01Local service landscape

Serving Papers From the Beach to the Pine Woods

Hancock County is Mississippi's westernmost coastal county, bordered by St. Tammany and St. Bernard parishes in Louisiana, Pearl River County to the north and Harrison County to the east. About 14 percent of its 553 square miles is water. The 2025 estimate put the population near 46,900. Bay St. Louis is the county seat, Waveland and Diamondhead are the other cities, and Kiln, Pearlington, Clermont Harbor and Lakeshore are among the unincorporated communities. Every job is quoted in writing through our Mississippi process serving program.

I-10 enters from Louisiana at the East Pearl River, US 90 crosses the Bay St. Louis Bridge, and Highway 603 runs north from the coast. Along the water, one street can hold year-round residences, rentals and second homes, so occupancy is not always obvious. Inland, addresses spread along wooded roads. If an address may be out of date, we suggest a current address confirmation first, and the Mississippi rate map shows Hancock's tier.

  • Waveland and Clermont Harbor
  • Diamondhead north of the bay
  • Kiln, Pearlington and the inland county

02Attorneys and law firms

For Coast Firms and Counsel Filing From Afar

Hancock County shares its chancery and circuit districts with Harrison and Stone counties as of 2026, so Gulfport and Biloxi firms routinely carry Hancock cases. Law offices in New Orleans, Jackson or Mobile may also need a Bay St. Louis defendant served without sending staff. Our Mississippi attorney services keep the written quote, the attempt log and the affidavit with one coordinator, which helps when several coastal addresses are moving at once.

Federal cases from Hancock County belong to the Southern Division in Gulfport, at the Dan M. Russell, Jr. U.S. Courthouse on 15th Street. We note the division and case number on every return. When a matter needs more than delivery, such as witness backgrounds or a claim review, our Hancock County investigators and insurance claim investigations are available under separate written scopes.

03Evasive and hard-to-serve

Reaching Defendants on the Western Coast

Hancock County's hard-to-serve defendants often split time between places: a coastal house and a camp inland, a Mississippi address and a job across the Louisiana line, or a seasonal rental and a permanent home elsewhere. Gated drives and second homes make it easy to ignore a knock. Our servers vary the time and day of each attempt, note vehicles and any activity, and record exactly what they saw so the log shows genuine effort.

If the pattern points to avoidance or a move, we suggest a different approach. An evasive defendant locate can identify a new residence or employer, and a short Mississippi surveillance engagement can confirm when someone is actually home. For a defendant who has moved to Louisiana, we explain in writing what coordination is possible. Each step is optional, quoted separately and started only on written approval. A judgment debtor search fits collection files.

04Family law, evictions, small claims, subpoenas

Family, Rental and Subpoena Papers in Hancock County

Divorce, custody and support cases are filed with the Hancock County Chancery Clerk on Main Street. Effective July 1, 2026, the special summons for custody, support and contempt is in M.R.C.P. 4(i), and it calls the defendant to a hearing on a date the court sets. Mississippi law now generally presumes joint custody, a presumption that strong evidence can rebut, while the Albright factors still guide the chancellor. See our guide to custody investigations in Mississippi for lawful evidence gathering.

Coastal landlords generally serve a three-day written notice for unpaid rent or a 14-day notice for other breaches under Miss. Code Ann. § 89-8-13 before filing. Justice court eviction and small claims summonses go to the constable first, and only a sheriff or constable removes a tenant. Witness subpoenas under M.R.C.P. 45 require personal delivery with one day's fee and mileage tendered. Our Mississippi service of process guide covers each paper.

  • Rule 4(i) summonses and contempt petitions
  • Rent demand and lease breach notices
  • Deposition and trial subpoenas

05Documentation and challenges

Affidavits Prepared for a Challenge

M.R.C.P. 4(f) requires a private server to prove service by affidavit, and we build ours from notes written at each visit. They state the documents, the person served, the address, the date and time, the method and how identity was confirmed. When papers are left at the home, the affidavit identifies the spouse or family member above the age of sixteen who accepted them, the stated relationship and the date of the first-class mailing that completes service ten days later. Every job follows the Delator documentation standard.

Seasonal and second homes are a frequent basis for challenge on the coast: a defendant may argue a beach house was never the usual place of abode. Our log records what the server observed about occupancy, and we keep it with any photographs and the mailing receipt so counsel can respond quickly. If a hearing is scheduled, the server is available to testify. Raise any concern about an address through Delator's contact page before the first attempt.

06Mississippi service rules

Mississippi Service Rules for Coastal Cases

Mississippi does not license process servers statewide, and under M.R.C.P. 4(c)(1) any non-party who is at least 18 may generally serve a summons. The sheriff serves on a party's written request and returns the papers within 30 days. Businesses are generally served through an officer or managing agent, with Miss. Code Ann. § 79-35-13 pointing first to the registered agent. Our guide to hiring help where no Mississippi license exists explains how to judge a provider.

Rule 4(c)(5) generally allows certified mail, return receipt requested and restricted delivery, to a person outside Mississippi, which often matters for a defendant who lives in Louisiana. Rule 4(h) generally allows 120 days to serve, and Rule 12(a) gives 30 days to answer. If an out-of-state court needs discovery from a Hancock County witness, M.R.C.P. 45(a)(3) routes the subpoena through the local clerk. These summaries reflect the rules as of 2026 and are not legal advice. See the Mississippi service and investigations hub.

07A Hancock County angle

The Louisiana Line, Stennis and Storm Season

Hancock County's western edge is the Louisiana state line, and many residents work, shop or keep family across it. A Mississippi case may therefore involve a defendant in St. Tammany Parish, and a Louisiana case may involve a witness in Waveland. The county is also home to the John C. Stennis Space Center, NASA's rocket engine test facility, where a private server cannot simply walk in. We plan off-site service for anyone connected to a secured federal facility.

Weather is the other local factor, for serves and for field investigations in Hancock County alike. Hurricane Katrina made its final landfall in Hancock County in August 2005, and storm surge reached miles inland. When a storm threatens, we pause attempts, tell you immediately and reschedule against the court deadline rather than sending a server into an evacuation. Harrison County files go to our Harrison County team, and Louisiana or other states use the multistate rate map.

FAQ

Frequently Asked Questions

Does a process server need a license in Bay St. Louis?

Mississippi has no state license for process servers. M.R.C.P. 4(c)(1) generally lets any person at least 18 who is not a party serve a summons, and the sheriff serves on written request. Proper method and a detailed affidavit are what protect your case, and that is the standard on our Mississippi service of process overview.

What does it cost to serve papers in Hancock County?

Routine service in Hancock County has a published starting rate of $130. Urgent service is priced at 1.5 times Routine, Rush at twice and Same Day Rush at three times. The final price depends on the address, the deadline and the documents, and it is confirmed in writing before any attempt begins.

The defendant lives in Slidell. Can a Mississippi case still reach them?

Usually there is a route. M.R.C.P. 4(c)(5) generally permits certified mail with return receipt and restricted delivery to a person outside Mississippi, and personal delivery in Louisiana may also be possible. Your attorney chooses the method. Include the Louisiana address with your request, and we will confirm in writing whether we can coordinate personal service there.

What happens to a serve if a hurricane is coming?

We pause attempts when a storm threatens, notify you right away and reschedule around the court deadline. Counsel can see how we report status on our Mississippi law firm services page. If an evacuation or storm damage makes service impossible before the deadline, our dated log helps counsel explain the delay to the court. We never send a server into an active evacuation zone to make a deadline.

Who serves Hancock County justice court papers?

The constable handles justice court service first, including evictions and small claims. Miss. R. Just. Ct. 14(g) opens the door to a private server only after the constable has not returned process and the plaintiff asks in writing. Send the case number and what the constable has done, and we will tell you in writing whether we can assist.

Can you serve someone who works at Stennis Space Center?

We do not enter secured federal facilities without authorization, so service on someone who works at Stennis is planned at their residence or another lawful location. Send any schedule or address information you have, and we will propose an approach in writing. Counsel should confirm whether any special federal procedure applies to the case.

Is a beach house the defendant's usual abode?

Not necessarily. Abode service under M.R.C.P. 4(d)(1)(B) must be made at the defendant's usual place of abode, with a spouse or family member above sixteen, followed by mailing. A seasonal or rental property may not qualify. Our log records occupancy observations, and your attorney decides whether abode service is appropriate.

Does Delator have an office in Bay St. Louis?

No. Delator Group is a licensed Tennessee firm headquartered in Nashville, with no office in Mississippi. Delator Field Services coordinates Hancock County jobs, and a vetted contract server may complete the delivery under Delator's attempt-log and affidavit standard. More about the firm's structure appears on the About Delator Group page.

What if the defendant left the county after a storm?

Displacement after storms is common on the coast. Once an address is confirmed vacant we stop and call you, and a missing person locate can often find a temporary or new residence. When even a diligent search fails, publication under M.R.C.P. 4(c)(4) may be considered, and it needs a sworn showing of the search.

What should a Hancock County request include?

Send the filed papers, the defendant's full name, every address including second homes and any Louisiana address, a photo or description, vehicles, employer and schedule, and the court deadline. Add the witness fee and mileage if it is a subpoena. Self-represented filers should start with our Mississippi guide on how service works.
