Quick answer
How do I hire a process server in Rome, Georgia?
Call or upload the filed papers. We check the issuing court, the Floyd County address and the type of server the court accepts, then send the tier and price in writing. Routine Floyd County service has a published starting rate of $130, and the county rate map for Georgia lists every neighboring county.
01Local service landscape
Serving Papers in Rome and Floyd County
Rome sits where the Etowah and Oostanaula rivers join to form the Coosa, and the city grew across seven hills with the rivers running between them. That geography matters on the ground: two addresses a short distance apart on a map can be separated by a river and a bridge, and some neighborhoods are reached only by a single winding road. Rome had 37,713 residents at the 2020 census and Floyd County about 101,378 in 2025. Our Bartow County process service picks up defendants east toward Cartersville. A defendant farther north is handled by our Whitfield County seat servers instead.
Outside the city, Floyd County runs from Cave Spring in the southwest to Armuchee and the ridges in the north, with Lindale to the south. Rural routes mean a server plans the order of attempts carefully, and house numbering on county roads can be inconsistent. We confirm each address before dispatch so the first trip counts. Defendants who have moved into the suburbs to the southeast are served through our Paulding County servers.
- Downtown Rome and Broad Street
- Hillside neighborhoods divided by the rivers
- Cave Spring, Lindale and Armuchee
- Rural county roads with irregular numbering
02Attorneys and law firms
Rome Service for Floyd County Lawyers and Regional Firms
Rome lawyers handle family, injury, real estate and employment matters, and Atlanta and Chattanooga firms often need a Floyd County defendant served on short notice. Rome's economy rests on manufacturing, healthcare and education, with employers that include Pirelli's North American headquarters, State Mutual Insurance and hospitals such as Atrium Health Floyd and AdventHealth Redmond. Suits against those institutions and their employees call for careful handling. Our law firm service desk keeps one contact on every file.
Company defendants are served under O.C.G.A. 9-11-4(e)(1)(A) through an officer, a managing agent at a Georgia office, or the registered agent. If none can be served, the Secretary of State may act as the corporation's agent once the plaintiff certifies the mailing steps the statute requires. We read the corporate filing before dispatch so the server asks for the right person. The Georgia registered agent service page explains what counsel should send.
03Evasive and hard-to-serve
Hillside Homes, Long Driveways and Defendants Who Avoid Service
Floyd County's ridges and river bottoms produce long gravel driveways, gated farm entrances and homes set far back from the road. A server never climbs a locked gate or ignores a posted property line; instead, attempts are timed for when the defendant is likely to be coming or going, and every visit is logged with what the server saw. Georgia's gated community provision, 9-11-4(f)(4), applies to subdivisions with a guard, not to a single home with its own gate. Our page on hard-to-serve Georgia defendants covers the method.
When someone clearly avoids service, the dated log supports counsel's affidavit of diligence. Georgia courts expect a plaintiff who files near a limitation deadline to show reasonable diligence in serving, and case summaries show conclusory affidavits failing. If the defendant still cannot be found, the court may order publication under 9-11-4(f)(1), as our publication service explainer describes. Our avoided-service guide for Georgia lists what counsel usually files next.
04Family law, evictions and subpoenas
Divorce, Dispossessories, Magistrate Claims and Subpoenas in Floyd County
Floyd County divorce and custody cases are filed with the Superior Court clerk at Government Plaza. A cooperative spouse can sign an acknowledgment of service, while other cases need personal or abode service under the Civil Practice Act. We serve family papers calmly, confirm identity and keep children and workplaces out of it whenever possible. The Georgia divorce papers guide explains each route.
Rome's college and hospital workforce supports a large rental market. Since July 1, 2025, O.C.G.A. 44-7-51(a) allows a dispossessory summons to be served by the sheriff, a constable or an approved process server, but the term is undefined and courts differ. We ask the Floyd Magistrate Court how it handles dispossessories before accepting one and never carry out evictions or writs. Magistrate claims up to $15,000 are served under 15-10-43, explained on our small claims service page. Landlords can also read our dispossessory papers overview.

Floyd County Returns That Answer the Hard Questions
Georgia requires a private server's proof of service to be an affidavit stating the date, place and manner of service, filed within five business days in the court where the case is pending. A defendant's answer period generally does not start until proof is filed, so we return Floyd County affidavits promptly. Each one is backed by a log of every attempt, and the log is available to counsel on request. Our same-day and rush service uses the same record.
If service is challenged, the affidavit and log show exactly who received the papers, where, and why the server believed that person qualified. That precision matters for abode service, where the papers must go to a person of suitable age and discretion who actually lives at the dwelling. Serves outside Tennessee may be carried out by vetted Georgia servers Delator contracts with, each held to Delator's written standard. For witnesses, see our Georgia subpoena delivery page.
06Georgia rules
Georgia Service Rules in Plain Terms for Rome Cases
O.C.G.A. 9-11-4(c) generally permits service by a sheriff or deputy, a court marshal, a citizen specially appointed by the court, a non-party adult appointed by the court as a process server or permanent process server, and a certified process server under 9-11-4.1. A certified server must file a yearly notice of intent with the sheriff of each county and may serve only where that sheriff accepts it. We confirm what Floyd County accepts for your case and never claim a certification or appointment we have not verified. Our Georgia explainer on authorized servers covers each one.
The server is expected to act within five days of receiving the summons and complaint, although a later serve is not invalid for that reason alone. Defendants may also waive service under 9-11-4(d), and a waiving defendant answers 60 days after the request was sent. Service may be made anywhere in Georgia under 9-11-4(g). These are summaries, not legal advice, and the how-to guide for serving papers in Georgia goes further. Defendants abroad have longer periods, and our magistrate claims service notes the second-original rule.
07Rome angle
A Federal Division Seat for Northwest Georgia
Rome is the seat of the Northern District of Georgia's Rome Division, which covers eleven counties stretching from Paulding in the south to Dade, Walker and Catoosa on the Tennessee line. A federal complaint filed there can name defendants in Dalton, Cartersville, Calhoun or Fort Oglethorpe area communities, all within one division. Federal service follows Federal Rule 4, and counsel decides whether to use its own methods or Georgia's. Our Dalton process serving page covers the carpet-industry county to the north.
History also shapes the downtown. After the 1886 flood, when a steamboat reportedly traveled down Broad Street, the city raised the street by about 15 feet during later flood-control work, and the Between the Rivers Historic District now holds many of Rome's older commercial buildings. Upper-floor apartments and offices there have separate street entrances, so we confirm unit access before an attempt. Berry College and Shorter University students add a calendar to plan around, which our Kennesaw service page also addresses for its own university.

FAQ
Frequently Asked Questions
How much does a process server in Rome cost?
Routine service in Floyd County has a published starting rate of $130. Floyd County's Urgent tier is $195, Rush $260 and Same Day $390. The final price depends on the address, deadline and papers, and it is confirmed in writing before the first attempt. The Georgia rate map shows the neighboring counties.
Who can legally serve papers in Floyd County?
Georgia generally allows the sheriff or a deputy, a court marshal, a person the court specially appoints, a court-appointed or permanent process server, or a certified process server where the county sheriff accepts one. We confirm which of these your court will accept for the case before quoting, and your attorney can raise any appointment question with the court.
Do you serve federal papers for the Rome Division?
Yes. The Northern District's Rome Division covers eleven northwest Georgia counties, from Paulding to the Tennessee line. For Rome federal work, Federal Rule 4 governs and counsel chooses the method. The Rome return we prepare is suited to federal filing. For papers issued in another state's court, our out-of-state papers service explains how we match their rules.
Can you serve a dispossessory in Rome?
Only after confirming the Floyd Magistrate Court's practice. Georgia's dispossessory statute now allows an approved process server as well as the sheriff or a constable, but it does not say who approves one. Set-outs and writs in Floyd County are left to law enforcement. The Georgia eviction service guide walks landlords through the process.
How long does a Floyd County defendant have to answer?
In superior court, generally 30 days after service, and the period generally does not start until proof of service is filed. Magistrate civil claims also allow 30 days. A Floyd County dispossessory answer is due seven days after actual service, moving to the next business day when day seven is a weekend or holiday. Counsel should calculate the deadline from our affidavit.
Can a server enter a gated property in Floyd County?
Georgia's gated community rule, 9-11-4(f)(4), lets a person authorized to serve enter a guarded community for a reasonable time after identifying the person to be served and showing identification and evidence of appointment. It does not cover a single home or farm with its own gate. Our servers do not climb gates; they plan attempts for when the defendant comes and goes.
What if the defendant lives across the state line in Tennessee or Alabama?
Georgia law allows service outside the state in some situations, including in place of publication under 9-11-4(f)(1), and the defendant then has 30 days to answer. Delator Field Services is based in Nashville, Tennessee, so Tennessee addresses are coordinated through the same office. The Georgia service for out-of-state matters page explains the paperwork.
What goes into a Rome affidavit of service?
A Rome affidavit states the date, place and manner of service, names or describes the person served and carries the server's signature, as O.C.G.A. 9-11-4(h) requires for private service. We prepare the Rome return so it can be filed within five business days. A log of every attempt supports it, including failed visits, so counsel has a complete account if the serve is questioned.
Can you serve a student at Berry College or Shorter University?
For Rome students, home service comes first. We do not enter restricted campus buildings or classrooms without authorization, and we discuss any on-campus approach with counsel before attempting it. Every off-campus attempt is logged so the record shows what was tried, and divorce and family papers involving students get the same care.
Does Delator Field Services have a Rome office?
No. Delator Field Services, the process serving division of Delator Group, runs Rome files from its Nashville, Tennessee headquarters and keeps no Georgia office. Floyd County serves are coordinated through servers who meet the issuing court's requirements, confirmed in writing before the first attempt, and every file keeps one point of contact from intake to affidavit.
