Quick answer
Can a private investigator help with stalking in Idaho?
Yes, in a support role. Police and prosecutors enforce Idaho's stalking statutes, but an investigator can document repeated following, preserve messages, check for GPS devices and hidden cameras, and identify an unknown harasser through lawful research. That record supports a police report or a civil protection petition. Our guide to what investigators may legally do explains the limits.
01Before anything else
Safety Planning Comes Before Evidence
When someone is following, watching or contacting you against your wishes, the first call belongs to 911, the city police or the county sheriff. A private firm cannot arrest, cannot order anyone to stay away and should never be your emergency plan. Tell a trusted person what is happening, keep your phone charged, save every message without replying, and note dates and places as they occur. If a coworker is involved, your employer may also have duties, which our workplace investigations address. Domestic violence advocates in your county can help with a safety plan if the person is a current or former partner.
Our part begins once you have a plan for staying safe. A Delator stalking investigation is built to answer the questions police and judges ask: what happened, when, how often, and who did it. We organize what you already have, add lawful documentation, and keep everything in a form an officer can read quickly. Clients who are unsure where an investigator's authority ends can review our explainer on lawful investigator activity and our wider surveillance casework in Idaho before the first call.
- Call 911 if you feel threatened
- Save messages; do not reply or delete

02The law
How Idaho Code Defines Stalking in Two Degrees
Under Idaho Code § 18-7906, second degree stalking generally means knowingly and maliciously engaging in a course of conduct, meaning repeated acts of nonconsensual contact, that would cause a reasonable person substantial emotional distress or fear of death or injury to themselves or a family or household member. The statute's definition of nonconsensual contact expressly includes following the victim or maintaining surveillance, including by electronic means. Second degree stalking is a misdemeanor carrying up to one year in county jail and a fine of up to $1,000, and evidence gathered for one degree often supports the other, as our surveillance investigators see when conduct spills over state lines.
First degree stalking under § 18-7905 is a felony, punishable by one to five years and a fine of up to $10,000. It applies when the conduct violates a protective or no-contact order, occurs while the offender is on probation or parole, targets a victim under 16, involves a weapon, or follows a prior stalking conviction or listed violent offense against the same victim within seven years. Whether facts meet those elements is a prosecutor's call, and our investigations for Idaho attorneys support victims' counsel presenting them.
03Civil protection
Civil Protection Orders and the Ninety-Day Window
Idaho Code § 18-7907 lets a victim petition the magistrate division for a civil protection order based on stalking, threatening communications or malicious harassment. The petition is verified and describes conduct within the 90 days before filing that is likely to recur. A hearing is generally set within 14 days, the court applies a preponderance standard, and an order may last up to one year with renewal possible. A dated chronology with supporting exhibits gives the judge something concrete to weigh, and a background check on the respondent can surface prior orders.
Where the person is a current or former intimate partner or household member, a domestic violence petition under chapter 39-63 may fit better, and counsel can advise which path applies. The court generally sends the order to law enforcement for personal service unless the petitioner chooses a private server, and our Idaho process serving team can handle related civil papers when counsel asks. Families dealing with a custody dispute alongside the harassment can also read our Idaho custody investigation guide.
04The record
Documenting Following and Repeated Contact
Most stalking cases fail for lack of a clear pattern rather than lack of fear. We build a single chronology that ties each incident to a date, time, location and piece of proof: a screenshot with the username visible, a voicemail, a dashcam clip, a doorbell video, a witness name. Where the person appears at your workplace, gym or route home, a discreet surveillance team can document their presence from public places, which turns an account of being followed into observed, time-stamped fact.
Idaho is a one-party consent state under Idaho Code § 18-6702, so you can generally record a call or conversation you take part in. Hiding a device to capture conversations between other people can be a felony, and we will not do it or advise it. Harassing texts and emails may also fall under § 18-6710, where a second offense becomes a felony. Our guide to recording laws in Idaho explains what victims can safely capture on their own.
05Device checks
Trackers, Hidden Cameras and Shared Accounts
When a harasser always seems to know where you are, the explanation is often technical: a magnetic tracker under a bumper, a tag device dropped into a bag, location sharing left on in a family phone plan, or a password the other person still knows. We inspect vehicles you own or lawfully use, review device and account settings with you, and photograph anything found in place before it is touched, so police can take custody of it with its condition documented.
Covert electronic tracking of a person can amount to stalking under Idaho Code § 18-7906, and hidden imaging devices in private places may implicate the video voyeurism statute, § 18-6605. Delator never places trackers on vehicles it has no right to, and we do not access another person's accounts. If an employer's systems are involved, our corporate investigations group can coordinate with company counsel, and people worried about how much of their address history is public can ask about an OSINT exposure review and data wipe.
06Identification
Naming a Harasser Who Hides Behind Accounts
Anonymous harassment usually leaves a trail: a writing style, a time pattern, a photo only certain people could have taken, a burner account that follows the same few friends. We compare those details against people with motive and access, research public records and open sources, and present a reasoned conclusion with the supporting points spelled out. When identification depends on subscriber records from a platform or carrier, that generally takes a subpoena or court order obtained by counsel or police, not a private request.
Our cyberbullying investigations cover online harassment in more depth, including preserving posts before they are deleted. If the suspected harasser is a coworker or a former employee, our workplace harassment investigations can run alongside the stalking file. When the likely source is a dating match whose real identity is unclear, a dating background check often answers the first question quickly and at a modest cost.
07Idaho specifics
College Towns, Two Time Zones and Long Drives
Idaho's geography changes how stalking cases unfold. Moscow and Pullman sit minutes apart across the Washington line, and Latah County lies in the Pacific time zone while Boise runs on Mountain time, so we log every incident with its zone to keep the chronology clean. Students at the University of Idaho, Boise State and BYU-Idaho in Rexburg often face harassers who move between campus, apartments and social media, and our investigators serving Moscow and other college towns plan around that.
In North Idaho a harasser may live across the line near Spokane, and in the south the drive between Boise and Coeur d'Alene runs roughly 380 to 390 miles, most of it on US-95. Conduct that crosses state lines can raise federal questions that counsel should assess. On reservation land, tribal law and tribal courts may govern, so we confirm the approach with counsel first. Clients near the Panhandle can reach our Coeur d'Alene investigators, and Treasure Valley clients our Boise investigators.

Statewide coverage
Stalking Cases Across Idaho
Delator assigns investigators to stalking matters in every Idaho county, from the Treasure Valley to the Panhandle and the Upper Snake River Plain. Clients in Canyon County can start with our Nampa investigators, while eastern Idaho cases often run through our Pocatello team or the Rexburg investigators who work around BYU-Idaho. Delator has no Idaho office, so our investigators travel to the case; we schedule fieldwork around the distances and time zones involved and confirm every step in writing before it begins. Southwest Idaho clients outside Boise often find that a single planning call settles the logistics before anything else is scheduled.
FAQ
Frequently asked questions
Is the first call to police or to an investigator?
Police first, every time there is a threat or an incident in progress. Officers can respond, take a report and arrest when the law allows. An investigator adds value afterward by organizing evidence and filling gaps the police may not have time to cover. Many victims bring us in after a report is filed so the detective receives a cleaner, better-supported file.
Is stalking a felony in Idaho?
It can be. Second degree stalking under Idaho Code § 18-7906 is generally a misdemeanor. First degree stalking under § 18-7905 is a felony when aggravating facts exist, such as violating a protection order, having a weapon, targeting a child under 16, or a prior conviction within seven years. A prosecutor decides the charge, and your attorney can explain how the facts fit.
Can I record the person who is stalking me?
Idaho generally allows a participant to record a conversation or call they are part of, under the one-party consent rule in Idaho Code § 18-6702. You should not hide a device to capture other people's private conversations. Video of conduct in public places is usually lawful. Our one-party consent guide for Idaho covers the details victims ask about most.
I found a GPS tracker on my car. What should I do?
Photograph it where it sits, do not remove or damage it, and call police. A tracker can be evidence of stalking under § 18-7906, and its condition and placement matter. If you want a full inspection of the vehicle for other devices, we can check it, document what is found and coordinate with the officer so the evidence is handled properly.
How do I get a civil protection order for stalking in Idaho?
Under Idaho Code § 18-7907, you file a verified petition in the magistrate division describing conduct within the previous 90 days that is likely to continue. A hearing is generally held within 14 days. Organized evidence helps the judge see the pattern. Court self-help staff can explain forms, and an attorney can advise whether a domestic violence petition is the better fit.
Can you identify the person running an anonymous account?
Often, yes, through lawful pattern analysis and open-source research that we explain step by step in the report. We cannot obtain a platform's subscriber records ourselves; that usually requires a subpoena or court order through counsel or police. Our findings can support that request. Our online harassment investigations page explains how we preserve posts first.
Do you confront or warn the stalker?
No. Contact with the person can escalate danger and can complicate a criminal case or protection order hearing. We document from a distance, keep our presence unnoticed, and leave any warning, arrest or order to police and the courts. If counsel needs papers delivered after filing, our Idaho process servers handle that with documented attempts and a signed affidavit.
Does an Idaho investigator need a state license?
The state of Idaho does not issue a private investigator license. Delator Group is a licensed Tennessee private investigation firm in Nashville that assigns vetted, insured investigators to Idaho cases and holds itself to Tennessee's standard here. Some Idaho cities regulate investigators locally, and we confirm current local requirements before fieldwork. Our guide to vetting an investigator sets out the questions worth asking before you hire anyone.
What does a stalking investigation cost?
Investigative time is billed at $100 per hour, and a remote background check on a named person starts at $102. Every case begins with a written scope and price you approve before work starts, with no open-ended retainer. Our Idaho investigation pricing page lists the full schedule, including deep-dive reports and fieldwork minimums.
What if the stalker lives in Washington or another state?
We can document conduct in Idaho and research the person's location and history wherever they live. Conduct that crosses state lines may raise federal issues, and protection order enforcement across borders is a question for your attorney. North Idaho clients near Spokane and Pullman are common, and we note the Pacific time zone on every entry in those files.
