Urgent, Rush and Same Day Rush tiers

Same Day Process Serving in Georgia

When a hearing, deposition or filing deadline is close, Delator Field Services offers three priority tiers above Routine service in Georgia: Urgent at 1.5x the county rate, Rush at 2x, and Same Day Rush at 3x. Quick answer

Is same day process serving available in Georgia?

Often, but not always. Same Day Rush is priced at 3x the county's published Routine rate, and its tier description is a first attempt within two hours of receipt, with availability assessed case by case. Rush (2x) and Urgent (1.5x) cover shorter deadlines that are less extreme. Check your county on the Georgia rate map.

01What each tier means

Routine, Urgent, Rush and Same Day Rush Explained

Every Georgia county has a published Routine starting rate, and the three priority tiers are simple multiples of it. Routine describes a first attempt in five to seven days. Urgent, at 1.5x, describes a first attempt in three to five days. Rush, at 2x, describes a first attempt in one to two days. Same Day Rush, at 3x, describes a first attempt within two hours of receipt, and its availability is assessed case by case before we accept the job. Those descriptions are the commitment; nothing beyond them is promised. The Georgia process serving overview explains how servers are assigned.

A first attempt is not the same thing as completed service. A defendant who is not home at 4 p.m. on a Same Day Rush job is still not served, and the next attempts follow the plan we agreed in writing. That is why we ask about the defendant's schedule at intake: a fast tier helps most when the server arrives at an hour when the person is likely to be there. Delator Field Services is the process serving division of Delator Group, headquartered in Nashville with no Georgia office, and our attorney service page describes how firm requests are handled.

  • Routine: first attempt in 5 to 7 days
  • Urgent (1.5x): first attempt in 3 to 5 days
  • Rush (2x): first attempt in 1 to 2 days
  • Same Day Rush (3x): first attempt within 2 hours of receipt, where available

02Deadlines that drive the tier

When a Priority Tier Is Worth the Cost

Not every deadline needs Same Day Rush. A hearing set for next week can usually be met with Urgent service, which costs half as much as Same Day Rush. Rush tends to fit a hearing two or three days out, or a subpoena that must be served a reasonable time before a deposition. Same Day Rush is for the genuine emergency: papers that must reach someone today. We ask what the deadline is and suggest the least expensive tier that realistically meets it. That is how same day process serving in Georgia should be used: only when the calendar truly needs it. Subpoena deadlines are discussed further on our Georgia subpoena page.

Georgia's own rules create some of these pressure points. O.C.G.A. § 9-11-4(c) expects service within five days of the server receiving the summons, though a later service is not invalid. Garnishment notice under § 18-4-8 must follow within three business days after the garnishee is served. And when a suit is filed near the end of a limitation period, prompt and diligent service matters; those questions belong with your attorney. Our garnishment and magistrate service page covers the post-judgment timeline.

03Atlanta logistics

Planning Rush Attempts Around Metro Atlanta Traffic

Speed in metro Atlanta depends less on the server and more on the roads. Interstate 285, the Perimeter, runs about 64 miles around the city through Fulton, Cobb, DeKalb and Clayton counties, and published traffic accounts describe it slowing to a crawl at rush hour. The Top End between I-75 and I-85 is reported to carry roughly 250,000 vehicles a day, and I-75 and I-85 share the Downtown Connector through the city. A Same Day Rush job across the Perimeter at 5 p.m. is a different job from the same serve at 10 a.m.

We plan around those realities by assigning a server already working nearby when possible and by timing the first attempt for when the roads and the defendant cooperate. GA 400 has its own pattern, with express-lane construction expected to continue on the corridor for several years. Defendants in the GA 400 corridor are served through our Sandy Springs servers and Roswell process serving, and Cobb jobs near the I-285 and I-75 interchange through our Smyrna process server page.

04Readiness

What Has to Be Ready for a Same Day Serve

Same Day Rush works only when the papers are ready to go. That means filed papers with the case number, every exhibit attached, the correct number of copies, a current address and any access details such as a gate code, a building name or the defendant's work hours. Missing pages or an unsigned summons can cost hours that a same day job does not have. Our Georgia guide to serving legal papers lists what a complete package includes.

The court and county matter too. Certified process servers may serve only in counties whose sheriff accepts them, and Hall County's sheriff does not, so a Gainesville same day request may need a different route. Gated communities have their own entry conditions under § 9-11-4(f)(4). Dispossessories are a special case: we confirm with the magistrate court whether it accepts an approved process server before taking one, which can rule out same day handling. Our Gainesville process server page and the eviction papers page explain both situations.

  • Filed papers with the case number
  • All exhibits and the right number of copies
  • A current service address and access notes
  • The defendant's likely hours at that address

05The math

How Priority Pricing Works County by County

Routine starting rates in Georgia run from $125 to $260, set by population and distance to the nearest metro area. In Fulton, Cobb, DeKalb, Gwinnett and Chatham, Routine starts at $125, so Urgent is $188, Rush is $250 and Same Day Rush is $375. In Richmond County, the $150 Routine rate becomes $450 for Same Day Rush. Bibb starts at $130 and Muscogee at $135. In Lowndes, Routine is $180 and Same Day Rush $540, and Dougherty's $195 Routine becomes $585. The statewide pricing map for Georgia shows every county.

These are published starting rates, never a ceiling or a promise. The final price depends on the address, urgency and document readiness, and it is confirmed in writing before the first attempt. If you are comparing several states for a multi-defendant case, the multistate process serving rate map uses the same tier multiples. For Macon-area filings, our Macon process server page lists local courts.

06Beyond Atlanta

Priority Service in Savannah, Augusta, Macon and South Georgia

Outside metro Atlanta, the question is usually distance rather than congestion. I-16 runs from Macon to downtown Savannah and meets I-95 in Pooler near the airport, and I-75 runs the length of the state from the Florida line near Valdosta to the Tennessee line north of Dalton. In smaller counties, a same day serve may depend on whether a server is available in that part of the state that afternoon, which is why Same Day Rush is assessed case by case. Our Savannah process servers handle coastal priority work.

For Augusta and the Columbia County suburbs, our Augusta process serving page covers the Augusta Circuit and the Southern District's Augusta division. In south Georgia, longer drives are already reflected in each county's higher Routine rate, and we tell you honestly when Rush is a better fit than Same Day Rush. The Valdosta process server page covers Lowndes County, where the Routine rate is $180 and the federal Middle District keeps a clerk's office on North Patterson Street. For same day process serving in Georgia outside the metro, an early call gives us the most room to arrange a server.

07Reporting

Fast Reporting and an Affidavit Ready to File

On priority jobs, we report each attempt promptly so your team knows where things stand, and the signed affidavit follows service. Under § 9-11-4(h), proof is filed within five business days of service, stating the date, place and manner, and a late filing generally delays the start of the defendant's answer period. A fast serve with a slow affidavit defeats the purpose, so we treat the paperwork as part of the job. The who can serve process in Georgia guide explains the affidavit requirements for private servers.

If the first attempt fails, the attempt log records the date, time and what the server observed, and the next attempt follows the plan agreed in writing. A defendant who keeps missing the server may need a varied-time pattern rather than more speed, which our page on serving evasive defendants describes. Divorce petitions with a temporary hearing date are handled through our Georgia divorce service page.

Statewide coverage

Priority Service Across Georgia

Many same day requests involve metro Atlanta counties, where our Atlanta process servers, Marietta servers and Brookhaven process serving pages cover the core of the region. Gwinnett priority jobs run through Lawrenceville service. Outside the metro, Rush and Same Day Rush depend on server availability in that county, and each county's published Routine rate is the base for the tier multiple. Whatever the county, the tier, the server and the final price are confirmed in writing before the first attempt.

FAQ

Frequently asked questions

How much is a Same Day Rush serve in a Georgia county?

Same Day Rush is 3x the county's published Routine rate. In metro counties with a $125 Routine rate, such as Fulton, Cobb and DeKalb, that is $375. In Richmond County it is $450, and in the highest-rate counties it reaches $780. Nothing is dispatched until that number is confirmed in writing. See the Georgia county rate finder.

Does Same Day Rush mean the papers will be served today?

No. The Same Day Rush tier description is a first attempt within two hours of receipt, where available. Whether service is completed depends on the defendant being there. If the first attempt fails, follow-up attempts proceed under the plan agreed in writing, and each attempt is logged with the date, time and what the server observed.

How do I know if Same Day Rush is available for my county?

Contact us with the county, the address and the papers. Availability is assessed case by case, based on server availability in that area, the court's requirements for who may serve, and whether the papers are complete. We answer in writing before accepting, and if Same Day Rush is not realistic we tell you which tier is.

What is the difference between Urgent and Rush?

Urgent is 1.5x the Routine rate and describes a first attempt in three to five days. Rush is 2x and describes a first attempt in one to two days. For a hearing a week away, Urgent is often enough. Our attorney process serving page explains how firms choose a tier for each deadline.

Can a rush serve be done in a gated community?

Possibly. Under § 9-11-4(f)(4), entry requires identifying the person to be served to the guard or managing agent, showing government photo ID and showing evidence of a current appointment as a process server. We confirm whether the assigned server can meet that before planning entry, which affects whether a fast tier is realistic.

Can you rush a subpoena for a hearing tomorrow?

Often, if the papers and the witness address are ready. Any adult non-party may serve a subpoena under § 24-13-24, and an out-of-county witness subpoena is valid only if served with a tender of one day's fee plus mileage. Send the check with the papers. Our subpoena delivery page explains the tender rule.

Can eviction papers be served same day?

We confirm with the magistrate court whether it accepts an approved process server for the dispossessory summons before taking one, because Georgia county practice varies since the July 1, 2025 change to § 44-7-51(a). That confirmation can rule out same day handling. Writs and set-outs are never part of our work. See our Georgia eviction service page.

Do you serve on weekends for priority jobs?

Attempt days and times are planned with counsel. Weekend attempts can be part of a priority plan when the defendant's schedule calls for them and the client approves. We do not state a Georgia rule either way on Sunday service; your attorney can advise if the timing is sensitive for your case.

How fast will I get the affidavit on a rush job?

We send the signed affidavit promptly after service so it can be filed within the five business days § 9-11-4(h) allows. It states the date, place and manner of service, identifies the recipient and lists the documents delivered. Our hard-to-serve defendants page explains what the record looks like when service fails.

Can I upgrade a Routine job to Rush after it starts?

Yes, if a deadline moves up. Tell us as soon as you know, and we confirm the new tier and the revised price in writing before the server changes the plan. The new tier's description applies from the time of the upgrade, and attempts already made stay in the log. Call (629) 310-8667 for a change that cannot wait for email.
