Quick answer

Which court handles a Roanoke County case, and where is it?

Roanoke County's circuit and general district courts are at 305 E. Main St. in Salem, which is itself an independent city. The City of Roanoke has separate courts on West Church Avenue. We confirm the locality for every address, serve the papers and return the private-server affidavit to the Salem clerk. Routine county service starts at $170; see our Roanoke city process servers.

01Local service landscape

Suburbs Around Two Cities That Are Not Part of the County

Roanoke County's map is unusual even for Virginia. The cities of Roanoke and Salem sit inside the county's outer boundary but are not part of it, so the county is a ring of suburbs, mountains and valleys around them. Most residents live in suburban areas near the two cities, in places such as Cave Spring, with about 26,755 people in 2020, and Hollins, about 15,574, while the north and west stay rural and mountainous. Our Virginia process server coverage sorts addresses by locality before quoting, and the Vinton and county rates appear beside the two cities' rates.

Vinton, east of the City of Roanoke, is the county's only incorporated town. County administration is in Cave Spring, but the courthouse stayed in Salem. That leaves a server working three localities in a single afternoon, and three different clerks if the case papers are not read carefully. Our Montgomery County process service handles the next valley west along I-81.

02Attorneys and law firms

Downtown Roanoke Firms and the Salem Courthouse

Most Roanoke Valley firms practice in all three of the 23rd Circuit's courts: the City of Roanoke's on West Church Avenue, Salem's, and Roanoke County's at 305 E. Main St. in Salem. They expect a server who knows a Cave Spring address goes to the county clerk even though it carries a Roanoke mailing address. We check the locality against the property record and the case caption before every serve. Our Virginia law firm process serving page explains intake, and corporate defendants go through our registered agent service in the Roanoke Valley.

The Western District's Roanoke Division sits downtown on Franklin Road, so federal and state cases often run side by side. Firms filing in both systems want returns that match each court's format, and we prepare them that way. When defendants live farther out, our Bedford County process servers cover Smith Mountain Lake and the east, and our New River Valley team covers the west, under one written quote with a separate return for each serve.

03Evasive and hard-to-serve

Mountain Roads, Gated Drives and Cul-de-Sacs

The Roanoke Valley is ringed by ridges, and some county homes sit on steep private drives where a car cannot simply pull to the door. Other defendants live in quiet suburban cul-de-sacs where an unfamiliar car is noticed quickly. We plan each attempt around the setting, spread attempts across weekday evenings and Saturdays, and never attempt on Sunday. Every visit goes in the log. Our Virginia evasive defendant service page covers the method.

When a defendant avoids the door, Va. Code § 8.01-296 permits delivery to a family member 16 or older at the usual place of abode, with an explanation of what the papers are, and then posting at the front or main entrance. Posting is not the end of the process: the filing side mails a copy and files a certificate of mailing at least 10 days before default. The guide to posted service in Virginia explains the timing, and the guide to avoided service in Virginia covers waiver and publication.

04Family law, evictions, small claims, subpoenas

Family Cases, Unlawful Detainer, Small Claims and Subpoenas

Divorce complaints for county residents go to Roanoke County Circuit Court in Salem, while custody and support cases go to the county's Juvenile and Domestic Relations District Court. A spouse may accept service in writing under Va. Code § 20-99.1:1, and we serve the complaint when that does not happen. A protective order in the same family is a law-enforcement serve, not ours. The Virginia divorce papers guide explains acceptance and service.

Landlords with county properties may have a private server deliver the unlawful detainer summons, at least 10 days before the return day. The writ that follows a judgment belongs to the sheriff, and our Virginia unlawful detainer papers work ends with the summons. Small claims reach $5,000. For witness subpoenas, an attorney-issued subpoena sent at least five business days before the appearance gives the court firmer footing to enforce it; our subpoena delivery in Virginia page explains more.

  • Divorce: Roanoke County Circuit Court, Salem
  • Custody and support: Roanoke County J&DR
  • Unlawful detainer: summons 10+ days before return
  • Small claims: up to $5,000

05Documentation and challenges

Returns That Hold Up in a Three-Locality Circuit

The fastest way to lose time in the 23rd Circuit is a return that goes to the wrong clerk or names the wrong locality. Each return we prepare repeats the court and case exactly as the papers state and contains everything Va. Code § 8.01-325 requires of a private server: the qualifications affidavit, date and manner of service, name of the person served, private-server notation, and the server's name, address and telephone number.

Returns generally go to the issuing clerk within 72 hours of service, and counsel receives the attempt log with them. If a defendant later claims no one ever came, the log shows the dates, times, observations and any words exchanged. Lower-dollar cases served through our small claims service in Virginia receive the same log, because a $3,000 claim can be contested as hard as a large one. When the defendant has left Virginia, our out-of-state service of process keeps that same format.

06Virginia service rules

Virginia's Rules on Who Serves and When, in Brief

Va. Code § 8.01-293 generally allows service by a sheriff or by any adult 18 or older who is not a party and has no interest in the case. Virginia has no statewide license for private servers, so the protection lies in the qualifications affidavit on every return. A handful of acts belong only to officers: executing writs of possession, levying on property and serving capiases or show cause orders. Read the Virginia guide to who can serve for the details.

A serve completed in the first year after filing is timely under Va. Code § 8.01-275.1, and one completed later stands only on a due-diligence finding. A circuit court defendant generally has 21 days after service to respond under Rule 3:8. Civil process may not be served on Sunday. Your attorney can confirm how these apply, and the how to serve papers in Virginia guide collects them.

07A Roanoke County angle

Catawba Mountain, the Trail and the Quiet Back Valleys

McAfee Knob, on Catawba Mountain at about 3,197 feet, is a well-known stop on the Appalachian Trail, and its trailhead parking is on Route 311 in the Catawba area. That is a reminder that much of the county's northwest is mountain and farm valley rather than suburb. Addresses there are spread out, mail may go to rural boxes, and a missed attempt costs real time. We schedule those serves with extra planning and tell counsel up front what to expect.

The county's northern edge, near the Botetourt line, includes the Hollins area and Hollins University. A census place that extends into a neighboring county is a clue to check the locality carefully, and we do. Defendants who work in downtown Roanoke are often easier to reach there, and our Roanoke city team and Lynchburg process servers to the east coordinate under one quote.

FAQ

Frequently Asked Questions

Is the City of Roanoke part of Roanoke County?

No. The City of Roanoke and the City of Salem are independent cities inside the county's outer boundary but not part of it. Each has its own courts. A Roanoke mailing address can belong to either the city or the county, so we confirm the locality before quoting. Our Roanoke city process service handles city addresses.

Why is the Roanoke County courthouse in Salem?

Salem was the county seat before it became an independent city, and the county courthouse remained there afterward. County administration moved to Cave Spring. Today the Roanoke County circuit and general district courts are at 305 E. Main St. in Salem, and returns for county cases go to those clerks.

What does service cost in Roanoke County?

The published Routine starting rate for Roanoke County is $170. That makes Urgent about $255, Rush $340 and Same Day Rush $510. The City of Salem has its own rate, $200 Routine, and the City of Roanoke matches the county at $170. The final price is always confirmed in writing before the first attempt; our Virginia rate map shows every locality.

Can a private server serve papers in Roanoke County?

Generally yes. Va. Code § 8.01-293 allows the sheriff or any adult 18 or older who is not a party or otherwise interested to serve process. Eviction writs, levies and capiases are reserved to the sheriff and other officers. Virginia does not license private servers, and every return we file includes the qualifications affidavit.

Is Vinton handled by the county courts?

Yes. Vinton is an incorporated town inside Roanoke County, not an independent city, so its civil cases go to the Roanoke County courts in Salem. We serve Vinton addresses at the county rate of $170 Routine, and returns go to the Salem clerks like any other county case. Vinton sits next to the City of Roanoke, so we check each address against the line before quoting.

What if the defendant lives on a gated mountain property?

We review the address before the first attempt, look for lawful points of contact such as a public road entrance or a workplace, and never enter private property without lawful access. If personal delivery keeps failing, Virginia's substituted service and posting steps may apply, and counsel decides how to proceed.

How long does a Roanoke County defendant have to respond?

In a circuit court case, Rule 3:8 generally gives the defendant 21 days after service of the summons and complaint. General district court cases run on the return date stated on the warrant or summons, which is why late service there can be costly. Counsel can calculate the exact date from the return, which is one reason we file returns promptly.

Do you serve federal court papers in Roanoke County?

Yes. Federal summonses and subpoenas, whether from the Western District's Roanoke Division or from courts elsewhere, can be served here under the applicable federal rules, with the proof of service prepared for that court. Tell us the court, the deadline and any special instructions at intake, and see federal and out-of-state papers for more.

Can papers be posted on the door in Roanoke County?

Posting at the front or main entrance is allowed under Va. Code § 8.01-296 only after personal service and delivery to a family member 16 or older have not worked. The filing side must then mail a copy and file a certificate of mailing at least 10 days before default. Our guide for defendants who avoid service covers it.

No. Delator Field Services is the division of Delator Group, a Tennessee firm headquartered in Nashville, that handles service of papers.
