Quick answer
How do I hire a process server in Virginia Beach?
Send the filed papers, the service address and any deadline. We confirm which Virginia Beach court issued them, check the address is inside the city, and quote the tier in writing. The published Routine starting rate for the city is $125. Our Virginia process serving overview explains how DFS coordinates service statewide.
01Local service landscape
A Resort City and a Farm County Under One Name
Virginia Beach became its present shape in 1963, when the small resort town merged with Princess Anne County and the combined city kept the better-known name. Seven boroughs came out of that merger: Bayside, Blackwater, Kempsville, Lynnhaven, Princess Anne, Pungo and Virginia Beach. The result is an independent city with roughly 245 square miles of land, so a single job can mean a high-rise along Atlantic Avenue in the morning and a gravel lane near the North Carolina line by afternoon. Our Virginia county and city rate map shows why the whole city still sits at one starting rate.
Interstate 264 carries most traffic east from Norfolk and ends near Parks Avenue by the Oceanfront, while Shore Drive (US 60) reaches the Oceanfront from the Chesapeake Bay side. Rural addresses in Pungo or Blackwater can be spread out along long county-style roads. We plan routes around those realities and note on the attempt log where an address turned out to be a farm gate, a shared driveway or a seasonal cottage. Defendants across the city line are handled through service in neighboring Chesapeake or Norfolk papers and courts.
- Seven boroughs from the 1963 merger
- About 245 square miles of land (secondary)
- I-264 ends near the Oceanfront
- All civil returns go to the Nimmo Parkway courts
02Attorneys and law firms
Support for Counsel Filing at the Municipal Center
Virginia Beach's circuit court clerk and general district court share one address, 2425 Nimmo Parkway, so most local filings and returns move through a single campus. Firms send us warrants in debt, complaints for personal injury and contract claims, motions for judgment and deposition subpoenas. Out-of-state counsel often needs a resident or a local business served quickly after a case is filed elsewhere, and same day service options exist for those deadlines. Our service program for Virginia attorneys keeps the quote, the attempt notes and the signed return with one DFS contact from start to finish.
The 2nd Judicial Circuit is unusual because it reaches across the Chesapeake Bay. Under Va. Code 17.1-506 it covers Virginia Beach plus Accomack and Northampton counties on the Eastern Shore, which drivers reach over the tolled Chesapeake Bay Bridge-Tunnel on US 13. When a Virginia Beach filing names a defendant on the Shore, we price that leg separately in writing. Federal matters filed in the Eastern District's Norfolk Division follow Federal Rule 4, and counsel can review our approach to papers from other states before sending a foreign case.
03Evasive and hard-to-serve
Base Gates, Condo Lobbies and Doors That Stay Shut
Naval Air Station Oceana and Joint Expeditionary Base Little Creek-Fort Story both sit inside the city, and many defendants work on one of them. Access to a military installation is controlled by its command. Navy regulations at 32 CFR 720.20 let a commanding officer permit service and designate a place for it, such as the legal office, so we coordinate with counsel rather than show up at a gate. Most service members are easier to reach at home, and our notes on defendants who dodge service describe how we schedule those visits.
Oceanfront towers bring a different problem: a front desk, a fob reader and a resident who never comes down. We vary the day and hour of each visit, record what the concierge or neighbor said, and stop short of anything a building forbids. Virginia law bars civil service on Sunday under Va. Code 8.01-289, so weekend pressure has to fall on Saturday, a point covered in the statewide Virginia process serving page. When personal delivery keeps failing, the attempt log becomes the record counsel uses to weigh the next step, explained in what happens when someone avoids service.
04Family law, landlords and subpoenas
Divorce, Custody, Unlawful Detainer, Small Claims and Witnesses
Divorce complaints in Virginia Beach are filed in the circuit court, while custody, visitation and support petitions go to the Juvenile and Domestic Relations District Court. Many defendants simply accept service under Va. Code 20-99.1:1 by signing before a notary or the clerk, which counsel may try first. When a personal handoff is needed, we make it quietly and describe on the return exactly how it happened. The Virginia divorce papers service page compares acceptance, personal delivery and substituted service.
Landlords across the city send us unlawful detainer summonses. Va. Code 8.01-126 allows that summons to be served by a private server under 8.01-293, and it must be served at least 10 days before the return day. Once a judgment is entered, only the sheriff or high constable executes the writ of eviction, so we never carry out a removal or post the notice of execution. Small claims up to $5,000 and witness subpoenas round out the docket, covered on our small claims service page and the Virginia subpoena delivery page.
- Circuit court divorce and J&DR custody papers
- Unlawful detainer summons served 10+ days before return
- Writs of eviction stay with the sheriff
- Small claims division up to $5,000

What a Virginia Beach Return of Service Must Show
Virginia sets out the contents of a private server's return in Va. Code 8.01-325. The return goes to the clerk's office within 72 hours of service, and if that deadline lands on a weekend or legal holiday it moves to the next business day. It must carry the server's affidavit of qualifications, the date and manner of service, the name of the party served, a stamped or printed note that a private server made the delivery, and the server's name, address and telephone number. Our step-by-step guide to serving papers in Virginia shows where that return fits in the case.
If a defendant later denies that anyone came to the door, the field notes answer the question: each address visited, the hour, the person spoken to and a description of the door or building. Outside Tennessee, serves may be carried out by vetted servers Delator contracts with, and every one of them works to the same written documentation standard. You can ask for the attempt log at any point, and rush and same day service in Virginia produces the same record on a shorter clock.
06Virginia rules
Who May Serve and How Substituted Service Works
Under Va. Code 8.01-293, process may generally be served by a sheriff or by any person 18 or older who is not a party or otherwise interested in the case, and a private process server is simply such a person who charges a fee. No Virginia statute licenses private servers. Certain acts stay with officers: executing a writ of possession, levying on property and serving a capias or show cause order. Our guide to who can serve process in Virginia covers the details.
Va. Code 8.01-296 sets the order for an individual, starting with personal delivery. If the person is not found at the usual place of abode, a copy may be left with a family member age 16 or older who is not a temporary guest and is told what the papers are. Failing that, the papers may be posted at the main door. Before a default judgment, the filing party or its attorney must mail a copy and file a certificate of mailing at least 10 days ahead, a step we coordinate with counsel. The posted service guide walks through it; the Virginia eviction papers page applies it to landlords.
07Virginia Beach angle
Summer Rentals, Hotels and the Usual Place of Abode
A resort city creates a legal wrinkle that matters for substituted service. Virginia's statute allows a household member to receive papers only at the defendant's usual place of abode, and it excludes temporary sojourners and guests. A week-long Oceanfront rental, a hotel room or a friend's Sandbridge cottage may not qualify. Before leaving papers with anyone, we confirm whether the address is where the defendant actually lives, and if it is not, we try for personal delivery or report back so counsel can choose another route.
Seasonal workers add a timing problem. Someone who lives at the beach from May to September may have a different abode by the time a winter suit is filed, and the twelve-month service window under Va. Code 8.01-275.1 keeps running. We tell you promptly when an address looks stale so you can update it, and the hard-to-serve defendant program picks up from there. A process server in Virginia Beach who knows the difference between a vacation address and a home saves a challenge later, and Delator Group's background and Nashville headquarters explain who stands behind the work.

Process Servers Near Virginia Beach
Hampton Roads cases rarely stay inside one city line. Defendants west along I-264 are handled through our Portsmouth service page, and those past the Great Dismal Swamp side of the region go to Suffolk process service. Papers bound for the Peninsula cross the water to Hampton serves and service in Newport News. Each of those jobs carries the same written quote, the same dated attempt log and the same 8.01-325 return as a Virginia Beach serve, so a file assembled from several cities reads the same way to the clerk.
FAQ
Frequently Asked Questions
Can any adult serve papers in Virginia Beach?
Generally, yes. Va. Code 8.01-293 allows any person 18 or older who is not a party or otherwise interested in the case to serve process, alongside the sheriff. Some acts are reserved to officers, including executing a writ of eviction and levying on property. Every server we assign meets the statute's qualifications, and each return carries the affidavit that 8.01-325 requires.
How much does a process server in Virginia Beach cost?
The published Routine starting rate for the City of Virginia Beach is $125, which makes Urgent $188, Rush $250 and Same Day Rush $375. The final figure depends on the address, the papers and the deadline, and we confirm it in writing before anyone is sent. Compare other localities on the multistate pricing map.
Can you serve someone on a Virginia Beach military base?
Base access belongs to the command. Navy rules at 32 CFR 720.20 let a commanding officer permit service on the installation and designate a place for it, such as the legal office. We coordinate with counsel instead of arriving unannounced, and many service members are easier to reach at home. Counsel also handles the Servicemembers Civil Relief Act affidavit before any default.
Do you serve papers in Virginia Beach on Sunday?
No. Va. Code 8.01-289 bars service of civil process on Sunday except in narrow cases such as persons escaping custody. We schedule early-morning, evening and Saturday attempts instead and log each one, so the record shows a real effort across the week. If Saturday visits fail too, counsel can review the log and choose substituted or posted service where Va. Code 8.01-296 permits it.
Can you serve an unlawful detainer in Virginia Beach?
We can serve the unlawful detainer summons, which Va. Code 8.01-126 allows a private server to deliver at least 10 days before the return day. We do not execute the writ of eviction or deliver the notice of execution; only the sheriff or high constable does that. The Virginia eviction service guide explains each step.
What if the defendant is staying at an Oceanfront hotel?
A hotel room or short-term rental is usually not the defendant's usual place of abode, so substituted service on someone there may not hold up. We attempt personal delivery where the property allows it and otherwise report back with what we learned. Counsel can then decide whether to send us to the defendant's home address or another location.
How long does a Virginia Beach defendant have to respond?
In circuit court, Rule 3:8(a) of the Rules of the Supreme Court of Virginia generally gives a defendant 21 days after service of the summons and complaint. General district court cases instead run to the return date on the warrant or summons. Your attorney can confirm the deadline for the specific papers.
How long do I have to get a Virginia lawsuit served?
Va. Code 8.01-275.1 treats service within twelve months of filing as timely, and later service only if the court finds the plaintiff used due diligence. Rule 3:5(e) adds a similar limit on judgments. Sending papers early leaves room for repeat attempts, and our Virginia hub page lists the main deadlines.
Can you serve a company in Virginia Beach?
Yes. For a Virginia corporation, Va. Code 8.01-299 allows personal service on an officer, director or registered agent, and an LLC is served through its registered agent. When no registered agent can be found, the Clerk of the State Corporation Commission becomes the agent, and that filing goes through the Clerk's office. See registered agent service in Virginia.
Does Delator have an office in Virginia Beach?
No. Delator Group is a Tennessee firm headquartered in Nashville, and Delator Field Services coordinates Virginia serves through vetted servers working to our documentation standard. You deal with one DFS contact for the quote, updates and return. Contact Delator Field Services to start a Virginia Beach serve, and expect the written price before any attempt is made.
