Quick answer
How do I hire a process server in Spartanburg?
Upload the filed papers and the defendant's address in Spartanburg or anywhere else in the county. We confirm the court, check that the paper is one a private adult may serve, and send a written price. Routine Spartanburg County service has a published starting rate of $125, and the Spartanburg County service page lists the outlying towns.
01Local service landscape
A County Shaped by Two Interstates
Spartanburg had 38,732 residents in the 2020 census, but Spartanburg County holds roughly 380,000 people, most of them outside the city in fourteen other municipalities and the unincorporated land between them. Interstate 26 enters near Landrum and runs southeast through the county, and Interstate 85 swings around the north side of the city on its bypass while I-85 Business follows the older route. A day's attempts can move from Landrum in the foothills to Woodruff in the south. The countywide Spartanburg service page covers each of those towns.
Spartanburg County's Routine starting rate is $125, the same as Greenville County next door, while Cherokee County is $135 and Union County $165. We confirm the county from the address before quoting, which matters most along the Greer and Duncan edges where county lines are easy to misread. For papers headed west along I-85, our Greenville process service handles the neighboring county, and the statewide rate map for South Carolina shows the full picture.
- I-85 bypass north of downtown
- I-26 from Landrum toward Columbia
- Fifteen municipalities in the county
- 7th Circuit shared with Cherokee County
02Attorneys and law firms
Working With Spartanburg Counsel and Remote Firms
Spartanburg firms send us debt actions, construction and contract disputes, injury complaints and non-party subpoenas, and firms in other states may need a Spartanburg County defendant served on a schedule. We start by reading what you send. The summons should carry the Spartanburg County caption and the complaint should be attached, because SCRCP 4(d) contemplates that the two are served together. Our South Carolina attorney service program explains how quotes, attempt notes and affidavits are delivered.
One recurring question from out-of-state firms is whether their own staff may hand over the papers. SCRCP 4(c) says a summons may be served by any person at least 18 who is not a party and not an attorney in the action, so the lawyer of record is excluded but an independent adult is not. Delator Group is a Tennessee firm headquartered in Nashville, and the South Carolina process servers hub describes how service is coordinated across the state's 46 counties, and the multistate service rate map helps firms with cases in several states.
03Evasive and hard-to-serve
Plant Shifts, Apartment Complexes and Closed Doors
Spartanburg County is home to large industrial employers, including the BMW plant in its Greer area, and a defendant who works a night shift may sleep through every daytime knock. Apartment complexes along the interstates add gate codes, leasing offices that will not confirm a tenant, and residents who simply do not answer. We schedule visits against the likely shift pattern, record who answers and what they say, and never hand over papers until identity is confirmed. Our approach to hard-to-serve South Carolina defendants sets out the sequence.
Service at a workplace is possible when the employer permits access, but we do not enter restricted areas. Sunday visits are permitted under S.C. Code 15-9-17, with an exception for anyone heading to, attending or leaving a religious service. When ordinary attempts have run their course, counsel may weigh publication under S.C. Code 15-9-710, which the publication service guide for South Carolina covers, or a faster tier through same-day South Carolina service.
04Family law, landlords and subpoenas
Family Court, Magistrate Claims and Spartanburg Subpoenas
Divorce and custody filings in Spartanburg move through the Clerk of Court for Family Court at the Magnolia Street courthouse. The summons and complaint are served under SCRCP 4, and a cooperative spouse may sign an Acceptance of Service form instead. When personal delivery is the plan, our server confirms identity, hands over the papers without discussing the case and records the details. Contempt rules to show cause are another category, served by the sheriff or a court-designated person. See our South Carolina family law papers page.
Spartanburg landlords should know that the magistrate's rule to vacate is generally served through the sheriff's office, and we take it only where the magistrate court confirms that private service is accepted, and posting or executing a writ of ejectment is never part of our work. Magistrate summonses in claims up to $7,500 are different, since SCRMC 6(c) allows private service and proof by affidavit, as our magistrate court service page explains. Our Rule 45 subpoena service covers witnesses.
- Family Court summonses and complaints
- Magistrate civil summonses
- Landlord suits for unpaid rent or damage
- Subpoenas for hearings, trials and depositions

Building a Return That Survives a Challenge
A non-officer proves South Carolina service by affidavit, and SCRCP 4(g) asks for the date, time and place of service and the name and address of the person served, or a description if the name is unknown. Our Spartanburg affidavits answer each of those points plainly. Where papers were left at the home, we add who received them and why they qualified as a resident of suitable age and discretion. The guide on how South Carolina papers are served puts the affidavit in context.
The affidavit is the summary; the attempt log is the evidence underneath it. We record every visit, including the failed ones, with time, address and observations, so counsel can answer a motion that claims service never happened. In South Carolina the assigned server may be a vetted contractor rather than a Tennessee employee, and the logging and affidavit standard does not change. Questions about how the firm is organized are answered on the about Delator Group page.
06South Carolina rules
How South Carolina's Service Rules Apply in Spartanburg County
No South Carolina agency licenses private process servers. Under SCRCP 4(c), the sheriff, a deputy, or any non-party adult who is not an attorney in the case may serve a summons, and every server we assign meets those requirements. All other process, including orders and writs, generally goes to the sheriff, another officer or a person the court designates, so we confirm the court's requirements before accepting such papers. Our explainer on who may serve process covers the details.
SCRCP 4(d)(1) allows personal delivery, delivery at the home to a resident of suitable age and discretion, or delivery to an authorized agent. A summons may also travel by restricted-delivery certified mail under 4(d)(8) or a qualifying commercial delivery service under 4(d)(9), though a default generally requires the defendant's own signature on the receipt. Answers are generally due 30 days after service under SCRCP 12(a). Your attorney can confirm what applies, and the registered agent service page explains entity service.
07Spartanburg angle
Two Courthouses on Magnolia Street
Spartanburg is unusual in how much of its court system sits on one street. The county courthouse at 180 Magnolia Street, which opened in 2023 according to secondary sources, houses the circuit, family, probate, magistrate and municipal courts along with the Clerk of Court, and the Russell Federal Building stands at 201 Magnolia Street. A process server in Spartanburg may therefore deliver papers from several different courts to the same defendant over a few months. The Greer process server page covers the county's western edge.
Each court still has its own rules. A federal summons from the Spartanburg division follows Federal Rule 4, a Common Pleas summons follows SCRCP 4, and a magistrate summons follows SCRMC 6. We read the caption first and match the affidavit to the court that will receive it. Federal cases from this division may be heard in Greenville, Anderson or Spartanburg, so we also note the case number and division. Defendants to the south can be reached through Anderson process service.

Process Servers Near Spartanburg
Spartanburg files often name defendants elsewhere in the Upstate. Addresses just west along I-85 are handled through Greenville County service, and suburban addresses south of Greenville through the Mauldin process server page. Defendants near Clemson and the Pickens foothills go to the Pickens County process servers, and those who moved down I-26 toward the capital to Lexington County service. Every one of those jobs gets the same treatment as a Spartanburg serve: a price in writing, logged attempts and a sworn affidavit.
FAQ
Frequently Asked Questions
How much does a process server in Spartanburg cost?
Spartanburg County's published Routine starting rate is $125. Urgent is $188, Rush $250 and Same Day Rush $375. The final price depends on the address, the paper and the deadline, and we put it in writing before anyone is assigned. Neighboring counties carry their own rates, which the South Carolina county rate finder lists.
Does South Carolina license process servers?
There is no state license to check. SCRCP 4(c) sets the qualifications instead: the server must be at least 18 and must not be a party to, or an attorney in, the case. Every server we assign meets those requirements. Court orders and writs fall under a separate sentence of the rule and generally go through the sheriff or a court designee.
Can a summons be left with a family member?
Under SCRCP 4(d)(1), copies may be left at the defendant's dwelling house or usual place of abode with someone of suitable age and discretion who lives there. A guest, a neighbor or a contractor at the house does not qualify. Our affidavit records who received the papers and how we confirmed that person resides at the address.
Do you serve rules to vacate in Spartanburg?
Only where the magistrate court confirms that private service is accepted. The magistrate courts checked across South Carolina send the rule to vacate through the sheriff's office, and only a constable or deputy sheriff carries out a writ of ejectment. We do serve summonses in landlord suits for rent or damages. The guide to South Carolina eviction service lays out the process.
What if the defendant works at a plant or warehouse?
Workplace service is possible when the employer allows access to a lobby, gate or front office, but we do not enter secured areas or disrupt operations. Often a better approach is timing home visits around the shift. We note the employer, the hours we tried and what we observed, so counsel can decide whether to keep going or ask the court about other options.
Can you serve a non-party deposition subpoena here?
Yes, if it was issued correctly. SCRCP 45(b)(2) requires a non-party deposition or production subpoena to be issued from, and served in, the county where the witness lives, works or regularly transacts business in person. Witness fees of $25 a day plus mileage are tendered when the witness arrives. The overview of who may serve South Carolina papers is a useful starting point.
Is Sunday service allowed in South Carolina?
Generally yes. S.C. Code 15-9-17 allows a process server to serve judicial documents on Sunday, with one exception: a person who is going to, attending or returning from a church or other religious service may not be served at that time. We plan any Sunday attempt with that limit in mind and record the hour in the log.
How fast must a South Carolina summons be served?
If the statute of limitations has run by the time the case is filed, SCRCP 3(a) generally requires actual service within 120 days after filing for the action to be treated as commenced on filing. Counsel tracks that deadline. When it is close, we can move the job to Urgent, Rush or Same Day Rush, each confirmed in writing before the first attempt.
What does your affidavit of service include?
It gives the date, time and place of service, the name and address of the person served or a description if the name is unknown, and the method used, which follows SCRCP 4(g). For abode service it also describes the resident who received the papers. The supporting attempt log is available to counsel, as the guide for defendants avoiding service explains.
Can you serve South Carolina papers on someone in North Carolina?
Rule 4(f) of the SCRCP permits service beyond the state line only where a statute authorizes it, and S.C. Code 15-9-750 treats personal service of a summons out of state as equivalent to publication, complete on the day of service. Counsel decides whether that route fits the case. We can coordinate delivery and an affidavit under SCRCP 4(h). Our out-of-state papers page explains more.
