01Local service landscape

Serving Papers in Ashland and Across Boyd County

Ashland sits on the south bank of the Ohio River where Kentucky meets Ohio, a short distance from the West Virginia line, and had 21,625 residents in the 2020 census. It is the largest city in Boyd County, home to about 47,700 people, yet the county seat is neighboring Catlettsburg. Boyd Circuit and District Court cases are filed and returned at the Judicial Center on Louisa Street there. Our eastern Kentucky rate map shows how Boyd and its neighbors are priced.

US 23 follows the river through town, US 60 runs east and west, and Kentucky Route 168 becomes Blackburn Avenue in south Ashland. Interstate 64 passes to the south and reaches the West Virginia line near Catlettsburg. Hills and hollows shape how addresses are grouped for attempts, and rural roads toward Cannonsburg and Summit take longer to reach. Addresses in the rest of the county are handled through Boyd County coverage.

Boyd County runs on Eastern Time. Every attempt is scheduled and logged in local time so the return lines up with shift schedules, time cards or other records counsel may compare it with later. Greenup County, just west of Boyd, has its own elected circuit clerk, and Greenup and Carter County pricing is quoted separately when a defendant lives across that line.

02Attorneys and law firms

Process Service for Boyd County and Tri-State Litigators

Ashland firms, Huntington and Ironton firms with Kentucky defendants, and out-of-state counsel all use one intake. Send the filed summons and complaint, any return of non-service, a description of the defendant and your calendar, and we reply with a written quote stating the court, tier and price. Nothing is attempted before you approve it. Process serving support for Kentucky attorneys lists what to include.

Under CR 12.01, a defendant generally has 20 days after service of the summons to answer, and CR 4.02 requires the summons to say so. CR 4.03 calls for proof to be filed promptly and inside that window. When a hearing is near, rush Kentucky process serving can shorten the schedule, and Lexington process service handles related defendants in the Bluegrass. Counsel can confirm how each deadline applies to a specific case.

03Hard-to-serve recipients

When an Ashland Defendant Works Around the Clock

UK King's Daughters, a 465-bed hospital and Ashland's largest employer with more than 4,000 workers, runs around the clock, and many residents work rotating shifts there or at other regional employers. A weekday afternoon knock often misses them. Attempts are spread across early mornings, evenings and weekends, since KRS 454.135 gives defendants no exemption from civil service on Sundays or holidays. At a workplace, we ask for the person at a public entrance or front desk and never enter patient or restricted areas. Hard-to-serve Kentucky defendants explains our logs.

If a defendant moves across the river or out of the county to avoid service, conceals themselves or has been absent from Kentucky for four months, CR 4.05 lets the clerk issue a warning order on an affidavit. The clerk appoints a warning order attorney, who writes to the defendant and reports within 50 days, and the defendant is deemed summoned on the 30th day after entry. Kentucky warning order procedure explains the steps, and your attorney decides whether to use them.

04Family law, evictions, small claims, subpoenas

Family, Eviction, Small Claims and Subpoena Papers in Ashland

Boyd County dissolution and custody cases are filed in Circuit Court at the Catlettsburg Judicial Center. When a respondent will not sign a waiver of service and entry of appearance, the petition must be handed to them personally or offered on refusal. If the other spouse now lives in Ohio or West Virginia, CR 4.04(8) may allow delivery there. Kentucky dissolution papers service describes both approaches, and serving divorce papers under Kentucky rules covers waiver and mail as well.

Kentucky forcible detainer warrants are directed to the sheriff or a constable under KRS 383.210, and the current AOC-215 notice is addressed to them. We do not serve that notice or carry out warrants of restitution. We can deliver a landlord's written pre-suit notice where the lease allows and serve a separate suit for unpaid rent or damages. Kentucky eviction-related service explains what we do and do not handle.

In small claims, which cap at $2,500, the clerk's certified mail or the sheriff is the usual route, and we step in only if the court permits. Any person over 18 may serve a subpoena under CR 45.03, and Boyd County subpoena service comes back with an endorsed affidavit and a note about KRS 421.015 mileage for witnesses who live in a different county.

05Documentation

Returns Built for the Boyd County Clerk

Under CR 4.01(1)(b), when the clerk transfers the summons to an authorized person for delivery, the endorsed return serves as proof. If a court appoints the server under KRS 454.145, the return must be verified by affidavit. Our returns state the date, time, place and manner of delivery, describe the person served and note any refusal and offer. Because the courts are in Catlettsburg, the return is addressed for filing there. The step-by-step Kentucky service guide shows a complete file.

If a defendant claims they were never served, counsel's first answer is the return. Specific times, a physical description, the vehicle present and the words exchanged give the court concrete facts. Unsuccessful attempts are logged in the same detail, since they may support a warning order affidavit. For papers issued in Ohio or West Virginia, the proof is matched to that court's rule, as Kentucky service for out-of-state courts explains.

06Kentucky service rules

Kentucky Law on Who May Serve in Ashland

Under CR 4.01, the clerk issues the summons and, as the plaintiff directs, mails it by certified mail, transfers it to a person other than a mail carrier who is authorized to deliver it, or returns it to the filing party to arrange service. The sheriff receives process under KRS 454.140, and KRS 454.145 lets a court appoint a specific person for a particular paper when there is good cause. Kentucky does not license private process servers, which the Kentucky guide to authorized servers explains.

Delator Field Services holds no Kentucky license, certification or appointment, because there is no state program for one. For each Ashland job, we confirm with the Boyd County clerk or court how the summons will issue and whether private delivery or a special appointment is needed before accepting the papers. Where only an officer may serve a paper, we say so and it goes to the sheriff.

CR 4.04(2) generally requires delivery to the individual personally, offering the papers on refusal, or delivery to an agent authorized by appointment or law. There is no household or abode substitute, so a summons is not left with a spouse, parent, roommate or anyone else who happens to answer the door at the home. Companies are served through an officer, managing agent or registered agents for Kentucky companies.

07Local angle

Three States and a Federal Courthouse

Ashland is a principal city of the Huntington-Ashland metropolitan area, known locally as the Tri-State, which had about 376,000 residents in 2020. People live in one state, work in another and shop in a third, so many papers served here come from Ohio or West Virginia courts. No Kentucky statute governs how an out-of-state summons is served here, so the issuing state's rules control. A process server in Ashland asks for that rule up front, and Pike County process serving covers the coalfield counties to the south.

Ashland also hosts a federal clerk's office at 1405 Greenup Avenue. After the Eastern District stopped holding court in Pikeville at the end of 2025, cases from Johnson, Magoffin and Martin counties moved to the Ashland division, joining Boyd, Carter, Greenup, Lawrence and other northeastern counties. The city began as Poage's Landing in 1786 and took the name Ashland in 1854. Its steel era ended when the former Armco works shut down completely in 2019. Winchester process service covers defendants west along I-64.

FAQ

Frequently Asked Questions

Where is the return filed after an Ashland serve?

With the Boyd County Circuit Court Clerk at the Boyd County Judicial Center, 2805 Louisa Street in Catlettsburg. Ashland is the county's largest city, but the state courts are in Catlettsburg. CR 4.03 calls for prompt filing of proof, within the period the defendant has to respond. Federal returns go to the clerk at 1405 Greenup Avenue in Ashland.

How much does it cost to serve papers in Ashland?

Routine service in Boyd County has a published starting rate of $195. Urgent starts at $293, Rush at $390 and Same Day Rush at $585. The final figure depends on where, what and how soon, and it is confirmed in writing before anyone knocks. The multi-state rate map lets you compare Boyd with nearby counties and states.

Who can serve process in Ashland?

Under CR 4.01, the Boyd County clerk can send the summons by certified mail, transfer it to a person authorized to deliver it, or return it to the filing party to arrange service. The sheriff handles process under KRS 454.140, and on good cause a court may appoint a person for one paper. Because Kentucky has no license for private servers, the clerk's practice is the first thing we confirm.

Can you serve Ohio or West Virginia papers in Ashland?

Yes, when the issuing court allows service outside its state. Kentucky has no statute regulating how an out-of-state summons is served here, so that court's rules govern. Tell us the rule and we match the delivery and proof to it. Foreign subpoenas go first to the Boyd circuit clerk under KRS 421.360, who issues a Kentucky subpoena.

Can you serve a Kentucky summons on someone in Huntington or Ironton?

Generally yes. Under CR 4.04(8), any person over 18 may hand-deliver a Kentucky summons outside the state, except to a defendant who is a minor, of unsound mind or a prisoner. That server must swear to the time and place and to personally knowing the person served. That kind of service without an appearance does not support a personal judgment, so counsel should weigh it first.

Can papers be left with a relative at an Ashland home?

Not for a summons. CR 4.04(2) generally limits service to handing the papers to the individual, offering them on refusal, or delivering them to an authorized agent. There is no household substitute. Leaving papers with a family member is an officer's option for eviction notices under KRS 454.030, which is not work we take.

Can you serve an eviction notice in Ashland?

No. KRS 383.210 sends the forcible detainer warrant to the sheriff or a constable, and today's AOC-215 notice is written to them. We do not deliver that notice, and we never execute a restitution warrant. What we can do is deliver a landlord's written notice before suit and serve any separate civil case, as the Kentucky eviction service guide explains.

Do you serve small claims papers in Boyd County?

Boyd District Court small claims papers generally go out by the clerk's certified mail or through the sheriff, and the state handbook does not mention private servers. If the certified mail is not delivered, ask the clerk which options remain before sending papers our way. Kentucky small claims service explains the limited role we play, and our statewide Kentucky page lists other counties.

What if an Ashland defendant keeps avoiding service?

We vary attempts across days and hours, including weekends, and log each one. If service still fails and the defendant is concealed, has left the county to avoid service or is absent from Kentucky, counsel may consider a warning order under CR 4.05. When a Kentucky defendant avoids service explains the options.

Do you serve subpoenas for Boyd County depositions?

Yes. CR 45.03 authorizes any person over 18 to serve a subpoena throughout Kentucky by giving or offering the witness a copy. Mileage at the state-employee rate is allowed under KRS 421.015 for a witness from another county. Notice generally goes to other parties before a non-trial subpoena is served, so counsel should handle that step first.
