01Local service landscape

Serving Papers Along the Colorado and Roaring Fork Rivers

Garfield County had an estimated 63,500 residents in 2025. Most live in a chain of towns along I-70 and the Colorado River: Glenwood Springs, the county seat, then New Castle, Silt, Rifle and Parachute, with Battlement Mesa across the river from Parachute. Carbondale sits up the Roaring Fork Valley toward Aspen. Rural addresses climb into side canyons and mesas where distances grow fast, so we confirm every address before quoting, and Grand Junction process serving handles defendants who moved down valley into Mesa County.

Housing ranges from older blocks in Glenwood Springs to newer subdivisions in Rifle and New Castle, ranches south of Silt and long private drives in the Four Mile area south of Glenwood Springs. Servers plan routes by geography, daylight and weather. When a defendant's current address is in doubt, our Grand Junction investigators can confirm a residence before a long trip.

02Attorneys and law firms

Service for Roaring Fork and Colorado River Valley Firms

Garfield County district court cases are filed at the courthouse on 8th Street in Glenwood Springs, and county court matters may be heard there or at the Rifle Associate Court on East 18th Street. Local firms send us construction and real estate disputes, energy and contracting claims, injury cases, landlord-tenant matters and domestic cases. Delator's attorney services across Colorado give each firm one coordinator for the written quote, the attempts and the signed return.

Aspen, Denver and out-of-state counsel often need a Garfield County worker, contractor or former employee served. We check the caption first, because a case can come from Garfield, Pitkin, Eagle or Rio Blanco County, and each has its own clerk. When a witness or party has moved, witness background checks and Colorado lost contact locates can run while service proceeds.

03Evasive and hard-to-serve

Commuters, Field Crews and Defendants Who Work Up Valley

Many Garfield County residents commute up the Roaring Fork Valley to resort jobs near Aspen, or work in energy, construction and service jobs with early or rotating shifts. A defendant who lives in Rifle may spend most waking hours in another county. Servers try early mornings, evenings and weekends, log every attempt with its result, and note when family members say the person works away, so the next visit can be timed better.

When a defendant avoids service deliberately, a Delator investigator can take over through evasive defendant searches, using public records and lawful observation rather than entering private land. If counsel later seeks a C.R.C.P. 4(f) order, the server's affidavit is drawn straight from that log. The log keeps every date and observation for counsel. Energy and contracting employers can ask about stolen equipment investigations, and insurers about workers' comp surveillance.

04Family law, evictions and subpoenas

Family Law, Evictions, Small Claims and Subpoenas in Garfield County

Garfield County dissolution and parenting-time cases are generally heard in district court in Glenwood Springs. Under C.R.S. 14-10-107, a respondent generally must be personally served unless they join the petition or waive service, and the automatic temporary injunction applies from service. We record the exact time and place. Counsel can read our guide to hidden assets in a Colorado divorce and custody investigation guide.

Landlords file FED cases in Garfield County Court. Under C.R.S. 13-40-104 a residential nonpayment notice is generally 10 days, and the summons itself must be served or posted no later than seven days before the court date. The Garfield County Sheriff asks for one FED copy per defendant plus one for "Any and All Other Occupants" when it serves. Writs of restitution are executed only by the sheriff, and screening applicants first protects owners.

  • Dissolution and parenting-time petitions
  • FED summonses for Glenwood or Rifle county court
  • Small claims notices 15 days before trial
  • Witness subpoenas for 9th District hearings

05Documentation

Garfield County Returns That Hold Up

Each Garfield County return states that the server is 18 or older and not a party, lists the documents, and gives the date, time, place and manner of service on the pattern of the JDF 98 Affidavit of Service. The supporting log records every attempt, including rural visits, road closures and weather delays. Serves may be carried out by vetted servers Delator contracts with, all working to one written standard and a price confirmed in writing.

If a defendant disputes service, counsel can show whether delivery was personal, on a family member 18 or older at the home, on a listed workplace contact, or after a refusal under C.R.C.P. 4(k). The log also identifies which court location the return is intended for. For broader factual disputes, investigative consulting for counsel and auto shop damage investigations are available.

06Colorado rules

Colorado Service Rules for Garfield County Papers

No license is needed to serve papers in Colorado. The rule, C.R.C.P. 4(d), generally permits service by a non-party who is at least 18. Under C.R.C.P. 4(e)(1), a server may deliver personally, leave papers at the abode with a family member 18 or older, leave them at work with a supervisor, secretary, administrative assistant, bookkeeper, human resources representative or managing agent, or give them to an authorized agent. The Colorado process serving overview covers business and government defendants.

C.R.C.P. 4(m) generally gives a plaintiff 63 days from the filing date to complete service. Defendants generally answer within 21 days, or 35 if served outside Colorado or by publication, which is limited to property and status cases by court order. Subpoenas need one day's mileage tendered under C.R.C.P. 45. These are summaries, not legal advice, and the Colorado guide to serving papers and lawful investigation limits explain more.

07Garfield County angle

Glenwood Canyon, Two Court Locations and a Carbondale Mix-Up

The I-70 section through Glenwood Canyon, about 12 miles long and completed in 1992 with the Hanging Lake tunnel, is the main link between Garfield County and the Eagle River valley. When the canyon is closed or chain-law conditions apply, travel east can be badly delayed. We build that into scheduling, tell you when weather or closures affect an attempt, and never promise winter turnaround times. Eastbound papers go through Eagle County process serving.

Addresses can mislead. Carbondale is in Garfield County, but Eagle County's El Jebel court location also uses a Carbondale mailing address, and Basalt crosses into Eagle and Pitkin counties. We confirm the county of each Roaring Fork address and which court issued the papers. The Garfield County Sheriff, with offices in Glenwood Springs and Rifle, bills mileage beyond city limits and requires prepayment, and Summit County papers go through Summit County service.

FAQ

Frequently Asked Questions

Does a process server in Garfield County need a license?

No. There is no Colorado license for process servers, and C.R.C.P. 4(d) generally lets any non-party adult 18 or older serve a summons. Because no agency screens servers, ask how attempts, rural visits and delays are documented. Our vetting guide for Colorado providers lists the questions to ask. That matters most on long rural routes.

How much does it cost to serve papers in Garfield County?

Routine service in Garfield County has a published starting rate of $170. Urgent starts at $255, Rush at $340 and Same Day Rush at $510. Mesa County starts at $125 and Pitkin at $200. The final price depends on the address, distance, deadline, number of people and road conditions, and it is confirmed in writing first.

Which Garfield County court handles my case?

Check the caption. District court cases are filed at the Garfield County Courthouse, 109 8th Street, Suite 104, Glenwood Springs. County court matters may be heard there or at the Rifle Associate Court, 200 E. 18th Street, Suite 103. Our affidavit names the court that issued the papers so the return reaches the right clerk.

Is Carbondale in Garfield County?

Yes, the Town of Carbondale is in Garfield County, where Routine service starts at $170. Confusion arises because Eagle County's El Jebel court location uses a Carbondale mailing address, and nearby Basalt crosses into Eagle and Pitkin counties. We confirm the county of each Roaring Fork address before quoting or scheduling.

Can papers be left with family at a Rifle or New Castle home?

In most cases yes, provided a family member of the defendant aged 18 or older takes them at the usual place of abode, per C.R.C.P. 4(e)(1). An unrelated roommate, ranch hand or guest generally does not qualify. The affidavit names who took the papers and how they are related to the defendant, which lets the court judge it if service is contested.

Will Glenwood Canyon closures delay my serve?

They can. When I-70 through Glenwood Canyon is closed or chain-law conditions apply, travel between Garfield and Eagle counties can be badly delayed. We schedule around conditions, tell you when weather or closures affect an attempt, and never promise winter turnaround times. Rush tiers still depend on safe roads and an open canyon.

Do you serve in Parachute and Battlement Mesa?

Yes. Parachute, Battlement Mesa, Rulison, Silt, New Castle and Rifle are in Garfield County, where Routine service starts at $170. Western county addresses can be far apart, so servers plan routes carefully and note any gate or access issue. Papers for De Beque, just west in Mesa County, are quoted at Mesa's rate.

What if a Garfield County defendant cannot be served?

Counsel may file a C.R.C.P. 4(f) motion for substituted service, backed by the server's affidavit explaining each attempt and why it failed. The judge has to find due diligence and a method reasonably calculated to give the defendant notice. Our attempt log supports that motion, debtor locates help after judgment, and Colorado missing person guidance explains lawful searches.

How do you serve an energy company or contractor here?

Most often through the registered agent on file with the Colorado Secretary of State, or through an officer, manager or general partner. If the agent cannot be served with reasonable diligence, C.R.S. 7-90-704 generally allows registered or certified mail to the principal address; the Secretary of State is not a substitute agent. Corporate collusion investigations are a separate service.

It coordinates service across Garfield County through vetted servers held to one documentation standard, and it works to Tennessee's licensing standard in every state.
