Quick answer
How do I hire a process server in Charleston?
Send us the filed summons and complaint, or the subpoena, with the most current address you have. We check the issuing court, confirm whether the address sits in Charleston or Berkeley County, and send the tier and price in writing. Routine service starts at $125, and our guide to South Carolina process serving explains how DFS works statewide.
01Local service landscape
A Peninsula City Spread Across Rivers, Islands and Two Counties
The City of Charleston is not one compact grid. The historic peninsula sits between the Ashley and Cooper rivers, West Ashley spreads beyond the Westmoreland Bridge, and James Island and Johns Island run south toward the barrier beaches. Daniel Island belongs to the city but lies in Berkeley County. We confirm the county from the street address before routing a serve, and our Charleston County countywide page lists the towns outside city limits, while Berkeley County service covers Daniel Island's home county.
Getting around depends on the bridges, while defendants who relocate to the Midlands are reached by our Columbia process servers. I-26 ends at US 17 on the peninsula, I-526 starts in West Ashley and loops through North Charleston to Daniel Island, and the Ravenel Bridge carries US 17 to Mount Pleasant. A defendant who works downtown and lives on Johns Island can be reached at either end of the day if the route is planned around those crossings. The South Carolina county rate map shows how Charleston compares with Dorchester and Berkeley next door.
- Peninsula, West Ashley, James Island and Johns Island
- Daniel Island sits in Berkeley County
- I-26, I-526 and US 17 shape every route
- Civil returns go to the issuing court's clerk
02Attorneys and law firms
Working With Broad Street Firms and Counsel From Other States
Charleston's law offices cluster within a few blocks of the county clerk at 100 Broad Street and the federal courthouses on Broad and Meeting. They send us collection suits, injury complaints, construction disputes and deposition subpoenas, and firms outside South Carolina often need a Charleston resident or company served before a filing deadline. Our program for South Carolina law firms keeps the written quote, the attempt notes and the affidavit with one DFS contact, and same day service in South Carolina is available when a hearing is close.
We read every packet before dispatch. A Common Pleas summons, a federal summons under Federal Rule 4 and a foreign subpoena reissued by the Charleston clerk under the Uniform Interstate Depositions and Discovery Act each follow a different path. When a defendant has moved to Summerville or a registered agent has changed, we tell counsel before the first attempt rather than after the deadline. Out-of-state firms can review how we handle papers from other states served in South Carolina before sending a file.
03Evasive and hard-to-serve
Port Shifts, Hospitality Hours and Doors That Stay Shut
Much of Charleston works outside a nine-to-five schedule. The Columbus Street and Union Pier terminals sit on the peninsula's Cooper River side, and restaurant and hotel staff downtown often finish after midnight. A defendant on a late shift is rarely home in the afternoon and may be asleep at breakfast, so we time attempts around the hours the client describes. Our notes on defendants who avoid the door explain how that planning works in practice.
When someone refuses to answer, repeating the same visit accomplishes little. We shift attempts to early mornings, evenings and weekends, and S.C. Code 15-9-17 allows Sunday service except on a person going to, attending or returning from a religious service. Each visit is logged with the time, what was seen and who responded. If the defendant still cannot be found, counsel can weigh the options in the guide to defendants who avoid service, including court-ordered publication where the facts support it.
04Family law, landlords and subpoenas
Family Court, Landlord Disputes, Magistrate Claims and Witnesses
Divorce, custody and support cases in Charleston are filed with the county clerk and heard in family court on Broad Street. The summons and complaint are served under SCRCP 4 like any civil action, and many spouses instead sign the Acceptance of Service form, SCCA 400.03. When personal delivery is needed, we handle it discreetly and record who received the papers. Rules to show cause in family court are a different kind of process that goes through the sheriff or a person the court designates, as the South Carolina divorce papers page explains.
Evictions follow their own track. The magistrate issues a rule to vacate or show cause, and the magistrate courts we checked route it through the sheriff's office, so we serve it only where the court confirms private service is accepted and never post or execute a writ of ejectment. We do serve landlords' summonses in suits for rent or damages. Magistrate claims up to $7,500 can be served by any qualifying adult, as our magistrate court claims page describes, and witness papers are covered by subpoena delivery across the state.
- Family court summonses and complaints
- Acceptance of Service (SCCA 400.03) as an alternative
- Landlord suits for rent or damages, not writs
- Magistrate claims up to $7,500
- Witness subpoenas under SCRCP 45
05Documentation
What a Charleston Affidavit of Service Contains
A sheriff proves service by certificate, but a private server proves it by affidavit. SCRCP 4(g) asks that the proof state the date, time and place of service and the name and address of the person served, or a description if the name is unknown. Our Charleston affidavits add the manner of delivery and the attempt history, and the step-by-step South Carolina service guide shows where the proof fits in the case.
If a defendant later says nobody served them, the field record answers the question: the street, the hour, the person who took the papers and a physical description. Outside Tennessee, Delator may assign vetted contract servers, and every one works to the same written documentation standard. Counsel can request the attempt notes at any time. The rule also says that failing to file proof does not undo valid service, but a prompt, complete affidavit avoids the argument entirely. Rates for every county are on our multistate rate map.
06South Carolina rules
Who May Deliver a Summons in Charleston Under South Carolina Law
SCRCP 4(c) splits the work in two. The sheriff, a deputy or any adult of 18 or older who is neither a party nor counsel in the action may deliver a summons. Court orders, rules and writs are treated differently, usually staying with the sheriff or someone the judge names, and we check that requirement before taking any of them. South Carolina has no statewide license for private process servers, a point our explainer on who can serve process in South Carolina covers in more depth.
Rule 4(d)(1) allows personal delivery, delivery at the defendant's dwelling to a resident of suitable age and discretion, or delivery to an authorized agent. A summons may also go by restricted-delivery certified mail under 4(d)(8) or a qualifying commercial delivery service under 4(d)(9), but neither supports a default unless the defendant signed. Each Charleston server we send meets that age and non-party test. These are plain summaries, not legal advice; read more about Delator Group, a Tennessee firm headquartered in Nashville.
07Charleston angle
Daniel Island, the Barrier Islands and the Question of Venue
Charleston's city limits cross a county line, and that small fact causes real confusion. A Daniel Island resident has a Charleston mailing address but lives in Berkeley County, so a non-party deposition subpoena under SCRCP 45(b)(2) must be issued and served in the county where that witness lives, works or regularly does business. We flag the county on intake. When you need a process server in Charleston who checks those details first, the Mount Pleasant process server page shows the same approach across the harbor.
The beach towns raise a different issue. Folly Beach, Sullivan's Island and Isle of Palms are separate municipalities with many seasonal rentals, and abode service only works with someone of suitable age and discretion who actually resides at the dwelling, not a weekend guest. When the person answering the door is a visitor, we note it and try again rather than leave papers with the wrong person. Defendants who have moved inland may be easier to reach through our North Charleston service team.

Charleston papers often cross a river or a county line. Defendants up I-26 near the airport and the port terminals are handled by our North Charleston servers, and addresses farther inland in Dorchester County go through Summerville process service. Papers bound for Berkeley County neighborhoods near the Naval Weapons Station use service in Goose Creek, and Lowcountry addresses to the south fall under Hilton Head Island process service. FAQ
Frequently Asked Questions
Who can serve papers in Charleston?
Under SCRCP 4(c), the sheriff, a deputy, or any person at least 18 who is not a party to or an attorney in the action may serve a summons. Subpoenas may be served by any non-party adult under Rule 45. Orders, writs and rules to show cause generally go to the sheriff or a person the court designates, so we confirm before accepting those papers.
How much does a process server in Charleston cost?
Charleston County's published Routine starting rate is $125, which makes Urgent $188, Rush $250 and Same Day Rush $375. The final figure depends on the address, the document and the deadline, and we put it in writing before a server is assigned. A sheriff's office may charge less per paper, and we will say when that route makes more sense.
Can a Charleston summons be left with a family member?
Yes, in many cases. SCRCP 4(d)(1) allows delivery at the defendant's dwelling house or usual place of abode to a person of suitable age and discretion who resides there. A houseguest, a contractor or a short-term renter does not qualify. Our affidavit records the name or description of the person who received the papers so the court can judge the service.
Do you serve eviction papers in Charleston?
Not the rule to vacate as a routine job. The magistrate courts we checked send it through the sheriff, and only a constable or deputy sheriff carries out a writ of ejectment. We serve the rule only where the court confirms private service is accepted, and we serve landlords' other papers. The South Carolina eviction service guide explains the steps.
How long does a Charleston defendant have to answer?
Under SCRCP 12(a), a defendant generally has 30 days after service of the complaint to answer. Magistrate court uses a similar 30-day period under SCRMC 7(b). The self-represented divorce summons allows 35 days when service is by restricted-delivery certified mail. Your attorney should confirm the exact deadline for your case and court.
Is a Daniel Island address in Charleston County?
No. Daniel Island is part of the City of Charleston but lies in Berkeley County, whose clerk is in Moncks Corner. A case can still be pending in Charleston County, but a non-party deposition subpoena must be issued and served in the county where the witness lives, works or regularly does business. Our Daniel Island and Berkeley County coverage explains more.
What if the Charleston defendant cannot be found?
We report each failed attempt and keep a dated log. If a defendant cannot be found in South Carolina after due diligence, the court or the clerk of common pleas can order service by publication on an affidavit under S.C. Code 15-9-710. A detailed attempt record is the kind of evidence counsel use to show diligence. See how service by publication works.
Can you serve a company at its Charleston office?
Yes. We deliver to the registered agent or to an officer or managing agent named in counsel's papers. Where a South Carolina corporation's agent cannot be reached, S.C. Code 15-9-210(c) lets the court or clerk order certified mail to the corporate secretary instead. An unauthorized foreign corporation may be served through the Secretary of State under 15-9-245.
When do Charleston witnesses get paid for a subpoena?
Under SCRCP 45, a witness receives $25 per day plus mileage from home to the place named in the subpoena, paid when the witness arrives rather than when served. No tender is required for a subpoena issued for the State. Magistrate subpoenas carry a similar daily amount under SCRMC 23(e). Our process service for South Carolina litigators covers witness lists of any size.
Do you serve federal papers in Charleston?
Yes. The District of South Carolina's Charleston Division sits at the Waring Judicial Center, 83 Meeting St., and the courthouse at 85 Broad St. Federal summonses follow Federal Rule 4, which also allows state-law methods. We serve federal papers anywhere in the city and return proof formatted for the federal file. Contact Delator Field Services with the case number to begin.
