01Local service landscape

Serving Papers in a Consolidated City and County

Denver is both a city and a county, with an estimated 740,000 residents in 2025, so one boundary decides which court, which sheriff and which rate apply. That boundary is irregular. A house on one side of Yale Avenue or Sheridan Boulevard can sit in Denver while the house across the street is in Arapahoe or Jefferson County. We confirm the jurisdiction of every address before scheduling, and papers that turn out to belong next door are routed to Aurora process serving or service in Lakewood.

Most Denver serves are short drives, but the city has its own obstacles: high-rise apartments with controlled lobbies, condo towers in LoDo and Cherry Creek, scattered townhome rows in Central Park and Green Valley Ranch, and heavy traffic on I-25 and I-70 at commute hours. Servers plan routes around access, not just distance. When a building manager will not let a server in, the attempt log says so, and our Denver investigators can confirm whether the defendant still lives there.

  • One consolidated city and county jurisdiction
  • Controlled-access towers and condo lobbies
  • Irregular borders with Arapahoe, Jefferson and Adams
  • Commute-hour traffic on I-25 and I-70

Support for Downtown Firms and Counsel Filing From Out of State

Denver concentrates more courts in a few blocks than anywhere else in Colorado. The City and County Building, the Lindsey-Flanigan Courthouse, the Arraj federal courthouse, the bankruptcy court at the Custom House and the Tenth Circuit's Byron White Courthouse on Stout Street all sit downtown. Firms send us commercial collection suits, construction and employment claims, insurance coverage disputes and federal complaints, and Delator's attorney services in Colorado keep the quote, the attempts and the return under one coordinator.

Out-of-state counsel often need a single Denver defendant served on a federal or foreign-state case. We read the papers before scheduling, because a federal summons, a Colorado district court summons and a deposition subpoena follow different rules, and we flag problems early, such as an entity whose registered agent changed or a defendant who now lives in Douglas County. When a witness has to be found first, witness background research and lost contact locates can run alongside the serve.

03Evasive and hard-to-serve

Shift Workers, Airport Crews and Defendants Who Will Not Answer

Denver International Airport handled a record 82.4 million passengers in 2025, and the airlines, concessions and contractors there employ thousands of people on rotating shifts. Hospital staff, restaurant workers and construction crews downtown keep similarly uneven hours. Servers try early mornings, evenings and weekends, record each visit and its result, and note when a doorman refuses entry or a neighbor says the person moved.

Some defendants simply avoid the door. They stop answering, park elsewhere or stay with friends in another county. When routine attempts stall, a Delator investigator can take over the search through locating evasive parties in Colorado. If the person still cannot be served, the diligence record becomes the backbone of a motion for substituted service under C.R.C.P. 4(f), and debtor locates help collection counsel find a current address before judgment.

04Family law, evictions and subpoenas

Domestic Relations, FED, Small Claims and Subpoena Service in Denver

Divorce and parenting-time cases in Denver are generally filed in Denver District Court. Under C.R.S. 14-10-107, the respondent generally must be personally served unless they join the petition or waive service, and the automatic temporary injunction binds the respondent once served, which is why we record the exact time of delivery. The 91-day waiting period also generally runs from service, not filing. Parenting-time investigations in Colorado explain what else counsel may need, and tracing marital assets covers financial disputes.

Denver County Court hears most evictions. A forcible entry and detainer summons generally must be served personally, or posted on the premises by a qualified server after diligent effort with the plaintiff mailing a copy, at least seven days before the appearance date. Only the sheriff executes a writ of restitution, and Delator never performs removals. Small claims papers must reach the defendant at least 15 days before trial, and tenant screening can prevent the next case.

  • Petitions for dissolution and parenting time
  • FED summonses served or posted on time
  • Small claims notices at least 15 days before trial
  • Deposition and trial subpoenas with mileage

What a Denver Return of Service Shows if It Is Challenged

Colorado lets a private server prove service with a sworn or unsworn declaration stating the date, place and manner of delivery, and the Judicial Branch's JDF 98 Affidavit of Service is the usual form. Our Denver returns follow that form and rest on a field log of every attempt, including failed ones, with the address, the time and what the server observed. Serves may be carried out by vetted servers Delator contracts with, all held to the same written standard.

If a defendant later claims they were never served, the record answers the question. It shows whether the papers went to the person, to a family member at least 18 at the home, to a listed workplace contact, or were left in a conspicuous place after a refusal under C.R.C.P. 4(k). Counsel can request the notes at any time. When a service dispute grows into a factual fight, investigative consulting for counsel and criminal defense investigations can take it further.

06Colorado rules

Colorado Service Rules That Apply in Denver

Process servers in Colorado are not licensed by the state. Under C.R.C.P. 4(d), papers can generally be served by any person 18 or older who is not a party. Personal delivery is the default, but C.R.C.P. 4(e)(1) also allows leaving the papers at the person's usual home with a family member 18 or older, or at the usual workplace with a supervisor, secretary, administrative assistant, bookkeeper, human resources representative or managing agent. The statewide Colorado service overview and a step-by-step serving guide cover the rest.

Timing matters. If a defendant is not served within 63 days after the complaint is filed, C.R.C.P. 4(m) generally requires dismissal without prejudice or an order setting a new deadline. Once served, a defendant generally has 21 days to answer, or 35 days if served outside Colorado or by publication. County court cases follow the parallel C.R.C.P. 304. These are summaries, not legal advice, and what a PI may lawfully do in Colorado explains the limits on field work.

Private Service Next to the Denver Sheriff's Civil Unit

The Denver Sheriff Department's Civil Unit serves papers only inside the City and County of Denver. It asks for a complete address, including direction, unit number and any access code, and papers with incomplete addresses can come back unserved. It also asks filers for the person's age, workplace, best time, vehicle and physical description. Partial refunds for unsuccessful service are mailed by the Denver Auditor's Office weeks after the return. A private server is an alternative when a filer wants more attempts or varied hours.

Denver is also the seat of state government, so many cases name state agencies or officers. Under C.R.C.P. 4(e), papers against the State are generally delivered to the Attorney General, and papers against a state officer or agency go to that officer or agency head plus the Attorney General. Counsel should confirm each recipient. Related claims against facilities are handled through nursing home abuse investigations, and the Colorado investigations overview describes the firm's wider work.

FAQ

Frequently Asked Questions

Does a process server in Denver need a license?

No. Colorado issues no process server license, and C.R.C.P. 4(d) generally lets any person at least 18 who is not a party serve a summons. That makes vetting your server's documentation more important. Delator Field Services applies one written standard to every Denver serve, and how to vet a provider now that Colorado has no PI license covers the questions to ask.

How much does it cost to serve papers in Denver?

Routine service in the City and County of Denver has a published starting rate of $125. In Denver, Urgent begins at $188, Rush at $250 and Same Day Rush at $375. The final price depends on the address, the deadline and the number of people served, and it is confirmed in writing before the first attempt.

Can papers be left with a roommate in a Denver apartment?

Usually not under the abode rule. C.R.C.P. 4(e)(1) generally allows papers to be left at the usual place of abode with a member of the person's family who is 18 or older, so an unrelated roommate does not normally qualify. Workplace service on a listed contact is another option. If neither works, counsel can ask the court for substituted service under C.R.C.P. 4(f).

Which Denver court do I file the affidavit with?

With the court that issued the papers. Denver District Court civil and domestic filings go to the clerk at 1437 Bannock Street, Denver County Court matters to the county court in the same building, and federal cases to the clerk at the Arraj Courthouse. Probate and juvenile cases have their own courts. The issuing court is printed on our affidavit.

What if the defendant refuses to take the papers?

Under C.R.C.P. 4(k), service is generally valid if the server identifies the person and the documents, offers delivery, and leaves a copy in a conspicuous place after the refusal. The JDF 98 affidavit has a box for that manner of service. Our server records what was said and where the papers were left so the court can evaluate it.

How long do I have to serve a Denver defendant?

Under C.R.C.P. 4(m), a defendant generally must be served within 63 days after the complaint is filed, or the court will dismiss without prejudice or set a new deadline. County court rules differ. Send papers as soon as they are filed, and use Denver missing person resources if the defendant's whereabouts are unknown.

Can you serve someone at work in downtown Denver?

Yes, when building security allows a visitor to reach the person. C.R.C.P. 4(e)(1) also generally permits leaving the papers with the person's supervisor, secretary, administrative assistant, bookkeeper, human resources representative or managing agent at the usual workplace. We stay polite, avoid scenes and record exactly who accepted the papers. Employers worried about the reverse problem can ask about workplace investigations.

How do I serve a Colorado company headquartered in Denver?

Usually through its registered agent listed with the Colorado Secretary of State, or an officer or manager. If the agent cannot be found with reasonable diligence, C.R.S. 7-90-704 generally allows registered or certified mail to the entity's principal address. It does not make the Secretary of State an agent for service. Business partner background checks are a separate service.

Do you serve papers in Denver neighborhoods near the airport?

Yes. Montbello, Green Valley Ranch and the airport area are inside the City and County of Denver, so Routine service starts at the same $125 published rate. Some nearby addresses actually fall in Adams County or Aurora, so we confirm the jurisdiction before scheduling and quote any change in writing.

Is Delator Group a Denver company?

No. Delator Group is headquartered in Nashville as a licensed Tennessee private investigation firm, and it has no office in Denver. It coordinates service in Denver through vetted servers working to one documentation standard and holds itself to Tennessee's licensing standard in every state where it works. The Colorado service pricing page lists investigative rates.
