01Local service landscape

Seven Cities and a Lot of Unincorporated Ground

Cobb County has about 793,000 residents (2025 estimate) and only seven incorporated cities: Marietta, Smyrna, Kennesaw, Acworth, Powder Springs, Austell and the newly incorporated Mableton. Much of the county, including East Cobb and Vinings, sits outside any city, so a mailing address can name a city the home is not actually in. Our Marietta service page explains how we sort that out around the county seat, and Delator Group's background explains who stands behind the work.

Interstate 75 runs the length of the county with express lanes in the northwest corridor, I-575 branches north of Marietta toward Cherokee, and I-285 crosses the southeast corner at the Cobb Cloverleaf. Attempts are grouped by corridor so a Kennesaw residence and an Austell workplace are not crammed into one evening. Pricing stays the same everywhere in the county, as the statewide service pricing map shows.

02Attorneys and law firms

Service for Firms That File on Haynes Street

Cobb has a busy civil bar of its own, plus Atlanta firms that file there because a defendant or a contract sits in the county. Counsel generally want the summons and complaint served together, an affidavit that will not invite a motion, and updates without having to chase them. We keep one contact on each file and describe every attempt plainly. The attorney intake page shows the details that speed up a Cobb serve.

Corporate defendants are common here, from contractors to companies headquartered near Cumberland and along I-75. We serve an officer, a managing agent at the Georgia office or the registered agent, and if none can be served, explain the Secretary of State route so counsel can decide. Our registered agent and business service describes the certification counsel must make before that route is used.

03Evasive and hard-to-serve

East Cobb Gates, Lakefront Homes and Defendants Who Will Not Answer

Gated neighborhoods in East Cobb and around Lake Allatoona are a routine part of Cobb service. O.C.G.A. 9-11-4(f)(4) gives an authorized server reasonable entry to a secured community after naming the person to be served and showing photo ID and proof of appointment. We prepare for the gatehouse in advance and note in the log how entry was handled, so nothing about access is left unexplained. Rush service for Cobb deadlines follows the same rule.

When a defendant is clearly avoiding the door, we vary the pattern deliberately: different hours, different days, and the workplace where appropriate. Every attempt is recorded at the time with what the server saw. That record is what supports a later request to the court about other methods. Read what to do when a person evades service, or see our approach to difficult serves.

04Cobb family, landlord and claim papers

Divorce, Custody, Dispossessory and Magistrate Claim Papers in Cobb

Cobb Superior Court divorce and custody papers follow the Civil Practice Act, so personal delivery, abode service or a signed acknowledgment are the usual paths. We deliver them discreetly and confirm identity first. For claims up to $15,000 in Cobb Magistrate Court, the defendant generally answers within 30 days, and our Georgia small claims service page explains the second-original rule for defendants in other counties.

For dispossessories, we start with the court's practice. Georgia added an approved process server to O.C.G.A. 44-7-51 in 2025 without defining it, and the Cobb Sheriff's Civil Section executes writs at $25 per person on the judgment. Under HB 1203, a landlord whose writ is not executed within 14 days may hire certain off-duty officers. We never carry out writs. See dispossessory service rules and subpoenas in Georgia.

05Documentation and challenges

An Affidavit Built for a Cobb Motion Hearing

A Georgia affidavit of service has to state the date, place and manner of service, and a private server files it with the court where the case is pending. If proof is late, the defendant's time to answer does not begin until it is filed. We return the signed affidavit quickly so counsel can file within the five business days in O.C.G.A. 9-11-4(h). Our legal papers service guide lists what the return should include.

Motions to dismiss for insufficient service in Cobb often turn on the abode recipient, the address and the plaintiff's diligence near a limitation date. Our notes are written when each attempt happens, so counsel can answer those questions with facts. If something has to be corrected, the court may allow proof to be amended, and we provide whatever detail the record supports. Talk to us before a re-serve if a hearing is close.

06Georgia service rules

Georgia's Five Categories of Servers, Briefly

Georgia generally allows service by a sheriff or deputy, a marshal, a citizen specially appointed by the court, a non-party adult appointed by the court or as a permanent process server, or a certified process server under O.C.G.A. 9-11-4.1. A certified server must file a written notice of intent, lasting one year, with the sheriff of each county where the sheriff allows certified service. Our guide to authorized servers explains the differences.

DFS does not hold itself out as certified or appointed in Cobb or anywhere else in Georgia. For each Cobb file we assign a server who meets the requirements of that court and paper and confirm the arrangement in writing before accepting the work. Where private service is not accepted for a document, we tell you, and the papers go to the Sheriff. The Georgia process serving overview covers the statewide picture.

07Local angle

Mailing Addresses That Do Not Match the Map

A Marietta mailing address can belong to a home in unincorporated East Cobb, and a Smyrna address may actually sit in Vinings or the new city of Mableton. Austell crosses into Douglas County, and Acworth sits near the Bartow and Cherokee lines. Because venue and the affidavit both depend on the true location, we confirm the county and city before quoting. Our Smyrna page shows how that plays out near I-285.

Cobb is also a commuter county. Many residents drive to Fulton or Cherokee every weekday, and Kennesaw State University brings students and staff from across the region. A person who is hard to reach at home may be easier to serve near work, if counsel agrees. We coordinate those attempts across lines under one quote with Cherokee County service and our Kennesaw coverage.

  • Marietta addresses outside Marietta city limits
  • Austell extends into Douglas County
  • Acworth near the Bartow and Cherokee lines
  • County and city confirmed before quoting

Process Servers Near Cobb County

Cobb's neighbors are close enough that one case often spans several of them. North of the county, Cherokee papers and attempts cover Woodstock and Canton, while Dallas and Hiram fall under Paulding County service. Across the Chattahoochee, Fulton County process service covers Sandy Springs and Atlanta, and Douglas County coverage handles Douglasville and the rest of Austell. Each uses the same written quote, the same attempt log and the same signed affidavit, so counsel reviewing a multi-county return sees one consistent format.

FAQ

Frequently Asked Questions

Who is allowed to serve court papers in Cobb County?

Under O.C.G.A. 9-11-4(c), a sheriff or deputy, a marshal, a court-appointed or permanent process server, or a certified server whose notice of intent the Cobb Sheriff accepts may generally serve. Which one a court takes can depend on the paper. We assign a server who meets the court's requirements and confirm it in writing before accepting the serve.

What does a process server in Cobb County charge?

Our published Routine starting rate for Cobb addresses is $125. Urgent runs 1.5 times that, Rush twice and Same Day Rush three times. The figure for your file depends on the address, the deadline and the documents, and we confirm it in writing before the first attempt so there are no surprises later.

What does the Cobb Sheriff charge for civil process?

The Cobb Sheriff's Civil Section lists $10 for subpoenas and $50 for process from other counties or states, and $25 per person on the judgment to execute a writ of possession. Fees can change, so check the Sheriff's site. A private server is an option where the issuing court accepts one for that paper.

Can a server get into a gated East Cobb subdivision?

Georgia law generally lets an authorized server enter a gated or secured community for a reasonable time during reasonable hours after naming the person to be served and showing photo ID and proof of appointment. The rule excludes a single residence with its own gate. We plan entry in advance and note in the log how access was handled.

Will you serve a dispossessory filed in Cobb Magistrate Court?

Only after confirming the court's current practice. The 2025 amendment to O.C.G.A. 44-7-51 mentions an approved process server without defining the term, so courts differ. We never carry out writs or set-outs; the Cobb Sheriff executes them, and our dispossessory paperwork page explains what we do handle. Our Georgia eviction service guide explains the 7-day answer and tack-and-mail rules.

Can papers be left with a spouse or adult child at the house?

Usually. O.C.G.A. 9-11-4(e)(7) generally allows leaving papers at the defendant's dwelling with a person of suitable age and discretion who lives there. The affidavit names or describes that person and records the time. Your attorney decides whether abode service suits the case, especially in family matters where a spouse may be the opposing party.

How are out-of-county Cobb Magistrate claims served?

A Cobb Magistrate claim is served within the county by an authorized person, and outside the county by second original under O.C.G.A. 15-10-43(b) and 9-10-72. We handle the out-of-county serve under the same quote and return an affidavit for the Cobb clerk. Our magistrate claim paperwork overview explains the steps.

What if the Cobb defendant has moved out of Georgia?

Publication may be ordered when a defendant resides outside Georgia, has left the state, cannot be found after due diligence or is concealing himself, under O.C.G.A. 9-11-4(f)(1). Personal service outside the state can replace publication in many cases. See service by publication in Georgia and talk with counsel about which route fits.

Do you serve federal court papers in Cobb County?

Yes. Cobb is in the Northern District of Georgia's Atlanta Division, and federal summonses and subpoenas are served under the federal rules. We prepare the affidavit for the federal court and note any waiver request counsel sent first, since a defendant who unreasonably refuses waiver may face the cost of service.

How quickly can a Cobb serve be completed?

Routine files are scheduled on a normal corridor plan, while Urgent, Rush and Same Day Rush move the file ahead at 1.5, 2 and 3 times the Routine rate. No tier can promise a result, because service depends on reaching the right person. Same-day and rush service details explain how tiers are chosen.
