Quick answer

How do I hire a process server in Roanoke?

Send the filed papers and the street address. We first confirm whether the address is in the City of Roanoke, Roanoke County or Salem, since each has its own clerk and published rate. Then we identify the court and send the price in writing. City addresses start at $170 Routine, and Roanoke County service covers the surrounding county.

01Local service landscape

A Mountain Valley City With Dozens of Neighborhoods

Roanoke sits in a valley ringed by the Blue Ridge, and the city recognizes about four dozen official neighborhoods, from the Victorian streets of Old Southwest to post-war subdivisions in Greater Deyerle and the commercial strip along Williamson Road. Mill Mountain, with its lighted star, rises just south of downtown. Housing ranges from older rentals near the core to hillside homes on narrow, steep streets, which we account for when planning routes. The Virginia locality rate map shows the city beside its neighbors.

Interstate 81 runs along the valley's northwest edge, and the I-581 spur carries traffic from I-81 into downtown. Weather in the western part of Virginia can delay attempts at hillside or rural-edge addresses, and we note any delay in the log rather than rushing a visit. Every civil return for a city case goes to the courts at 315 West Church Avenue. When the defendant lives beyond the city limits, the job moves to Roanoke County process serving, which covers Cave Spring and the Town of Vinton, or to Bedford County service farther east.

02Attorneys and law firms

Supporting Roanoke Valley Firms in State and Federal Court

Roanoke is the legal center for much of western Virginia. The Western District's Roanoke Division clerk works from the federal building on Franklin Road, and that division takes cases from the Roanoke Valley, the New River Valley and counties south toward Martinsville and Galax. Local firms send us complaints, collection suits, injury cases and witness subpoenas, and firms in Richmond, Northern Virginia or out of state send defendants who live in the city. Our attorney service in Virginia keeps each file with one contact.

The Western District's civil divisions are not the same as its bankruptcy divisions, so we read the caption before dispatch. Federal summonses follow Federal Rule 4, and state-court plaintiffs may first try a waiver of service under Va. Code 8.01-286.1. For a subpoena from another state, the clerk of the Virginia circuit court where discovery will happen issues a Virginia subpoena that we then serve. Counsel can read our notes on out-of-state papers and how Virginia subpoenas are served.

03Evasive and hard-to-serve

Shift Work, Older Rentals and Hillside Addresses

Some Roanoke defendants work rotating or overnight shifts, which leaves homes empty at predictable times. We ask counsel for any known schedule and spread attempts across early mornings, evenings and Saturdays. In older neighborhoods, a single house may be split into several units with one shared door and no clear labels, and we note which entrance was used and who answered. The Virginia service for hard-to-reach defendants page explains how those visits are recorded.

Hillside homes in South Roanoke or near Mill Mountain may sit well above the street, and some have no visible door from the road. We do not cross posted barriers or enter fenced areas without permission. Under Va. Code 8.01-289, civil process cannot be served on Sunday, so the plan covers six days a week. When a defendant keeps avoiding contact, counsel can use our log to weigh the options in the guide to avoided service in Virginia, and Montgomery County service picks up if the person has moved west.

04Family law, landlords and subpoenas

Divorce, Custody, Unlawful Detainer and Small Claims

A divorce in the City of Roanoke begins with a complaint at the circuit court clerk's office on West Church Avenue, while custody, visitation and support start in the city's Juvenile and Domestic Relations District Court. Va. Code 20-99.1:1 lets a spouse accept service by a notarized writing or by signing before the clerk, and many lawyers request that first. When personal delivery is needed, we keep it discreet and describe the recipient precisely. The Virginia divorce paper service page outlines the options.

Landlords file unlawful detainer cases in the general district court. Under Va. Code 8.01-126, a private server may deliver the summons, provided it is served at least 10 days before the return day. After judgment, the sheriff executes the writ of eviction and gives the tenant at least 72 hours' notice, and we have no part in that step. Small claims up to $5,000 are covered on the Virginia small claims page, and the unlawful detainer guide for Virginia covers the tenant timeline.

  • Divorce filed on West Church Avenue
  • Custody and support in J&DR
  • Unlawful detainer summons only
  • Small claims to $5,000

05Documentation

What a City of Roanoke Return Contains

A private server's return in Virginia must satisfy Va. Code 8.01-325. Ours lists the server's affidavit of qualifications, the date and manner of service, the name of the party served, an annotation that the service was made by a private server, and the server's name, address and telephone number. It is returned to the clerk within 72 hours unless the court directs otherwise, and a deadline that falls on a weekend or holiday moves to the next business day. The Virginia guide to serving legal papers shows the steps.

Each job also produces a dated attempt log with the address, date and time, the entrance used and any conversation at the door. If a defendant later disputes service, counsel has the specifics. Outside Tennessee, serves may be carried out by vetted servers Delator contracts with, and they all follow the same written documentation standard. For short deadlines, Virginia rush and same day service applies the same standard, and the multistate rate map shows the tier prices.

06Virginia rules

How Virginia's Service Rules Apply in Roanoke

Va. Code 8.01-293 allows service by the sheriff or by any person 18 or older who is not a party or otherwise interested in the case, and it calls such a person a private process server when a fee is charged. Virginia does not license the work. Officers alone may execute writs of possession, levy on property or serve a capias or show cause order, and protective orders go to law enforcement. We decline all of those, as our Virginia guide to who may serve process explains.

Individuals are served under Va. Code 8.01-296, beginning with personal delivery. If the defendant is not found at the usual place of abode, a family member 16 or older living there, not a temporary guest, may receive a copy with an explanation. If that fails, the copy may be posted at the main entrance, and the filing party or its attorney then mails a copy and files a certificate of mailing at least 10 days before default. The posted service guide for Virginia covers the mailing.

07Roanoke angle

City of Roanoke, Roanoke County and Salem Are Three Localities

The City of Roanoke sits inside the boundaries of Roanoke County but is not part of it, and the same is true of Salem. The three share the 23rd Judicial Circuit, yet each has its own circuit court clerk and its own general district court. Roanoke County's courthouse is in Salem at 305 East Main Street, while the city's courts are on West Church Avenue. A Roanoke, VA mailing address can belong to a home in the county, such as one in Cave Spring, so we check the parcel before quoting.

The distinction changes the rate as well as the clerk. The city's published Routine starting rate is $170, while Roanoke County and Salem carry their own figures. A process server in Roanoke who confirms the locality first gives counsel the right price, the right clerk for the return and the right sheriff if a private serve fails. When the address is outside the city, Lynchburg process service and the other Western Virginia pages pick up, and Delator Group's about page explains who manages the work.

FAQ

Frequently Asked Questions

Who can serve papers in the City of Roanoke?

Under Va. Code 8.01-293, the sheriff or any adult 18 or older who is not a party and has no interest in the subject matter may serve process. Such a person working for a fee is a private process server. Virginia has no license for the role, but the return must include an affidavit of the server's qualifications.

What does a process server in Roanoke cost?

The City of Roanoke's published Routine starting rate is $170, which puts Urgent at $255, Rush at $340 and Same Day Rush at $510. Your final price depends on the papers, the address and the deadline, and we confirm it in writing first. Roanoke County and Salem have separate published rates.

Is my Roanoke address in the city or the county?

A Roanoke, VA mailing address may be in the independent City of Roanoke or in Roanoke County, which surrounds the city but does not include it. Salem is a third, separate city. Each has its own clerk and published rate. Send the full street address and we confirm the locality before quoting.

Where are the Roanoke County courts?

Roanoke County's circuit and general district courts are in Salem at 305 East Main Street, even though Salem is a separate independent city. City of Roanoke cases go to 315 West Church Avenue instead. We read the issuing court on the summons before filing the return, so proof reaches the right clerk. County addresses are handled on our Roanoke County serves page.

Can you serve an unlawful detainer in Roanoke?

We serve the summons. Va. Code 8.01-126 allows private service of the unlawful detainer summons, which must be delivered at least 10 days before the return day. The writ of eviction is executed by the sheriff after at least 72 hours' notice to the tenant. Our Virginia eviction papers service page explains the sequence.

Do you serve federal papers in Roanoke?

Yes. The Western District of Virginia's Roanoke Division clerk is at 210 Franklin Road SW, and federal summonses follow Federal Rule 4. We serve those papers anywhere in the city and nearby counties and provide proof formatted for the federal file. The Western District's bankruptcy divisions differ, so counsel should confirm the court.

Do you serve papers on Sunday in Roanoke?

No. Va. Code 8.01-289 bars serving civil process on Sunday except in narrow cases such as persons escaping custody. We schedule early mornings, evenings and Saturdays instead, and the attempt log shows that full pattern if a defendant later challenges the diligence of the effort. Our Virginia evasive defendant service explains the scheduling.

How long does a Roanoke defendant have to respond?

In circuit court, Rule 3:8(a) of the Rules of the Supreme Court of Virginia generally allows 21 days after service of the summons and complaint. In the general district court, the date that matters is the return date printed on the warrant or summons. A waiver of service under Va. Code 8.01-286.1 changes the timing, so counsel should confirm the deadline.

Can you serve a Roanoke business?

Yes. For a Virginia corporation, Va. Code 8.01-299 permits delivery to any officer, director or registered agent; a Virginia LLC is served through its registered agent. If no registered agent can be found with reasonable diligence, the Clerk of the State Corporation Commission may become the agent, handled through the Clerk's office. See Virginia registered agent service.
