How Eviction Papers Are Served in Kentucky: The Forcible Detainer Process
In Kentucky, the forcible detainer warrant and eviction notice are directed to the sheriff or any constable of the county, and the officer gives the tenant at least three days' notice of the trial. Private servers do not serve that notice or carry out a warrant of restitution. DFS delivers pre-suit notices and papers in related civil cases.

Quick answer
Who serves eviction papers in Kentucky?
KRS 383.210 directs the forcible detainer warrant to the sheriff or any constable of the county where the property is, and the current AOC-215 eviction notice is addressed To the Sheriff or any Constable. The officer gives at least three days' notice of the trial. DFS does not serve that notice; see our Kentucky landlord papers page for what we deliver.

What a Kentucky Forcible Detainer Case Is
Kentucky calls the court eviction process a forcible detainer. The landlord files a sworn complaint, the AOC-216 form, in District Court, the trial court that also hears civil cases of $5,000 or less and small claims. The complaint form itself has no service section, because the statute handles notice to the tenant separately. Anyone handling eviction papers in Kentucky should keep that split in mind: the complaint is filed by the landlord or counsel, and the notice of the trial goes out through an officer. Our Kentucky process serving overview explains how DFS fits around that structure, and our Kentucky process serving for attorneys page covers landlord counsel.
The relevant statutes sit in KRS Chapter 383. KRS 383.210 covers the warrant and notice, KRS 383.215 bars an inquiry against a tenant who was not notified, and KRS 383.245 governs appeals and the warrant of restitution. Localities that adopted the Uniform Residential Landlord and Tenant Act add their own notice rules from KRS 383.500 to .715. A landlord with units in both kinds of places, such as Louisville Metro and a smaller Hardin County city, may face two different notice periods, and our Hardin County process servers see that mix regularly.

Why the Sheriff or a Constable Serves the Eviction Notice
KRS 383.210 directs the warrant to the sheriff or any constable of the county where the property lies and commands the officer to give the defendants at least three days' notice of the time and place of the trial. The current AOC-215 Eviction Notice, revised in October 2025, carries the same instruction and is addressed To the Sheriff or any Constable. Delator Field Services does not serve that notice and does not carry out warrants of restitution. Our guide to Kentucky server rules by paper type lists the other officer-only papers.
The Jefferson County Sheriff's Office lists forcibles among the papers its process unit serves, at $70 per paper from November 1, 2025, payable by check or money order. Smaller counties route the same notice through the sheriff or a constable. Landlords sometimes ask whether a court could appoint a private server under KRS 454.145 instead. No Kentucky court practice of doing that for forcible detainers was found, so we do not suggest it, and our Louisville landlord support focuses on the papers around the case.
- Warrant directed to the sheriff or any constable
- AOC-215 addressed to the same officers
- At least three days' notice of trial
- DFS does not serve this notice

How the Officer Gives Notice, and Why It Differs From a Summons
Under KRS 454.030, if the officer cannot find the tenant at the premises, the officer may explain the notice and leave a copy with a member of the tenant's family over 16 who is at the premises. If no such person is there, the officer posts a copy conspicuously on the premises and mails a copy by regular first-class mail to that address. The AOC-215 return lists the same three outcomes: personal delivery, a family member after the defendant could not be found, or posting plus mail. Landlords using our Lexington process servers for related papers see that return in Fayette District Court files.
That family-member option is specific to the officer's eviction notice. An ordinary civil summons in Kentucky is served under CR 4.04(2) by delivery to the person, offering it on refusal, or delivery to an authorized agent, with no household option. Mixing the two rules can leave a summons defectively served, which is why our Jefferson County process servers never treat a summons like an eviction notice. Under KRS 383.215, the court may not proceed against a tenant who was not notified, and a tenant notified less than three days before trial may get an adjournment. Our Kentucky civil summons guide covers the summons rule.

Pre-Suit Notices: URLTA and Non-URLTA Areas
Before filing, most landlords must give the tenant written notice, and the period for eviction papers in Kentucky depends on where the property is. In localities that adopted URLTA, KRS 383.660(2) lets a landlord terminate if rent stays unpaid seven days after written notice of nonpayment and intent to terminate. Other material noncompliance generally calls for written notice of a termination date at least 14 days after the tenant receives it, and the statute's mention of a cure period should be reviewed with counsel. A repeat violation within six months also carries 14 days' notice.
Outside URLTA areas, KRS 383.195 ends a tenancy at will or by sufferance on one month's written notice to vacate. There is no official statewide list of URLTA localities; a 2015 tenant-advocacy handout named Louisville-Jefferson, Lexington-Fayette, Oldham and Pulaski counties and several Northern Kentucky cities, but that list is dated. DFS can deliver a landlord's pre-suit notice by hand where the lease and law allow and record the date and time of receipt, which helps count the period. Our Oldham County process service and Pulaski County servers handle these deliveries.
- URLTA nonpayment: 7 days after written notice
- URLTA noncompliance: at least 14 days, hedged
- Non-URLTA tenancy at will: one month
- Receipt date documented on delivery

After Judgment: Appeal Window and the Warrant of Restitution
When the District Court rules for the landlord, KRS 383.245 gives the tenant until the seventh day after the finding to appeal. Absent an appeal, a warrant of restitution issues to the sheriff or any constable, ordering the officer to put the landlord back in possession. That step is also an officer's job, and DFS does not take part in it. Set-out timing is a question for the officer's office, and our Hopkinsville process servers handle only the related civil papers in Christian County.
Judgment for possession does not always end the matter. Unpaid rent, damage claims and deposit disputes can lead to separate civil suits, garnishments after a money judgment, or subpoenas in later hearings. Those papers follow the ordinary service rules, and a dated, signed return keeps the record clean. Our Kentucky hard-to-serve service helps when a former tenant has moved and a new address must be served in a separate suit. Rates for that work are published on the Kentucky county rate table.

What Delator Field Services Delivers for Kentucky Landlords
Our part of a landlord's case sits before and around the forcible detainer. We hand-deliver written pre-suit notices where the lease and law allow delivery and record who received them and when. We serve summonses in separate suits for unpaid rent or property damage, using CR 4.04(2) personal delivery for individuals or a registered agent for a company tenant. We deliver subpoenas to witnesses for the hearing under CR 45.03, and post-judgment papers the court allows to be delivered privately. Our Kentucky subpoena service explains witness mileage under KRS 421.015.
Small rent claims of $2,500 or less may go to small claims court, where the Kentucky handbook describes service by the clerk's certified mail or by the sheriff and does not mention private servers. DFS helps there only where the court permits or appoints. Commercial landlords in Northern Kentucky can use our Covington process service for these related suits, and the Kentucky small claims papers page explains the limits.

Tenants on Active Duty Near Fort Knox and Fort Campbell
Kentucky has two large Army posts, and rental markets around them include many servicemember tenants. Fort Knox covers parts of Bullitt, Hardin and Meade counties south of Louisville, and Radcliff sits beside it. Fort Campbell straddles the Kentucky and Tennessee line between Hopkinsville and Clarksville, with most of the post in Tennessee. Our Radcliff process servers and Christian County service coverage work these markets for landlords' related civil papers.
The federal Servicemembers Civil Relief Act matters most at the default stage. Before a default judgment, the court must require an affidavit stating whether the defendant is in military service. If the defendant appears to be serving, no judgment may enter until the court appoints an attorney, and a stay of at least 90 days may be required. Whether papers can be delivered on post depends on each base's access rules. Counsel should handle the SCRA questions, and our Elizabethtown process service team files Hardin County returns at 120 E. Dixie Ave.

FAQ
Frequently asked questions
Can a private process server serve a Kentucky eviction notice?
Generally no. KRS 383.210 directs the forcible detainer warrant to the sheriff or any constable, and the AOC-215 eviction notice is addressed to those officers. No Kentucky court practice of appointing private servers for forcible detainers was found. Delator Field Services does not serve the eviction notice or carry out warrants of restitution, and we will tell you so before taking any job.
How much notice does a tenant get before the eviction trial?
KRS 383.210 requires the officer to give the tenant at least three days' notice of the time and place of the trial. Under KRS 383.215, the court may not proceed against a tenant who was not notified, and a tenant who received less than three days' notice may get an adjournment until the three days have run. Your attorney can confirm the hearing schedule.
Can the officer leave the eviction notice with a family member?
Yes, under KRS 454.030, if the officer cannot find the tenant at the premises. The officer may explain the notice and leave a copy with a member of the tenant's family over 16 at the premises. If nobody qualifies, the officer posts a copy on the premises and mails one by regular first-class mail. That option does not apply to an ordinary civil summons.
What pre-suit notice does a Kentucky landlord give?
It depends on the locality. In URLTA areas, KRS 383.660(2) allows termination if rent remains unpaid seven days after written notice, and other material noncompliance generally needs at least 14 days' written notice. Outside URLTA areas, KRS 383.195 ends a tenancy at will on one month's written notice. Our landlord notice delivery records when the notice was received.
Which Kentucky cities and counties follow URLTA?
There is no official statewide list. KRS 383.500 lets cities, counties and urban-county governments adopt the act only in its entirety. A 2015 tenant-advocacy handout listed Louisville-Jefferson, Lexington-Fayette, Oldham and Pulaski counties and cities including Covington, Newport, Florence, Shelbyville, Georgetown and Barbourville. That list is dated, so confirm the current status with the locality or counsel.
How long does a tenant have to appeal an eviction judgment?
KRS 383.245 sets the appeal deadline at the seventh day after the finding. If no appeal is filed, the court issues a warrant of restitution directed to the sheriff or any constable, who puts the landlord in possession. DFS does not carry out those warrants. Timing questions about set-outs belong with the officer's office and your attorney.
Can DFS serve a lawsuit for unpaid rent?
Yes, when it is a separate civil suit and the clerk issues the summons for private delivery or returns it to the filing party. An individual former tenant is served personally under CR 4.04(2), and a company tenant through its registered agent or an officer. Claims of $2,500 or less often go to small claims, which our small claims service in Kentucky page explains.
How do I get a witness to the eviction hearing?
Use a subpoena. CR 45.03 lets anyone who may serve a summons, or any person over eighteen, deliver a subpoena anywhere in Kentucky, and a witness who lives in another county is allowed mileage at the state-employee rate under KRS 421.015. Our subpoenas for Kentucky hearings page covers the affidavit and the certified statement filed with the court.
Does military service change anything for a tenant defendant?
The Servicemembers Civil Relief Act requires, before any default judgment, an affidavit on whether the defendant is in military service. If the tenant appears to be serving, the court must appoint an attorney before judgment and may need to grant a stay of at least 90 days. Counsel should handle these questions, and our Radcliff and Fort Knox area service covers related civil papers nearby.
What do landlord deliveries cost in Kentucky?
DFS publishes a Routine starting rate for each county, from $125 in Jefferson, Fayette, Kenton and several other metro counties up to $255 in Carlisle County; Hardin County starts at $130 and Warren at $145. Urgent is priced at 1.5 times Routine, Rush at 2 times and Same Day Rush at 3 times. See the Kentucky rate finder by county.
