Quick answer

How do I hire a process server in Clarke County, Georgia?

Send the filed papers, the addresses you have and the deadline. We confirm which servers the Athens-Clarke court accepts, quote the tier in writing, assign a server and return a signed affidavit for filing on East Washington Street. Routine service starts at a published $125, and our Athens process servers cover the city itself.

01Local service landscape

A Consolidated Government With Two Separate Towns

Clarke County is compact, yet it holds an estimated 130,000 people, many of them tied to the university. Since 1991 the City of Athens and the county have operated as a unified government, so most addresses fall under Athens-Clarke. Two exceptions remain. Winterville, incorporated in 1904, is the only municipality located wholly inside the county, and part of Bogart crosses in from Oconee County. Our statewide Georgia process serving program handles all three with one written process.

The county's housing mix shapes how attempts are planned. Downtown and the blocks around campus are full of apartments, duplexes and shared houses, many with controlled entry and frequent turnover. Eastside and the Atlanta Highway corridor hold subdivisions and retail, while east Clarke near Winterville is quieter and more rural. We check each address before quoting, and for defendants who moved into Oconee, Barrow or Jackson, our Gwinnett County servers and Georgia rate map help plan the next step.

02Attorneys and law firms

Western Circuit Service for Athens and Statewide Counsel

Clarke County litigation comes from Athens practitioners, Atlanta firms with clients in the university town, and out-of-state counsel handling landlord-tenant, contract, injury and employment matters. Many defendants are students or recent graduates whose addresses change each August. Our Georgia law firm service program gives each office one contact for the written quote, the dated attempt log and the signed affidavit.

We review the papers before assigning a server. Frequent issues include a defendant whose lease ended in May, a property management company with its registered agent in another county, and a federal case in the Athens Division that requires a Rule 4 return instead of state practice. For business defendants, our registered agent service in Georgia follows O.C.G.A. 9-11-4(e)(1), and firms with matters in several states can compare figures on the multistate pricing map.

03Evasive and hard-to-serve

Roommates, Controlled Entry and Addresses That Change Every Year

In a college town, the hardest part of service is often timing. A defendant may share a house with three roommates who decline to say where he is, live in a complex where the leasing office will not open the door, or leave for the summer the week after finals. We plan attempts around those patterns, vary the hours with counsel's approval, and record each visit. Our page on people who are hard to serve explains our method.

Gated and secured residential communities are addressed by O.C.G.A. 9-11-4(f)(4), which generally allows a person authorized to serve to enter for a reasonable time after identifying the person to be served and showing identification and evidence of an appointment. Before a complex visit, we make sure the assigned server carries the documents that rule describes. When attempts still fail, counsel can review the log and weigh other methods through the court, as our guide to evaded service and the publication guide describe.

04Family law, evictions, small claims, subpoenas

Family Papers, Student Rentals, Magistrate Claims and Subpoenas

Divorce and custody filings in the Western Circuit are generally served under O.C.G.A. 9-11-4, though the other spouse may sign an acknowledgment of service instead. Clarke and Oconee share the circuit, so a family case filed in one may involve a spouse living in the other. We deliver discreetly and confirm identity before handing over the papers. Parties can review the Georgia divorce paper service page for how deliveries work.

Student housing makes dispossessories a regular part of the magistrate court docket. Since July 1, 2025, O.C.G.A. 44-7-51(a) allows an approved process server to serve the summons in addition to the sheriff and constables, but approval is not defined, so we confirm the court's practice before accepting and never carry out writs. Security deposit and roommate disputes often become magistrate claims up to $15,000, and our small claims paper service handles those. Out-of-county witnesses must receive $25 plus mileage.

  • Divorce, custody and support papers
  • Dispossessory summonses after the court confirms its practice
  • Deposit and roommate claims up to $15,000
  • Subpoenas with the out-of-county tender

05Documentation and challenges

Proof of Service Ready for the Athens-Clarke Record

In Georgia, a server who is not a sheriff or marshal generally proves service with a sworn affidavit giving the date, the place and the manner of delivery. O.C.G.A. 9-11-4(h) calls for filing within five business days, and when proof is late, the defendant's time to answer does not begin until it is filed. We return affidavits promptly so a Washington Street filing stays on track. Delator Group's history explains who is accountable for the work.

Our affidavits come from notes written at each attempt: arrival time, unit number, who answered and what was said. In shared housing, the record notes whether the person who accepted actually lives there, because abode service generally requires delivery to a resident of suitable age and discretion. If a defendant later claims the papers went to a former roommate, counsel has the details to answer that. Questions about a specific challenge can come through the DFS contact form, and witness deliveries are on our subpoena service page.

06Georgia service rules

Who Can Serve Papers in Athens-Clarke Under Georgia Law

The service section of the Civil Practice Act, 9-11-4(c), generally lets five kinds of people serve: the sheriff and deputies, a marshal of the court, a citizen the court specially appoints, a non-party adult the court appoints for the case or as a permanent process server, and a server certified under 9-11-4.1. Certified servers must file a yearly notice of intent with the sheriff of each county where they serve, and that notice is accepted only where the sheriff allows them. Our overview of who may serve in Georgia covers each path.

DFS never claims that a server holds a particular Georgia certification or appointment. For each Clarke County job, we assign a server who meets the requirements of the issuing court and confirm it in writing before accepting. Where private service is not permitted for a document, we tell you and the papers go through the sheriff. Individuals may be served personally or at their dwelling, and answers are generally due 30 days after service. This is general information, not legal advice; our guide to serving Georgia legal papers adds detail.

07A Clarke County angle

Serving Papers on the University of Georgia Calendar

The University of Georgia shapes Clarke County's population more than any other institution. Leases tend to turn over in late summer, the town empties at winter break and in May, and football Saturdays bring crowds and road closures that make attempts slow and awkward. We schedule around those dates where deadlines allow and tell counsel in writing when a hearing falls during a slow stretch. No campus-specific service rules are assumed; we coordinate with counsel before any attempt on university property.

Because so many residents move away after graduation, a Clarke County case can quickly become a service problem elsewhere in Georgia or another state. When a former student has returned home to metro Atlanta, our Lawrenceville process servers and Rockdale County team can take the papers. If the defendant has left Georgia, the issuing court's rules govern, and our rush service tiers help when time is short.

FAQ

Frequently Asked Questions

Who may serve process in Athens-Clarke County?

Georgia generally allows service by the sheriff or a deputy, a marshal, a specially appointed citizen, a court-appointed or permanent process server, or a certified process server where the sheriff accepts them. We confirm which category the Athens-Clarke court will accept, assign a server who meets it, and say so in writing before the first attempt.

How is Athens-Clarke process serving priced?

The county's published Routine starting rate is $125; Urgent costs half again as much, Rush twice as much and Same Day Rush three times as much. Controlled-entry complexes or attempts timed around the academic calendar are discussed before work begins, and the final price is confirmed in writing. See the Georgia county rate table for comparisons.

Can you serve a student who lives near campus?

Yes, at an off-campus residence or another lawful location. We do not assume any campus-specific rule and coordinate with counsel before any attempt on university property. Because students move often, we ask for every known address and confirm residency at the door, which matters if abode service is used and later questioned.

Is Winterville part of Athens-Clarke?

Winterville is a separate municipality with its own mayor, and it is the only city located wholly inside Clarke County. Part of Bogart also extends into the county from Oconee. Papers for addresses in either town are still filed with the Clarke County courts when the case is pending there, and we serve them under the same standard.

Does handing papers to a roommate count as service?

O.C.G.A. 9-11-4(e)(7) generally allows leaving copies at the defendant's dwelling with a person of suitable age and discretion who resides there. A roommate who actually lives in the unit may qualify, but a guest does not. Your attorney decides whether to use this method, and our affidavit records who accepted and why the server believed they lived there.

Do you serve dispossessory papers for Athens landlords?

Only after confirming the Athens-Clarke magistrate court's practice. Since July 1, 2025, Georgia law allows an approved process server to serve the summons, but the term is undefined and courts vary. DFS does not perform lockouts, set-outs or writ enforcement. Landlords can review steps for serving a Georgia eviction before filing.

What if the defendant has moved out of state?

Georgia generally allows personal service outside the state by court order in certain cases, and publication may be ordered when a defendant resides outside Georgia. Your attorney decides which route applies. We document the attempts made in Clarke County, and our out-of-state papers page explains how we coordinate deliveries beyond Georgia.

How fast can papers be served in Athens?

Routine service begins with a first attempt within several days of receipt. Shorter windows are available as Urgent, Rush or Same Day Rush, costing 1.5, 2 or 3 times Routine, and a same-day request is checked against server availability first. Tell us the hearing date and we will confirm a realistic timeline in writing before we accept, as our expedited Georgia service page describes.

Does DFS have an Athens office?

No. DFS, the process serving division of Delator Group, operates from the group's Nashville, Tennessee headquarters and has no Georgia location or local staff office. Athens-Clarke serves are coordinated through servers who meet the requirements of the issuing court, with logged attempts, a price confirmed in writing and a signed affidavit on every job.

What belongs in an Athens-Clarke service request?

Send the filed papers, the defendant's full name, current and former addresses with unit numbers, a photo or description, vehicle details and the deadline. A subpoena should come with the witness's fee and mileage payment ready to tender. If a defendant keeps dodging attempts, read our hard-to-serve defendant service page before submitting the request and list every attempt already made.
