Quick answer

What do insurance investigations in Idaho cover?

Idaho insurance work typically combines lawful activity checks from public places, recorded statements, scene canvasses, background research and witness locates, organized into a report an adjuster or attorney can rely on. Fraud is graded seriously: Idaho Code § 41-293 makes many false claims a felony. Investigative hours are billed at $100 per hour, as outlined on our Idaho pricing page.

01Idaho law

How Idaho Defines and Grades Insurance Fraud

Idaho Code § 41-293 is the state's main insurance fraud statute. It generally covers presenting false, incomplete or misleading material information in support of a claim, helping prepare such a claim, using runners, offering inducements to file false claims, making false statements to obtain or extend workers' compensation benefits and employer misrepresentation of payroll or headcount. Each instance may be charged separately, which is why claim files built through Idaho claim surveillance note every date and observation separately.

The penalty is significant. A violation is generally a felony punishable by up to 15 years and a fine of up to $15,000, with mandatory restitution. The Idaho Department of Insurance has a Fraud Investigation Unit and a fraud hotline at 1-866-939-7226. Our role is factual: we gather and document information for the carrier or counsel, who decide whether to refer a matter. Defense firms often pair that factual work with our broader support for Idaho defense attorneys.

  • Runners and inducements to file claims
  • Payroll or headcount misrepresentation by employers

02Workers' compensation

Workers' Compensation Claim Investigations in Idaho

Idaho treats workers' compensation fraud under two statutes. Idaho Code § 72-801 makes a knowingly false statement to obtain a benefit a misdemeanor and causes a person convicted to forfeit compensation. The same conduct also appears in the felony fraud statute, § 41-293. In 2025, the Department of Insurance announced that a Post Falls man pleaded guilty to felony insurance fraud for collecting full State Insurance Fund disability benefits after returning to work, receiving more than $7,500 he should not have. Our Post Falls investigators know that region's job sites and commute patterns.

Most claims are legitimate, and a fair investigation is designed to show either result. We check activity against the restrictions in the file, document hours at a second job when one is suspected and note anything that supports the claimant. Employers with broader concerns about attendance or side work can request workers' compensation surveillance or a targeted employee surveillance review under a written scope.

03Bodily injury and liability

Bodily Injury, Premises and Wrongful Death Claims

Timing shapes liability work. Under Idaho Code § 5-219(4), personal injury and wrongful death claims generally must be filed within 2 years, and § 5-311 lets heirs or personal representatives bring a wrongful death action. Scene conditions change, witnesses move and video is overwritten long before that deadline, so we document premises, lighting, signage and camera locations early. Families and defense counsel alike use our wrongful death investigations to preserve the record.

Activity checks must stay within Idaho law. We observe from public places, never enter posted or fenced land in violation of Idaho Code § 18-7008 and never record inside places where people expect privacy, which can be a felony under § 18-6605. Repeated covert monitoring can also implicate the stalking statute, so each assignment has a defined window and purpose. Our Idaho surveillance investigators work under the same rules, and our guide to Idaho recording laws explains the consent rules.

04Auto claims

Auto and Hit-and-Run Claims on Idaho Highways

Idaho's road network creates its own claim patterns. I-84 runs about 276 miles across the south, US 95 climbs grades such as White Bird Hill, roughly 2,700 feet in 7 miles, and winter weather affects the I-90 passes in the Panhandle. Collisions on long rural stretches may have few witnesses and little video. We canvass businesses, identify drivers who stopped and reconstruct timing from receipts and records, often alongside a Twin Falls claim investigator for I-84 losses.

Hit-and-run claims carry their own law. Under Idaho Code § 18-8007, a driver who knows or has reason to know of an injury or death must generally stop, remain, give identifying and insurance information and render reasonable aid, and failure is a felony with a mandatory one-year license revocation. Identifying that driver supports uninsured motorist claims and subrogation, which is the focus of our hit-and-run driver locates. Vehicle damage disputes can be referred to our auto shop damage investigations.

05Property and agriculture

Farm, Dairy, Equipment and Commercial Property Losses

Agricultural losses are a large share of rural Idaho claims. The state ranks third nationally in milk, milk cows and cheese and first in potatoes, and 2024 farm cash receipts reached $11.79 billion. Livestock deaths, equipment theft, barn fires and storage losses can involve large values and few outside witnesses. We document conditions, confirm ownership and look for prior losses or related claims. When equipment disappears, the file may become a stolen equipment investigation as well as a claim review.

Commercial and construction claims are growing with the Treasure Valley. Large projects, new rentals and fast turnover of small contractors raise questions about who was on site, whether work was completed and whether reported damage existed earlier. Our Idaho Falls investigative team covers eastern Idaho property and agricultural files, while Nampa claim investigators handle much of the Canyon County growth corridor.

06Statements

Recorded Statements, Witness Interviews and Idaho Consent Rules

Idaho is a one-party consent state. Under Idaho Code § 18-6702(2)(d), a party to a conversation may generally record it, and intercepting conversations you are not part of can be a felony punishable by up to 5 years. Investigators conducting recorded statements therefore identify themselves, state who they represent and record openly. We do not disguise our role to obtain a statement, and we note any refusal in the report. Claims involving moved witnesses start with a witness background and locate.

Geography affects interview logistics. North Idaho and the Lewiston area run on Pacific Time while the south uses Mountain Time, so appointment confirmations name the zone. A Lewiston field investigator can take statements in the Lewiston-Clarkston area, and canvasses in the Boise metro are scheduled around commute traffic. When a claimant or witness cannot be found, our statewide skip tracing service is the next step.

07Reports and testimony

Claim Reports, Video and Testimony That Hold Up in Idaho Courts

Claim disputes in Idaho can land in several forums. The magistrate division generally hears civil actions up to $10,000, small claims cases up to $15,000 as amended in 2026, and the district courts hear larger civil cases and felonies. Federal cases are heard in Boise, Coeur d'Alene and Pocatello. Our reports are written for the forum: dated entries, original video retained, a clear chain of custody and plain descriptions that an adjuster, a judge or a jury can follow.

When a case calls for testimony, the investigator who made the observations is available to testify about what was seen and how it was documented. Before any field work, counsel can also request a review of what evidence is realistic through our investigative consulting service. Treasure Valley files are usually staffed by Boise insurance investigators, and our statewide Idaho coverage page lists the regions we serve.

  • Time-stamped activity logs with the time zone
  • Original video preserved with chain of custody
  • Statements identified by date, place and consent

Statewide coverage

Insurance Investigation Coverage Across Idaho

We assign claim work statewide. In the Treasure Valley, Meridian claim investigators and our Caldwell field coverage handle most Ada and Canyon files. In eastern Idaho, Pocatello insurance investigators work the I-15 and I-86 corridors toward Chubbuck and American Falls. In the Panhandle, our Coeur d'Alene investigators cover Kootenai County on Pacific Time. Rural claims in the Magic Valley, the Wood River Valley and the Palouse are assigned by distance, with mileage and travel time quoted in the written scope before any investigator leaves.

FAQ

Frequently asked questions

Do investigators need a license to work Idaho insurance claims?

Idaho has no statewide private investigator license, so carriers cannot rely on a state credential when choosing a vendor. Some cities, including Chubbuck and Coeur d'Alene, regulate investigators locally, and those rules should be confirmed before work inside city limits. Delator Group is a licensed Tennessee private investigation firm, carries insurance and applies its Tennessee standard to insurance investigations in Idaho.

Is claim surveillance legal in Idaho?

Observing and recording a claimant in public places is generally lawful. The limits are trespass on posted or fenced land under Idaho Code § 18-7008, recording in places where people expect privacy under § 18-6605 and conduct that becomes stalking under § 18-7906. We define each assignment's purpose and window in writing, stay in public places and stop when the claim questions are answered.

Can you record a statement without telling the person?

Idaho is a one-party consent state, so a participant may generally record a conversation. As a practice, our investigators still identify themselves, state who they represent and record openly when taking claim statements, because that approach is more persuasive to adjusters and courts. We never record conversations we are not part of, which can be a felony under Idaho Code § 18-6702.

How is Idaho workers' comp fraud penalized?

Idaho Code § 72-801 makes a knowingly false statement to obtain workers' compensation a misdemeanor and forfeits the right to compensation. The same conduct is also listed in Idaho Code § 41-293, the felony insurance fraud statute, which carries up to 15 years and $15,000. Which statute applies is a decision for prosecutors, and we simply document facts accurately.

What does an insurance investigation cost in Idaho?

Insurance investigations are billed at our standard $100 hourly rate, with mileage and travel time estimated in advance. A short activity check costs far less than a multi-day file with statements and canvasses. We confirm the full scope and price in writing before work starts. Our Idaho cost guide for investigators explains the factors that move the total.

How quickly can you start on a claim?

Start dates depend on location, the activity window you need and weather, particularly in North Idaho and on mountain routes in winter. We tell you a realistic start date in the written scope rather than promising a response time we cannot keep. Files tied to a hearing, an independent medical exam or a deposition date should be sent as early as possible, and a records-based fraud risk review can begin while field timing is set.

Do you only look for evidence against the claimant?

No. Our reports describe what was observed, including activity consistent with the reported injury. A balanced report is more credible and protects carriers from accusations of selective investigation. When observations support the claim, we say so plainly. Defense counsel tell us that an accurate report helps them evaluate a case honestly, which also shortens the path to resolution. Our claim surveillance specialists write every log that way.

Can you investigate a claim near a reservation?

Yes, with care. Idaho is a partial Public Law 280 state, and investigation or service on reservation land may be governed by tribal law and tribal court rules. We confirm the approach with counsel, and with the tribal court where needed, before field work on reservation land. Our Idaho process serving coverage follows the same confirmation step for papers.

Will your investigator testify?

Yes. The investigator who made the observations or took the statement can testify about what was seen and how it was documented, whether at deposition, a hearing or trial. We prepare reports with that possibility in mind: dated entries, retained original video and plain language. Testimony time is billed at the standard hourly rate agreed in the written scope.

Do you handle claims outside Idaho?

Yes. Claimants often live across a state line, especially near Spokane, Clarkston or the Wyoming border. Delator works in Wyoming, South Dakota, Alaska and Mississippi as well, and our South Dakota investigations team is one example of how a multistate claim can be handled under one scope, one report format and one point of contact.
