Quick answer

How does process serving in Colorado work with Delator?

Start by sending the filed papers along with each address on file. Delator Field Services confirms the county, service level and price in writing, assigns a vetted server and logs each attempt with the time and place. Routine rates start at $125 in Denver and ten other counties, and the Colorado rate finder by county shows every level for all 64.

01Local service landscape

Serving Papers Across a State Split by the Continental Divide

Colorado's population sits mostly on the Front Range, so the bulk of service happens between Fort Collins and Pueblo. That density brings its own problem: several large cities cross county lines. Aurora spans Arapahoe, Adams and Douglas counties, and Arvada, Westminster, Longmont and Littleton each straddle two or three. The right court and sheriff depend on which side of the line an address falls, so we confirm the county for every address before quoting. Metro work starts with the Denver process server page or our Aurora service coverage.

Sheriffs serve civil papers in Colorado too, but each office sets its own limits. The Denver Sheriff Department's civil unit serves only inside the City and County of Denver and returns papers with an incomplete address. Larimer County's civil unit states that it does not skip trace and does not expedite service, and Weld County asks filers to call first on Erie, Longmont and Brighton addresses to confirm the county. A private server fills those gaps, which is why many firms send suburban work to our Adams County service team.

Outside the metro, the challenges are distance and weather. Mountain counties lose roads to storms and chain-law restrictions from September through May, and the Eastern Plains spread small towns across long county roads. We schedule rural attempts in clusters, tell you when weather moves an attempt, and never promise a winter turnaround we cannot meet. Distance is already built into the published rural starting rates, so a long drive to Burlington or Lamar does not turn into a surprise charge.

02Attorneys and law firms

What Colorado Law Firms Need From a Process Server

Law firms want three things from a server: a quick first attempt, a clean return and no surprises on the bill. Colorado gives counsel limited time to deliver. C.R.C.P. 4(m) generally requires service within 63 days after the complaint is filed, after which the court must dismiss without prejudice or set a deadline, extending it for good cause. We track that date from intake and tell the firm when an address is not producing results. Pikes Peak region firms reach us through the Colorado Springs process serving page.

Entity defendants are usually served on the registered agent listed with the Colorado Secretary of State. If no agent is listed, the agent is not at the listed address, or reasonable diligence fails, C.R.S. § 7-90-704 generally allows service by registered or certified mail to the entity's principal address. It does not make the Secretary of State an agent for service, so we never route papers there as a substitute. Boulder County firms serving local companies use our Boulder process server coverage.

Answer deadlines follow the method of service. A Colorado defendant served in the state generally has 21 days to answer under C.R.C.P. 12(a), and 35 days when served outside Colorado or by publication. Every affidavit we return states the exact date, time and place so the clerk and opposing counsel can calculate the date without guessing. The Colorado litigation support page explains how our investigators back up a serve that turns into a locate.

03Evasive and hard-to-serve

Evasive Defendants and the Diligence Colorado Courts Expect

Some people know papers are coming and act accordingly. Colorado's rules help. Under C.R.C.P. 4(k), a person who refuses to take the papers is still served if the server identifies the person and the documents, offers delivery and leaves a copy in a conspicuous place nearby. C.R.C.P. 4(e)(1) also allows service at the usual workplace through a supervisor, secretary, administrative assistant, bookkeeper, human resources representative or managing agent. We vary attempt times, days and locations so the record shows real effort, and our evasive party locates in Colorado take over when the address itself is the problem.

When personal service keeps failing, counsel can ask the court for substituted service under C.R.C.P. 4(f). The motion needs an affidavit from the person who attempted service, describing each effort and why it failed, along with the proposed recipient and addresses. The court must find due diligence and that the alternative is reasonably calculated to give actual notice. Our attempt logs are written with that motion in mind, and the step-by-step guide to serving papers in Colorado explains where substituted service fits.

04Family law, evictions and small claims

Divorce Papers, FED Evictions and Small Claims Service

In a Colorado dissolution case, the non-filing spouse must generally be personally served unless they join as co-petitioner or waive and accept service. Service also starts two clocks. The 91-day waiting period before a decree generally runs from the court acquiring jurisdiction over the respondent, and the automatic temporary injunction on hiding marital property or removing the children from the state binds the respondent once served. We serve family law papers quietly, away from children where possible, and parenting-time cases often pair with our guide to parenting-time investigations.

Evictions follow C.R.S. title 13, article 40. Most residential tenancies need a 10-day written notice, which may be handed to the tenant, left with a family member over 15 who lives there, or posted if no one is present. The FED summons and complaint must be served personally or, after diligent effort, posted by a qualified server with the landlord mailing a copy first class, at least seven days before the appearance date. Only the sheriff executes a writ of restitution, and we never perform removals. Weld County landlords use our Greeley process service.

Small claims cases, which cover disputes up to $7,500, must be served at least 15 days before trial, either personally or by the clerk's certified mail. The state's self-help instructions ask the server to sign the small claims affidavit of service before a notary, and we follow that form. Protection orders are a separate category: courts and sheriffs often handle that service, and we serve them when the court and the client direct. Southern Colorado filings go through our Pueblo service coverage.

05Documentation

Documentation That Holds Up if Service Is Challenged

A defendant who wants to delay a case often attacks the service first. The best defense is a record made at the time. Every Delator Field Services attempt is logged with the date, time, address and what the server saw, and the completed serve is reported on Colorado's official Affidavit of Service, form JDF 98, or the form the court requires. JDF 98 records the documents served, the manner of service, and for abode service the relationship of the family member who accepted the papers. Northern Colorado clients can read how this works on the Fort Collins serve page.

C.R.C.P. 4(h) generally allows proof of service by a sworn or unsworn declaration of the person who completed it, so JDF 98 is signed under penalty of perjury rather than notarized. If the defendant later claims never to have been served, the attempt log, any photographs and the server's notes support a declaration or testimony. Western Slope firms sending Mesa County papers use the Grand Junction process server page, where the documentation is identical.

06Colorado service rules

Process Serving in Colorado: The Service Rules in Plain English

Under C.R.C.P. 4(d), process in Colorado may generally be served by any person 18 or older who is not a party to the action. Colorado has no process server license, so the safeguards come from the rules and the server's own standards. Delator assigns vetted servers, and outside Tennessee those may be servers we contract with under our documentation standard. Personal delivery comes first. Abode service is generally allowed only with a member of the person's family who is 18 or older, not any adult in the household. Douglas County filings in the new 23rd District run through our Douglas County process server.

Other rules cover special defendants. Minors aged 13 to 17 are generally served along with a parent or guardian, and the state is served through the attorney general. Service by mail or publication is limited to actions affecting specific property or status, by court order, and publication runs once a week for five successive weeks. Subpoenas fall under C.R.C.P. 45: any non-party adult may serve one, one day's mileage must be tendered, and depositions generally need seven days' notice. County court cases follow the parallel C.R.C.P. 304, which your attorney can confirm. Papers that must reach other states start on the multistate rate map.

07Mountains and plains

Mountain Towns, Resort Housing and the Eastern Plains

The ski counties are a service problem of their own. In Summit and Eagle counties, many residents live in seasonal rentals, employer housing or second homes owned by someone else, and addresses change with the season. Gated developments and condominium front desks add another layer. Our Eagle County service team works Vail, Avon and Eagle, where the Justice Center sits, and the Eisenhower-Johnson Memorial Tunnel at 11,158 feet stands between those towns and Denver.

Farther west, Glenwood Springs and Rifle both hold Garfield County courts, and Interstate 70 through Glenwood Canyon is the main route in. Our Garfield County process serving plans around that corridor. In the southwest, Durango holds the La Plata County courthouse and a federal court location, and the Southern Ute and Ute Mountain Ute reservations call for confirmation with counsel before any attempt. The Eastern Plains, from Julesburg to Springfield, are open country where a single serve can mean a long drive, which is why Routine rates there reach $250 and above.

Published rates

Colorado Process Serving Rates by County

Each Colorado county has a published Routine starting rate, from $125 in Denver and ten other metro and regional counties to $255 in Sedgwick County. Faster levels are priced at 1.5, 2 and 3 times the Routine figure, and you approve the final price in writing before any server goes out.

Denver County · Colorado

  • RoutineFirst attempt in 5–7 days$125
  • UrgentFirst attempt in 3–5 days$188
  • RushFirst attempt in 1–2 days$250
  • Same Day Rush*Within 2 hours of receipt$375

Published starting rates. Final pricing depends on location, urgency and document readiness and is confirmed in writing before the first attempt. Rates are set from each county's population and its distance from the nearest metro area. Urgent is 1.5 times Routine, Rush is 2 times and Same Day Rush is 3 times. *Same Day Rush availability is assessed case by case; any request for service within 24 hours is billed as Same Day Rush. FAQ

Frequently Asked Questions

Do process servers in Colorado need a license?

No. Colorado has no license or registration for process servers. Under C.R.C.P. 4(d), generally any person 18 or older who is not a party to the case may serve. Because the state does not screen servers, Delator Field Services applies its own written standard: vetted servers, logged and time-stamped attempts, and a signed affidavit on JDF 98 or the form the court requires.

How much does process serving in Colorado cost?

Delator Field Services publishes a Routine starting rate for every county. It is $125 in Denver, Adams, Arapahoe, Broomfield, El Paso, Jefferson, La Plata, Larimer, Mesa, Pueblo and Weld counties, and reaches $255 in Sedgwick County. Each faster level multiplies that figure, by 1.5 for Urgent, 2 for Rush and 3 for Same Day Rush. The county-by-county rate list shows every level, and the final price is confirmed in writing first.

Can a Colorado server leave papers with another person at the home?

Sometimes. C.R.C.P. 4(e)(1) generally allows abode service only with a member of the person's family who is 18 or older and lives at the usual place of abode. A roommate or a visiting friend does not qualify. Eviction notices are different: C.R.S. § 13-40-108 allows the notice or demand to be left with a family member over 15. Our affidavit records the relationship of whoever accepts the papers.

What happens if the defendant refuses to take the papers?

Under C.R.C.P. 4(k), refusal does not defeat service. If the server identifies the person and the documents, offers delivery and the person refuses, leaving a copy in a conspicuous place nearby generally completes service. JDF 98 has a checkbox for this. Our servers note exactly where the papers were left and what was said, so the record answers any later dispute.

Can you serve a Colorado company through the Secretary of State?

Not as a substitute agent. C.R.S. § 7-90-704 has no provision deeming the Secretary of State the agent for service. Entities are generally served through the registered agent listed in the Secretary of State's business records or an officer or manager. If the agent cannot be served with reasonable diligence, service may be made by registered or certified mail to the entity's principal address. Counsel decides which route fits the case.

How are eviction papers served in Colorado?

Most residential tenancies first need a 10-day written notice under C.R.S. § 13-40-104. The FED summons and complaint must then be served personally or, after diligent effort, posted on the premises by a qualified server with the landlord mailing a copy first class, at least seven days before the appearance date. Only the sheriff executes a writ of restitution. Our tenant screening in Colorado helps landlords avoid the problem.

When can a court order service by publication?

Rarely. Under C.R.C.P. 4(g), mail or publication is generally limited to actions affecting specific property or status, or other in rem actions, and requires a verified motion showing diligent efforts. Notice by publication appears weekly for five successive weeks. For ordinary money claims, the usual route after failed attempts is substituted service under C.R.C.P. 4(f), which depends on a detailed affidavit from the server.

Do you serve papers in mountain towns during winter?

Yes, with honest scheduling. Colorado's chain and traction laws apply on the I-70 corridor from September through May, and closures can delay an attempt in Summit, Eagle, Clear Creek or Garfield counties. We plan mountain attempts around conditions and tell you when weather moves one. Our Breckenridge and Silverthorne service page covers resort housing and seasonal addresses in more detail.

Can you serve papers from another state on a Colorado resident?

Usually. Colorado residents named in out-of-state lawsuits can generally be served here under the rules of the issuing state, and the issuing court decides what proof it needs. Answer time for a defendant served outside the forum depends on that state's rules. We confirm the required affidavit format before the first attempt, and the multistate process serving map lists the other states we cover.

What if the defendant's address is out of date?

We tell you before charging for a serve that cannot succeed. A $102 database skip trace often produces a current address, and a field locate starting at $1,000 handles people who move often or avoid contact. Because the same organization runs both the locate and the serve, the attempt history stays in one file, which helps if counsel later needs a C.R.C.P. 4(f) motion.
