How Private Investigators Help in Idaho Child Custody Cases
Idaho judges decide custody by the child's best interests under Idaho Code § 32-717, and § 32-717B presumes joint custody unless the evidence shows otherwise. A private investigator helps by lawfully documenting the facts those factors turn on: stability, home conditions, exchanges, substance use and domestic violence, in a report your attorney can use.

Quick answer
How can a private investigator help in an Idaho custody case?
By gathering lawful, verifiable facts tied to the best-interest factors in Idaho Code § 32-717: how exchanges actually go, who lives in each home, whether a parent drives impaired, and whether domestic violence is occurring. The investigator reports to your attorney, who decides what to present. Our Idaho surveillance investigations are the most common starting point.
01The legal standard
Idaho's Best-Interest Factors Under Idaho Code § 32-717
Idaho courts decide custody by asking what serves the child's best interests. Idaho Code § 32-717(1) lists the factors a judge considers: the parents' wishes, the child's wishes, the child's relationships with parents and siblings, the child's adjustment to home, school and community, the character and circumstances of everyone involved, the need for continuity and stability, and domestic violence, whether or not it occurred in the child's presence. The court weighs them all; none decides a case alone.
Those factors tell an investigator what to look for. Adjustment and stability can be shown through school attendance patterns, consistent routines and a settled household. Character and circumstances can turn on who lives in the home, substance use and conduct in public. Domestic violence evidence may come from police reports, protection order files and witness accounts. Child custody investigations in Idaho are most useful when every observation in the report connects to one of those statutory questions.
Custody cases, including divorce, support and modification matters, are generally heard in the magistrate division of the district court in the county where the case is filed. Magistrates see conflicting accounts every week and give weight to specific, dated facts. Our Idaho attorney support team writes reports for that setting, and our investigators in Nampa and across the Treasure Valley handle child custody investigations in Idaho magistrate courts, including those in Canyon and Ada counties.
- Parents' and child's wishes
- Relationships, adjustment and stability
- Character and circumstances of all involved
- Domestic violence, in or out of the child's presence
02The starting point
The Joint Custody Presumption and the Domestic Violence Exception
Idaho Code § 32-717B presumes that joint custody is in the child's best interests unless a parent shows otherwise by a preponderance of the evidence. That means the parent seeking sole custody, or a lopsided schedule, generally carries the burden of proving why the presumption should not apply. Vague concerns rarely carry that burden. Specific, documented facts, gathered lawfully and organized by date, give an attorney something to argue.
The presumption reverses when a parent is found to be a habitual perpetrator of domestic violence, as defined by reference to Idaho's domestic violence statutes. Separately, § 32-717 lists domestic violence as a factor whether or not the child witnessed it. Investigators do not diagnose abuse, but they can locate witnesses, gather public court records, build a timeline from records already on file and track compliance with existing orders. Our stalking and harassment investigations often support those files.
Protection orders interact closely with custody. A petition under Idaho Code § 39-6304 is filed in the magistrate division and must disclose any pending custody or divorce case. Under § 39-6306, a hearing is held within 14 days, and relief can include temporary custody, no-contact terms and stay-away distances such as 1,500 feet, for up to a year. Our Boise private investigators can document violations of those terms.
03Evidence that matters
What Investigators Document in Idaho Custody Cases
Exchanges are the most common assignment. An investigator records arrival times, who brought the child, whether the vehicle had a car seat, and whether the parent appeared impaired, all from public places such as a parking lot or street. Patterns matter more than one bad afternoon, so we log several exchanges before drawing conclusions. A Meridian investigator or one in Idaho Falls can cover exchange points along I-84 or I-15.
Impaired driving with a child is a serious concern. Under Idaho Code § 18-8004, it is unlawful to drive at a 0.08 alcohol concentration or higher, or under the influence of drugs, and a prescription is not a defense. Investigators cannot test anyone, but they can document observable behavior, driving patterns and visits to bars before parenting time, and report what they saw so counsel can decide next steps. If a child is in immediate danger, we call 911.
Household composition is another frequent question. Who actually lives in the home, and does a new partner have a record? Remote background research starts at $102 for a basic check and $300 for a deep dive. Our dating and new partner background checks apply to a co-parent's new partner the same way, and a deep-dive background check can cover a roommate or relative living in the house.
- Exchange timing, punctuality and conduct
- Observable impairment before driving
- Who lives in or frequents the home
- Compliance with existing orders
04Staying lawful
What Investigators Will Not Do in a Custody Case
Custody evidence is only valuable if it is lawful. Delator investigators do not record conversations they are not part of, which can be a felony under Idaho Code § 18-6702, and they do not plant trackers on the other parent's car. Second-degree stalking under § 18-7906 includes maintaining surveillance on a person by electronic means as part of a course of conduct, so covert tracking can backfire on the parent who ordered it. Our Idaho recording law guide explains the eavesdropping rules.
Investigators also stay off private property without permission. Idaho's criminal trespass statute, § 18-7008, treats posted land, including unfenced ground marked with orange paint at corners and access points, as property you have reason to know is off limits. Observation happens from streets, public lots and other places the public may lawfully be. That keeps photographs admissible and keeps the investigator from becoming the story at the hearing.
We are also careful about children themselves. We do not interview a child without counsel's direction, approach a child at school, or use a child to gather information. Judges notice when a parent has pulled a child into the conflict, and it can weigh against that parent under the character and circumstances factor. If you are unsure about a step, ask first through our investigative consulting service.
05When a child is withheld
Custodial Interference, Out-of-State Moves and Locating a Child
Idaho Code § 18-4506 makes it a crime to intentionally take, entice away, keep or withhold a child from a parent or custodian without lawful authority, whether a custody order exists, no order exists yet, or a case has started. It is generally a felony, and a misdemeanor only if the child was not taken out of state and was returned unharmed before arrest. Affirmative defenses include protecting the child from imminent harm and returning the child within 24 hours after a visitation period ends.
If the other parent has kept the child, call law enforcement and your attorney first. Investigators can then help by locating the child through lawful records, social media and field checks, and by documenting the address and caregivers for a court filing. The court may order the defendant to repay reasonable costs of locating the child under § 18-4506. Our Idaho missing child support is built for that situation.
Interstate moves add complexity. Proceedings under the UCCJEA, the uniform law that governs which state decides custody, are among the matters that can be assigned to magistrates under I.C.A.R. 5. Panhandle families may have ties to Washington, and eastern Idaho families to Wyoming or Utah. Location work in those cases often begins with an Idaho skip trace and expands across the line under our out-of-state surveillance service.

How Investigation Evidence Reaches the Magistrate
A custody report should read like a record, not an argument. Ours list each observation by date, time, location and time zone, identify who observed it, attach photographs and video tied to the log, and separate facts from any interpretation. Counsel decides which findings to use, whether to disclose them in discovery, and whether the investigator should testify. We prepare for that testimony and for cross-examination about how each observation was made.
Many custody files also need papers served: a petition, a motion to modify, a subpoena for a witness. Family-law service in Idaho follows I.R.F.L.P. 204, which allows service by an officer or any non-party adult and mirrors the 182-day deadline in the civil rules. Delator Field Services coordinates those serves with logged attempts and a signed affidavit through our Idaho process serving hub, with Ada County service starting at a published $125.
Costs stay predictable when the scope is written down. Investigative work in Idaho is billed at $100 per hour, the same as Tennessee, and the written scope states the number of surveillance days, the exchanges to be covered and the report format you will receive. Our Idaho service pricing page and the Idaho investigator vetting checklist help you compare proposals from different firms fairly and on the same terms.
07Idaho specifics
Long Distances, Two Time Zones and Tribal Jurisdiction
Idaho parents often live far apart. A schedule that sends a child from Coeur d'Alene to Boise means roughly 380 to 390 miles, most of it on US 95, with winter grades at White Bird Hill and Lewiston Hill. North Idaho and the Lewiston area keep Pacific Time while the south runs on Mountain Time, so exchange logs must state the zone. Our Lewiston investigators and Coeur d'Alene team plan around both.
Tribal jurisdiction can matter when a parent or child is a tribal member or lives on reservation land. Idaho is a partial Public Law 280 state, and Idaho Code § 67-5101 assumes state jurisdiction in Indian country for certain subjects, including domestic relations and dependent, neglected and abused children. How that applies to a particular family depends on the people, the land and the case, so we confirm the approach with counsel, and with the tribal court where needed, before any field work.
Military families raise their own logistics. Mountain Home Air Force Base, home of the 366th Fighter Wing, is listed by the Idaho courts as a separate jurisdiction for protection order service, and access to the installation requires coordination with base authorities. Our Mountain Home private investigators confirm those requirements before scheduling any work near the base, and exchanges in Elmore County are logged on the same standard used everywhere else in Idaho.

FAQ
Frequently asked questions
How do Idaho courts decide child custody?
By the child's best interests. Idaho Code § 32-717 lists factors including the parents' and child's wishes, the child's relationships, adjustment to home, school and community, the character and circumstances of everyone involved, the need for continuity and stability, and domestic violence. Section 32-717B presumes joint custody is in the child's best interests unless the evidence shows otherwise.
Does Idaho presume joint custody?
Yes. Under Idaho Code § 32-717B, joint custody is presumed to be in the child's best interests unless a parent shows otherwise by a preponderance of the evidence. The presumption reverses if a parent is found to be a habitual perpetrator of domestic violence. Your attorney can explain how the presumption applies to your schedule and what evidence would matter.
Can a private investigator testify in an Idaho custody hearing?
Yes, if your attorney decides to call them. An investigator testifies about what they personally observed and how they recorded it, using the report and photographs as support. Delator investigators prepare for direct and cross-examination with counsel. The decision to disclose or use any finding always rests with your attorney, who knows the rules of the magistrate court.
Can I put a GPS tracker on my ex's car?
Do not do it without legal advice, and generally not at all. Idaho's second-degree stalking statute, § 18-7906, includes maintaining surveillance by electronic means as part of a course of conduct, and a tracker on a car you do not own or control invites that problem. Delator does not place trackers on vehicles the client has no right to. Lawful co-parent surveillance is safer.
Can I record my co-parent during exchanges?
Idaho is generally a one-party consent state under Idaho Code § 18-6702, so a parent can usually record a conversation they are part of. Recording conversations you are not part of, or bugging the other home or car, can be a felony. Whether a recording helps or hurts in court is your attorney's call. Our Idaho recording guide explains the details.
What if the other parent will not return our child?
Call law enforcement and your attorney right away. Idaho Code § 18-4506 makes keeping or withholding a child from a parent or custodian without lawful authority a crime, generally a felony unless the child stayed in Idaho and was returned unharmed before arrest. An investigator can help locate the child and document the address for an emergency filing. See our missing child support.
How much does a custody investigation cost in Idaho?
Delator bills investigative work in Idaho at $100 per hour. Remote background checks on a new partner cost $102 for a basic report or $300 for a deep dive. Surveillance assignments are scoped by the number of exchanges or days covered, with the hours and price confirmed in writing before work starts. Our Idaho pricing page lists published minimums.
Will the other parent find out I hired an investigator?
Surveillance from public places is designed to be discreet, and we do not contact the other parent unless you and your attorney approve. If findings are used in court, they may be disclosed in discovery, and the investigator may testify. Plan with counsel for that possibility from the start, and assume anything you send in writing may eventually be seen.
Can investigators help if the other parent moved out of Idaho?
Yes. Location work can begin with records research and expand into field work in Washington, Wyoming, Utah or other states under one written scope. Which state's court decides custody is governed by the UCCJEA, and those questions belong with your attorney. Our out-of-state infidelity and relocation work uses the same reporting standard.
Do custody investigations work differently on reservation land?
They can. Idaho is a partial Public Law 280 state, and Idaho Code § 67-5101 assumes state jurisdiction in Indian country for some subjects, including domestic relations. How that applies to a particular family depends on the people, the land status and the matter. Delator confirms the approach with counsel, and with the tribal court where needed, before any field work.
