person is reliably present. Each option is optional, separately quoted and started only with written approval. A judgment debtor locate suits collection matters.

04Family law, evictions, small claims, subpoenas

Chancery, Landlord and Subpoena Papers in Lamar County

Family cases in the Lamar County Chancery Court range from divorce and custody to support modifications and contempt. Since July 1, 2026, the summons for those matters appears in M.R.C.P. 4(i) rather than Rule 81(d), and it calls the defendant to a hearing on a date the court sets. A no-fault divorce under Miss. Code Ann. § 93-5-2 generally needs a joint complaint or a defendant personally served or waiving process in writing. See our Mississippi guide to custody investigations for the evidence side.

For rental homes, Miss. Code Ann. § 89-8-13 generally requires a three-day notice for nonpayment and a 14-day notice for other breaches. Justice court eviction summonses go to the constable, and only a sheriff or constable carries out a removal. Small claims up to $3,500 follow the same constable-first path. Subpoenas under M.R.C.P. 45 are served personally with a day's fee and mileage tendered. The Mississippi service of process explainer covers each.

  • Divorce complaints and Rule 4(i) summonses
  • Support and contempt petitions
  • Three-day and 14-day landlord notices
  • Trial and deposition subpoenas

05Documentation and challenges

How We Document a Lamar County Serve

M.R.C.P. 4(f) requires a server who is not a sheriff to prove service by affidavit. We draft ours from notes written during each attempt: the address, the date and time, who answered, what they said, and how the server confirmed identity. For abode service the affidavit names the spouse or family member above the age of sixteen who accepted, gives the relationship they stated and records the first-class mailing. Every job follows Delator's documentation standard.

Subdivision addresses add one more item we record: which county the parcel sits in. A Hattiesburg mailing address in Lamar County is a frequent source of confusion, and an affidavit that lists the wrong county invites a challenge. If service is contested, we provide the log, photographs and mailing receipt, and the server can testify. Concerns about a particular address can be raised through Delator's contact page before the first attempt.

06Mississippi service rules

The Service Rules Behind Every Lamar County Job

M.R.C.P. 4(c)(1) generally allows a summons to be served by anyone who is at least 18 and not a party, and Mississippi does not license servers statewide. A party may instead ask the sheriff in writing, and the sheriff returns the papers within 30 days. Mail service with a sworn acknowledgment is possible under Rule 4(c)(3), but if the form does not come back within 20 days another method is needed. Our guide to hiring field help without a state license explains how to judge a provider.

Abode service is a fallback under Rule 4(d)(1)(B), available only when personal delivery cannot be made with reasonable diligence, and service is complete ten days after the follow-up mailing. Rule 4(h) generally allows 120 days from filing to serve, and Rule 12(a) gives 30 days to answer. These are summaries as of 2026, not advice for a particular case. The Mississippi service and investigations hub covers statewide topics.

07A Lamar County angle

A Hattiesburg Address That Is Really Lamar County

The most populous community in Lamar County is not its county seat. West Hattiesburg, an unincorporated area, holds more people than Purvis, and part of the City of Hattiesburg itself lies inside Lamar. Lumberton, at the other end, reaches into Pearl River County. So the name on an envelope often points to the wrong county, and that affects which justice court and constable apply and which county tier sets the published price.

We resolve that question before anyone drives. Each address is matched to its county, the quote reflects it, and the affidavit states it. Addresses that turn out to be on the Forrest side go to Forrest County process serving, and Coast-bound files go to our Harrison County team. Cases that reach other states run through the multistate service price map.

FAQ

Frequently Asked Questions

Does a process server in Mississippi need a license?

Mississippi has no statewide licensing program for process servers. M.R.C.P. 4(c)(1) generally permits any non-party who is at least 18 to serve a summons, and the sheriff will serve on written request. The court cares about method and proof, so every Lamar County serve follows the written standard on our statewide service page.

What does it cost to serve papers in Purvis or west Hattiesburg?

Routine service in Lamar County has a published starting rate of $125. Urgent service is 1.5 times Routine, Rush is twice and Same Day Rush is three times. The final price depends on the address, the deadline and the documents, and we confirm it in writing before the first attempt so there are no surprises later.

My defendant's address says Hattiesburg. Why does the county matter?

Part of Hattiesburg and all of west Hattiesburg sit in Lamar County, while the rest of the city is in Forrest. The county decides which justice court and constable handle certain papers and which pricing tier applies, and the affidavit should state it correctly. We confirm the parcel's county before the first attempt and note it on the return.

Can you get through a gated subdivision?

We follow each community's entry procedure and never force access. Many gated neighborhoods allow entry through a guard, a call box or a resident, and some defendants are easier to reach at work. Send any gate codes or instructions you have legitimately obtained, and we will plan the attempts around them and record each step in the log.

Who handles Lamar County justice court service?

In Lamar County justice court, the constable is the default server for evictions and small claims. Under Miss. R. Just. Ct. 14(g), the plaintiff may ask in writing for a private server once the constable has failed to return process. Tell us the case number and what has been tried, and we will confirm in writing whether we can take it.

Can you remove a tenant in Lamar County?

No. Under Miss. Code Ann. § 89-8-39, only a sheriff or constable executes a warrant for removal after judgment, and the tenant generally has seven days to vacate unless the court orders otherwise. We confirm with the court whether a private server may deliver your eviction papers before accepting them. Screening help is on our tenant background check page.

Which federal court covers Lamar County?

Lamar County belongs to the Eastern Division of the Southern District of Mississippi, which sits in the Colmer Federal Building in Hattiesburg. A federal summons is served under Federal Rule of Civil Procedure 4, and our affidavit records the method, date, time and place. Firms can see how we handle federal files on our attorney services page.

Do you have an office in Lamar County?

No. Delator Group is a licensed Tennessee firm with headquarters in Nashville and no office in Mississippi. Delator Field Services coordinates Lamar County jobs, and a vetted contract server may complete the delivery under Delator's attempt-log and affidavit standard. More about the company's structure is on the About Delator page.

What if the defendant moved out of the subdivision?

We stop attempts once a house is confirmed vacant and call you. A missing person locate can often find a forwarding residence or new employer quickly. Should a diligent search come up empty, publication under M.R.C.P. 4(c)(4) may be an option, and it requires a sworn showing that the defendant could not be found despite real effort.

What should I include with a Lamar County request?

Send the filed papers, the defendant's full name, every address with subdivision names and lot or unit numbers, gate procedures, a photo or description, vehicles, employer and schedule, and the court deadline. Add the witness fee and mileage for subpoenas. Self-represented filers can review our Mississippi guide to serving legal papers first.
