Upload the filed papers and the defendant's address. Routine service has a published starting rate of $125, and the statewide South Carolina service page explains how DFS operates across all 46 counties.

01Local service landscape

A Fast-Growing Town Joined to Charleston by Two Big Crossings

Mount Pleasant counted 90,801 residents in the 2020 census, which makes it one of the larger municipalities in the state, yet every civil case from here is filed in Charleston County and returned to the clerk on Broad Street. The town sits east of the Cooper River, with the Old Village and Shem Creek near the harbor and newer subdivisions toward the Wando River. Our Charleston County service area covers Awendaw and McClellanville beyond the town line, and Summerville process servers take papers for defendants who have moved inland.

Two crossings set the rhythm of the day. The Arthur Ravenel Jr. Bridge carries US 17 over the Cooper River into Charleston, with weekday-morning congestion, and I-526 ends at Johnnie Dodds Boulevard after crossing the Wando on the James B. Edwards Bridge. Many residents commute out over one of them, so a home attempt at 8:30 a.m. often finds an empty driveway. The rate finder for each South Carolina county shows how faster tiers are priced when timing matters.

02Attorneys and law firms

What East Cooper Practices and Out-of-State Firms Send Us

A good share of our Mount Pleasant work comes from attorneys in downtown Charleston who need a defendant served on this side of the harbor, and from firms in other states whose defendant owns a second home here. Typical files include contract and construction claims, real estate disputes, injury suits and deposition subpoenas. The DFS program for law firms gives each case one contact and one written quote, and our same day and rush service covers deadlines measured in days.

We review the papers before assigning anyone. If a defendant's real residence is in another state and the Mount Pleasant house is a second home, abode service may not work, because the rule speaks of the dwelling house or usual place of abode. When that question comes up, we flag it for counsel instead of guessing. Firms outside South Carolina can read our notes on serving papers issued by courts in other states first.

03Evasive and hard-to-serve

Commuters, Long Driveways and People Who Simply Do Not Open Up

Many Mount Pleasant defendants are not hiding; they are simply gone during the day. Commuters leave early for Charleston, North Charleston or Daniel Island, and some work at the Wando Welch Terminal on the town's waterfront, where shifts vary. We schedule visits in the early evening and on weekends first, much as our Myrtle Beach servers do for resort workers, and we ask counsel for vehicle descriptions and any work schedule. Our approach to hard-to-reach defendants describes how attempts are spaced and logged.

Others do avoid the door. When the lights are on and nobody answers, we record what the server saw and move to a different time rather than knocking again an hour later. South Carolina permits Sunday service, with an exception for a person going to, attending or leaving a religious service under S.C. Code 15-9-17. If service still fails after real diligence, the overview of options when service is avoided explains the court-ordered routes counsel may request.

04Family law, landlords and subpoenas

Family Cases, Rental Homes, Magistrate Claims and Witnesses

Divorce and custody cases from Mount Pleasant are filed in Charleston County family court. The summons and complaint are served under SCRCP 4, and the spouse can also sign the Acceptance of Service form, SCCA 400.03, which many counsel try first. When personal delivery is needed, we arrange it to avoid a scene in front of children or neighbors. Rules to show cause are other process handled by the sheriff or a court-designated person, as the South Carolina family law service page explains.

The town has many rental homes and townhouses, and landlords often ask about evictions. In the magistrate courts we checked, the rule to vacate is served through the sheriff, so we take it only where the court confirms private service is accepted, and we never post or carry out a writ of ejectment. We regularly serve landlords' summonses for unpaid rent or damage. Claims of $7,500 or less are described on the magistrate claims service page, and witnesses are handled through Rule 45 subpoena service.

05Documentation

Affidavits, Written Acceptances and Correcting a Return

Not every Mount Pleasant case ends with a knock at the door. SCRCP 4(j) treats a written, signed acceptance as complete proof on its own, whether the defendant or the defendant's lawyer signs it, once it reaches whoever was making service. When a defendant's lawyer offers to accept, counsel may prefer that route. When it does not, our affidavit follows Rule 4(g), and the guide to serving papers in South Carolina shows each step.

A private server's affidavit states the date, time and place of service and the name and address of the person served, or a description. If something in the proof needs fixing later, Rule 4(i) lets the court allow an amendment unless it would materially prejudice the defendant. Outside Tennessee, Delator may assign vetted contract servers working to the same written documentation standard, and attempt notes are available on request. Firms with multistate cases can compare figures on the multistate rate map.

06South Carolina rules

The Rules That Decide Who Serves a Mount Pleasant Summons

In South Carolina, the summons and the rest of the court's process follow different rules. SCRCP 4(c) lets the sheriff, a deputy or any person at least 18 who is not a party or an attorney in the action deliver a summons. Orders, writs and rules generally require the sheriff, another officer or a person the court designates, so we confirm before accepting them. The state has no statewide license for private process servers, as our who can serve explainer notes.

Rule 4(d)(1) covers personal delivery, delivery at the dwelling to a resident of suitable age and discretion and delivery to an authorized agent. For a summons, restricted-delivery certified mail under 4(d)(8) or a qualifying commercial delivery service under 4(d)(9) is also allowed, but neither supports a default without the defendant's own signature. These summaries are not legal advice. Read more about Delator Group, a Tennessee firm headquartered in Nashville that runs Delator Field Services.

07Mount Pleasant angle

When Certified Mail Is Enough and When Hand Delivery Is Safer

Because so many residents are away during business hours, some Mount Pleasant filers start with restricted-delivery certified mail. Service by that route is effective on the delivery date shown on the return receipt, but a default requires a receipt showing the defendant accepted it, and a default must be set aside if an unauthorized person signed. A process server in Mount Pleasant gives counsel a signed affidavit instead, which avoids the question of who signed the green card.

Hand delivery also helps with the barrier islands next door. Sullivan's Island and Isle of Palms are separate towns with many seasonal rentals, and the person who answers may be a visitor rather than a resident, which rules out abode service. We record who answered and come back when that happens. Defendants who have moved off the islands may be reached by our Charleston peninsula servers or by Goose Creek process service.

FAQ

Frequently Asked Questions

Who may serve papers in Mount Pleasant?

A summons may be served by the sheriff, a deputy or any person at least 18 who is not a party to or an attorney in the case under SCRCP 4(c). A subpoena may be served by any non-party adult. Orders, writs and rules generally go through the sheriff or someone the court designates, so we check before accepting them.

How much does a process server in Mount Pleasant cost?

Mount Pleasant uses the Charleston County published Routine starting rate of $125. Faster tiers come to $188 (Urgent), $250 (Rush) and $375 (Same Day Rush). The final price depends on the address, the papers and the deadline, and we confirm it in writing before we assign a server. Sheriff service may cost less, and we will say so; same day service options are explained separately.

Is certified mail enough to serve someone in Mount Pleasant?

It can be. SCRCP 4(d)(8) allows restricted-delivery certified mail for a summons, effective on the delivery date shown on the receipt. But a default requires a receipt showing the defendant accepted it, and a default is set aside if someone else signed. Many attorneys prefer hand delivery and an affidavit for that reason.

Do you serve eviction papers in Mount Pleasant?

Not the rule to vacate as a standard job. Every magistrate court we reviewed relies on the sheriff for that paper, and writs of ejectment belong to constables and deputies alone. We serve the rule only if the court confirms private service is accepted. Landlord summonses for rent or damage are routine. The step-by-step eviction guide has more.

Can a defendant's attorney accept service instead?

Yes. Under SCRCP 4(j), when acceptance of service is acknowledged in writing, signed by the person served or that person's attorney and delivered to the person making service, no other proof is required. The acceptance should state the date and place. Counsel often tries that route first, and we serve in person if it does not happen.

Can papers be served at a Mount Pleasant second home?

Personal delivery to the defendant works wherever we find them. Abode service is different: the rule refers to the defendant's dwelling house or usual place of abode and a person of suitable age and discretion residing there. If the house is a second home, counsel should decide whether it qualifies. We record what we see so that decision rests on facts.

How long does a Mount Pleasant defendant have to answer?

In Common Pleas, the usual period is 30 days after service of the complaint under SCRCP 12(a). The self-represented divorce summons allows 35 days when served by restricted certified mail. Magistrate court counts 30 days from the first day after service. Your attorney should confirm the deadline for the specific case.

What if the Mount Pleasant defendant has moved?

We tell you right away and note what we learned at the address. If the person cannot be found in South Carolina after due diligence, counsel may ask the court or the clerk of common pleas for an order of publication under S.C. Code 15-9-710. Our publication guide for South Carolina explains the affidavit that requires.

Can you serve a business near the Wando Welch Terminal?

Yes. We serve the company's registered agent, or an officer or managing agent named in counsel's papers, and record the recipient's name and title. For a South Carolina corporation without a reachable agent, a court or clerk may order certified mail to the corporate secretary. Details are on our entity service page for South Carolina.

Do you serve federal papers in Mount Pleasant?

Yes. Mount Pleasant falls in the Charleston Division of the District of South Carolina, which sits at 83 Meeting St. and 85 Broad St. Federal summonses follow Federal Rule 4, which allows state-law methods. We return proof formatted for the federal file. Send your Mount Pleasant request with the case number and deadline.
