Serving Papers in a Resort County Split by Mountains
Eagle County had an estimated 54,300 residents in 2025, slightly fewer than in 2020, spread along two separate valleys. Most people live in the Eagle River valley along I-70, from Vail and Minturn down through Avon, Edwards, Eagle and Gypsum. A smaller population lives on the Roaring Fork side around El Jebel and Basalt, which is closer to Glenwood Springs than to the county seat. Papers for that side are often paired with Garfield County process service.
The county has seven incorporated towns: Vail, Avon, Eagle, Gypsum, Minturn, Red Cliff and most of Basalt, which crosses into Pitkin County. Large unincorporated communities such as Edwards and EagleVail add many addresses, and Beaver Creek is a gated resort community where access is controlled. We confirm each address and its access rules before quoting, and our Grand Junction investigators handle Western Slope locates when a defendant has moved down valley.

- Eagle, Gypsum and the county seat
- El Jebel and Basalt on the Roaring Fork side

02Attorneys and law firms
Service for Valley Practitioners and Front Range Counsel
Eagle County cases are filed at the Justice Center on Chambers Avenue in Eagle, with a limited-hours court location in El Jebel for the Roaring Fork side. Local firms send us real estate and construction disputes, HOA and property management claims, ski and hospitality injury cases, employment matters and domestic cases involving second-home owners. Delator's attorney services in Colorado keep the quote, attempts and return with one coordinator.
Denver, out-of-state and international counsel frequently need a part-year resident or property owner served in the valley. We read the papers before scheduling, confirm whether the Vail-area address is the person's usual place of abode, and tell counsel when the person appears to live elsewhere most of the year. Background checks on business partners and lost contact locates help when parties are hard to pin down.
03Evasive and hard-to-serve
Seasonal Workers, Second Homes and Defendants Who Leave After the Season
Resort employment shapes service here. Lift, restaurant, lodging and construction workers often share employee housing, change addresses between winter and summer, and leave the valley when the season ends. Second-home owners may be present only a few weeks a year, and their caretakers or property managers generally cannot accept papers for them. Servers vary attempt times, log every visit and its result, and report when a home looks closed for the season.
When a defendant deliberately avoids service, a Delator investigator can take over through locating evasive parties, using public records and lawful observation rather than entering gated property. That log then becomes the server's sworn account if counsel files a C.R.C.P. 4(f) motion in Eagle County. If the trail goes cold, the log documents every effort. Employers facing internal losses can ask about workplace theft investigations, and lodging operators about hotel surveillance.
04Family law, evictions and subpoenas
Family Law, Evictions, Small Claims and Subpoenas in Eagle County
Eagle County dissolution and parenting-time cases are generally heard in district court in Eagle. Under C.R.S. 14-10-107, a respondent generally must be personally served unless they join the petition or waive service, and the automatic temporary injunction on marital property, insurance and the children's travel applies from service. When spouses own homes in several states, that matters. Counsel can read our Colorado divorce asset guide and custody investigation guide.
Landlords, including employers who provide housing, file FED cases in Eagle County Court. Under C.R.S. 13-40-104, the notice period is generally 10 days for most residential tenancies but 3 days for employer-provided housing, a distinction counsel should confirm. The FED summons must be served or posted at least seven days before the appearance date. Only the sheriff executes a writ of restitution, and tenant screening helps owners renting long term.
- Dissolution and parenting-time petitions
- FED summonses including employer housing
- Small claims notices 15 days before trial
- Witness subpoenas for Eagle hearings

Eagle County Returns That Withstand Scrutiny
Each Eagle County return states that the server is 18 or older and not a party, lists the documents, and gives the date, time, place and manner of service on the pattern of the JDF 98 Affidavit of Service. Behind it is a log of every attempt, including road and weather conditions that affected timing. Serves may be carried out by vetted servers Delator contracts with, all working to one written standard and a price confirmed in writing first.
If service is challenged, counsel can show whether delivery was personal, on a family member 18 or older at the usual place of abode, on a listed workplace contact, or after a refusal under C.R.C.P. 4(k). The log also records when a caretaker, concierge or property manager declined to help, which can matter in a substituted-service motion. For deeper disputes, investigative consulting and real estate risk research are available.
06Colorado rules
Colorado Service Rules for Eagle County Papers
There is no Colorado process server license to check. Any adult 18 or over who is not a party to the case can generally serve under C.R.C.P. 4(d). C.R.C.P. 4(e)(1) lists the options: personal delivery, abode service on a family member 18 or older, workplace service on a supervisor, secretary, administrative assistant, bookkeeper, human resources representative or managing agent, or an authorized agent. The Colorado process serving page summarizes the full rule.
C.R.C.P. 4(m) generally requires service within 63 days after filing, so seasonal absences can put a deadline at risk. A served defendant generally has 21 days to respond, or 35 when served out of state or by publication. These are summaries, not legal advice, and the Colorado guide to serving papers and the limits on lawful investigation add context for counsel and self-represented parties.
07Eagle County angle
Vail Pass, Chain Law and the I-70 Corridor
Vail Pass, at roughly 10,662 feet on I-70 between Vail and Summit County, is one of the highest points on the interstate corridor, and closures there can cut the valley off from the Front Range for hours. Colorado's passenger traction law and chain law are in force on I-70 from Morrison to Dotsero, at the west end of Eagle County, from September 1 through May 31. Mountain serves can be delayed by closures and chain-law conditions.
We build that into scheduling and tell you when weather affects an attempt, and we never promise winter turnaround times. Rush tiers still depend on safe travel. Papers headed over the pass to Silverthorne, Frisco or Breckenridge are quoted through Summit County process serving, and Front Range papers through Denver process service, while our Denver investigators take on related metro work.

FAQ
Frequently Asked Questions
Does a process server in Eagle County need a license?
No. Colorado does not license process servers, and C.R.C.P. 4(d) generally allows anyone 18 or older who is not a party to serve. Because no agency screens servers, ask how attempts, access refusals and weather delays are documented. Our Colorado vetting guide suggests what to check before hiring anyone for the job.
How much does it cost to serve papers in Eagle County?
Routine service in Eagle County has a published starting rate of $195, reflecting mountain distance. Urgent starts at $292, Rush at $390 and Same Day Rush at $585. Summit and Garfield counties start at $170. The final price depends on the address, deadline, number of people and road conditions, and it is confirmed in writing first.
Which court handles Eagle County cases?
Most cases are filed at the Eagle County Justice Center, 885 Chambers Avenue in Eagle. The county also has a limited-hours court location in El Jebel, at 20 Eagle County Drive, for the Roaring Fork side. Confirm with the clerk which location handles your matter. Our affidavit names the court that issued the papers.
Can a property manager accept papers for a Vail homeowner?
Generally not, unless the manager is an agent authorized by appointment or law to receive service. Abode service under C.R.C.P. 4(e)(1) requires a family member 18 or older at the person's usual place of abode, and a part-year home may not qualify. We confirm where the owner really lives and serve there when possible.
Can you serve someone inside Beaver Creek or another gated area?
Only with lawful access. Servers ask security or a resident for entry and do not trespass. If access is refused, the attempt log records it, and we look for lawful alternatives such as the person's workplace or a different residence. Counsel can then consider a C.R.C.P. 4(f) motion if repeated attempts fail.
Will winter weather delay my Eagle County serve?
It can. The I-70 traction and chain laws apply from Morrison to Dotsero between September 1 and May 31, and Vail Pass closures can stop travel for hours. We schedule around conditions, tell you when weather affects an attempt, and never promise winter turnaround times. Rush tiers still depend on safe roads.
Do you serve in Gypsum, Edwards and El Jebel?
Yes. Gypsum, Eagle, Edwards, EagleVail, Avon, Minturn, Red Cliff, Wolcott and El Jebel are all in Eagle County, so Routine service starts at $195. Basalt is mostly in Eagle County but crosses into Pitkin County, which starts at $200, so we confirm the county of each Basalt address first. Skip tracing in Colorado helps with unclear addresses.
What if the defendant left the valley after the season?
Then the case needs a current address before more attempts are made. A Delator investigator can locate the person, and Colorado papers can generally be served outside the state by a qualified adult, with a 35-day answer period under C.R.C.P. 12(a). Colorado missing person guidance explains the lawful search methods.
How do you serve a resort or lodging company?
Usually through the registered agent listed with the Colorado Secretary of State, or an officer, manager or general partner. If the agent cannot be served with reasonable diligence, C.R.S. 7-90-704 generally allows registered or certified mail to the principal address; the Secretary of State is not a substitute agent. Corporate malfeasance investigations are a separate service.
Is Delator Group based in Eagle County?
No. Delator Group is headquartered in Nashville, Tennessee, where it is a licensed private investigation firm, and it has no Eagle County office. It coordinates service across Eagle County through vetted servers held to one documentation standard, and it works to Tennessee's licensing standard in every state.
