Quick answer
How do I hire a process server in DeKalb County?
Send the filed papers, every address you have and your deadline. We confirm whether the address is really in DeKalb, which court issued the papers and what it accepts, then quote in writing and log each visit. Routine service starts at a published $125; DeKalb and other county rates are on the rate map.
01Local service landscape
Thirteen Cities and the Neighborhoods Between Them
DeKalb County holds about 774,000 people (2025 estimate) in thirteen cities and a large unincorporated area. Brookhaven, Dunwoody, Tucker and Stonecrest are among the newer cities, and part of Atlanta itself lies inside DeKalb. That means an Atlanta mailing address can be a DeKalb case. Our Dunwoody process serving page shows how the northern office and apartment districts are handled.
Three interstates shape the work. I-285 crosses the north end at the Top End and meets I-85 at the Tom Moreland Interchange, known as Spaghetti Junction; I-20 runs east through Stonecrest toward Rockdale; and I-85 cuts through the Chamblee and Doraville area. Our servers schedule by area so attempts on both sides of the Perimeter are not stacked into the same rush hour. See the Georgia rate map for county tiers.
- North: Dunwoody, Brookhaven, Chamblee, Doraville
- Central: Decatur, Avondale Estates, Druid Hills, Tucker
- East: Clarkston, Stone Mountain, Pine Lake
- South and east: Lithonia, Stonecrest

Supporting Decatur Litigators and Firms Filing From Elsewhere
Decatur's courthouse complex on McDonough Street draws a steady civil docket, and many Atlanta and out-of-state firms file there because a defendant lives or does business in DeKalb. Counsel usually need the summons and complaint served together, a dependable return and updates they do not have to request. Our service program for litigators describes how we take instructions and report each attempt.
DeKalb defendants include apartment owners, medical practices, retailers and many small businesses. We serve an officer, a managing agent at the Georgia office or the registered agent, and tell counsel when the Secretary of State fallback might become necessary. When the case was filed in another state, we match the DeKalb delivery to that court's rule, as our foreign papers page explains.
03Evasive and hard-to-serve
Large Complexes, Controlled Entry and Repeat No-Answers
Apartment communities along the Buford Highway, I-285 and I-20 corridors are a large part of DeKalb service, and many use controlled entry. Georgia law gives an authorized server limited entry to gated or secured communities after naming the person to be served and showing photo ID and proof of appointment. We prepare the approach before the visit, record how entry was handled in the log, and quote faster tiers for DeKalb deadlines in writing when time is short.
When a defendant ignores the door, we change the hours and days, try a workplace if counsel approves, and keep a dated entry for every attempt. That record supports any later request to the court about alternative service or publication, because judges look for specifics rather than a bare statement that the person could not be reached. Our guide for evasive defendants and hard-to-serve page explain what a strong diligence log looks like in Georgia.
- Controlled-entry apartment communities
- Townhomes and condos near the Perimeter
- Shift workers on I-20 and I-85
- Dated entries for every attempt

Decatur Divorce Cases, Magistrate Claims and Dispossessory Questions
Divorce and custody papers filed in DeKalb Superior Court follow the Civil Practice Act, so personal service, abode service at the spouse's home or a signed acknowledgment are the usual choices. We serve them respectfully and confirm identity before anything is handed over. DeKalb Magistrate Court hears claims of $15,000 or less; our statement of claim service covers the 30-day answer period.
Since July 1, 2025, Georgia's dispossessory statute lists an approved process server alongside the sheriff and constable, but it does not say how a server is approved. Courts handle that differently, so we confirm DeKalb Magistrate Court's practice before taking a dispossessory, and we never carry out evictions. The Georgia dispossessory service page and DeKalb subpoena delivery give more detail.
05Documentation and challenges
Returns That Answer the Questions Opposing Counsel Will Ask
A Georgia affidavit of service must state the date, place and manner of service and be filed with the court where the case is pending. Until proof is filed, the defendant's time to answer generally does not begin. We return the signed affidavit quickly so counsel can file within five business days, as O.C.G.A. 9-11-4(h) contemplates. Our step-by-step service guide lists each element.
Service challenges in DeKalb often involve apartment numbering, an abode recipient who may not live at the unit, or a dispute about who accepted papers for a business. Because our notes are written at each attempt, counsel can answer with facts. Courts may also allow proof to be amended if it does not prejudice the defendant. Reach our team when a re-serve or supplemental affidavit is needed.
06Georgia service rules
How Georgia Decides Who Serves a DeKalb Summons
Georgia's Civil Practice Act lists the people who may serve: a sheriff or deputy, a marshal, a citizen specially appointed by the court, a non-party adult appointed by the court or as a permanent process server, and a certified process server under O.C.G.A. 9-11-4.1. Certified servers may serve only in counties whose sheriff accepts their yearly notice of intent. Our who-may-serve guide compares the categories.
DFS makes no claim to a Georgia certification or a DeKalb appointment. For each file, we assign a server who meets that court's requirements for the paper and confirm it in writing before accepting the serve. When a court will not take private service for a document, we say so plainly and the papers go through the Sheriff. The Georgia statewide service hub has the broader picture.

When an Atlanta Address Belongs in Decatur
Part of the City of Atlanta lies in DeKalb, so an Atlanta address does not automatically mean a Fulton case or a Fulton return. Neighborhoods east of the city line, along with Druid Hills and the Emory area, are common sources of confusion. We check the county before quoting and state it in the affidavit. When the address turns out to be in Fulton, our Fulton County process servers take it under the same quote.
DeKalb also shares long borders with Gwinnett and Rockdale. Tucker and Stone Mountain residents often work across the Gwinnett line, and Stonecrest and Lithonia sit near Rockdale on I-20. We coordinate attempts across those lines without a new quote through Stonecrest service and Rockdale County coverage, so one case keeps one record. Delator Group's standards apply on both sides of the line.

Process Servers Near DeKalb County
DeKalb sits between Atlanta and the eastern suburbs, so many cases reach into the counties around it. Peachtree Corners, Norcross and Lilburn fall under Gwinnett County process service, and the southern edge near Ellenwood borders Henry County coverage. Within DeKalb, our city pages cover Brookhaven service and the Dunwoody office districts, while Conyers and the I-20 corridor east of Stonecrest fall to Rockdale. Every page uses the same written quote, logged attempts and signed affidavit, so a case with defendants in two or three counties reads as one file.
FAQ
Frequently Asked Questions
Who can serve a summons in DeKalb County?
Georgia generally permits a sheriff or deputy, a marshal, a court-appointed or permanent process server, or a certified server whose notice of intent the DeKalb Sheriff accepts. Whether a particular court accepts private service for a particular paper can vary. We assign a qualified server for that court and confirm it in writing before taking the serve.
How much does a process server in DeKalb County cost?
DeKalb's published Routine starting rate is $125. Urgent is 1.5 times that, Rush is double, and Same Day Rush is triple. The price for your file depends on the address, the deadline and the documents, and it is confirmed in writing before the first attempt. Our rush and same day page explains when the faster tiers make sense.
My defendant has an Atlanta address. Is that DeKalb or Fulton?
It can be either. Part of the City of Atlanta lies in DeKalb, and neighborhoods near the city line are often misread. We check the county before quoting and note it in the affidavit. Your attorney decides venue, but you will know which county the address is in before any attempt is made.
Can papers be left with a roommate in a DeKalb apartment?
Possibly. Abode service under O.C.G.A. 9-11-4(e)(7) generally requires leaving the papers at the defendant's dwelling with a person of suitable age and discretion who resides there. A roommate who lives in the unit may qualify; a visitor or leasing agent generally does not. The affidavit describes the recipient so the court can judge it.
Will you take a DeKalb dispossessory?
Only after confirming the Magistrate Court's current practice. The 2025 change to O.C.G.A. 44-7-51 lists an approved process server without defining the term, and courts handle it differently. Executing a writ or a set-out is outside what we do in DeKalb. The Georgia eviction service guide explains the 7-day answer period, the tack-and-mail fallback and why a money judgment after posting needs an appearance.
How long does a defendant have to answer in DeKalb?
In superior and state court, a defendant served with a summons generally has 30 days. In magistrate civil claims, the answer is generally due within 30 days and may be written or oral. A dispossessory answer is due within seven days of service. Counsel should confirm the exact deadline for the case.
What if the DeKalb defendant keeps avoiding service?
We vary attempt times, try a workplace where counsel approves, and log every visit. If those efforts do not succeed, counsel may ask the court about publication under O.C.G.A. 9-11-4(f)(1), which requires showing the defendant cannot be found after due diligence or is concealing himself. Our publication service guide covers the clerk's process.
Can you serve divorce papers in DeKalb discreetly?
Yes. We plan family-law deliveries to avoid scenes, serve the spouse personally or at the residence, and confirm identity before handing anything over. Many couples use a signed acknowledgment instead, which avoids a visit entirely. The Georgia divorce service guide explains each option, and our DeKalb family papers page covers the waiting period counsel should confirm.
Do you serve subpoenas for DeKalb hearings?
Yes. Any person 18 or older may generally serve a Georgia subpoena under O.C.G.A. 24-13-24. When the witness lives outside the county where testimony will be given, the subpoena is valid only if served with a tender of one day's $25 fee plus 45 cents a mile. Send the tender with the subpoena and we document it in the return.
What goes into a DeKalb affidavit of service?
It states the date, place and manner of service, identifies who received the papers and how they were identified, and is signed by the server. For abode service it describes the resident who accepted. We also keep the attempt log behind it, so counsel can answer any later challenge with details recorded at the time.
