Quick answer
What should witness background checks in Idaho cover?
They should identify felony convictions that may be usable under Idaho Rule of Evidence 609, civil cases and prior statements bearing on credibility, relationships that suggest bias, and for experts, credentials and past testimony. Many cases also need the witness located and served. Our Idaho attorney support page explains engagement terms, and the Boise litigation team handles in-person pulls.
01Impeachment research
How Idaho Rule of Evidence 609 Shapes Conviction Research
Idaho's version of Rule 609 is narrower than many lawyers expect. It allows impeachment only with felony convictions, and only after the court holds a hearing outside the jury's presence and finds that the conviction bears on truthfulness and that its probative value outweighs unfair prejudice. The circumstances of the crime are not admissible. That means our research must answer precise questions: was the case a felony, what was the conviction, when did confinement end and how was the judgment entered. Our felony defense investigators build the record around those elements.
Two Idaho features need extra care. A withheld judgment, which Idaho courts use often, cannot be used as a conviction under the rule, so a case that looks like a felony conviction in an index may not qualify at all. And convictions more than ten years old, measured from the conviction or release from confinement, whichever is later, come in only if their value substantially outweighs prejudice and written notice is given. We pull the judgment and sentencing documents to settle both points, which our misdemeanor defense team also relies on when a witness has mixed charges.
- Felony convictions only
- Hearing outside the jury's presence
- Withheld judgments do not count
- Ten-year limit with written notice
02Where the records are
Idaho Court Records, the State Repository and Certified Copies
Idaho's public court indexes reach all 44 counties, generally from 1995 forward, through the iCourt Portal and the older Data Repository. Because public entries omit addresses and identification numbers, we tie each hit to the witness through at least two identifiers before reporting it. Older cases and the judgment documents needed for Rule 609 come from the clerk in the county where the case was filed. Our Nampa investigators and Pocatello team handle many of those clerk requests in person.
The Idaho State Police repository holds Idaho arrests supported by fingerprints, and ISP lists a $20 name-based check and a $25 fingerprint-based check. The repository covers Idaho only and keeps dismissed charges with the dismissal noted, so it supplements court research rather than replacing it. For witnesses who lived elsewhere, we search each prior state's courts, including South Dakota and other states in our network. Certified copies for trial are ordered once counsel decides what to use, and our basic remote check methods supply the identity matching.
03Bias and motive
Relationships, Employment and Reasons to Shade Testimony
Bias often matters more than a criminal record. We look for relationships between a witness and the parties: shared employers, business entities registered together through the Idaho Secretary of State, property co-ownership, family ties and prior lawsuits between them. A witness who sued the defendant five years ago, or who works for a company that benefits from the outcome, has a reason to lean. Public posts can show friendships or grudges the witness will not mention in a deposition. Our corporate collusion investigators use the same mapping techniques in business cases.
Cooperating witnesses and informants in criminal cases require a different approach. Defense teams need to know about prior cases the witness had dismissed or reduced, pending charges that create pressure and any history of cooperation. We research the public side of that history and help counsel frame discovery requests for the rest. Since October 2024, trial-level public defense has been run by the State Public Defender, and appointed lawyers can request this work through our court-appointed defense support.
- Shared employers, entities and property
- Prior lawsuits between witness and party
- Public posts showing ties or grudges
- Informant benefits and pending charges
04Experts
Vetting Retained and Opposing Expert Witnesses
An expert's credibility can decide a case, and a hidden problem found by the other side can sink it. For experts you plan to retain, we verify degrees directly with schools, confirm licenses and discipline through the issuing board, and check professional memberships and claimed positions. Idaho's Division of Occupational and Professional Licenses oversees 42 boards and commissions, so most experts holding an Idaho license can be checked there, and out-of-state experts are checked with their home boards. Our investigative consulting group coordinates that review.
For opposing experts, the focus shifts to consistency. We gather prior reported testimony, published articles, conference presentations and public statements, then flag positions that conflict with the opinion in your case. We also look for disciplinary history, assets and business interests tied to the case, lawsuits against the expert and any financial relationship with the party who retained them. Idaho courts handle many agricultural, construction and medical cases, and our Idaho insurance investigations team often helps vet the experts who appear in them.
05Testing perception
Testing What an Eyewitness Could Actually See
Eyewitness accounts can be tested against the scene itself. We visit the location at the same time of day and season, measure distances and sight lines, photograph obstructions and record lighting conditions. In Idaho, that work has to account for real conditions: early winter darkness in the north, glare off snow, dust on rural roads and the time-zone line that makes a 6 p.m. event in Lewiston an hour earlier than one in Boise. Our Lewiston investigators know how that shift confuses timelines.
Scene work stays on public property or land where we have permission. Idaho Code § 18-7008 makes entering or remaining on another person's property without permission a crime in many circumstances, including unfenced land posted with signs or orange paint, so we confirm access before stepping off the road. For motor vehicle cases, we also gather public information on road design and traffic controls. Our hit-and-run investigators bring the same discipline to crash scenes.
06Finding and serving
Locating Witnesses and Serving Subpoenas Under I.R.C.P. 45
A witness who cannot be found cannot testify. Our locate specialists use public records, address histories and interviews with people willing to help to find witnesses who moved, changed phones or left the state, and we confirm a current address before service is attempted. Panhandle witnesses often move to Spokane, and eastern Idaho witnesses to Utah or Wyoming. Our Idaho skip tracing team handles most of these searches, and our Coeur d'Alene staff work the Washington side.
Under Idaho Rule of Civil Procedure 45, any person who is at least 18 and not a party may serve a subpoena by delivering a copy to the named person, and one day's attendance fee and mileage must generally be tendered if requested. Hearing and trial subpoenas may be served anywhere in Idaho, while a resident generally can be required to attend a deposition only in the county where they live, work or do business. Delator Field Services serves subpoenas with documented attempts and a signed affidavit, and our Idaho process serving page lists published rates.
07Interviews
Witness Interviews and the Lines We Do Not Cross
Interviews often matter more than records. We approach witnesses openly, identify who we work for when asked and never misrepresent our purpose. Represented parties are not contacted directly, and we follow counsel's direction on any witness who may be adverse. Idaho is a one-party consent state under Idaho Code § 18-6702, which generally allows a participant to record their own conversation, but we tell counsel how each interview was documented so nothing surprises anyone at trial. Our Idaho recording law guide explains the statute.
We do not pressure witnesses, offer anything of value for testimony or discourage anyone from cooperating with the other side. Statements are summarized accurately, including the parts that do not help the client, because counsel needs to know the weak points before the other side finds them. Witness background checks in Idaho are only as useful as they are honest, and our written reports keep fact and analysis clearly apart. For witnesses who are also potential jurors' neighbors in small counties, our jury research service coordinates carefully.

How it works
How witness research works
- 01
Identify the witnesses
Counsel lists the witnesses, the issues and the deadlines. We agree in writing on which witnesses get which level of research, the budget and the delivery dates.
- 02
Confirm identity
Each witness is tied to a date of birth and address history before any record search, so convictions and lawsuits belonging to someone else are never reported.
- 03
Research and verify
We search courts, the state repository and public sources, pull judgment documents for Rule 609 questions and map the relationships that may suggest bias toward a party.
- 04
Report, locate and serve
You receive a written report with sources cited. If needed, we locate the witness, conduct approved interviews and serve the subpoena with a signed affidavit.

FAQ
Frequently asked questions
Can a misdemeanor be used to impeach a witness in Idaho?
Generally not under Rule 609. Idaho's rule allows impeachment only with felony convictions, after a hearing outside the jury's presence and a finding that the conviction bears on truthfulness. Misdemeanor history may still matter for other purposes, such as bias or a specific contradiction, which is a question for counsel. We report misdemeanors separately so counsel can decide.
Why does a withheld judgment matter so much?
Idaho's Rule 609 says a withheld judgment cannot be used as a conviction for impeachment. Court indexes may still list a felony charge and a guilty plea, which can look like a conviction at first glance. We pull the judgment documents to confirm how the case was resolved, so counsel does not rely on a record that the court will exclude.
How far back do you search a witness's history?
Idaho electronic court records generally reach back to 1995, and older files are available from county clerks. For impeachment, convictions older than ten years from conviction or release face a stricter test and require written notice. For bias research, relationships matter whenever they formed. We agree on the lookback in the written scope for each witness.
Do you contact the witness during a background check?
Not unless counsel asks us to. Records research does not involve contact, and the witness is not told about it. If counsel wants an interview, we approach the witness openly, never contact represented parties directly and document how the interview was conducted. Our witness interview and defense work follows those rules in every case.
Can you find a witness who left Idaho?
Yes. Many Idaho witnesses move to Washington, Utah, Oregon, Montana or Wyoming. We locate them through public records, field-work skip tracing and lawful interviews, confirm the address and coordinate service under the rules of the state where they now live. For witnesses in Wyoming, our Wyoming coverage page describes how we work there.
Who can serve a subpoena in Idaho?
Under I.R.C.P. 45, any person who is at least 18 and not a party may serve a subpoena by delivering a copy to the named person. If requested, one day's attendance fee and mileage generally must be tendered at service. Delator Field Services handles service with documented attempts and an affidavit, and our guide to serving legal papers in Idaho explains the basics.
Does Delator have an Idaho investigator license?
The state of Idaho does not license private investigators, though Chubbuck and Coeur d'Alene are examples of cities with local rules for investigators or detective agents, which we check before working inside those limits. Delator Group holds a Tennessee private investigation license and brings that standard to Idaho litigation work. Our investigator vetting guide explains what to ask.
How do you vet an expert's prior testimony?
We gather reported decisions, published articles, presentations and public statements by the expert, then compare their positions with the opinion offered in your case. We also check licenses, discipline and lawsuits. Deposition transcripts held privately by other lawyers are not public, but we can identify the cases where the expert testified so counsel can request transcripts.
Can you check an opposing party's witness list quickly?
Yes, within reason. A basic remote check on each lay witness is often enough for an initial screen, and deeper work follows for the witnesses who matter most. We do not promise turnaround in hours, but we prioritize by trial date and deliver results witness by witness rather than waiting for the full list to finish.
What does witness research cost?
A basic remote check costs $102 per witness. Civil litigation support carries a $1,000 minimum, with additional work at $100 per hour. Criminal defense engagements follow case-based minimums of $750 for a misdemeanor, $1,000 for a single felony and $1,500 for multiple charges. Field-work locates start at $1,000. Every scope and price is confirmed in writing.
