Quick answer

How do I hire a process server in Bluffton?

Send the filed papers, the defendant's Bluffton address including any community name, and any deadline. Routine Beaufort County service has a published starting rate of $130, and the Beaufort County service page covers Beaufort, Port Royal and Hilton Head Island.

01Local service landscape

A Town That More Than Doubled in a Decade

Bluffton grew by more than 120 percent between 2010 and 2020, reaching 27,716 residents in the 2020 census, and the July 2025 Census estimate put it near 36,800. The town sits on US 278, the road that links Hilton Head Island with Interstate 95, and growth on that scale means new streets and neighborhoods. For a server, that can mean addresses that did not exist a few years ago. Our Beaufort County countywide page covers Bluffton's neighbors.

The courts that handle Bluffton cases are not all in Bluffton. Common Pleas and family cases are filed at the Beaufort County Courthouse on Ribaut Road in Beaufort, while the Bluffton Magistrate hears local civil claims. Beaufort County starts at $130 Routine, Jasper County across the line at $150 and Hampton County at $190. We confirm the county before quoting, and defendants on the island are handled through Hilton Head Island process service. The South Carolina rate map lists every county.

02Attorneys and law firms

For Lowcountry Firms and Counsel Who Never Leave the Office

Bluffton and Hilton Head practices file collection actions, real estate and construction disputes, injury claims and family cases, and firms in Charleston, Columbia or another state may need a Bluffton defendant served without making the trip down US 278. We begin with the papers: the Beaufort County caption, the attached complaint and the defendant's name and community. Our South Carolina attorney service program explains how quotes, attempt updates and affidavits reach your office.

Under SCRCP 4(c), neither a party nor an attorney in the action may serve the summons, but any other adult 18 or older may. Federal cases from Beaufort County fall in the Beaufort division, whose cases are heard in Charleston, so we note the division and response period on any federal summons. Delator Group is a Tennessee firm headquartered in Nashville, and the South Carolina process servers overview explains how DFS coordinates service across all 46 counties.

03Evasive and hard-to-serve

Community Gates, New Streets and Servicemember Defendants

When a defendant lives behind a staffed or coded gate, a server may need a resident's permission or an access arrangement to reach the door. New streets may be missing from older maps, and seasonal residents may be away for months. We do not misrepresent who we are to get through a gate. Instead we time attempts for when the defendant is likely to come and go, ask counsel about any access options, and record what gate staff said. Our hard-to-serve South Carolina defendants page shows the approach.

Beaufort County is home to the Marine Corps Recruit Depot at Parris Island and Marine Corps Air Station Beaufort, so some defendants may be servicemembers. Access to an installation depends on that base's rules, and default judgments against servicemembers raise Servicemembers Civil Relief Act questions for counsel, including the military-status affidavit required by 50 U.S.C. 3931. We note anything relevant we observe. When attempts keep failing, the South Carolina publication guide explains the next option, and Rush service in South Carolina helps with deadlines.

04Family law, landlords and subpoenas

Family Court, Bluffton Magistrate Matters and Subpoenas

Beaufort County divorce, custody and support cases are filed with the Clerk of Court in Beaufort and served under SCRCP 4 like any civil action. A cooperative spouse may sign an Acceptance of Service; otherwise counsel can choose personal delivery, and our server confirms identity, hands over the papers calmly and records the details. A family court rule to show cause is other process, served by the sheriff or a court-designated person. Our divorce and family law service page compares the routes.

Bluffton landlords should know that Beaufort County's own magistrate form page says eviction papers are processed and served by a sheriff's deputy. We therefore do not serve the rule to vacate there, and we never post or carry out a writ of ejectment. We do serve landlords' civil summonses for unpaid rent or damage, and magistrate claims up to $7,500 under SCRMC 6(c), as the magistrate court service page explains. Witnesses are covered by our subpoena service across South Carolina.

  • Bluffton Magistrate civil summonses
  • Trial and deposition subpoenas

05Documentation

Affidavits That Name the Community and the Gate

A private server proves South Carolina service by affidavit, and SCRCP 4(g) requires it to state the date, time and place of service and the name and address of the person served, or a description if the name is unknown. In Bluffton we also record the community name and any gate or access detail, because those facts often explain why an attempt succeeded or failed. For abode service, we describe the resident who received the papers. The guide to serving South Carolina legal papers shows the filing step.

Underneath every affidavit is a dated log of each visit, including the unsuccessful ones and any conversations with gate staff or neighbors. Counsel can rely on it if a defendant later denies service. Outside Tennessee, Delator may assign a vetted server it contracts with, and that server follows the same written documentation standard as every DFS serve. 06South Carolina rules

South Carolina's Service Rules for Beaufort County Cases

For a Beaufort County summons, SCRCP 4(c) names the sheriff, a deputy, or any adult 18 or older who is neither a party nor an attorney in the action. South Carolina does not license private servers, so our Bluffton servers qualify by meeting exactly those conditions. Other court orders and rules generally go through the sheriff or a person the court designates, so we confirm what the court requires before accepting them. The guide on who can serve process in South Carolina explains more.

SCRCP 4(d)(1) allows personal delivery, delivery at the dwelling with a resident of suitable age and discretion, or delivery to an authorized agent. Certified mail with restricted delivery and qualifying commercial carriers are also available for a summons, but a default usually depends on the defendant having signed for it personally. Defendants generally have 30 days to answer under SCRCP 12(a). Your attorney can confirm what applies, and our registered agent service for South Carolina covers businesses.

07Bluffton angle

Where Bluffton Papers Come From: Beaufort, Bluffton and Charleston

A single Bluffton defendant can receive papers from three different places. A Common Pleas or family summons comes from the Clerk of Court on Ribaut Road in Beaufort. A civil claim up to $7,500 may come from the Bluffton Magistrate. A federal summons from the Beaufort division may involve a case heard in Charleston. A process server in Bluffton needs to read the caption first, because each court has its own rule set and its own expectations for proof.

We match the proof to the court. Common Pleas papers follow SCRCP 4(g), a magistrate summons follows SCRMC 6(g), and a federal summons follows Federal Rule 4, which permits state-law methods. If the defendant has moved across the line into Jasper County or up toward Charleston, we tell counsel before the first attempt. Lowcountry neighbors are reached through Summerville process service and the Charleston process server page.

Process Servers Near Bluffton

Bluffton cases often reach up the coast. Defendants in the Summerville area and the rest of that county are handled through Dorchester County service, and those around the port through North Charleston process service. Addresses across the harbor go to the Mount Pleasant process server page, and the rest of the county to the Charleston County process servers. Every one of those jobs follows the same routine as a Bluffton serve: a written price before the first attempt, logged visits and a signed affidavit for the issuing court.

FAQ

Frequently Asked Questions

How much does a process server in Bluffton cost?

Beaufort County's published Routine starting rate is $130. Urgent comes to $195, Rush to $260 and Same Day Rush to $390. Gate access, distance and deadline all feed into the final number, which you receive in writing before we commit a server. Jasper and Hampton counties have their own rates on the South Carolina county rate finder.

Can you get into a gated community?

Only with permission. Some communities let a resident authorize a visitor or have an access process at the gate; others do not. We never misrepresent who we are. If access is refused, we time attempts for when the defendant is likely to leave or arrive and record what gate staff said, so counsel can decide what to try next.

Who can serve a summons in Beaufort County?

SCRCP 4(c) permits service by the sheriff or a deputy, or by an adult at least 18 who has no role in the case as a party or attorney. The state has no licensing program for private servers. Court orders, rules to show cause and writs follow a separate sentence of the rule and generally go through the sheriff or a court designee.

Do you serve Bluffton eviction papers?

No. Beaufort County's Bluffton magistrate form page says eviction papers are processed and served by a sheriff's deputy, and only a constable or deputy sheriff carries out a writ of ejectment. We do serve landlords' civil summonses in suits for unpaid rent or damage. The South Carolina eviction service guide explains the full process.

What if the defendant is in the military?

Service at a military installation depends on that base's access rules, and we do not assume access. Before any default judgment, the Servicemembers Civil Relief Act requires an affidavit on whether the defendant is in military service, and the court may need to appoint an attorney or grant a stay. Counsel handles those questions; we record any relevant facts we observe.

Can papers be left with a family member?

Under SCRCP 4(d)(1), copies may be left at the defendant's dwelling house or usual place of abode with a person of suitable age and discretion who resides there. A family member who lives at the home can qualify; a visiting relative, a housekeeper or gate staff cannot. Our affidavit describes the recipient and how residence was confirmed.

When are subpoena witness fees paid?

SCRCP 45 provides $25 a day plus mileage from the witness's home to the place named in the subpoena, tendered when the witness arrives rather than at service. A non-party deposition subpoena must be issued and served in the county where the witness lives, works or regularly does business in person, which we check first.

Is Sunday service allowed in Bluffton?

Generally yes. South Carolina law, S.C. Code 15-9-17, permits Sunday service of judicial papers but bars serving someone traveling to, attending or leaving a worship service, so a Sunday attempt near a church needs care. We plan Sunday attempts with that limit in mind. The guide for defendants who avoid service discusses timing.

Is certified mail an option for a Bluffton defendant?

SCRCP 4(d)(8) allows restricted-delivery certified or registered mail with a return receipt, and 4(d)(9) allows a qualifying commercial delivery service. Service is effective on delivery, but a default generally requires the defendant's own signature, and seasonal residents may never sign. Many attorneys therefore prefer hand delivery with a detailed affidavit.

Can you serve a Bluffton resident who now lives in Georgia?

Counsel decides the route. SCRCP 4(f) allows service outside South Carolina only when a statute provides, and S.C. Code 15-9-750 treats personal service of the summons out of state as equivalent to publication, complete on the day served. Proof may be by affidavit before a notary under SCRCP 4(h). Details are on our out-of-state papers page, and the Delator Group front page covers the firm.
