Process Server in Albemarle County, VA, Not the City of Charlottesville
Delator Field Services serves civil papers throughout Albemarle County, from Crozet and Ivy in the west to Hollymead and Earlysville along US 29 and Pantops east of the river. Albemarle is a separate locality from the City of Charlottesville, with its own courts on Park Street, so we confirm the locality, quote in writing and log every attempt.

Quick answer
Is a process server in Albemarle County different from one in Charlottesville?
The server may be the same, but the locality is not. Albemarle County and the City of Charlottesville are separate jurisdictions with separate circuit and general district courts, separate clerks and different rates. We confirm which locality an address sits in before quoting. Albemarle's Routine rate starts at $150; Charlottesville city service starts at $165.
01Local service landscape
A County Wrapped Around a City It Does Not Govern
Albemarle County covers about 726 square miles of the Piedmont and completely surrounds the City of Charlottesville, which is an independent city and not part of the county. Many county homes carry a Charlottesville mailing address, so an address that reads Charlottesville may belong to either locality. Before we quote, we confirm from the property record which side of the line the address falls on, because the court, the clerk and the rate all follow that answer. Our statewide Virginia process service page explains the independent-city system, and the Virginia rates by county and city show how the two localities differ.
The county is also broad and varied. US 29 carries growth north through Rio, Hollymead and the airport area; Crozet and Ivy sit west toward the Blue Ridge, where the county's western border runs inside Shenandoah National Park; Scottsville and Esmont lie south toward the James River. Addresses in the hills often mean long driveways and gates, and we review those before the first attempt rather than after a wasted trip. Addresses that turn out to be in the city go to our Charlottesville city service of process team.
- US 29 north: Rio, Hollymead and the airport area
- West: Crozet, Ivy and Free Union
- East: Pantops and Keswick
- South: North Garden, Esmont and Scottsville
02Attorneys and law firms
Two Clerks Two Blocks Apart
Lawyers who practice in Charlottesville file in two different courthouses depending on where the case belongs. Albemarle County matters go to the county courthouse on Court Square at 350 Park St., while City of Charlottesville matters go to the city's circuit court on East High Street and its district court on East Market Street. A return sent to the wrong clerk is not a small mistake. We read the caption on every paper and route the return accordingly. Our Virginia attorney process serving page outlines firm intake.
Firms here also send defendants elsewhere in the 16th Circuit and beyond. Someone who has moved over the mountain to the Valley is served by our Rockingham County process service team, and a defendant who works in the city is handled through Charlottesville. One written quote can cover several addresses, and each serve still produces its own return for its own court. When a hearing is days away, ask about Virginia same-day serves.
03Evasive and hard-to-serve
Estates, Gates and Defendants Who Split Their Time
Parts of Albemarle are horse country and estate land, with gated drives, caretakers and owners who are often away. Other defendants rent near the university and move each lease cycle. In both cases, the work is the same: attempts at different hours and on different days, careful notes on who was present, and no attempts on Sunday, which Virginia does not allow for civil process. We never enter a gated property without lawful access. Our service on evasive defendants page describes the method.
If personal delivery fails, Va. Code § 8.01-296 allows delivery to a family member 16 or older at the usual abode, not a guest, and then posting at the main entrance. A caretaker or house guest is not a family member for this purpose, and we do not treat them as one. When posting is the result, counsel handles the mailing and certificate, as the posted service steps in Virginia describe. The guide for when someone avoids service covers what comes next.
04Family law, evictions, small claims, subpoenas
Family Petitions, Rental Cases, Small Claims and Witnesses
Divorce complaints for county residents go to Albemarle Circuit Court, and custody and support petitions to the county's Juvenile and Domestic Relations District Court. A spouse who agrees can accept service in writing under Va. Code § 20-99.1:1, which may save a trip, and we serve the papers when that is not possible. Law enforcement, not a private server, serves any protective order. The guide to serving divorce papers in Virginia explains the options.
Rental housing is a large part of the county economy near the US 29 and Pantops corridors. A private server may deliver the unlawful detainer summons, at least 10 days before the return day, but only the sheriff executes the writ of eviction; our unlawful detainer papers in Virginia page covers landlord intake. Small claims in general district court reach $5,000. Witness subpoenas are served under the general statute, and our Virginia subpoena delivery page explains the timing advice.
- Divorce: Albemarle Circuit Court, 350 Park St.
- Custody and support: Albemarle J&DR District Court
- Unlawful detainer: summons served 10+ days before return
- Small claims: up to $5,000

Records That Hold Up When Service Is Disputed
Every Albemarle return we prepare follows Va. Code § 8.01-325: the server's affidavit of qualifications, the date and manner of service, the name of the person served, a notation that service was by a private server, and the server's name, address and telephone number. The return goes to the issuing clerk within 72 hours of service, with weekend and holiday deadlines moving to the next business day.
Behind the return sits the attempt log. If a defendant on a large property later says no one ever came, the log shows the dates, times, what the server observed and any conversation at the door. If a family member accepted papers, it records their name or description and the information given about what the papers were. Business defendants get the same treatment through our service on Virginia companies. Our small claims service in Virginia uses the same format for lower-dollar cases.
06Virginia service rules
The Virginia Statutes Behind an Albemarle Serve
Under Va. Code § 8.01-293, a sheriff or any adult 18 or older who is not a party and has no interest in the case may generally serve process. No Virginia statute creates a license for private process servers. Every server we assign meets that statutory description, and each return includes the required qualifications affidavit. Officers alone execute writs of possession, levy on property and serve capiases or show cause orders. The Virginia guide on who may serve explains the reserved acts.
A defendant served with a circuit court summons generally has 21 days to file a response under Rule 3:8. Va. Code § 8.01-275.1 accepts service made within a year of filing; after that, the plaintiff needs a court finding of due diligence. Waiver of service under Va. Code § 8.01-286.1 is another route in some cases. Your attorney can advise which fits, and our Virginia service of process guide summarizes them.
07An Albemarle County angle
Federal Filings, Monticello Country and a University Next Door
Albemarle is home to Monticello, Thomas Jefferson's estate, and the hillsides around it are dotted with vineyards and farms. That setting brings land, estate and business disputes, and some of them land in federal court. The Western District of Virginia's Charlottesville Division keeps its clerk's office at 255 W. Main St., and it covers Albemarle, the city and the surrounding Piedmont counties. We serve federal summonses and subpoenas the same way, with the return prepared for the case's requirements, and our federal and out-of-state papers page covers the details.
The University of Virginia sits on the city's edge, and students, staff and visiting faculty often live in county neighborhoods. Their addresses change with the academic year, and a former apartment is not a usual place of abode once the lease ends. We confirm current addresses with counsel before attempting. For defendants who have left for school in the Valley, our Harrisonburg process servers take over.

FAQ
Frequently Asked Questions
Is Charlottesville part of Albemarle County?
No. Charlottesville is an independent city with its own government, courts and sheriff, even though Albemarle surrounds it and the county courthouse sits inside the city on Park Street. A Charlottesville mailing address can be in either locality. We confirm which one before quoting, since the court and the rate depend on it. See our Charlottesville process servers for city addresses.
What does it cost to serve papers in Albemarle County?
The published Routine starting rate for Albemarle County is $150, which puts Urgent at $225, Rush at $300 and Same Day Rush at $450. Mountain, estate and farm addresses can change the quote, and the final price is always confirmed in writing before any attempt. The City of Charlottesville starts at $165 Routine.
Can a private server serve papers in Albemarle County?
Generally yes. Va. Code § 8.01-293 lets any adult 18 or older who is not a party or otherwise interested serve process, as well as the sheriff. A few acts, including executing writs of eviction, levies, capiases and protective orders, stay with officers. Our Virginia process server guide lists them.
Which court do I use for an Albemarle County divorce?
A divorce for a county resident is filed in Albemarle Circuit Court at 350 Park St. Custody, visitation and support matters are heard in the Juvenile and Domestic Relations District Court. A cooperative spouse may accept service in writing, and when that does not happen we serve the complaint in person or under the substituted service statute.
How do you handle gated estates and farms?
We review the address before the first attempt, look for lawful points of contact such as a public road entrance or a work location, and never enter private property without lawful access. Attempts are spread over different days and times, and every one is logged so counsel can show the court what was tried.
Can you serve papers on a Sunday in Albemarle County?
No. Virginia bars service of civil process on Sunday, with narrow exceptions such as a person escaping custody. We plan Saturday and evening attempts instead, which often suit estate owners and commuters better anyway. If a return date is close, flag it at intake so the schedule accounts for the Sunday rule and any travel time to the far corners of the county.
What is in the return of service?
The server's affidavit of qualifications, the date and manner of service, the name of the party served, a notation that service was by a private server, and the server's name, address and telephone number, as Va. Code § 8.01-325 requires. It is generally returned to the clerk within 72 hours of service.
Do you serve federal papers in Albemarle County?
Yes. Federal summonses and subpoenas from the Western District of Virginia's Charlottesville Division, or from federal courts elsewhere, can be served in Albemarle under the applicable federal rules. Tell us the court, the deadline and any service instructions at intake, and the return will be prepared in the form that court expects. Our out-of-state and federal papers service page has more.
Can you serve an Albemarle County winery or farm business?
Yes. Va. Code § 8.01-299 allows service on any officer, director or registered agent of a Virginia corporation, and on the registered agent of an LLC, whether the business is a winery, a farm or a firm. If no registered agent can be reached, the SCC Clerk becomes the agent and counsel files there. Our registered agent and business service page explains.
Is there a Delator office in Charlottesville?
There is not. Delator Group is a Tennessee firm headquartered in Nashville, and Delator Field Services is its process serving division. For Albemarle serves we coordinate a server suited to the county courts and the address, and every serve is held to one written standard of time-stamped attempts and a signed return.
