Quick answer

Can I hire a private investigator to catch a cheating spouse in Idaho?

Yes. Idaho has no statewide private investigator license, but investigators must still obey the state's stalking, trespass, eavesdropping and voyeurism laws. A careful investigator documents a spouse only from places open to the public and never tracks a car without the right to do so. Our Idaho surveillance team works within those limits at $100 per hour.

01Idaho divorce law

Why Evidence of an Affair Still Matters in an Idaho Divorce

Idaho lets a spouse file on several grounds. Idaho Code § 32-603 lists adultery alongside extreme cruelty, wilful desertion and irreconcilable differences, and most couples proceed on the no-fault ground. That does not make the affair irrelevant. Spousal maintenance under § 32-705 is decided with a list of factors that expressly includes the fault of either party, so proof of an affair can shape what support is awarded. Our attorney support desk works with Idaho family lawyers who need that evidence organized for a hearing.

Property is treated differently. Idaho is a community property state, and § 32-712 starts from a presumption of a substantially equal division of the community estate, with factors that do not include marital fault. Money is where the affair can still count. Under § 32-906, income earned during the marriage is community property, so gifts, rent or travel paid for another partner may raise questions your attorney will want answered. Our guide to hidden assets in an Idaho divorce explains how that spending is usually traced.

02The work

What an Idaho Infidelity Surveillance Record Shows

A useful record answers a narrow question: where the spouse went, who they met and how they behaved together in public. Our investigators begin at a known point, such as the workplace parking lot at quitting time, and follow at a lawful distance. Every stop is logged with a time, an address and photographs taken from a street, sidewalk or business open to the public. When the evening ends at lodging, our hotel and motel surveillance methods cover arrivals and departures without ever approaching a room.

The companion matters as much as the meeting. If a spouse repeatedly meets the same person, we can identify that person lawfully through public records, from a $102 basic check to a $300 deep-dive history run through our relationship background checks. The final report pairs the photographs with a plain narrative, notes any gap in coverage honestly and avoids guesswork about what happened behind closed doors. Counsel can then decide whether the facts justify more field surveillance across Idaho or whether the question is already answered.

  • Times the spouse came and went at every stop
  • Vehicles used and who drove
  • Companions, with lawful identification if requested
  • Public displays of affection, documented without commentary
  • Time-stamped photographs from public vantage points

When the Affair Touches Custody and Parenting Time

An affair by itself rarely decides custody in Idaho. Courts apply the best-interest factors in Idaho Code § 32-717, including the child's adjustment to home, school and community, the need for continuity and stability, and domestic violence whether or not it happened in front of the child. Section 32-717B adds a presumption that joint custody serves the child, which reverses if a parent is a habitual perpetrator of domestic violence. These cases are usually heard in the magistrate division of the district court in your county.

What the affair can show is how a parent spends parenting time. If a spouse leaves young children with a new partner they barely know, skips school pickups or brings the children to overnight stays, those facts relate directly to the statutory factors. We document them carefully and keep children out of photographs wherever possible. Our guide to Idaho custody investigations explains what judges tend to weigh, and our Meridian family investigators handle many Ada County parenting files.

05Idaho geography

Two Time Zones, One North-South Highway and a Lot of Distance

Idaho is a hard state to follow someone across. The Panhandle and the Lewiston and Moscow area run on Pacific Time while the south keeps Mountain Time, so a spouse who says they left work at five may mean either. US-95 is the only road connecting the Panhandle with the rest of the state, and Boise to Coeur d'Alene is roughly 380 to 390 miles. We plan northern and southern coverage as separate operations, and our Coeur d'Alene infidelity investigators handle Kootenai County files directly.

The Treasure Valley is a different problem. Ada and Canyon counties together held about 821,000 people in the 2025 Census estimate, and traffic on I-84 between Boise, Meridian, Nampa and Caldwell makes a mobile follow harder at rush hour. In eastern Idaho, I-15 connects Pocatello, Blackfoot and Idaho Falls, and our Idaho Falls surveillance team covers Bonneville County. When a spouse crosses into Washington, Utah or another neighboring state, our out-of-state infidelity coordinators take over the planning.

Discretion in Small Towns and How to Vet an Investigator Without a State License

In a town of a few thousand people, a strange car parked on the same street two nights running gets noticed. We rotate vehicles, vary positions and sometimes recommend fewer, better-timed shifts rather than long stakeouts that risk exposure. Communication goes only to you or your attorney, through the channel you choose. If your spouse shares your phone plan or email, tell us at the first call so we never send anything they might see.

Idaho does not issue a statewide private investigator license, although some cities, such as Chubbuck and Coeur d'Alene, regulate investigators or detective agents locally, so current requirements should be confirmed for work inside city limits. That leaves vetting to you. Delator Group holds a Tennessee private investigation license and runs every Idaho spouse case to the same written standard. Our checklist for vetting an investigator lists the questions to ask any firm, and you can read about Delator's leadership before you call.

07Price

What Married Infidelity Investigations Cost in Idaho

Surveillance is billed at our standard $100 hourly investigative rate, the same rate we charge in Tennessee. Mileage and travel to rural counties are disclosed before work begins, never added afterward. Most assignments start with two or three shifts timed around the hours you are most worried about, which keeps the cost tied to the question rather than to open-ended watching. Every figure appears on the Idaho service pricing page.

Optional add-ons are priced separately: a $102 basic or $300 deep-dive background check on a companion, and asset research when spending is the real concern. We put the scope, the hours and the total in writing, and any added shift needs your approval first. If you want to understand how estimates are built before calling, our cost guide for hiring an Idaho investigator walks through typical surveillance budgets, or you can request a confidential consultation.

Statewide coverage

Infidelity Investigations Across Idaho

We take spouse cases in every part of the state. Canyon County files are handled by our Nampa infidelity investigators, and the capital area by the Boise private investigators. In the Magic Valley, our Twin Falls surveillance team covers the I-84 and US-93 corridors, while Bannock County cases go to our Pocatello investigators. Rural assignments are planned as separate field trips with travel priced upfront, and every report follows the same format regardless of county. Panhandle and southern files are scheduled separately because of the drive between them.

FAQ

Frequently asked questions

Is adultery still a ground for divorce in Idaho?

Yes. Idaho Code § 32-603 lists adultery among the grounds for divorce, along with irreconcilable differences and several others. Most Idaho divorces proceed on irreconcilable differences, but evidence of an affair can still matter for spousal maintenance, because § 32-705 lists the fault of either party as a factor. Your attorney decides which ground to plead and how to use the evidence.

Will proof of cheating change how property is divided?

Usually not directly. Section 32-712 starts from a substantially equal division of community property and its listed factors do not include fault. The exception is money: if community funds were spent on another partner, your attorney may raise that spending. Our asset tracing service documents where the money went so counsel can decide.

Can I put a GPS tracker on my spouse's car?

Be very careful. Idaho's second-degree stalking statute, § 18-7906, covers maintaining surveillance on a person by electronic means, and that can include covert tracking. Joint ownership of a vehicle does not automatically make tracking lawful. Delator does not place trackers on vehicles it has no right to, and we recommend talking with an attorney before you consider one.

Is it legal to record my husband's or wife's calls?

You may generally record a call you are part of, because Idaho is a one-party consent state under § 18-6702. Recording your spouse's calls with someone else, or hiding a device to capture them, can be a felony. Our legal guide for Idaho investigations explains the difference in more detail.

Do you need a license to investigate infidelity in Idaho?

There is no state-issued private investigator license in Idaho. Some cities, including Chubbuck and Coeur d'Alene, regulate investigators or detective agents locally, so requirements inside city limits should be confirmed. Delator Group is a licensed Tennessee private investigation firm, and it applies that same standard to every Idaho assignment, including insurance, written scope and court-ready reporting.

How many shifts does a spouse case usually need?

Many questions are answered in two to four well-timed shifts, although some spouses are careful and take longer. We report after each shift so you can decide whether to continue, stop or change the timing. No added hours are worked without your written approval, which keeps the budget under your control from start to finish.

Will my spouse find out I hired an investigator?

We take several precautions. Investigators rotate vehicles, avoid repeated positions on quiet streets and never contact your spouse, their employer or their friends. Updates go only through the channel you choose. If your spouse can see your email or phone bill, tell us early so we can set up a safer way to reach you.

Will a magistrate judge see your report?

Our reports are written to be used by attorneys, with dates, times, locations and photographs presented plainly and without speculation. Whether a report is admitted, and how, is a decision for your lawyer and the magistrate judge. Our investigators can be available to testify about what they observed, and our Idaho attorney services page explains how we support counsel.

What if my spouse travels to Washington or Utah?

Many Idaho spouses cross state lines for work or weekends, especially to Spokane from the Panhandle or to Utah from eastern Idaho. We coordinate coverage in the other state at the same hourly rate, with travel disclosed in advance, and the report reads as one continuous record. Our multi-state surveillance planning page explains the handoffs.

What does an Idaho infidelity case cost?

Our investigative rate is $100 per hour, with mileage and travel disclosed before work begins. A typical assignment starts with a few targeted shifts rather than open-ended watching, and an optional companion background check costs $102 basic or $300 deep-dive. The full list is on our statewide pricing page, and your scope is confirmed in writing.
