Quick answer
How does process serving in Harrison County work?
Send the filed papers, the judicial district on the summons and each address and work schedule you have. We confirm the Harrison County rate and total in writing, assign a vetted server, log each attempt and return a signed affidavit for the Gulfport or Biloxi clerk. Routine service starts at $125, and the rate map for all 82 counties shows the neighbors.
01Local service landscape
Mississippi's Most Populous County, Split Between Gulfport and Biloxi
Harrison County's 2025 estimate of 217,136 residents now edges past Hinds County, making it the most populous county in Mississippi by that count. The county has two judicial districts, with courthouses in Gulfport and Biloxi, and the clerk on the summons tells us where the return belongs. Most addresses sit in a narrow band along the water, while the northern half reaches inland toward Saucier, Lyman and the coastal investigations team for Harrison County when an address needs checking first.
I-10 runs east and west through the county, and I-110 connects US 90 in Biloxi with I-10 in D'Iberville. Shoreline traffic, tourist weekends and bridge crossings over Biloxi Bay can stretch a short drive, so we cluster attempts by area. A Harrison file often has a second stop next door, either in Bay St. Louis and Hancock County or across the bay in Ocean Springs and Jackson County, and we price both in one written quote.

02Attorneys and law firms
Coast Litigation, Federal Filings in Gulfport and Out-of-State Counsel
The coast produces a steady run of premises liability claims, maritime and construction disputes, insurance matters and commercial collection suits, and many of them land in the Southern Division courthouse on 15th Street in Gulfport. Firms in New Orleans, Mobile and Jackson send us defendants who live or work on the coast. Our services for Mississippi law firms keep the quote, the assigned server, the attempt log and the affidavit with one coordinator.
We review each packet before a server goes out. A Second District chancery summons, a county court complaint and a federal summons each carry different expectations, and we flag missing pieces such as a suite number, a company that changed names or a defendant whose last known address was a short-term rental. When a claim turns on what really happened, insurance claim investigations and premises and injury witness checks can run alongside the service work.
03Evasive and hard-to-serve
Casino Shifts, Base Schedules and Short-Term Addresses
Twelve of Mississippi's 26 casinos are on the Gulf Coast, and gaming, hotel and restaurant staff often work nights, weekends and rotating shifts. We ask counsel for any known schedule and set attempts for the hours the person is most likely home. Serving someone at a casino or hotel workplace depends on property security and management, so we do not walk onto a gaming floor uninvited and we note any refusal of access in the log.
Keesler Air Force Base in Biloxi brings transfers, training classes and deployments, and installation access rules control any attempt there. Tourism also leaves defendants in extended-stay hotels, rentals and relatives' homes. When the trail goes cold, locates for people avoiding service and debtor skip tracing on the coast can find a current address, and our attempt log supports a sworn showing if counsel later asks to serve by publication under M.R.C.P. 4(c)(4). Hotel surveillance helps when a stay is the key fact.
04Family law, evictions and subpoenas
Chancery Papers, Coast Evictions and Witness Subpoenas
Harrison County shares its chancery district with Hancock and Stone counties as of 2026, and Stone is scheduled to leave it in 2027. Divorce complaints, custody petitions and contempt motions come to us with the district already set, and a special summons under new M.R.C.P. 4(i) calls the defendant to a hearing on a date the chancellor sets. Military families add complexity, since a service member may be in training or deployed. Our Mississippi custody investigation guide explains how evidence fits a custody case.
Coast rental housing generates frequent eviction filings, and our Mississippi rate map shows the cost. In justice court, the constable serves the summons first, and a private server is used only after the constable has not returned process and the landlord asks in writing. County court eviction filings generally follow Rule 4, and we check the court's practice before taking them on. Physically removing a tenant is left to a sheriff or constable. For subpoenas, one day's attendance fee and mileage are tendered at service, and screening tenants before signing can prevent the next case.
- Divorce and custody papers for Gulfport and Biloxi
- Rule 4(i) special summonses for chancery hearings
- Eviction papers where a private server is allowed
- Trial and deposition subpoenas for coast witnesses

Returns That Name the Right District and Stand Up to Challenge
With clerk offices in both Gulfport and Biloxi, the return has to match the district on the papers, and our affidavits name the court, the district and the case number alongside who was served and how. Under M.R.C.P. 4(f), a server who is not a sheriff proves service by affidavit, and the attempt log behind it shows every visit, including failed ones. Our overview of Mississippi process serving describes that standard statewide.
Challenges to coast service often turn on who answered the door at a crowded rental or a family home. The log records the address, the hour, a description and, for abode service, the relationship and apparent age of the person who accepted the papers. Serves outside Tennessee may be carried out by vetted servers Delator contracts with, all held to the same written standard. If the challenge becomes a contest over facts, investigative consulting for counsel can review the record.
06Mississippi rules
The Rule 4 Basics for a Harrison County Serve
No state agency in Mississippi licenses process servers. Under M.R.C.P. 4(c)(1), any person who is not a party and is at least 18 may generally serve, and the sheriff serves on a party's written request and returns the papers within 30 days. Personal delivery is the default. If it cannot be made with reasonable diligence, papers may be left with a spouse or a family member above the age of sixteen at the usual place of abode, then mailed first-class, with service complete ten days after mailing.
Businesses are served through an officer or a managing, general or authorized agent, and for a registered entity Miss. Code Ann. § 79-35-13 points to the registered agent first. Service generally must be made within 120 days of filing, and the answer is generally due 30 days after service. Treat these as plain-language summaries rather than legal advice. Our Mississippi service of process guide and the page on what investigators may legally do in Mississippi cover the limits in more detail.
07Coast realities
Storms, Evacuations and the Hurricane Hunters' Home Base
Keesler Air Force Base hosts the 403rd Wing's 53rd Weather Reconnaissance Squadron, known as the Hurricane Hunters, which says a lot about life on this coast. When a tropical system threatens, residents leave, businesses close and courts may adjust schedules, so we pause attempts, tell counsel what changed and resume when roads and offices reopen. Defendants who evacuate sometimes do not come back to the same address, and the log notes what the server saw on return.
Storm damage also creates its own litigation, from insurance disputes to contractor claims, and those suits often name out-of-state companies and roofers who left after the work. When a contractor has moved on, contractor and scam investigations and asset searches for collection counsel can show where the company went, and service can follow through a registered agent, the Secretary of State or certified mail outside Mississippi under Rule 4(c)(5).

FAQ
Frequently Asked Questions
Which Harrison County district handles my case?
Harrison County has a First Judicial District based in Gulfport and a Second Judicial District based in Biloxi, each with its own chancery and circuit clerk offices. The district is chosen at filing and appears on the papers. We read it from the summons and make sure the affidavit names it, so the return reaches the correct clerk the first time.
What does process serving in Harrison County cost?
Routine service in Harrison County has a published starting rate of $125, with Urgent at $188, Rush at $250 and Same Day Rush at $375. Additional addresses, a locate or special access arrangements can change the figure, and any change goes into the written quote before the first attempt. You approve the price before any server heads out.
Can you serve someone at a casino where they work?
Sometimes. Whether a server can reach an employee at a casino or hotel depends on property security and management, and we do not walk onto a gaming floor uninvited. More often we schedule attempts at home around the person's shift. Casino operators and their employees work under Gaming Commission regulation, and employee theft investigations for gaming-sector employers are handled separately.
Can papers be served on Keesler Air Force Base?
Installation access rules control any attempt on Keesler Air Force Base, and a civilian server cannot simply drive onto the base. We coordinate with counsel before any attempt and usually look first for an off-base residence or another lawful way to reach the service member. Your attorney can advise on any federal protections that apply to service members in the case.
What happens to service during a hurricane threat?
We pause. When a tropical system threatens the coast, residents evacuate and offices close, so attempts stop until roads and businesses reopen. We tell counsel what changed and how it affects any Rule 4(h) or hearing deadline, then resume with the attempt log showing the gap. A defendant who does not return to the same address can be traced through missing person locates.
Who serves justice court papers in Harrison County?
Harrison County justice court papers go to a constable first under Miss. R. Just. Ct. 14. If the constable does not return them, the clerk may hand the job to the sheriff, or the plaintiff may request a private server in writing; that server must be over 18 and not a party. We take justice court papers only after that written request exists, and small business collection support helps find the defendant first.
Can papers be left with a family member in Gulfport or Biloxi?
Not as a first step. When reasonable diligence has failed to reach the defendant in person, M.R.C.P. 4(d)(1)(B) permits leaving the papers at the defendant's usual home with a spouse or with a willing family member above sixteen, then mailing a copy first-class. Service becomes complete on the tenth day after mailing, and the affidavit records who took the papers and how they are related.
Do you serve federal papers for the Gulfport courthouse?
Yes. Seven coastal and near-coastal counties, Harrison among them, send federal cases to the Dan M. Russell, Jr. U.S. Courthouse in Gulfport. We serve those summonses under Federal Rule 4 and prepare the return for the Gulfport clerk. Defense teams working federal cases on the coast can also use Mississippi criminal defense investigations.
How do I serve a contractor who left the coast?
Start with the company's registration. Under Miss. Code Ann. § 79-35-13, a registered entity is served through its registered agent, then its governors and then the Secretary of State. A person who has moved out of Mississippi can generally be served by certified mail with restricted delivery under Rule 4(c)(5). Corporate collusion investigations help when related companies share owners.
Is Delator Field Services based on the coast?
No. Delator Field Services is the serving arm of Delator Group, a Tennessee-licensed private investigation firm based in Nashville that applies Tennessee's licensing standard in every state where it works. Harrison County serves are carried out by vetted servers held to a single documentation standard, and the price is confirmed in writing before any attempt is made.
