Quick answer

How do I hire a process server in Atlanta?

Send the filed papers and the address. We confirm whether it sits in Fulton or DeKalb County, which court issued the papers and what that court allows, then send the tier and price in writing. Routine Fulton County service has a published starting rate of $125, and our Georgia process serving overview explains how we work statewide.

01Local service landscape

Serving Papers Across a City That Straddles Two Counties

Atlanta counted 498,715 residents in the 2020 census, and while it is the Fulton County seat, part of the city lies in DeKalb County. That split decides which clerk receives the return, so we confirm the county of every address before we schedule. Papers headed to the DeKalb side are filed in Decatur, and our DeKalb County service page covers that courthouse and the cities around it.

Getting around takes planning. The Downtown Connector carries I-75 and I-85 together through the middle of the city, I-20 crosses east to west, and I-285, the Perimeter, rings the whole region and can slow to a crawl at rush hour. A server who reaches a Midtown tower at 8 a.m. may need a different plan for a West End house at 6 p.m., so attempts are routed by neighborhood, much as we do for Brookhaven process service just north of Buckhead. The Georgia rate map by county shows how Fulton compares with the counties around it.

02Attorneys and law firms

Support for Atlanta Litigators and Out-of-State Counsel

Atlanta is where Georgia's appellate courts sit, where the Northern District hears federal cases on Ted Turner Drive, and where many of the state's largest firms practice. Firms here send us commercial complaints, collection suits, injury cases and deposition subpoenas, and firms in other states regularly need an Atlanta resident or company served. Our service program for Georgia attorneys keeps the quote, attempts and affidavit with one contact.

We read every document before we dispatch. A State Court of Fulton County summons, a federal summons and a foreign subpoena domesticated through the superior court clerk each follow different steps, and we flag gaps early, such as a defendant who has moved to Cobb County or an entity whose registered agent has changed. Firms sending papers from another state can review how we handle out-of-state papers served in Georgia.

03Evasive and hard-to-serve

Concierge Desks, Gated Communities and Defendants Who Will Not Answer

Many Atlanta defendants live behind a front desk. Midtown and Buckhead towers route visitors through concierge staff, and gated townhome communities post guards at the entrance. Georgia law addresses the second situation directly: under O.C.G.A. 9-11-4(f)(4), a person authorized to serve may enter a gated or secured community for a reasonable time after identifying the person to be served and showing photo identification and proof of appointment. Read more on serving defendants who are hard to reach.

When someone simply refuses to come to the door, we change the pattern rather than repeat it. Attempts move to early mornings, evenings and weekends, and each one is logged with the time, what was observed and who answered. If service still cannot be made, that log helps counsel decide whether to ask the court for another method, and the guide for when someone avoids service walks through the options in plain terms.

04Family law, evictions and subpoenas

Divorce, Dispossessory, Magistrate Claims and Subpoenas in Atlanta

Divorce and custody cases are filed in Fulton County Superior Court and are served under the same O.C.G.A. 9-11-4 methods as other civil actions. We handle these quietly, confirm identity before handing anything over and avoid scenes at a workplace when the home is an option. The divorce papers service page explains acknowledgment of service, sheriff service and private service side by side.

Dispossessory cases need extra care. Since July 1, 2025, O.C.G.A. 44-7-51 lets the summons go to the sheriff, a constable or an approved process server, but the statute does not define that last term, and Fulton's landlord pamphlet notes that the Marshal's Department schedules the eviction itself. We confirm the court's current practice before accepting a dispossessory and never carry out a writ. Magistrate civil claims up to $15,000 are covered on our small claims service page, and the Georgia dispossessory service page lists what we confirm first.

  • Divorce and custody summonses
  • Dispossessory summons, only where the court accepts it
  • Magistrate claims up to $15,000
  • Witness subpoenas with fee tender noted

05Documentation

What an Atlanta Affidavit of Service Records

Under O.C.G.A. 9-11-4(h), a private server proves service by affidavit, and the proof must state the date, place and manner of service. It is to be filed within five business days, and a late filing delays the start of the defendant's time to answer. Our Atlanta affidavits meet those points and are backed by a field log of every attempt, successful or not. The step-by-step guide to serving papers in Georgia shows where the affidavit fits.

If a defendant later says they were never served, the record answers the question: the address, the hour, the person who accepted and a physical description. Outside Tennessee, serves may be carried out by vetted servers Delator contracts with, all held to the same written documentation standard. Counsel can ask for the attempt notes at any time, and our same day and rush service uses the same reporting. Divorce filers can compare options in the guide to serving divorce papers in Georgia.

06Georgia rules

Who May Serve Process in Atlanta Under Georgia Law

Georgia is selective about who may deliver a summons. O.C.G.A. 9-11-4(c) generally lists the sheriff or a deputy, a marshal, a citizen specially appointed by the court, a non-party adult appointed by the court or as a permanent process server, and a certified process server under 9-11-4.1. In Fulton County, the Sheriff's civil section takes superior court papers, while state and magistrate court papers go to the Marshal. Our explainer on who can serve process in Georgia goes deeper.

We assign a server who meets the requirements of the court and county involved and confirm that rule in writing before we accept the job. Where a court does not allow a private server for a particular paper, we say so and the papers go through the sheriff or marshal. Once served, a defendant generally has 30 days to answer in superior and state court. These are plain summaries, not legal advice, and your attorney can confirm what applies. More background sits on the About Delator Group page.

Serving Corporations and Registered Agents in Atlanta

Atlanta hosts a large share of the companies sued in Georgia, and many registered agents keep offices in the city. Under O.C.G.A. 9-11-4(e)(1)(A), service on a corporation generally goes to the president or another officer, a managing agent at a Georgia office or the registered agent. If none of them can be served, the Secretary of State can become the agent after the plaintiff certifies a mailing to the registered office. Our business and registered agent service page explains that sequence.

Office towers bring their own logistics: security desks, badge readers and receptionists trained to redirect visitors. We confirm the agent's name and suite before the visit, ask for the right person politely and record the name and title of whoever accepts. When the Atlanta defendant's office is in a neighboring city, the same quote carries over to service in Sandy Springs and Perimeter Center or the Fulton County service page.

Process Servers Near Atlanta

Atlanta papers often leave the city limits. Defendants south of the airport are handled through Clayton County service in Jonesboro, and those across the Chattahoochee in Marietta, Smyrna or Kennesaw go to our Cobb County process servers. Papers headed northeast toward Lawrenceville and Duluth use Gwinnett County service, and the southwest Fulton neighborhoods beyond Cascade fall under process service in South Fulton. Every one of those serves carries the same written quote, dated attempt log and signed affidavit, wherever in Georgia the defendant lives.

FAQ

Frequently Asked Questions

Can any adult serve papers in Atlanta?

Generally, no. Georgia limits who may serve a summons under O.C.G.A. 9-11-4(c) to sheriffs, marshals, court-appointed or permanent process servers, specially appointed citizens and certified process servers. Subpoenas are different: O.C.G.A. 24-13-24 lets any person 18 or older serve one. We confirm which rule applies to your papers before we accept the job.

How much does a process server in Atlanta cost?

Fulton County's published Routine starting rate is $125, which puts Urgent at $188, Rush at $250 and Same Day Rush at $375. What you actually pay turns on the address, the document type and how soon you need it, and we put that number in writing before anyone knocks on a door.

Which courthouse gets the Atlanta return?

The court where the case was filed, not the defendant's address, decides that. Fulton superior court cases go to the clerk at 136 Pryor St. S.W., state and magistrate cases to the Justice Center Tower on Central Avenue, and DeKalb cases to Decatur. We name the issuing court on the affidavit so it can be filed without confusion.

Can you get into a gated community or apartment tower?

Georgia's gated-community rule, O.C.G.A. 9-11-4(f)(4), allows a person authorized to serve to enter for a reasonable time after identifying the person to be served and showing photo ID and proof of appointment. High-rise lobbies have no matching statute, so we work politely with the front desk and record what happened at each visit.

Will you serve an eviction in Atlanta?

Only when the magistrate court confirms it accepts a private server for the dispossessory summons. The 2025 change to O.C.G.A. 44-7-51 added approved process servers but did not define the term, and many courts still use the sheriff or marshal. We never carry out writs or set-outs. See the Georgia eviction service guide for the steps.

How fast can papers be served in Atlanta?

Routine is the standard pace. Urgent, Rush and Same Day Rush move the first attempt earlier for 1.5, 2 and 3 times the Routine rate. Actual timing still depends on the defendant's schedule, building access and traffic, so we give you the planned window in writing rather than promising an hour we cannot control.

Can papers be left with a family member in Atlanta?

Under O.C.G.A. 9-11-4(e)(7), papers can generally be left at the defendant's dwelling with a person of suitable age and discretion who lives there. A neighbor, a visitor or a building employee does not qualify. The affidavit describes the recipient, and your attorney decides whether abode service fits the case, as our countywide Fulton service notes also explain.

What if the defendant cannot be found after several attempts?

We tell you after each failed attempt and keep a dated log. If the person has left Georgia, has moved away or is concealing themselves, counsel may ask the court for service by publication under O.C.G.A. 9-11-4(f)(1), which requires an affidavit showing due diligence. The service by publication guide explains that path.

Do subpoenas for Atlanta witnesses need a fee?

A witness who lives outside the county where testimony is given must generally be served with a tender of one day's fee, $25, plus mileage at 45 cents a mile under O.C.G.A. 24-13-25, or the subpoena is not valid. Tell us where the witness lives and testifies, and our Georgia subpoena service notes the tender on the return.

Do you serve federal court papers in Atlanta?

Yes. The Northern District of Georgia's Atlanta Division sits at 75 Ted Turner Dr. S.W., and federal summonses follow Federal Rule 4. We serve federal papers anywhere in the metro and return an affidavit for the federal file. You can contact Delator Field Services with the case number and deadline to start.
