Quick answer

How do I hire a process server in Berkeley County?

Send the filed papers, the case number, every address and the deadline you are working toward. We confirm the document can be served privately in that Berkeley County court, quote the tier and price in writing and log every attempt. Routine has a published starting rate of $125, and our Goose Creek service page covers the county's largest city.

01Local service landscape

Fast-Growing Suburbs in the South, Lakes and Pine Country in the North

Berkeley County had about 274,666 residents in 2025, and much of that population lives in the south, in Goose Creek, Hanahan, the Berkeley side of North Charleston and Summerville, and newer communities such as Cane Bay. Daniel Island belongs to the city of Charleston but sits in Berkeley County. North of Moncks Corner the county opens into Lake Moultrie, farmland and long rural roads toward Bonneau, Jamestown and St. Stephen. Our North Charleston papers page covers the three-county city.

That split shapes routing. Southern addresses cluster around I-26 and the roads feeding Goose Creek and Hanahan, while I-526 crosses the Cooper River on the Don Holt Bridge to reach Daniel Island. Northern addresses can be far apart, so we group them into separate daylight runs. Before quoting, we confirm the county for any Goose Creek, Summerville or North Charleston address. The statewide hub for DFS in South Carolina explains coverage elsewhere.

  • Goose Creek, Hanahan and the Berkeley side of North Charleston
  • Daniel Island via I-526
  • Cane Bay and the Summerville-area growth corridor
  • Moncks Corner, Pinopolis, Bonneau, Jamestown, St. Stephen

02Attorneys and law firms

For Charleston Firms Whose Defendants Live Across the Cooper

Berkeley County shares the 9th Judicial Circuit with Charleston County, and many lawyers who practice on Broad Street also file at the Berkeley County Clerk of Court in Moncks Corner. They want the summons and complaint delivered together, an affidavit that tracks the caption and written updates after each attempt. Our service program for South Carolina firms lists the intake details that help, and the clerk's Charleston-area phone extension is handy for status calls.

Out-of-state counsel often have a Berkeley County defendant because the county's suburbs house many Lowcountry workers and military families. When the issuing court sits in another state, we match the South Carolina delivery and affidavit to its rule for service outside its state, as described on our interstate papers page. Federal summonses from the Charleston division are served under Federal Rule 4, and the multistate service pricing map helps when other states are involved.

Delator Group is a Tennessee firm headquartered in Nashville and keeps no Berkeley County office. Serves may be carried out by vetted servers Delator contracts with under one written documentation standard, and every server assigned is at least 18 and not a party to, or an attorney in, the case. Our firm background page explains how that standard is applied.

03Evasive and hard-to-serve

Base Housing, Master-Planned Communities and Remote Lake Roads

The Naval Weapons Station of Joint Base Lindsey Graham (formerly Joint Base Charleston), renamed on Aug. 10, 2026, sits in Goose Creek and Hanahan. Service at an installation depends on the base's access rules, and default judgments against servicemembers raise Servicemembers Civil Relief Act questions, including the court's required affidavit on military status. We confirm the approach with counsel first. Our page on defendants who are hard to reach explains how we keep the record.

Master-planned communities can have amenity gates and homeowner rules, and northern addresses near Lake Moultrie may sit down unpaved drives with no clear house number. Sunday service is allowed by S.C. Code 15-9-17 unless the person is on the way to, at, or returning from worship. If due diligence fails, the court or clerk of common pleas may order service by publication, as our publication process guide explains.

  • Military households tied to the Naval Weapons Station
  • Amenity-gated master-planned neighborhoods
  • Unnumbered rural drives in the northern county
  • Shift workers at plants, warehouses and the base

04Family, landlord, claim and witness papers

Family Court Filings, Magistrate Claims and Rental Papers

Berkeley County Family Court handles divorce, custody and support cases, and its summonses and complaints are served under SCRCP 4 like any civil action. A spouse who agrees can sign an Acceptance of Service (SCCA 400.03). Family court rules to show cause count as other process under Rule 4(c), going to the sheriff, another officer or a court-designated person, so we do not take them as routine work. The divorce service explainer for South Carolina covers each path.

Magistrate courts hear civil claims up to $7,500, and SCRMC 6(c) permits any adult who is not a party or attorney in the case to serve their summonses, proving service by affidavit; the magistrate court papers page has details. Ejectment is handled differently. The rule to vacate is usually served through the sheriff's office, and only a constable or deputy sheriff executes a writ. We serve the rule only where the magistrate court confirms private service is accepted, never post or execute a writ, and do serve rent and damage suits, as our rental papers service describes.

05Documentation and challenges

An Affidavit That Settles Where the Defendant Lives

SCRCP 4(g) asks that proof of service state the date, time and place and the name and address of the person served, or a description when the name is not known. A private server makes that proof by affidavit, and we keep the attempt log behind it. In Berkeley County the place of service deserves extra care, because a Goose Creek or Summerville street address may sit in another county, and the affidavit should reflect where service actually happened.

When abode service is challenged, the affidavit should show that the person who took the papers lived at the dwelling and was of suitable age and discretion. Military households with frequent moves raise the separate question of whether the address was still the defendant's usual abode, and our notes record what the server learned. On a short timeline, our faster service tiers help, and the practical guide to South Carolina service explains each method.

06South Carolina service rules

Summons Service, Other Process and the Answer Clock

A summons may be served by the sheriff, a deputy or any person 18 or older who is neither a party to nor an attorney in the action, under SCRCP 4(c). The rule's second sentence routes orders, rules and writs to the sheriff, another law enforcement officer or a person the court designates. South Carolina has no statewide license for private process servers, and DFS claims no South Carolina license or appointment. The qualifications to serve in South Carolina are summarized in our guide.

Methods include personal delivery, abode delivery to a resident of suitable age and discretion, an authorized agent, restricted-delivery certified mail and a qualifying commercial delivery service; the mail and courier routes support a default only with the defendant's signature. If the statute of limitations has run when the case is filed, actual service generally must be made within 120 days (SCRCP 3(a)). Defendants generally answer within 30 days of service (SCRCP 12(a)). Your attorney can confirm how these apply.

07Local angle

One Clerk With Three Phone Lines for a Long County

Berkeley County stretches from the Cooper River suburbs to St. Stephen in the north, and its Clerk of Court lists a main number in Moncks Corner plus extensions reachable from the Charleston area and from St. Stephen. That detail says a lot about the county's shape, and you can contact DFS with a Berkeley question before choosing a tier. For service, it means the same case can involve a Daniel Island condominium and a farmhouse at the far end of the county, which we quote and schedule as separate runs.

Because Berkeley shares the 9th Circuit and the federal Charleston division with Charleston County, many cases name defendants on both sides of the Cooper. We coordinate through Charleston County papers and attempts or Dorchester County service under one written quote, and the rate finder for each South Carolina county shows the starting rates, including Dorchester at $130 and Charleston at $125, so a multi-county file is priced county by county.

FAQ

Frequently Asked Questions

Who can serve a summons in Berkeley County?

Under SCRCP 4(c), the sheriff, a deputy or any person at least 18 who is not a party to or an attorney in the case may serve a summons. Court orders, rules and writs are generally left to the sheriff or a court-designated person. Our South Carolina process server hub explains how DFS handles each paper type.

What does a Goose Creek process server cost?

Berkeley County carries a $125 published Routine starting rate. Urgent costs 1.5 times that base, Rush double and Same Day Rush triple. The final price depends on the address, whether it is suburban or far north in the county, the number of people to serve and your deadline, and it is confirmed in writing first.

Can you serve someone at the Naval Weapons Station?

Access to an installation is governed by the base's own rules, so we agree on an approach with counsel before attempting service. Default judgments against servicemembers raise Servicemembers Civil Relief Act questions, and a court generally requires an affidavit on military status before entering a default. Your attorney decides the route, and our service help for unreachable defendants explains how attempts are logged.

Is Daniel Island in Charleston County or Berkeley County?

Daniel Island is part of the city of Charleston but lies in Berkeley County. That matters for magistrate filings, sheriff service and non-party deposition subpoenas, which must be issued from and served in the county where the witness lives, works or regularly does business in person. We confirm the county for every address before quoting.

Will you serve a rule to vacate in Berkeley County?

Not as a standard service. Magistrate courts we checked send the rule through the sheriff's office, and only a constable or deputy sheriff executes a writ of ejectment. A rule is accepted only after the magistrate court confirms that private service works there. Our South Carolina eviction steps guide explains what follows service.

How long does a Berkeley County defendant have to answer?

Ordinarily the answer is due 30 days after the complaint is served, under SCRCP 12(a). The self-represented divorce summons states 35 days when service was by restricted-delivery certified mail, and magistrate court answers are due within 30 days from the first day after service. Our affidavit records the exact service date so the deadline is clear.

Do you serve papers on Sundays in Berkeley County?

With counsel's approval, yes. Sunday delivery of judicial documents is lawful under S.C. Code 15-9-17, except to someone heading to, attending or leaving a church or other religious service. We confirm the plan with you first. A Sunday attempt can reach shift workers who are rarely home during the week, and each one is logged.

How are Berkeley County employers and companies served?

Most are served through the registered agent, or through an officer or managing agent as SCRCP 4(d)(3) allows. When a South Carolina corporation has no agent who can be served with reasonable diligence, the court or clerk can order certified mail to the corporate secretary (S.C. Code 15-9-210(c)). See our business service options.

Where are Berkeley County federal cases heard?

Berkeley County is in the Charleston division of the District of South Carolina, with cases heard at the Waring Judicial Center on Meeting Street or the courthouse at 85 Broad Street. We serve those federal summonses and subpoenas under the federal rules, which also allow state-law methods, and write the affidavit for that court.

What if the defendant recently moved off base or out of state?

We report what the server learned and log the attempt. If the defendant cannot be found in South Carolina after due diligence, counsel may seek publication under S.C. Code 15-9-710, and personal service outside the state is treated as equivalent to publication under S.C. Code 15-9-750. Our guide for avoided service covers next steps.
