Quick answer

How do I hire a process server in Richmond?

Email the filed papers and the defendant's Madison County address, whether in Richmond, Berea or the countryside. We confirm how the summons issued and which Richmond court building handles the case, then send the tier and price in writing. Routine service starts at $130, and the Madison County service page covers the whole county.

01Local service landscape

Two Cities, One County and Two Court Buildings

Richmond is the Madison County seat and home to Eastern Kentucky University, with about 34,600 residents in 2020. Madison has only two incorporated cities, Richmond and Berea, and the rest of the county is small communities and farmland. Berea has no court location of its own on the kycourts county page, so a Berea defendant's case is still filed and returned in Richmond. Our Berea process service page and the Madison County countywide page cover the south end.

I-75 runs north to south through the county, linking Richmond with Lexington to the north and Berea to the south, and most service routes follow it. A server can reach a downtown Richmond apartment and a farmhouse outside Waco on one planned loop. Madison County runs on Eastern Time, like Lexington. The Kentucky process serving rate map shows Madison's starting rate next to Fayette and Clark.

02Attorneys and law firms

Help for Madison County Counsel and Lexington Practitioners

Madison County shares the 25th Judicial Circuit with Clark County, and many attorneys who file in Richmond also practice in Lexington and Winchester. They send us collection and contract suits, injury complaints, family law petitions and deposition subpoenas, and firms from outside Kentucky often need a Richmond resident or employer served. Our Kentucky attorney service program keeps the written quote, attempt log and return under one contact.

The federal statute still lists Richmond as a place where the Eastern District may hold court, but no clerk's office is listed there, so federal papers in Madison County cases go through the Lexington clerk on Barr Street. We sort state and federal papers before scheduling and flag a defendant who has moved to Clark or Estill County. Winchester process service covers the other half of the 25th Circuit, and the out-of-state papers service page helps firms filing elsewhere.

03Evasive and hard-to-serve

Duplexes, Commuters and Defendants Who Split Their Time

Richmond's rental stock includes many duplexes and small apartment buildings, where the mailbox name and the person at the door often differ. We confirm we are speaking to the named defendant before handing over anything, and we never assume a roommate can accept. Commuters who work in Lexington leave early and return late, so attempts move toward mornings and evenings. Our page on Kentucky defendants who are hard to serve covers that planning.

Some defendants divide their time between a Richmond address and a relative's home in Berea or out in the county. We log every visit, note vehicles and lights, and adjust the schedule rather than repeating a pattern the person already expects. Sunday attempts are permitted, since KRS 454.135 grants no exemption from service on that day. When visits keep failing, the Kentucky guide for avoided service explains counsel's options, and Kentucky same day service handles tight deadlines.

04Family law, landlords and subpoenas

Madison Family Court, Landlord Papers, Small Claims and Witnesses

Madison County is one of the places where Family Court sits in its own building, at 119 North First Street, rather than in the main courthouse on West Main. Dissolution and custody papers are served under the regular Civil Rules, or the respondent may sign a waiver of service and entry of appearance. The return goes to the Family Court clerk, and we prepare it accordingly. The Kentucky divorce papers service page compares each delivery route.

Richmond's adoption of Kentucky's URLTA could not be confirmed, so landlords should ask counsel whether the one-month notice of KRS 383.195 or an URLTA period governs before we deliver a pre-suit notice. The forcible detainer notice itself is directed to the sheriff or a constable under KRS 383.210, and we never serve it. Small claims of $2,500 or less usually go by certified mail or the sheriff, as the small claims service page for Kentucky explains, and the subpoena page covers witnesses.

  • Family Court at 119 N. 1st St.
  • Pre-suit notices, never the forcible detainer notice
  • Small claims where private delivery is accepted
  • Subpoenas for Richmond and Berea witnesses

Building a Return That Stands Up in Madison County

A Madison summons handed to a private server under CR 4.01(1)(b) is proved by that server's endorsed return, while a court appointee under KRS 454.145 must verify the return by affidavit. CR 4.03 wants proof on file promptly and within the defendant's response time. Our Richmond returns record the date, time, address and manner of delivery, along with which court building the case belongs to. The how to serve legal papers in Kentucky guide walks through filing.

Behind each return is a log of every attempt, successful or not, with the hour, what the server saw and who answered. If the defendant later contests service, counsel has that record. Outside Tennessee, Delator may place a serve with a vetted contract server, and the same written documentation standard applies to every one of them. Our Kentucky process server hub page explains how the statewide work is organized.

06Kentucky rules

How Kentucky's Service Rules Work in Richmond

When a Madison complaint is filed, the clerk issues the summons and, as the plaintiff directs under CR 4.01, mails it by certified mail, transfers it to an authorized person other than a mail carrier, or returns it to the plaintiff to arrange delivery. KRS 454.140 directs process to the sheriff unless a party asks otherwise, and KRS 454.145 lets a court appoint a person for a single paper. There is no private server license, as the Kentucky guide to who can serve explains.

We confirm with counsel and the Madison clerk how the summons will issue and whether private delivery is accepted before accepting a Richmond job, and we send papers to the sheriff where only an officer may serve. CR 4.04(2) requires personal delivery, an offer on refusal or delivery to an authorized agent. The answer is generally due 20 days after service under CR 12.01. These are plain summaries, not legal advice. Learn more about Delator Group.

07Richmond angle

Getting the Return to the Right Richmond Office

Out-of-town filers sometimes assume a Berea case belongs in Berea, or that every Madison County paper goes to the courthouse on West Main. Neither is always right. Circuit and District matters are handled at 101 West Main Street, family cases at the Family Court building on North First Street, and Berea addresses still return to Richmond. A process server in Richmond should name the issuing court on the return so the clerk can file it without a phone call, and that is how we prepare ours.

Minors and adults under a disability are another Richmond question we see. Under CR 4.04(3), papers for a minor go first to a resident guardian or committee, then a parent within Kentucky, then the person who has control of the child, and if none exists the clerk appoints an attorney as guardian ad litem to be served. We confirm with counsel who the correct recipient is before the visit. The Danville process server page and Nicholasville service apply the same care.

Process Servers Near Richmond

Richmond cases regularly cross into neighboring counties. Defendants north in Lexington are handled through our Fayette County process servers, and those across the Kentucky River in Nicholasville or Wilmore through Jessamine County service. Papers headed south along I-75 toward London and Corbin use Laurel County service, and Somerset addresses go to Pulaski County process service. Each of those jobs starts with a written quote, follows a dated and timed attempt log and ends with a signed return addressed to the court that issued the papers.

FAQ

Frequently Asked Questions

Where are Berea cases filed?

In Richmond. The kycourts page for Madison County lists court locations only in Richmond: the main courthouse at 101 W. Main St. and the Family Court at 119 N. 1st St. No Berea location is listed. A Berea defendant's summons is issued and returned through the Madison circuit clerk, and our return names the correct Richmond court office.

How much does a process server in Richmond cost?

Madison County's published Routine starting rate is $130, so Urgent is $195, Rush $260 and Same Day Rush $390. The final price depends on the address, the document and how quickly you need it, and we confirm it in writing before a server is assigned. Berea and rural addresses are quoted on the same basis.

Can papers be left with a roommate in Richmond?

Not a summons. The rule for individuals, CR 4.04(2), accepts only a handoff to the defendant, an offer the defendant refuses, or delivery to an agent the defendant appointed or the law designates. A roommate, landlord or neighbor cannot accept for the defendant. The officer-only rule that allows leaving an eviction notice with a family member over 16 does not apply to private service.

Do you serve forcible detainer papers in Madison County?

No. Madison County's forcible detainer warrants go to the sheriff or a constable by statute, KRS 383.210, and the AOC-215 form names those officers as its recipients. The warrant of restitution that follows a judgment is also an officer's job. We can deliver a landlord's pre-suit written notice and serve papers in a separate suit. The Kentucky guide to eviction service explains the sequence.

How long does a Richmond defendant have to answer?

Generally 20 days after service, under CR 12.01, and the summons must say so under CR 4.02. The AOC-105 civil summons counts the period from the day after delivery. A defendant summoned by warning order is deemed summoned on the 30th day after entry and is warned to appear within 50 days. Your attorney should confirm the precise date.

How is a minor served in a Madison County case?

CR 4.04(3) sets an order: a resident guardian or committee if known, otherwise a parent within Kentucky, otherwise the person in Kentucky who has control of the minor. If none exists, the clerk appoints a practicing attorney as guardian ad litem, and that attorney is served. If a listed person is the plaintiff, the next one is served. Counsel confirms the recipient before we visit.

What if a Richmond defendant cannot be found?

You get a report after each unsuccessful attempt, and the log stays available. When the defendant has left the county to avoid service, is concealing themselves or has an unknown residence, CR 4.05 allows a warning order on an affidavit, and the clerk appoints a warning order attorney. Our Kentucky warning order attorney guide covers the 50-day report and the deemed-service date.

Do subpoenaed witnesses in Richmond get mileage?

A witness who lives in a county other than the one they are subpoenaed to is allowed the state-employee mileage set by KRS 44.060, under KRS 421.015. We have not seen a separate per-day witness fee in current statutes. A Clark or Fayette County witness called to Richmond is a typical example, and our CR 45.03 witness service notes on the return what was offered.

Can a business be served at a Richmond location?

Usually through its registered agent under KRS 14A.4-040, or through an officer, managing agent or the chief agent in the county where the action is brought under CR 4.04(5). If the agent cannot be served with reasonable diligence, certified mail to the principal office is available. Our Kentucky business service page explains how we confirm the recipient.

Where do federal papers from Madison County cases go?

Madison County belongs to the Eastern District of Kentucky's Lexington division, whose clerk's office is at 101 Barr St., Lexington. Richmond is still a statutory place of holding court, but no clerk's office is listed there. We serve federal papers anywhere in the county and return proof for the federal file.
