Urgent, Rush and Same Day Rush tiers, Monday through Saturday
Same Day and Rush Process Serving in Virginia
When a Virginia hearing, return date or deadline is close, Delator Field Services offers three faster tiers: Urgent at 1.5 times the Routine rate, Rush at 2 times and Same Day Rush at 3 times. Every rush serve is priced in writing first and scheduled Monday through Saturday, because Virginia law does not allow civil service on Sunday.

Quick answer
Is same day process serving available in Virginia?
Yes, as the Same Day Rush tier at 3 times the locality's published Routine rate, when the issued papers and a confirmed address arrive in time for a same-day attempt. Urgent (1.5 times) and Rush (2 times) are slower but still prioritized. No civil service happens on Sunday. Our Virginia process server rate map lists each locality's Routine rate.
01How the tiers work
Four Speeds of Service, From Routine to Same Day Rush
Every Virginia county and independent city has a published Routine starting rate, and the faster tiers are set multiples of it. In Virginia, the Urgent tier carries 1.5 times the locality's Routine figure, Rush carries twice that figure and Same Day Rush three times. In Fairfax County, where Routine starts at $125, that works out to $188, $250 and $375. In Highland County, the highest published Routine rate at $255, the same tiers are $383, $510 and $765. Our Fairfax County process servers and Alexandria rush team quote most Northern Virginia rush work.
The tier sets priority, not the law, and same day process serving in Virginia is held to the same rules as any other serve. A rush serve follows the same Va. Code § 8.01-293 qualifications, the same § 8.01-296 sequence for individuals and the same § 8.01-325 return as a Routine serve. What changes is how quickly a server is assigned and how tightly the attempts are packed. We confirm the tier and price in writing before anyone is dispatched. Firms planning ahead can compare localities on the multistate process serve pricing map.
- Routine: the published starting rate for the locality
- Urgent: 1.5 times Routine
- Rush: 2 times Routine
- Same Day Rush: 3 times Routine
02Va. Code § 8.01-289
No Sunday Service in Virginia, and How Rush Work Plans Around It
Virginia has a firm Sunday rule. Va. Code § 8.01-289 provides that no civil process shall be served on Sunday, except in cases of persons escaping out of custody or where the law expressly provides otherwise. A serve made on a Sunday invites a challenge, so we do not attempt one, whatever the tier. When a hearing falls on Monday morning, Saturday is usually the last realistic day. Our guide to serving legal papers in Virginia covers the rule in context.
That rule changes how firms should send weekend work, and it shapes every request for same day process serving in Virginia that arrives late in the week. Papers that arrive on a Friday afternoon may still allow a Same Day Rush attempt that day or a Rush attempt on Saturday, depending on the address. We did not find a Virginia statute that bars service on legal holidays, and we do not claim one either way; counsel can confirm for a specific court. Coastal weekend serves often go through our Virginia Beach process servers and Norfolk teams, who schedule Saturday attempts early when a Monday hearing is set.
03Why the clock matters
Virginia Deadlines That Turn a Routine Serve Into a Rush
Several Virginia deadlines push serves into faster tiers. An unlawful detainer summons must be served at least 10 days before its return day under § 8.01-126, and a residential case under the Virginia Residential Landlord and Tenant Act is generally set for an initial hearing no more than 21 days after filing. A late filing leaves little room, whether the rental is in Norfolk or in Suffolk. Landlords and their counsel can read our unlawful detainer service in Virginia page for the rest of that process.
Subpoenas carry their own window. A sheriff need not serve an attorney-issued subpoena issued fewer than five business days before attendance, and a court may decline to enforce one served fewer than five calendar days before the appearance. A private server can still deliver it, but the risk stays with the issuing side. And a general district court case served through the Secretary of the Commonwealth fails if the Secretary gets the papers within 10 days of the return day. Our Virginia subpoena service page explains witness timing.
04Tunnels and bridges
Rush Serves Across Hampton Roads Water Crossings
Hampton Roads routing is shaped by water. The Hampton Roads Bridge-Tunnel carries I-64 between Hampton and Norfolk, the Monitor-Merrimac Memorial Bridge-Tunnel carries I-664 toward Newport News, and the tolled Downtown Tunnel links Portsmouth and Norfolk on I-264. The Chesapeake Bay Bridge-Tunnel on US 13 is the direct road to the Eastern Shore counties of Northampton and Accomack. We plan rush attempts around tunnel and bridge traffic rather than promising a time. Our Portsmouth process servers cross these routes often.
Military schedules add another variable. Naval Station Norfolk, Joint Expeditionary Base Little Creek-Fort Story and Joint Base Langley-Eustis control access, and a rush tier cannot override a command's rules. We coordinate with counsel and look for an off-base address when that is faster. The Eastern Shore's published Routine rates are higher, $185 in Accomack and $180 in Northampton, reflecting the distance from the nearest metro area. Peninsula rush work runs through our Newport News process servers.
05Beltway and express lanes
Rush Work in Northern Virginia's Toll and Express Lane Network
Northern Virginia's highways are built around managed lanes. The 495 Express Lanes run on the Capital Beltway from the Springfield Interchange toward the American Legion Bridge, the 95 Express Lanes reach south to Fredericksburg, and I-66 is tolled inside the Beltway at peak hours and has express lanes out to Gainesville. Servers on rush assignments use whichever route the clock requires, and we do not quote travel times. Our Prince William County process servers work the I-95 and I-66 corridors.
Access is the other challenge. Office towers, federal contractors and apartment buildings in Arlington, Alexandria and Fairfax often control entry with a front desk or badge reader, and Fort Belvoir and the Pentagon are restricted. A Same Day Rush tier buys priority, not entry, so the server works within each building's visitor rules and records any barrier. Rush serves on commercial agents are covered on our business and registered agent service page, and Arlington addresses through our Arlington County team.
06Distance and terrain
Rush Serves in the Valley, Southside and Southwest Virginia
Western Virginia has the state's longest interstate. I-81 runs about 325 miles from Bristol through Wytheville, Christiansburg, Roanoke, Lexington, Staunton and Harrisonburg to Winchester, sharing pavement with I-77 near Wytheville and with I-64 between Lexington and Staunton. Rural localities along and beyond it carry higher published Routine rates, such as $205 in Wise County and $240 in Buchanan County. Our Blacksburg process servers and Montgomery County teams cover the New River Valley.
Same day work in mountain counties depends on the address. A farmhouse off a secondary road in Bath or Highland County may need daylight and a long drive, and weather can delay rural attempts. We tell the firm, including those working with our Lynchburg process servers, whether a same-day attempt is realistic before charging for one, and we suggest Rush or Urgent when that is the better fit. For Shenandoah Valley defendants, our Harrisonburg process servers work from the Court Square area where the shared Harrisonburg-Rockingham courts sit.
07After the serve
Returns, Attempt Logs and What a Rush Serve Delivers
A rush serve ends with the same paperwork as any other. Under § 8.01-325, the private server returns the process to the clerk's office within 72 hours of service, with an affidavit of qualifications, the date and manner of service, the name of the party served, a private server annotation and the server's contact details. On rush files, we send the firm a copy as soon as it is signed so counsel can act before the filing lands. Firms with recurring deadlines use our Virginia attorney process serving intake.
When a rush attempt fails, the firm still receives value: a time-stamped entry showing when the server arrived, what was seen and who answered. That record supports a second attempt at a better hour, substituted service under § 8.01-296 where counsel approves, or a diligence affidavit later. A faster tier never changes what Virginia allows; writs of eviction, levies and protective orders remain with officers. Defendants who keep dodging are covered on our Virginia hard-to-serve defendants page.

How it works
How a Virginia Rush Serve Is Scheduled
- 01
Send papers and the deadline
Send the issued papers, the defendant's address, the hearing or return date and the tier you want. Requests sent early in the day leave the most room for a same-day attempt.
- 02
Confirm feasibility and price
We confirm the locality, whether a same-day attempt is realistic for that address and day, and the tier price, all in writing before any server is dispatched.
- 03
Attempt Monday through Saturday
The server attempts service on the scheduled day, never on a Sunday, and logs the arrival time, what was seen at the door and who answered.
- 04
Copy now, return within 72 hours
You receive a copy of the signed return as soon as it is ready, and the private server return reaches the clerk's office within 72 hours.

Statewide coverage
Rush Service Across Virginia
Rush requests cluster where courts are busiest. Capital-area deadlines are handled through our Richmond rush process servers and Henrico coverage, while Northern Virginia work runs through Fairfax, Arlington and Loudoun County service. In Hampton Roads, our Chesapeake process servers and Norfolk teams plan around the tunnels. Western rush work moves along I-81 through Roanoke same day service and the Shenandoah Valley. Each locality's tier prices follow its published Routine rate, and the final figure is confirmed in writing before a server is dispatched.
FAQ
Frequently asked questions
Can papers be served on a Sunday in Virginia if it is an emergency?
Not civil process. Va. Code § 8.01-289 bars civil service on Sunday, except for persons escaping custody or where the law expressly provides otherwise. A rush tier does not change that, so we schedule the last attempt for Saturday when a hearing falls on Monday. Your attorney can advise whether any exception fits a specific matter.
How much does same day process serving in Virginia cost?
Same Day Rush is 3 times the locality's published Routine rate. In Fairfax County, Richmond (city) or Virginia Beach, where Routine starts at $125, that is $375. In Highland County, where Routine is $255, it is $765. The final price depends on the address and timing and is confirmed in writing before dispatch. See the Virginia county and city rate finder.
Is a same-day attempt always possible?
No. It depends on when the papers arrive, whether the address is confirmed, the distance involved and the day of the week. We tell you honestly at intake whether a same-day attempt is realistic and suggest Rush or Urgent when that fits better. A rural address in the mountains may need daylight and a long drive.
Does a rush tier change how service must be made?
No. A rush serve follows the same Virginia rules as any other: a qualified adult under § 8.01-293, the § 8.01-296 sequence of personal, family-member and posted service for individuals, and a private server return within 72 hours under § 8.01-325. The tier buys priority and tighter scheduling, not a different legal standard. Our guide to who can serve process in Virginia explains the qualifications.
Can you rush an unlawful detainer summons?
Yes, where a private server may serve it. Under § 8.01-126, the summons must be served at least 10 days before the return day, and a private server may serve it under §§ 8.01-293, 8.01-296 or 8.01-299. Only the sheriff or a high constable executes a later writ of eviction. Our guide to serving an eviction in Virginia covers the full sequence.
What if an attorney-issued subpoena is close to the hearing?
A private server can still deliver it, but timing rules matter. A sheriff need not serve an attorney-issued subpoena issued fewer than five business days before attendance, and a court may decline to enforce one served fewer than five calendar days before the appearance. We flag those at intake so counsel can decide, and the risk of a late subpoena stays with the issuing side.
Can you serve someone on a military base on a rush basis?
Base access is controlled by the command, and a rush tier cannot override it. Under 32 C.F.R. § 720.20, Navy and Marine Corps commanding officers may permit service and designate a place such as the legal office. We coordinate with counsel and, when an off-base address is faster, we use it. Our Hampton process servers often handle Peninsula addresses this way.
Do Virginia holidays stop service?
We did not find a Virginia statute barring civil service on legal holidays, and we do not claim a rule either way; your attorney can confirm for a specific court. Holidays do affect the return clock, though. Under § 8.01-325, if the 72-hour return deadline falls on a Saturday, Sunday or legal holiday, it moves to the next business day.
Will I get proof the same day?
On rush files, we send a copy of the signed return as soon as it is ready, often the same day as service. The formal private server return goes to the clerk's office within 72 hours under § 8.01-325. If an attempt fails, you receive a time-stamped log entry showing when the server arrived and what happened, so counsel can plan the next step.
Which Virginia localities have the smallest rush prices?
Metro localities with a $125 published Routine rate, such as Fairfax County, Arlington, Richmond (city), Henrico, Chesterfield, Norfolk and Virginia Beach, have the smallest tier prices: $188 Urgent, $250 Rush and $375 Same Day Rush. Rural and mountain localities cost more because of distance. Our Norfolk same day process server page shows one metro example.
