Quick answer
How do I hire a process server in York County?
Send the filed papers, the case number, home and work addresses on both sides of the state line, and your deadline. We confirm the document can be served privately in that York County court, quote the tier and price in writing and log each attempt. Routine starts at a published $125, and our Rock Hill service page covers the county's largest city.
01Local service landscape
Charlotte Suburbs to the North, Farm Roads to the West
York County counted about 306,887 residents in 2025, and its growth is concentrated in Rock Hill, Fort Mill, Tega Cay and the Lake Wylie area, all within the Charlotte commuting shed. The county seat is the much smaller town of York, and the western end around Hickory Grove, Sharon and Smyrna stays rural. Our Rock Hill papers and attempts page covers the largest city in more detail.
I-77 is the spine. It crosses the Catawba River at Rock Hill, passes Fort Mill and enters North Carolina near Carowinds on its way to Charlotte. Many York County residents commute on that road, which can empty neighborhoods during working hours and fills them after dark. We schedule around that rhythm and keep western-county attempts on separate runs. The South Carolina service hub explains how we cover other counties.
- Rock Hill and the I-77 river crossing
- Fort Mill, Tega Cay and the state-line suburbs
- Clover and Lake Wylie to the northwest
- York, McConnells, Sharon, Smyrna and Hickory Grove

When the Lawyer Is in Charlotte and the Defendant Is in Fort Mill
Many York County residents work in North Carolina, so counsel in cases filed across the state line often need a York County defendant served. The issuing court's rules decide how service outside its state must be made and proved. Tell us that rule and we match the South Carolina delivery and affidavit to it, as described on our page for papers from other states. Counsel should confirm any form the issuing court requires. When a case also names defendants in other states, our multistate price comparison shows where DFS serves.
South Carolina firms filing at the Moss Justice Center want the summons and complaint delivered together, an affidavit that tracks the caption and attempt reports as they happen. Our program for South Carolina litigators lists the intake details. Delator Group is a Tennessee firm headquartered in Nashville with no York County office; serves may be carried out by vetted servers Delator contracts with under one documentation standard, each at least 18 and not a party to, or an attorney in, the case. The Delator Group profile explains more.
03Evasive and hard-to-serve
Commuters, Lake Homes and New Neighborhoods on the Border
A defendant who commutes to Charlotte may leave before seven and return after dark, and one who works from home may never come to the door at all. Newer neighborhoods in Fort Mill and Tega Cay can have amenity gates, and lake homes near Lake Wylie may be occupied seasonally. We schedule early, late and weekend attempts with counsel's approval and log each one. The page on hard-to-reach South Carolina defendants describes how we build that record.
Under S.C. Code 15-9-17 Sunday service is permitted, but never on a person who is going to worship, attending it or heading home. Where due diligence still fails to find the defendant in South Carolina, S.C. Code 15-9-710 lets the court or the clerk of common pleas order publication on an affidavit. The service by publication explainer covers what counsel must show.
- Charlotte commuters gone during working hours
- Amenity-gated neighborhoods in Fort Mill and Tega Cay
- Lake homes near Lake Wylie used seasonally
- Rural western addresses with long driveways
04Family, landlord, claim and witness papers
Family Court in Rock Hill, Magistrates and Rental Cases
York County Family Court sits at 1555 West Main Street in Rock Hill rather than in the county seat. Divorce, custody and support summonses are served under SCRCP 4 like any civil action, and a cooperating spouse may sign an Acceptance of Service (SCCA 400.03). Family court rules to show cause are other process under Rule 4(c), handled by the sheriff, another officer or a court-designated person, so we do not offer them as routine service. Our guide to South Carolina divorce service explains the routes.
Magistrates hear civil claims up to $7,500, and SCRMC 6(c) lets any adult who is not a party or attorney in the case serve their summonses, proving service by affidavit; see our small claims papers page. For ejectment, the rule to vacate is typically served through the sheriff's office, and a writ is executed only by a constable or deputy sheriff. We serve the rule only where the magistrate court confirms private service is accepted, never post or execute a writ, and do serve rent and damage suits, as our eviction-related papers page explains.
05Documentation and challenges
Proof That Satisfies Courts in Two States
Under SCRCP 4(g), a private server's affidavit must state the date, time and place of service and the name and address of the person served, or a description if the name is unknown. When papers come from a North Carolina court, the affidavit may also need to meet that court's form requirements, so we ask counsel for any required language before the serve. The attempt log is kept either way, and you can send DFS the required wording ahead of time. Our rush tiers for South Carolina shorten turnaround when a hearing is set.
Challenges in York County often ask whether the defendant really lived at the address served, especially when someone keeps a residence on each side of the state line. If papers were left with a household member, the affidavit should show the person lived there and was of suitable age and discretion. The server's notes record what was said at the door. The overview of South Carolina service methods explains how each route is proved.
06South Carolina service rules
South Carolina's Service Rules, Including Reach Beyond the State
SCRCP 4(c) allows the sheriff, a deputy or any person 18 or older who is not a party to or an attorney in the action to serve a summons, while orders, rules and writs generally go to the sheriff, another officer or a court-designated person. No statewide license exists for private process servers in South Carolina, and DFS does not claim one or any appointment. The explainer on who may deliver South Carolina process covers each path.
Under SCRCP 4(f), process other than a subpoena may be served anywhere in South Carolina, and beyond the state only when a statute provides for it. S.C. Code 15-9-750 treats personal service of a summons outside the state as equivalent to publication, complete on the day it is made. Within South Carolina, methods include personal and abode delivery, an authorized agent, restricted-delivery certified mail and a qualifying commercial delivery service. Your attorney can confirm which route fits the case.

A County Seat, a Family Court City and a Federal Court in Columbia
York County spreads its courts across three cities. The clerk and the Court of Common Pleas sit at the Moss Justice Center on York Highway in the town of York, Family Court is in Rock Hill, and federal cases from the Rock Hill division are heard in Columbia at the Perry Courthouse. We read the caption before the first attempt so the affidavit is addressed to the right court, and we note the federal division on every federal file.
The Rock Hill federal division also covers Chester, Fairfield and Lancaster counties, so one case can name defendants across the region. When a co-defendant lives elsewhere in South Carolina, we coordinate through Spartanburg County service or Richland County papers under one written quote, and the county price finder shows each starting rate, including Chester at $150 and Lancaster at $130.
- Clerk and Common Pleas: Moss Justice Center, York
- Family Court: 1555 W. Main St., Rock Hill
- Federal Rock Hill division: heard in Columbia
- 16th Circuit: York and Union counties

FAQ
Frequently Asked Questions
Who may serve a summons in York County?
Under SCRCP 4(c), the sheriff, a deputy or any person at least 18 who is not a party to or an attorney in the action may serve a summons. Orders, rules and writs generally need the sheriff or a court-designated person. The South Carolina coverage page explains how DFS handles each type of paper.
What does a Rock Hill or Fort Mill process server cost?
York County carries a $125 published Routine starting rate. Urgent, Rush and Same Day Rush are 1.5, 2 and 3 times that base. Your price depends on the address, the number of defendants, commuting patterns and the deadline, and it is confirmed in writing before we make any attempt on the file.
Can you serve North Carolina court papers in York County?
Yes. The issuing court's rules govern service outside its state, so send us the rule your court uses and any required affidavit language. We match the South Carolina delivery and affidavit to it. No South Carolina statute specifically governing out-of-state summonses served here was found, so counsel should confirm the requirements.
Where is York County Family Court?
At 1555 West Main Street in Rock Hill, not in the town of York, according to the county directory. The Clerk of Court and Court of Common Pleas are at the Moss Justice Center on York Highway in York. We check the caption on every family file so the affidavit names the correct court.
How do I subpoena a York County witness for an out-of-state case?
Under South Carolina's Uniform Interstate Depositions and Discovery Act, a party submits the foreign subpoena to the clerk of court of the county where discovery is sought, and the clerk issues a South Carolina subpoena (S.C. Code 15-47-120). It is then served under SCRCP 45. Our subpoena service for South Carolina handles the delivery.
Will you serve a rule to vacate in York County?
Not as a standard service. Rules to vacate are usually served through the sheriff's office, and only a constable or deputy sheriff executes a writ of ejectment. We accept the rule only on the magistrate court's confirmation that private service is allowed. Our ejectment walkthrough explains the ten-day response period after service.
Do you attempt service on Sundays in York County?
When counsel approves. S.C. Code 15-9-17 permits Sunday service of judicial documents, with an exception for anyone going to, attending or coming home from a church or other religious service. We plan around that limit. For commuters who are rarely home on weekdays, a Sunday afternoon attempt can help, and each one is logged.
How are businesses in Fort Mill and Rock Hill served?
Usually by delivery to the registered agent or an officer or managing agent under SCRCP 4(d)(3). An out-of-state corporation not authorized to do business in South Carolina may be served through the Secretary of State under S.C. Code 15-9-245. Our South Carolina company service page covers the other routes, including court-ordered mail to a corporate secretary.
Where are York County federal cases heard?
York County is in the Rock Hill division of the District of South Carolina, but Rock Hill division cases are heard in Columbia at the Matthew J. Perry, Jr. U.S. Courthouse on Richland Street. We serve those federal summonses and subpoenas under the federal rules and write the affidavit for that court.
What if the defendant moved to North Carolina?
Under SCRCP 4(f), South Carolina process reaches beyond the state only where a statute authorizes it, and S.C. Code 15-9-750 treats personal service out of state as equivalent to publication. Counsel decides whether that route fits. Our guide for defendants who are hard to find explains how a dated attempt log supports the next step.
