Quick answer

How do I hire a process server in Florence?

Send the filed papers and the Boone County address. We confirm how the Boone clerk in Burlington issued the summons and whether private delivery is accepted, then quote the tier and price in writing. Routine service has a published starting rate of $125, and the Boone County service page covers Union, Walton, Hebron and Burlington.

01Local service landscape

The County's Largest City, With Its Courts Down the Road

Florence had about 32,000 residents in the 2020 census, which makes it the largest of Boone County's three incorporated cities, alongside Union and Walton. The county seat, though, is Burlington, and the Boone County Justice Center on Rogers Lane is where every Florence civil case is filed and returned. Out-of-town filers sometimes look for a Florence courthouse; there is none to look for. The Boone County countywide page covers Burlington and the river communities.

I-71 and I-75 run together through Florence on their way to Covington and Cincinnati, and I-275 loops west past the airport toward Petersburg. Shopping centers, office parks and apartment complexes cluster near the interchanges, while western Boone County is still rural. We route attempts by corridor and log them in Eastern Time. Neighboring Erlanger process service uses the same routing, and the Kentucky county pricing map lists Boone's rate.

02Attorneys and law firms

Serving for Northern Kentucky and Cincinnati-Area Counsel

Boone County cases are heard in the 54th Judicial Circuit, which it shares with Gallatin County, and federal cases from Boone go to the Eastern District's Covington division. Attorneys who send us Boone County work practice in Northern Kentucky, Cincinnati and Louisville, and they bring collection suits, commercial and employment disputes, injury claims and deposition subpoenas. Our service program for Kentucky lawyers keeps the quote, notes and return in one place.

We review papers before scheduling. A Boone Circuit Court summons follows CR 4, a federal summons from the Covington division follows Federal Rule 4 and the joint local rules, and an Ohio subpoena must first be reissued by the Boone circuit clerk under KRS 421.360. If the defendant has moved over the line into Kenton County, the case still belongs in Burlington if it was filed there, and Covington process service handles delivery on that side.

03Evasive and hard-to-serve

Overnight Logistics Shifts and Large Apartment Communities

Cincinnati/Northern Kentucky International Airport sits in Boone County near Hebron, and it hosts the Amazon Air hub, which began operations in 2017, and a DHL hub that opened in 1984 with about 2,500 employees, according to published figures. Some Florence residents work overnight sort or warehouse shifts, so a daytime visit often finds no one home. We ask counsel for the defendant's schedule and time the attempts to it. The Kentucky hard-to-serve defendants page describes how.

Florence also has large apartment communities with leasing offices, gated entries and building numbers that are hard to find at night. We confirm the building and unit before the visit, deal politely with staff and record which entrance was used. A defendant who will not come to the door gets varied attempts, including Sundays, which KRS 454.135 does not exempt. The guide for avoided service in Kentucky covers what counsel may weigh, and same day Kentucky service handles short deadlines.

04Family law, landlords and subpoenas

Boone Family Court, Rental Notices, Small Claims and Witnesses

Dissolution and custody cases for Florence families are filed in Boone Circuit Court in Burlington, where a Family Court is listed. Respondents may be personally served, served by the clerk's certified mail or, in narrow circumstances, brought in by warning order, and many sign a waiver of service and entry of appearance instead. We deliver family papers privately and away from a workplace where we can. The Kentucky divorce and custody service page explains the options.

Florence appears on a 2015 list of cities that adopted URLTA, which sets a 7-day written notice for unpaid rent under KRS 383.660; the list is dated, so check current status with counsel. The forcible detainer notice is directed to the sheriff or a constable under KRS 383.210, and we never serve it. Small claims up to $2,500 usually go by certified mail or the sheriff, as our small claims page for Kentucky courts notes, and witness subpoenas in Kentucky follow CR 45.03.

  • URLTA notices, status to be confirmed
  • Small claims only where private delivery is accepted

05Documentation

A Florence Return Built for the Burlington Clerk

For a Boone summons the clerk transferred for private delivery, the proof is the server's endorsed return, filed promptly and within the defendant's response time under CR 4.03. If the court appoints a person under KRS 454.145, that return is verified by affidavit. Our Florence returns list the date, time, address including building and unit, and manner of delivery, and they name the Burlington court. The Kentucky paper-serving guide explains where the return goes.

Each return is backed by a log of every attempt, successful or not, recording the time, the entrance and who answered. If a defendant later says no one served them, counsel has the record. Outside Tennessee, the server on a Boone County job may be a vetted contractor engaged by Delator, held to the same written documentation standard used across DFS. The Kentucky statewide service page explains how the network fits together.

06Kentucky rules

Kentucky's Service Rules in a Boone County Case

Once a Boone complaint is filed, the clerk issues the summons and, under CR 4.01, mails it by certified mail, transfers it to an authorized person other than a mail carrier, or returns it to the plaintiff to arrange service, depending on the plaintiff's instruction. KRS 454.140 directs process to the sheriff by default, and KRS 454.145 lets a court appoint a person for one paper. Kentucky does not license private servers, as the guide to Kentucky process server rules explains.

Before taking a Florence job, we confirm with counsel and the Boone clerk how the summons will issue and whether private delivery is accepted, and papers that only an officer may serve are routed to the sheriff. Individuals must receive the papers personally, refuse an offer of them, or be served through an authorized agent under CR 4.04(2). The answer is then generally due in 20 days under CR 12.01. This is a summary, not legal advice; see about Delator Group.

07Florence angle

Walton, the County Line and Which Clerk Gets the Return

Walton is one of Boone County's three cities, but part of it lies in Kenton County, and Florence and Erlanger sit close to the same line. That matters for two reasons. The issuing court decides where the return is filed, so a case filed in Burlington returns to Burlington even if the defendant lives in Kenton County. And a new filing belongs in the county that venue rules point to, which counsel decides. A process server in Florence should confirm the county of the address before the first trip, and we do.

The second Florence question is business service. Distribution and logistics companies near the airport are often foreign corporations registered in Kentucky, so their registered agent is the usual recipient under KRS 14A.4-040, and the Secretary of State does not serve them. When that agent is missing or cannot be reached with reasonable diligence, the statute permits certified or registered mail to the company's principal office. Our Kentucky registered agent page and Independence process service explain related steps.

Defendants east in Covington, Erlanger, Fort Mitchell or Independence are handled through our Kenton County process servers, and those across the Licking River in Newport, Bellevue or Fort Thomas go to Campbell County service. Every one of those serves is quoted in writing, attempted at logged times and returned with signed proof for the court that issued the papers.

FAQ

Frequently Asked Questions

Is there a courthouse in Florence?

No. Boone County's courts and circuit clerk are at the Boone County Justice Center, 6025 Rogers Lane, Room 141, in Burlington, the county seat. Florence cases, whether Circuit, District or Family Court, are filed and returned there. Our returns name the Burlington court so they can be filed without delay, and we confirm the case number before the first attempt.

How much does a process server in Florence cost?

Boone County's published Routine starting rate is $125, which makes Urgent $188, Rush $250 and Same Day Rush $375. The final number depends on the address, the document and the deadline, and we confirm it in writing before a server is assigned. Kenton and Campbell share the same starting rate, which keeps Northern Kentucky jobs simple to quote.

Can a household member accept papers in Florence?

Not a Kentucky summons. Delivery must be made to the defendant, offered to the defendant if they refuse, or made to an agent authorized by appointment or by law, under CR 4.04(2). Kentucky has no rule letting a private server leave a summons with a spouse or roommate. Our return identifies exactly who received the papers and where.

Do you handle Florence evictions?

We do not serve the forcible detainer notice or carry out warrants of restitution; KRS 383.210 and KRS 383.245 direct those to the sheriff or a constable. We can deliver a landlord's pre-suit written notice where the lease and the law allow it, and serve papers in a separate suit for rent or damage. The eviction process guide for Kentucky walks through it.

How long does a Florence defendant have to respond?

Generally 20 days after service, under CR 12.01; CR 4.02 requires the summons to state that deadline. Kentucky's AOC-105 summons runs the 20 days from the day after delivery. Where a warning order was used instead, CR 4.08 treats the defendant as summoned on the 30th day after its entry. Your attorney should calculate the exact response date for the case.

What if a Florence defendant cannot be served?

We send a report after each unsuccessful visit and keep a dated log. If the defendant has left the county to avoid service, is concealing themselves or has an unknown residence, CR 4.05 allows a warning order on an affidavit, and the clerk appoints a warning order attorney who reports within 50 days. The warning order attorney explainer covers the steps.

Can you serve someone at an airport-area warehouse?

Workplace service at a large distribution site depends on site access, security procedures and whether the defendant can be reached without disrupting operations. Many warehouse employees are easier to serve at home if attempts follow their shift. Counsel decides whether a workplace attempt is appropriate, and we record any visit in full detail.

What about a Walton address that might be in Kenton County?

Walton lies partly in Boone County and partly in Kenton County, so we confirm the county of the address before the first attempt. Where the defendant lives does not change where an existing case is filed; the return goes to the issuing court. For a new filing, counsel decides venue. Our Erlanger and Kenton-side service covers the eastern half.

Do Florence witnesses from other counties get mileage?

Under KRS 421.015, a witness who lives in a county other than the one they are subpoenaed to is allowed state-employee mileage under KRS 44.060. We found no current statute setting a daily witness fee. A Kenton or Campbell County witness called to Burlington is a common example, and our Kentucky subpoena delivery service notes what was tendered.

Do you serve federal papers in Boone County?

Yes. Boone County is part of the Eastern District of Kentucky's Northern Division at Covington, with its clerk's office at 35 W. 5th St. Federal summonses follow Federal Rule 4 and the joint local rules, and we return proof prepared for the federal file. Send your Boone County papers to DFS with the case number and deadline.
